SHOULD SECURITY BE REQUIRED AS A PRE-CONDITION TO PROVISIONAL INJUNCTIVE RELIEF? DAN B. DOBBSt I. INTRODUCTION The plaintiff who seeks a temporary restraining order or a pre- liminary injunction may be denied these remedies unless he posts a bond or other security. This study is concerned with a narrow set of questions: Should security be mandatory, or should the trial judge have discretion to dispense with it? Alternatively, should security be required in some cases, left to the trial judge's discretion in others, and perhaps even forbidden in still others? The present law under the federal rule and many state statutes is unclear and should be clarified by statutory amendment. This study proposes to set out, in the four succeeding parts, some basic informa- tion about the nature and purposes of provisional injunctive relief and the bond requirement, a summary of the present statutes and case law on whether the bond is mandatory or permissive, and finally, a sug- gested statutory amendment to clarify that law.

KAN. STAT. ANN. § 12-105b(d) governs the pre-suit notice requirement for claims against a municipality. That section provides that a claimant may not commence a claim until after the municipality notifies the claimant that it has denied the claim, or until after one hundred twenty (120) days has passed since the notice of claim was provided to the municipality, whichever occurs first. Additionally, if a claimant intends to bring suit under the Kansas Tort Claims Act, “a claimant shall have no less than ninety (90) days from the date the claim is denied or deemed denied in which to commence an action,” even if this exceeds the statute of limitations under the Code of Civil Procedure. B) Medical Malpractice. Kansas has a “health care stabilization fund,” which may provide payment in excess of a health care provider’s liability coverage in professional negligence cases brought against health care providers. INTRODUCTION The feeling of security is something that everyone covets and pursues, more so, when you are in the position of a plaintiff initiating a lawsuit. You would Want to have some reason to believe that there will be money awarded to you in the event that you are successful in the litigation. This expectation can become a mere fantasy and an absolute nightmare when you encounter a defendant who is certain to remove all of his assets out of the country in order to avoid the court's judgment, which in turn leaves you, the plaintiff, with absolutely nothing to collect. While there are some safeguards available to a plaintiff in these situations, the purpose of this paper is to show that the American legal system falls short of fully protecting plaintiffs in these matters. Moreover, it also examines the alternative available to the American legal system, the Mareva injunction. The American legal system offers a few choices to a plaintiff who seeks protection from a defendant removing his assets before or during trial.

Whenever a plaintiff sues a defendant for money damages, she runs the risk that the defendant will attempt to render herself unable to satisfy the expected money judgment by hiding or dissipating assets. Although most states have statutes that author- ize prejudgment attachment of the defendant's assets to prevent this result, the attachment statutes are poorly designed to reduce the plaintiff's risk. The attachment statutes are both under- and over-inclusive: they do not authorize the attachment of property located outside the state, thereby failing to prevent the dissipation of all of the defendant's prop- erty, yet they grant the plaintiff a lien in the attached property (a security interest to which she is not entitled) and authorize the attachment of property in the hands of innocent third parties on the plaintiff's word that the property is the defendant's.

    Election of Remedies and Pretrial Writs LEON J. ALEXANDER", I. INTRODUCTIN Our established civil procedure rules permit.a plaintiff to invoke varied temporary remedies before the trial takes place. The best known pretrial writ is still attachment, but many others are at times available, ranging from body arrest or claim and delivery to Uis pendens or receivership.' These writs are very powerful because they are still easy to obtain, take prompt effect and may impound defendants' property for years until the plaintiffs' rights are tested by a trial. Their effectiveness is demonstrated by the attention they receive in law reviews and court decisions. Hardly a session of our legislature passes without some changes in these laws. By these methods, the formal rules determining the use of writs are shaped to fit our ever-changing views of public policy.
