Gasparri proprietatem adnotationum ET, SI QUA DEDERIT, COMMENTARIORUM LIBER QUINTUS DE JUDICIIS ECCLESIASTICIS Can. 1. § 1. ludicium ecclesiasticum tunc habetur, quum de re­ bus, de quibus Ecclesia ius habet cognoscendi, coram tribu­ nali ecclesiastico competenti, iuris forma servata, ea di­ sceptantur quae ferendam sententiam respiciunt. § 2. Si agatur de iure vindicando vel de iure aut facto declarando, iudicium est mere contentiosum, si de delicto puniendo, criminale. Can. 2. Ecclesia iure proprio et exclusivo cognoscit: 1. ° De causis quae respiciunt res spirituales et spiri­ tualibus adnexas; 2. In causis in quibus tum Ecclesia tum civilis potestas aeque competentes sunt, quaeque dicuntur mixti fori, est locus iuri praeventionis inter easdem. Can. 5. § 1. Exorta controversia, partes, si velint contentiones forenses 'vitare, possunt vel in arbitros convenire vel con­ troversiam transigendo definire. § 2. Arbitri vel arbitrorum seu arbitratorum indicium laudum seu arbitramentum appellatur; effectus autem transactionis dicitur compositio seu concordia. Can. 6. § 1. Cum valde optandum sit ut lites inter fideles evi­ tentur, iudex, controversia sibi proposita iudicii forma diri­ menda, curabit litem per transactionem componere, si spes aliqua affulgeat concordiae. — 3 — § 2. Huic officio iudex satisfacere poterit sive antequam partes in iudicium evocentur, sive cum primum iudicio se stiterint sive denique quocumque tempore et efficacius et opportunius id tentari posse existimaverit. § 3. Convenit tamen dignitati iudicantis ne ipse per se, de regula saltem, hoc negotium suscipiat tractandum, sed ut illud alicui sacerdoti, praesertim ex iudicibus synodalibus, committat, qui ex bono et aequo transactionem suasurus ipsas partium personas, si fieri possit, convocabit. Can. 7. In compromisso in arbitros et in transactione serventur normae statutae a legibus civilibus loci in quo compromis­ sum aut transactio executioni mandatur, nisi iuri divino vel ecclesiastico adversentur et salvo praescripto canonum qui sequuntur. Can. 8. § 1. Nec compromissum nec transactio fieri valide pos­ sunt de matrimonio dissolvendo, neque de materia benefi­ ciaria, si de ipso beneficii titulo agatur, nisi eius, qui ea con­ ferre potest, interveniat auctoritas: nec de rebus spirituali­ bus aut quae extra commercium sunt, si interveniat solutio pretii aut cuiuscumque rei temporalis. § 2. Sed si quaestio fiat de bonis temporalibus ecclesia­ sticis et de iis rebus quae etsi spiritualibus sint adnexae, seorsim tamen a spiritualibus considerantur, compromissum aut transactio fieri possunt, servatis tamen, si materia id postulet, solemnitatibus a iure statutis pro alienatione re­ rum ecclesiasticarum. — 4 — Can. 9. Prohibentur ab arbitri munere minores, religiosi sine ve­ nia Superiorum, laici in causis mere spiritualibus, excom- municati et infames infamia iuris post sententiam decla- ratoriam vel condemnatoriam. Can. 10. § 1. Tribunal S. Officii suo more institutoque procedit sibique propriam consuetudinem retinet; et etiam inferiora tribunalia in causis quae ad S. Officii tribunal spectant, nor­ mas ab eodem traditas sequantur oportet. § 2. Cetera tribunalia servare debent praescripta cano­ num huius libri. — 5 — PARS PRIMA DE IUDICIIS ECCLESIASTICIS IN GENERE SECTIO L DE TRIBUNALIUM ECCLESIASTICORUM ORDINATIONE TITULUS I. De foro competenti. Can. 11. § 1. Apostolica Sedes a nemine indicatur. § 2. Quod si quis pro re temporali actionem contra eam experiendam habere censeat, ad Romanum Pontificem per supplicem libellum recurrat, qui, si opportunum duxerit, et iudicem designabit et personam quae ipsius Pontificis nomine aget. Can. 12. § 1. Sedis Apostolicae dumtaxat ius esto indicandi: 1. ° Imperatores, Reges aliosque supremos rerum pu­ blicarum moderatores in causis ecclesiasticis ad eorum per­ sonam spectantibus; 2. ° Patres Cardinales in omnibus causis etiam mere temporalibus; 3. ° Personas morales ecclesiasticas quae superiorem infra Romanum Pontificem non habent, uti religiones exem­ ptas, monasteria sui iuris etc. — 6 — 4.° Legatos Sedis Apostolicae, Episcopos, etiam titula­ res, Praelatos locorum Ordinarios et supremos Moderatores religionem exemptarum in omnibus causis quae ad eorum personam vel gubernium ecclesiasticum spectant. Sed in causis de rebus aut iuribus temporalibus ipsius Ordinarii aut eius mensae vel curiae, aut cathedralis ecclesiae, quili­ bet Ordinarius, etiam dignitate cardinalitia praefulgens, conveniri in prima instantia potest coram tribunali colle- giali eiusdem dioecesis, ad normam can. 42, § 1; coram quo personam constituet quae procuratorio nomine eum re­ praesentet. § 2. Alias quoque causas Sedes Apostolica potest ad suum avocare iudicium. Can. 13. In causis de quibus in can. 11, 12, aliorum indicum in­ competentia et dicitur et est absoluta. Can. 14. § 1. Exceptis causis quae Sedi Apostolicae sunt ipso iure reservatae aut quas Sedes Apostolica ad suum avocaverit iudicium, ceterae omnes cognoscantur apud diversa tribu­ nalia, servatis gradibus qui infra statuuntur. § 2. Quodlibet tamen tribunal ecclesiasticum, quod atti­ net testium examen, documentorum inspectionem, decre­ torum intimationem aliaque huiusmodi, poterit aliud tri­ bunal in subsidium rogare. Attamen ob primatum Romani Pontificis integrum est cuilibet fideli in toto orbe catholico causam suam sive contentiosam sive criminalem in quovis iudicii gradu, et in — 7 — quovis litis statu cognoscendam ad eundem deferre, licet penes tribunalia ordinaria nullum aliud supersit iuris re­ medium. § 2. Recursus ad Sedem Apostolicam interpositus non suspendit exercitium iurisdictionis in iudice qui causam iam cognoscere coepit; quique idcirco poterit, imo, si casus ferat, etiam debebit iudicium peragere et prosequi usque dum feratur definitiva sententia, nisi ex certis documentis sibi constiterit Sedem Apostolicam actorum processualium prosecutionem interdixisse et causam ad se advocasse. Qui peregrinus est in Urbe, licet per breve tempus, poterit in ipsa tamquam in proprio domicilio citari; sed ius habet revocandi domum, idest petendi ut ad proprium Or­ dinarium remittatur. § 2. Qui vero annum integrum Romae commoratus sit, et adhuc in Urbe versetur, ius habet declinandi forum Or­ dinarii et instandi ut coram Urbis tribunalibus citetur, salvo praescripto can. 23. Can. 20. Qui quasi domicilium in paroecia aut in dioecesi ha­ beat, eo perdurante, ibidem conveniri potest, veluti in pro­ prio domicilio. Can. 21.     WHEN BAD ADVICE IN CONFESSION BECOMES A CRIME The canonical crime of solicitation is likely more widespread than many may suppose. By Dr. Edward N. Peters All would agree that if a given piece of advice is bad in the confessional, then a priest's giving it to a penitent would be, at a minimum, a failure in pastoral care. Depending on circumstances, a priest's proffering of bad advice in confession might even, as a violation of charity or justice, be sinful. But, that the giving of bad advice in confession could be a crime under Church law would be startling. And yet, exactly this reading of Canon 1387 of the 1983 Code of Canon Law is required, I suggest, in light of sound canonical tradition and recent Roman curial norms. Canon 1387 states: "A priest who in the act, on the occasion, or under the pretext of confession solicits a penitent to sin against the sixth commandment of the Decalogue is to be punished, according to the gravity of the delict, by suspension, prohibitions, and privations; in graver cases he is to be dismissed from the clerical state." The image of solicitation that springs to mind here is, of course, that of a priest using the confessional to propose carnal liaisons to a female penitent.l To be sure, such reprehensible behavior is criminalized by Canon 1387. But neither the text of Canon 1387 (specifically the phrase, "solicits a penitent to sin against the sixth commandment of the Decalogue") nor the tradition behind the modern canon construes the crime of solicitation that narrowly.

Kan. 1395 sadrži tri vrste takvih kažnjivih djela: 1) priležništvo (kan. 1395, § 1); 2) sablažnjivo stanje (kan. 1395, § 1); 3) druga kažnjiva djela s posebnim otežavajućim okolnostima: a) kažnjivo djelo počinjeno upotrebom prisile ili prij etnje; b) kažnjivo djelo počinjeno javno; c) kažnjivo djelo počinjeno s osobom mlađom od 16 godina (kan. 1395, § 2). Nakon proglašenja važećega Zakonika došlo je do određenih izmjena s obzirom na određivanje kažnjiva djela počinje- noga s osobom mlađom od 16 godina (dob je podignuta na 18 godina). Autor se stoga po- sebno osvrće na kažnjivo djelo počinjeno s osobom mlađom od 18 godina, iznosi procesne novosti koje je donio Ivan Pavao II. dana 30. IV. 2001. godine apostolskim pismom u obliku motu propria Sacramentorum sanctitatis tutela (Normae de gravioribus delictis Congregationi pro Doctrina Fidei reservatis). Zakonodavac za kažnjivo djelo priležništva i sablažnjiva stanja klerika određuje višestruke kazne, prij e svega obveznu obustavu ferendae sententiae, kojoj se mogu postupno nadodati i druge kazne, ako počinitelj ustraje u kažnjivu djelu na- kon kanonske opomene, sve do otpusta iz kleričkoga staleža.

And it attempts to oppose John Paul II to Ratzinger by Massimo Introvigne (published on Avvenire on May 30, 2007) Only the secularist rage accounts for the sudden circulation over the internet of the BBC documentary “Sex Crimes and the Vatican”, dating back to October 2006, with Italian subtitles and for the frenzy of Michele Santoro (Italian anchorman) and the likes. The document is indeed damaged goods: when it first came out, it was immediately torn to pieces by the specialists in Roman canon law, given that it confuses Roman Catholic law with State law. The Church has also its own criminal law, which, among other things, deals with the offences committed by priests and with related sanctions, ranging from suspension a divinis to excommunication. These penalties have nothing to do with the State, even if a priest guilty of a crime falling under civil laws may be brought to trial twice: by the Church, which will reduce him to lay status, and by the State, which will send him to prison. On April 30, 2001, Pope John Paul II (1920-2005) published the apostolic letter Sacramentorum sanctitatis tutela, which contains a set of provisions establishing which canonical criminal trials fall under the jurisdiction of the Congregation for the Doctrine of the Faith and which ones under the jurisdiction of other Vatican or diocesan tribunals. The letter De delictis gravioribus, signed by Cardinal Joseph Ratzinger in his capacity as prefect of the Congregation for the Doctrine of the Faith on May 18, 2001 – the one presented by the BBC as a secret document, whilst it was immediately published on the official journal of the Holy See and it is posted on the Vatican’s website – contains directives for the practical implementation of the rules established by John Paul II.

    8.4.2004 EN Official Journal of the European Union C 88 E/105 Answer given by Mr Patten on behalf of the Commission (17 September 2003) The Commission attaches great importance to the rights of freedom of religion, belief and expression in its dialogues with third countries. Freedom of thought, conscience, religion and belief is one of the fundamental human rights and as such is enshrined in a number of international instruments including the Universal Declaration of Human Rights (Article 18), the International Covenant on Civil and Political Rights (Article 18) and the European Convention on Human Rights (Article 9). In addition, the Charter of fundamental rights of the European Union, which guides the Commission’s external action in this field, makes clear that everyone has the right to freedom of thought, conscience and religion (Article 10) and that cultural, religious and linguistic diversity should be respected. The Union has repeatedly affirmed that human rights and democratisation must form an integral part of all political dialogues with third countries. Religious freedom as a fundamental human right as well as the rights of religious minorities are thus addressed through the Union’s bilateral political dialogues, and, when appropriate, through démarches and public declarations, as well as through Union action in fora such as the United Nations (UN) Commission on Human Rights or the Third Committee of the UN General Assembly. As regards the situation in Laos, the Commission is aware of reports that freedom of religious expression remains restricted in Laos, including reports of members of Christian groups being persecuted and/or detained on grounds of their religious affiliation.
