Dear Parent/Carer, This booklet has been put together to help guide you through the secondary transfer process for pupils with EHC Plans. It tells you about secondary education in Birmingham, the secondary schools your child may be able to attend, and about how to express your preference for individual schools.

A large number of children and young people with EHC Plans are able to attend their local mainstream secondary school. If you are considering a placement for your child in a mainstream secondary school, Section 16 of this booklet provides details of these schools. For some children more specialist provision may be appropriate – please see Section 18. If you are interested in a particular secondary school, it is worthwhile contacting the school to arrange a visit. The Special Educational Needs Co-ordinator (SENCO) from your child’s current school will be able to help you with this.

You may have already been given advice on the type of secondary school suitable for your child through discussion at an Annual Review meeting, however, it is still important to visit potential schools and speak to their special needs staff to help you to make an informed decision about your preferences.

If, after reading this booklet, you need further help or advice you can ask the SENCO at your child’s school for support. You can also contact the Special Educational Needs Assessment & Review (SENAR) Service on 0121 303 1888. SENAR will carefully consider your preferences and inform you by 15 February 2019 of the September 2019 secondary school allocation for your child.

Autumn Term 2018 Birmingham LA formal consultation with the Governing Bodies of your preferred secondary school(s). This will include the maintaining LA for the school, if it is not in Birmingham.

By end of Autumn Notice of Amendment and letter of intent will be sent you, Term 2018 / Beginning identifying any proposed amendments to the EHC Plan and the Spring Term 2019 intended secondary school to be named in Section I of the EHC Plan. You will have an opportunity to make written representations to the proposals.

How the secondary transfer process will work As your child has an EHC Plan and is due to transfer to secondary education in September 2019, you will have the opportunity to state your preference(s) for a school using the preference form with this booklet.

What you need to know: • You must complete a Birmingham LA SENAR Preference Form, specifically for pupils with a EHC Plan. • If any of your preferences are for a school in another LA you must still complete the Birmingham LA SENAR Preference Form and name the school(s) in Part 2 of the form; we will approach the school and other LA on your behalf in order to seek a view on the suitability and availability of a place. • A school place will be allocated to your child in accordance with the SEND Code of Practice (2015): • the school is suitable to the child’s age, ability, aptitude or SEN, or • the placement would be compatible with the efficient education of the other children with whom your child would be educated, or • the placement would be compatible with the efficient use of resources. • Should your child currently be educated in mainstream primary school setting, and you are asking the LA to consider a secondary special school placement, evidence will be required to indicate a significant change in needs or required provision in order to warrant such a placement. • If you are applying for a Birmingham place you need to apply by 4pm on 30 June 2018 at the latest for your child to be entered in the selective test; the test will be held Saturday 8 September 2018. Please see Section 5 for further general information on grammar schools. • You may also submit a preference to the LA for a place in an independent or non-maintained school. The LA is required to consider this preference, but can consider maintained schools also in line with the efficient use of resources. You will be given the opportunity to make representations and to discuss any queries you have with your SENAR Principal Officer about the school allocated or the content of the EHC Plan.

Meeting your child’s needs Birmingham LA aims to provide pupils who have EHC Plans with a range of opportunities in secondary education to appropriately meet their special educational needs (SEND Local Offer). We are committed to a policy of inclusion which means educating pupils in the most appropriate provision, and in accordance with their needs. Birmingham LA believes in the principle of pupils being able to be educated in their local community, as close to home as possible. There are different types of mainstream secondary schools that are maintained by Birmingham LA: • Community • Voluntary Aided • Foundation Some schools have become Academies and are not controlled by the LA, but have similar admission procedures. Some Free Schools have also been opened or are due to open in the city. Again, these are not controlled by the LA but also operate similar admission procedures to Academies.

More specialist types of provision: In addition to mainstream schools, there are 17 special schools (three are co- located on mainstream secondary school sites). There are also 13 Resource Bases (three of which are fully-accessible schools) within mainstream schools that offer a range of specialist educational provision for different types of need. The specialist provision available in the city caters for the following special educational needs: • Cognition and Learning Needs - Moderate Learning Difficulties (MLD); Severe Learning Difficulties (SLD); Profound Multiple Learning Difficulties (PMLD) including associated health and/or medical needs; • Speech, Language and Communication Needs (SLCN), including Autism (ASC) • Visual impairment (VI) • Hearing impairment (HI) • Social, Emotional and Mental Health (SEMH) needs • Physical Difficulties (PD)

Finding out about Birmingham schools All schools have their own prospectus, booklet or school website that explains the curriculum, facilities and what they aim to achieve for their pupils, along with the school’s local SEND offer to pupils with identified special educational needs. We recommend that you visit those schools that you believe offer the type of provision that will meet your child’s special educational needs. It would be advisable to involve the SENCO from your child’s current school. Visiting schools and attending open days will give you the chance to talk to teachers and existing pupils before making your decision.

Entry to Grammar schools If you wish your child to be entered for an entrance test, you should discuss this with your child’s Head Teacher first. Within Birmingham LA there is one entrance test your child can sit. Entrance tests are held for places at one of the Grammar schools within ‘The Grammar Schools in Birmingham’ consortium. In addition, you may also wish your child to sit entrance tests for schools outside Birmingham. Please note that other LAs have different closing dates and admission arrangements and you are advised to contact them for further information. An application to sit the entrance test is not an expression of preference for the school concerned. Entry requirements Optional tests for the admission of pupils to any of The Grammar Schools in Birmingham will take place on Saturday 8 September 2018. If you wish your child to be entered for the entrance test for one of the above schools then you must complete the Request for Optional Test form by 4pm on Friday 29 June 2018 at the latest. You must include a passport sized photograph of your child for identification purposes.Forms must be submitted online via birminghamgrammarschools.org. Completing the Preference Form • Complete the form in BLOCK CAPITALS using black ink. • PART 1: Check that your child’s details in Part 1 of the form are correct • If the pre-printed address is incorrect, write the correct address in the space provided and attach proof of residence, such as a recent utility bill, by stapling it to the form. • PART 2: Enter the names of the schools in the order of your preference, starting with your most preferred school, including any preferences for grammar schools and schools in other Local Authorities. • If any of your preferences are for a place in one of the 10 Resource Bases or the 3 Fully Accessible (FAM) Schools, rather than the mainstream, please ensure you write ‘Resource Base’ or ‘FAM’ next to the name of the school on the form. • If your child has a sibling on roll at any of your preferences, and will still be in attendance in September 2019; you need to put the name and date of birth of the sibling in the boxes next to the relevant school name. • Ensure that you have discussed your preferences with your child’s current school SENCO and a signature (and comments where appropriate) are obtained to confirm. • PART 3: Insert any information you think is relevant to your preference(s) in this box. If your child is a twin, and you would ideally want them to attend the same school, please write this information in Part 3 and include the details of their twin. Attach additional sheets, by staple to the back of the form, if you wish. • PART 4: Make sure that you have completed the form in full using the checklist. • PART 5: Fully complete the parent carer details. • Ensure that the form is signed and dated.

If you do not submit a completed preference form If you do not submit a Birmingham LA SENAR Preference Form, we will: • Seek advice from your child’s current school; • Consider all information available such as the most recent Annual Review and current EHC Plan; and • Proceed to consult with the closest appropriate school setting in order to secure a placement. It is therefore important that you express a preference of a named school for your child, should you wish a specific school to be considered.

If you live within Birmingham and any of your preferences are schools in another LA, you still need to put them on the Birmingham LA form. Birmingham LA is required to consult the school and its maintaining LA regarding your request. Remember, other LAs may not be able to offer your child a place. Therefore, it is advisable to also consider Birmingham LA provision.

8. Pupil’s home address When you complete the Preference Form, please note that a child’s home address is the residential property that is the child’s only or main residence and which is either: • Owned by the child’s parent carer(s) or the person with parental responsibility for the child. • Leased to, or rented by, the child’s parent carer(s) or person with parental responsibility for the child. Where parent carers have shared responsibility for a child and the child lives with both parent carers for part of the week, then the main residence will be the address where the child lives for the majority of the school week. If your address is different to that printed on the preference form, please write the new address in the space provided and attach proof of residence, such as: • a copy of your council tax bill; • a copy of a recent utility bill (gas, water, electric etc. dated within the last six months); • a solicitors letter stating contracts have been exchanged and specifying a completion date and the new address;

birmingham.gov.uk A great city to grow up in 10 • a signed and dated tenancy agreement with the commencement date, plus proof of residency for example a copy of a recent utility bill. If a school is allocated on the basis of an address that is subsequently found to be different from the child’s normal permanent home address, then that place may be withdrawn.

9. How places are allocated School places are allocated in accordance with the SEND Code of Practice (2015), which requires that a decision is made after taking into account the child’s special educational needs, parental preference and the formal view of the schools requested. Birmingham LA is required to comply with parental preference for a maintained school unless:- • the school is unsuitable to the child’s age, ability, aptitude or SEN; or • the placement would be incompatible with the efficient education of the other children with whom the child would be educated; or • incompatible with the efficient use of resources. Oversubscription Criteria In cases where there are more applications for places than a setting can accommodate, places will be allocated on the basis that the setting is able to meet the child’s special educational needs, with priority given to:

i) Children for whom this particular setting is the only placement that can meet their specific SEN. ii) Children in care (see definition below) where the school is the most appropriate placement for their SEN.

Looked after children or children who were previously looked after but immediately after being looked after became subject to an adoption, residence or special guardianship order. This includes any child / young person who is subject to a Full Care Order, an interim Care Order, accommodated under Section 20 of the Children Act 1989, is remanded or detained into Local Authority accommodation under Criminal Law or who has been placed for adoption.

birmingham.gov.uk A great city to grow up in 11 iii) Children with a sibling (see definition below) already on roll at the school in September 2018, where the placement is clearly appropriate to the transferring child’s special educational needs. For the purposes of allocation, siblings (brothers or sisters) are considered to be those children who live at the same address and either:

a) have one or both natural parents in common or b) are related by parent’s marriage, or c) are adopted or fostered by a common parent, or d) unrelated children living at the same address, whose parents are living as partners, are also considered to be siblings.

iv) In the event that there are still places available at a setting, they will be allocated to children whose special education needs can be met in this type of provision and it is the nearest school to their home address.

Any further places will be allocated to children whose needs can appropriately be met at this type of provision.

10. Notifying you of the school we are proposing to allocate

You will be sent a letter of intent, along with a Notice of Amendment, at the end of the Autumn Term 2018 informing you of the proposed school to be allocated. This will explain how you can make representations to Birmingham LA if you disagree with, or have any concerns about the proposed school place before a final/ amended final EHC Plan is issued. Birmingham LA is required to issue a final/amended final EHC Plan by 15 February 2019.

You will have an opportunity to speak with someone in Birmingham LA about the intended school to be allocated to your child, before the EHC Plan is finalised. If you have concerns about the content of the proposed EHC Plan and the school that has been allocated, you can speak to your child’s SENAR Principal Officer who will work with you to identify the best way forward and to resolve any issues. 12. Special Educational Needs and Disability Information, Advice & Support Service (SENDIASS)

Birmingham’s SENDIASS provides comprehensive, quality and impartial advice to parents of and young people and children with special education needs on all aspects of education. SENDIASS will therefore be able to advise you how decisions are taken in relation to transfer to secondary schools and how you can raise any concerns you may have regarding the proposed school or content of the EHC Plan.

Travel assistance The majority of Birmingham pupils with an EHC Plan do not receive, nor require specialised travel assistance from the LA. Wherever possible the LA expects parent carers of pupils to make arrangements for their child to attend school in the same way as parent carers of pupils without special educational needs. If your child goes to a school more than three miles from your home (measured by the nearest available walking route), you may qualify for financial help to support you with arrangements for your child to get to and from school. Additional travel assistance support can be considered for children and young people who are resident within Birmingham and for children in the care of and who: a. have complex special educational needs, a disability or mobility problem as identified through the education, health and care needs assessment; and b. are of statutory school age, which is between five years of age and up to the last day of the school year when the child reaches sixteen years of age. We will also take into account whether your child lives within walking distance, is able to walk, and whether they are able to use public transport. Your child must be attending the nearest available school which meets their needs and is able to offer a placement. If you choose to send them to a school further away from your home, then you will be responsible for ensuring that your child is able to make the journey or be appropriately supported to make the journey to and from the school you have requested.

As a result of a revision of the Data Protection Act 1998, the new General Data Protection Regulation 2016 (and Associated Data Protection Act 2018). This change in legislation affects many aspects of data and its protection, including how it is gathered, managed, stored and distributed.

How to exercise your rights

The first copy will be provided free of charge, but additional copies may be subject to a reasonable fee.

We will respond to your request within 30 days, by either providing you with the information requested, requesting further information from you, or requesting further time to complete your request, if for example the request is substantial or we need to obtain information from various departments within the Council.

The Council can also refuse your request. In the event that the Council refuses your request we will provide you with reasons why, as well as provide you with details of how you can challenge or appeal our decision. You will also be informed of your right to legally challenge our decision with the ICO.
