PORT AND CRIME Paula Banerjee (Draft Only) Section I: Routine or Rarest of the Rare? Case 1 RPS Kahlon, the Chairman of Kolkata Port Trust, was arrested after he allegedly accepted a bribe of Rs. 20 lakh in a five-star hotel in Kolkata on 9 March 2016. The police further alleged that this was not the first time that Kahlon “had come under the scanner over the past few months.” 1 The bribe was given by a Jagtap Deoji who was into container business. Initially the duo was remanded in police custody until 17 March 2016 after which they were removed to jail custody. Predictably Kahlon’s lawyers were crying foul play. On trying to dig into this case we found two distinctly different version of who the real Kahlon was. One group of people describe him as a polite but strict officer. As the chairman of the Kolkata Port Trust, it was said that he took a number of “fearless steps,” of which one was to foreclose and remove the studio of a well-known film producer Srikant Mohta from the Brace Bridge area. The Calcutta High Court subsequently upheld the decision taken by the Kolkata Port Trust. Since Srikant Mohta was close to West Bengal Chief Minister Mamata Banerjee, a group of people were of the opinion that Kahlon was a victim of foul play. 2 They alleged that this arrest was politically motivated. Kahlon, they said, was a nice man who had been victimised because of his opposition to Mohta. That is the reason why the state police did not involve the CBI before taking action against Kahlon. -

VOL 8 | No. 6 June, 2012 from the desk of the PRESIDENT Dear Member, 8 June 2012 The first half of the calendar year has gone past us in a whirl of activities. We are also in the last month of the first quarter of the new fiscal. With GDP growth rates plunging to the lowest levels (6.5% in 2011-12) in many years, and the Rupee plunging deeper into the crevasse with each passing day, a rare source of encouragement is the fact that the nation's growth is largely being fuelled by the poorer States. Uttar Pradesh and Bihar, which between them account for a quarter of India's population, have performed exceptionally well, with Bihar growing at 13.1% in 2011-12. Although UP has grown at less than the national average, it is truly in a new league since it has firmly left behind those days when it used to grow abysmally below the national average. Orissa has grown by 8.6% and 7.2% in the last two years outperforming the national economy. Chhattisgarh has also grown by 11.6% and 10.8% in the last two years. With our neighbours doing so well, we also hope that with a combined effort from the Government, Industry and the people of our State, West Bengal will be back in the league of most-favoured investment destinations. Confidence-building measures are important and it is necessary for the policymaker in the State to be effective enablers who facilitate and formulate business friendly policies and their implementation. -

Member-Secretary FEBRUARY, 2016 BIKASH BHAVAN, SALT LAKE, KOLKATA Preface The Fourth State Finance Commission of West Bengal was set up towards the end of April 2013. However, it was not until October that it got an office space and some minimal support staff to become functional. The five months lying between April and October was spent on informal discussions with academicians and government officials to gather some initial information and form preliminary ideas which helped the Commission in its later deliberations. The Commission had initially started with two members; subsequently the member secretary was appointed in June, 2013 and another member in July, 2014. Apart from commenting on the overall working of local governments in West Bengal and the condition of state finance, the Commission had to undertake three broad exercises. First, the total sum of money to be devolved to the rural and urban bodies that the Commission were to recommend had to be arrived at. Second, given the total recommended sum going to the rural bodies, the Commission had to determine the sharing rule of this sum across the three tiers of Panchayati Raj Institutions, namely the Zilla Parishad, the Panchayat Samiti and the Gram Panchayat. Third, the distribution of devolution within each tier and within the urban bodies had to be decided upon. The Commission’s recommended devolutions to the rural and urban bodies were founded on three basic considerations: (a) the actual amounts devolved in the past as a percentage of the state’s own tax revenue, especially the pattern of devolution made in the recent past; (b) the magnitude and pattern of devolution by the Fourteenth Finance Commission to the local bodies of the state; and (c) the actual requirement of the local bodies for their smooth functioning. -
