INTRODUCCIÓN Europa se caracterizó por una política expansionista de sus dominios tras el descubrimiento de América, con lo cual incrementó sus rutas comerciales por el Atlántico. Esto motivó a que sus embarcaciones fueran susceptibles de ataques por parte de piratas que, en su momento, fueron marineros altamente adiestrados que estaban desempleados debido al fin de la Guerra de Sucesión Española (1714), lo que aumentó los asaltos marítimos y exigió que se regu- laran jurídicamente su persecución y sanción. 1 FERNANDEZ, Sanz Juan Cristóbal, Marco jurídico actual de la piratería: un antiguo delito del Derecho Internacio- nal del Mar, Facultad de Derecho Universidad de Chile, Revista Tribuna Internacional, Volumen 2, Número 4, 2013. pp. 23. 118 EL DELITO DE PIRATERÍA EN ALTAMAR EN EUROPA Este marco normativo fue permaneciendo al punto de no variar en sus premisas principales, y trascendió de tal forma que se incorporó a documen- tos internacionales a los que se han sumado casi la totalidad de los países en el mundo. Dicha trascendencia se debe a que la intensidad y ferocidad de los ataques piratas exigió figuras jurídicas especializadas que al final se desarrollaron de tal forma que hasta ahora se siguen ocupando varias de sus postulaciones en razón del surgimiento de piratas somalíes en el Cuerno de África contra embarcaciones cuyo destino es Europa, y que de manera forza- da deben surcar el golfo de Adén hasta el Mar Rojo para alcanzar el Medite- rráneo. Esta situación ha exigido una fuerte respuesta de la Unión Europea y, por ende, una normatividad con fines defensivos y represivos contra sus atacantes. 2. PIRATERÍA España, Portugal, Inglaterra, Francia y Reino Unido destacaron en el tema de la piratería en el siglo XVII, pues en la conquista de América y sus rutas comer- ciales era evidente el atractivo de apoderase de las embarcaciones repletas de mercancía, lo que generó la denominada época de oro de la piratería. Esta situación acarreó la regulación para castigar a los que ejercieran la piratería, ya que no sólo era el fuerte impacto económico sufrido, sino la manera pre- datoria y despiadada con la que se podía realizar. Esto, como antecedente, permite entender la legislación respectiva vi- gente, máxime para aquellos que establecen penas tan severas en su momen- to, como la muerte o la prisión vitalicia; ya en el contexto contemporáneo, aparentemente se vislumbra una nueva etapa de consideraciones legales a la luz de los ataques de embarcaciones europeas por parte de piratas somalíes, pues la estructura de sus efigies legales coetáneas toma como base las figuras creadas en la época de oro de la piratería, incluso en los presentes esquemas que buscan elevar como delito internacional a la piratería, puesto que ello ya había sido una consideración del jurista Marco Tulio Cirerón en el imperio romano durante el siglo I antes de Cristo, al señalar a los piratas como sed communis hostis omnium2, es decir, aquel que es enemigo común de todos: son enemigos de la humanidad. 2 Miller, Walter, Cicero de officcis. The Loeb Classical Library, Toronto, Canadá, 1928, pp. 384. 119 DÍKÊ 25 / ABRIL - SEPTIEMBRE DE 2019 En este sentido, a la par y en comunión con el Derecho Comunitario de la Unión Europea, los países se sumaron a la Convención de las Naciones Unidas sobre el Derecho del Mar, que, como se explicó en el primer capítulo, es un documento de suma trascendencia que establece diversas y amplias consideraciones marítimas, como lo relativo a la piratería, lo que hizo que sus signantes adoptaran sus figuras jurídicas, hecho que no pasó desapercibido en Europa, donde además se han creado resoluciones respecto al combate táctico contra este delito. 3. ESPAÑA España fue una de las potencias en las que se acentuó la piratería con el descubrimiento de América, ya que los barcos con el cargamento eran blan- cos de los ataques piratas, aunado a la rivalidad que sostuvo con Inglaterra durante siglos, que hizo que se incrementara con el tiempo este fenómeno; por ende, destacaron varios piratas españoles alrededor de los siglos XVII y XIX, como Amaro Pargo, quien asoló las embarcaciones inglesas y constituyó la figura arquetípica del pirata valiente pero misericordioso, ya que atacaba a los enemigos de su patria pero protegía a los débiles, de hecho, se tiene el dato de que “hizo muchas obras de caridad, se convirtió en un devoto reli- gioso y en un generoso benefactor de conventos, ermitas e iglesias”.3 Tuvo un final honroso y “pasó a la posteridad sus hechos fumosos, por lo que se le considera hoy como tipo legendario de nobles proezas”.4 Culminó sus días como un hombre adinerado y fue sepultado en una capilla bajo el escudo de una hidalguía que le fue otorgada; en su lápida quedó labrada una calavera pirata guiñando un ojo.

In doing so, I examine piracy and illicit activities such as smuggling and shipwrecking through a new lens. They act as a form of economic engagement that could not only be used by empires and colonies as tools of competitive international trade, but also as activities that served to fuel the developing Caribbean-Atlantic economy, in many ways allowing the plantation economy of several Caribbean-Atlantic islands to flourish. Ultimately, in places like Jamaica and Barbados, the success of the plantation economy would eventually displace the opportunistic market of piracy and related activities. Plantations rarely eradicated these economies of opportunity, though, as these islands still served as important commercial hubs: ports loaded, unloaded, and repaired ships, taverns attracted a variety of visitors, and shipwrecking became a regulated form of employment. In places like Tortuga and the Bahamas where agricultural production was not as successful, illicit activities managed to maintain a foothold much longer.

The aim of this thesis is to investigate English legal and political-theoretical writing on piracy and sovereignty of the seas to further understanding of what kinds of legal spaces oceans were in early modern English political thought, and the role of pirates as actors in those spaces. This is achieved by a study of legal and theoretical texts, which focuses on the concepts subjecthood, jurisdiction and sovereignty in relation to piracy. I show that piracy became a blanket-term of delegitimization applied to former kings as well as poor sailors and that the English struggle for the suppression of piracy was ideological as well as practical. By contrasting legal and political theory with its realpolitikal context I show that diplomatic and economic concerns often eclipsed theory when judging pirates in legal praxis.

INTERNATIONAL SEA PIRACY 1.1 Piracy “An act of boarding or attempting to board any ship with the intent to commit theft or any other crime and with the intent or capability to use force in the furtherance of that act”1. Piracy is an act of robbery or criminal violence at sea. The term can include acts committed on land, in the air, or in other major bodies of water or on a shore. It does not normally include crimes committed against persons travelling on the same vessel as the perpetrator (e.g. one passenger stealing from others on the same vessel). The term has been used throughout history to refer to raids across land borders by non-state agents. Piracy is the name of a specific crime under customary international law and also the name of a number of crimes under the municipal law of a number of States. It is distinguished from privateering, which is authorized by national authorities and therefore a legitimate form of war-like activity by non-state actors. Privateering is considered commerce raiding, and was outlawed by the Peace of Westphalia (1648) for signatories to those treaties. Those who engage in acts of piracy are called pirates. Historically, offenders have usually been apprehended by military personnel and tried by military tribunals. However, not all simulation videogames have the capacity to transmit heritage values efficiently. This article reviews the use of serious and commercial videogames in CH to frame and properly identify characteristics for the selection and assessment of videogames in the context of cultural communication. Based on the analysis of the capacities of videogames to motivate, immerse and represent reality, the videogame Minecraft is identified as one of the optimal solutions to represent and promote engagement with the cultural built environment. As such, the authors assessed the capacity of the videogame Minecraft to be used as an efficient tool to communicate built heritage environments, considering identified criteria on immersion, motivation, and fidelity on simulation.     "THEY WOULD HAVE A LAW OF THEIR OWN": THE DISCOURSE ON SMUGGLING AT THE OLD BAILEY, 1736-1814 by Annie Tock Morrisette November 2013 Director of Thesis: Timothy Jenks Major Department: History This thesis examines the cases of 136 men tried for smuggling offenses at London's central criminal court during the long eighteenth century. Before the 1770s, the government portrayed smuggling as a crime against the nation, but after this time, the discourse changed significantly. At a time when smugglers actually were consorting with the enemy, the language of nationalism virtually disappeared from their trials and was replaced by the portrayal of smuggling as a crime of assault against revenue officers. The accounts of smugglers themselves also reveal a shift in emphasis. During the first part of the eighteenth century, smugglers referred to their trade in terms of tradition, and they were surprised to find themselves awaiting execution for such a commonplace activity. But after the 1770s, their language changes, too. Smugglers are increasingly reported to define smuggled goods as their private property and to suggest that revenue officers are in the wrong for seizing what is not theirs by right. This thesis argues that the changes in the discourse reveal both the revolutionary potential of smuggling and the ways authorities sought to change the conversation from one of national import to one of personal assault.
