Abstract As of 1 December 2009 the Treaty of Lisbon came into force. The Treaty brings along several changes for the physical structure of the EU. There are no changes aimed direct- ly towards procurement, however the Treaty of Lisbon might prove to include changes of major impact. Article 3 (3) NEU includes a change to how the inner market shall be achieved. The Treaty text has gone from an inner market based on competition to in- clude a “social economic market”, however there is no indication of what this means from a procurement perspective. The inner market and procurement had difficulties al- ready before the entry of the Lisbon Treaty. There was arguments as regards to how fair a state could intervene trough public procurement to achieve positive social effects. The CJEU has persistently held that the inner market shall be built by the help of the inner market and competition. The Commission has during the last years started to express a different opinion than the CJEU with regards to low value procurements. The legislators has also shown a great interest for the SME‟s and ensured more leeway for these com- panies to receive help form the member states.

    Europe's Resource Grab Vested interests at work in the European Parliament Corporate Europe Observatory, 27 June 2011 On 30 June, the European Parliament’s industry, energy and research committee (ITRE) is due to vote on the EU’s Raw Materials Initiative, establishing guidelines for Europe's future policy on natural resource use. The Parliament’s report could effectively give the green light to mining in protected European nature reserves as well as a resource grab in Asia, Africa, the Americas and the Arctic. The vote follows fierce calls from a number of MEPs with close links to industry for European big business to be allowed to exploit other countries’ raw materials without any restrictions – via trade, development and even military policies. MEPs have also tried to block strong language in the report on the need to stop corporate abuse in the extraction sector and to reduce Europe’s over- consumption of raw materials. Several of the MEPs pushing this aggressive agenda are from the European People’s Party (EPP) and have close links to industry sectors which have a vested interest in the raw materials debate (Bendt Bendtsen – Denmark; Herbert Reul and Daniel Caspary – Germany). Others such as Paul Rübig MEP (EPP, Austria) seem to have clear conflicts of interest1. Rübig profits from companies which depend heavily on the access to cheap raw materials. He also has close connections with industry lobby groups which have tried to shape the EU’s Raw Materials Initiative. Nonetheless, Rübig is one of the lead persons in the debate in Parliament and has set up a cross-party group of MEPs, the European Raw Materials Group, which will follow the issue, working closely with a parallel industry group.

Herbert Reul MdEP: Das Vorschlagsrecht hatten und behielten die EU-Mitgliedstaaten. Ein formelles Recht abzulehnen hat Juncker nicht, aber er hat da schon Einfluss. Dass er z.B. die Anzahl Frauen von anfangs drei auf neun erhöht hat, ist seiner Beharrlichkeit ge- genüber den Mitgliedstaaten zu verdanken. ContraSalon: Parlamentspräsident Martin Schulz (SPD/S&D) hat früh gedroht: "Wenn Juncker zu wenige Frauen gewinnt und das Team unausgewogen ist, lassen wir (!) ihn durchfallen". Im Fall Slowenien hat Juncker die Kandidatin Bratusek ausdrücklich mit der Bemerkung hingenommen, die sei halt "sowohl Frau wie Liberale". Inzwischen steht eine Parlamentsmehrheit quer zu Bratusek. War dies unvermeidbar? Herbert Reul MdEP: Rückblickend kann man sagen, dass Frau Bratusek das schwächste Glied ihm möglichen Team war.
