RIFCIU- SWJTU ii ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project Preface Sichuan Yaxi Expressway Co. Ltd (hereinafter referred to as Yaxi Company), as the Owner of Central Sichuan Roads Development Project which has been evaluated by Asian Development Bank, has officially authorized Research Institute of Foreign Capital Introduction and Utilization of Southwest Jiaotong University to take charge of the external independent monitoring and evaluation. From July, 2008 to September, 2008, more than ten people from Research Institute of Foreign Capital Introduction and Utilization of Southwest Jiaotong University have gone to the site repeatedly to carry out the outdoor research. This Phase II Report on External Monitoring of Resettlement is finished based on the latest statistic data of Yaxi Company which has been analyzed and arranged. Based on the full line field investigation; overall understanding of the construction and progress of land requisition and resettlement of the Project, the compensation standards for demolishment and fund appropriation, the implementation of resettlement program; listening to the opinions and suggestions of the affected people; seriously verifying the Resettlement Arrangement Plan (RAP) and comparing the changes of the affected people’s production and living level before and after the resettlement, the Monitoring Group has already made an objective and impartial evaluation for the current resettlement effect of the Project. During the process of monitoring and evaluation preparation, field investigation and report preparation, Yaxi Company and resettlement agencies at different levels from Ya’an in Sichuan Province and Liangshan Yi Autonomous Prefecture have actively cooperate and given great support to the evaluation work of the external Monitoring Group. Summary on External Monitoring of Resettlement 1 Resettlement External Monitoring Status Yaxi Company, as the Owner of Central Sichuan Roads Development Project which has been evaluated by Asian Development Bank as the construction of an expressway at the length of 244km from Ya’an to Lugu, has officially authorized Research Institute of Foreign Capital Introduction and Utilization of Southwest Jiaotong University to take charge of the resettlement of external independent monitoring and evaluation. This report shall only monitor the resettlement of Ya-Lu expressway. Once the local road project concerning the land requisition and demolishment has been confirmed, the project arrangement office will provide the specialized resettlement arrangement plan and the external monitoring institute, according to the agreement, will start to carry out the monitoring, which includes the investigation of 5 counties and 29 towns as well as sampling survey of the affected people. 2 Monitoring of the Project’s Impact Until the end of August, 2008, Central Sichuan Roads Development Project has affected 29 towns, 102 administrative village as well as 5 counties (districts), that is, Yucheng , , Hanyuan Countyy, Shimian County and of Liangshan Prefecture. The investigation result has shown that, until the end of August, 2008, this Project has requisitioned various land as 1075.27ha, which is 106% of the planned requisition size. 60828 people have been affected in which the farmers account for 15865. In this Project, the houses to be demolished reach an area of 269,051 m2, which affect 2083 households with 8761 people, occupying 74% of the total demolishment area. This statistics have already contained the number of enterprises demolishment. Temporarily occupied Land and fragmentary tree will be monitored in next report. 3 Compensation Standards and Monitoring of Compensation Fee The Monitoring Group has mainly investigated the implementation of compensation standards by checking over the original bills of fund appropriation at Yaxi Company and local coordination office, and paying a visit to those affected people; the result proves that the compensation standards set up by resettlement arrangement plan have been strictly carried out by those counties alone the Ya-Lu Expressway; in the mean time, the Owner and local government proposed the compensation standards to resolve the demolishment problems caused by the price hikes. During the field investigation, Monitoring Group has paid much attention to fund appropriation and its channel. The Monitoring Group has figured out the fund appropriation status by following the tracks level by level; that is, the team went to Yaxi Company first to check the time and amounts of the fund appropriation and then head for the recipient to check the time and amount of fund located to basic levels; in the end, the team went to the villages to verify the payment. Monitoring Group 4 Monitoring of Resettlement Result By holding symposiums, talking with key informers and field observation, the resettlement Monitoring Group has got the resettlement result of residents and affected villages. On the whole, the subsidies for land requisition and resettlement have been fully allocated as planned. The affected villages and groups, after the land requisition, have been resettled by the monetary measure which means that the entire or partial subsidies for land requisition will be paid to the affected people; or by property rights

RIFCIU- SWJTU 2 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project transfer which means that the affected villages and groups will spend the subsidies on the development of agriculture production or public welfare services; or by the combination of the above-said two measures. However, after the land requisition, the per capita of cultivated land in some counties has decreased sharply; lots of farmers even lost their whole land. The resettlement agency has been researching on relevant policies to resettle these affected farmers. Besides, has not paid the subsidies for land requisition, or has kept these subsidies at the villages and groups without any detailed measures for land adjustments. Therefore, although the resettlement for land requisition has accomplished a lot with the efforts of the Owner and resettlement departments of local government at all levels, valid policies still have to been set up to resettle the farmers who have lost their land and finish the land adjustment work. In the mean time, also by holding symposiums, talking with key informers and field observation, the Monitoring Group has got the demolishment resettlement result of the affected people. On the whole, such demolishment resettlement has to face many challenges, which however, will get improved in the near future for the reason that the Owner and local governments have decided to take measures to resolve these problems, including: (1) lifting the compensation standards for demolishment; (2) replenish the price differences between the compensation standards and the market price of housing land; (3) help the affected farmers look for the housing land to build new houses; (4) start to construct the public facilities and resettlement places as soon as possible. 5 Monitoring of Resettlement Institute Yaxi Company has set up the project demolishment office to directly take charge of coordinating the plan, implementation, finance and report of land requisition and demolishment. Two cities (prefectures) and five affected towns (districts) have already establish the leading groups as well as land requisition and demolishment offices with each possessing six to eight members. The resettlement agency of each county shall take the principal responsibilities for the removal consultation, implementation as well as granting rights and interests promptly, to which the related towns and villages shall offer the assistance hereby. 6 Conclusion, problems and suggestions The land requisition and demolishment resettlement of Yaxi expressway project has been under the way basically according to the planned time and procedure. Until the field investigation carried out by the Monitoring Group in July of 2008, the land requisition and resettlement of the full line has been accomplished by 97% of the resettlement arrangement plan; however, since the land requisition has increased compared with the original plan due to the alteration of the design, the actual accomplishment shall be approximately 90%. From the work of land requisition and demolishment resettlement at each towns and districts we could see that, all the resettlement work has been implemented strictly according to the resettlement arrangement plan without any significant problems for the reasons as follows: the resettlement work has been prepared very well; the resettlement arrangement plan is applicable; the compensation standards are reasonable; the resettlement measures have been fully carried out; the pubic has actively participated in the Project and the resettlement institutes work actively. Especially after the monitoring of Phase I, the Monitoring Group has found some problems which have been paid much attention to by the Owner and local governments, who will take the following measures to greatly improve the affected people’s living status and accelerate the resettlement progress.

RIFCIU- SWJTU 3 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project  Adjusting the compensation standards: On 13th day of August this year, People’s Government of Ya’an ratified the lifted compensation standards for some land surface attachments such as the removal of houses and graves, drawn by , Yingjing County and Shimian County according to the local specific situations; such standards have already been carried out now. The adjustment of standards at Mianning County is on the way and will put into practice in the coming days. The compensation measure of Hanyuan County is still in the consideration due to its particularity. After the adjustment of compensation standards, the price difference of houses that has been demolished before could be replenished by the new standards.  The demolishment of schools: Three elementary schools and two middle schools shall be removed from the line, including a national middle school and a national elementary school in Shimian, a national elementary school in Mianning, a middle school and an elementary school in Hanyuan. Yaxi Company, through consultation with local governments, will make the compensations according to the expenses needed by building a new school that will meet the local teaching requirements. In this way, the above-mentioned five schools have already begun to construct their new schools. In order to provide the construction site for the expressway as soon as possible, some schools even rent the classrooms with the transition fee provided by Yaxi Company. The classroom of Xichong national elementary school, which has become the dangerous building after the Wenchuan earthquake, is so outmoded that Yaxi Company has provided the transition fee for the school’s removal into movable houses which has greatly resolved the students’ problems. Compensations for demolishment of urban houses at the planned area: With the help of Yaxi Company, the government of Shimian County has established a set of measures which are applicable and conform to current policies: Provisional Transition Measures on the Removal Arrangement for Urban Residents at the Planned Area of Shimian County for Ya-Lu Expressway, Opinions on compensation resettlement for Ya-Lu Expressway Demolishment at the Planned Area of Shimian County, Implementation Scheme on Demolishment Resettlement for Residents at Planned Area of Shimian County for Ya-Lu Expressway. Yaxi Company, through comparison, has invited an agency company, which has got the house, assets and land evaluation quality with rich experience to operate in coordination with Shimian government to conduct this work. In order to resolve the house land problem and capital difficulties, the government, with Yaxi Company’s fund, has made a whole plan as constructing the river embankment and building the house and public facilities to create a environmental, energy-conversational and green living environment which will be better than before. By this demolishment, the living quality of the poor group will get greatly improved.  Settle the house land actively for the people affected by demolishment: For the separated resettlement household, the local government should positively coordinate and help them settle the house land as well as make compensations according to the compensation standards ratified by the provincial government; besides, the local government shall also compensate the basic facilities construction fee by person or household. For those farmers who have large house land construction, the construction units will provide the machines for assistance. For those extremely poor peasants, the construction units will assign workers to help demolish the house. For those farmers who fail to find the house land, the

The local government pays much attention to the security and environment of the resettlement place, which shall be designed and evaluated by qualified units according to the requirements of the new rural construction. During the construction, it shall conduct the tendering and bidding procedure as well as supervision to ensure that the environment protection, energy conservation and green has been up to the standard; road, water, electric, telephone and television line have been installed at the resettlement area; the house and various facilities meet the demands of farmers’ production and living; all of the above-mentioned contents have clearly shown that the living environment and conditions have been much better than before. The public land requisition, demolishment, road building and electric, water, telephone line, television line and drainage installation shall be at Yaxi Company’s expenses (without occupying farmers’ compensation fee for demolishment). However, although this resettlement project has achieved a lot, our external monitoring institute has to point out that there are still some problems for us to resolve as follows:  After the land requisition, lots of farmers of some counties have lost their land; these farmers are located out of the way and have limited working abilities on their own, especially for those middle-aged and the old who will have difficulties in living years later. The Monitoring Group suggests that local resettlement departments and the Owner shall transfer these people into urban residents and purchase endowment insurances for them, thus should they have difficulty in living, they could have the minimum living guarantee and endowment insurances.  After the land requisition, only part of the compensation fees to the village have been allocated to the affected people; the other part have been kept by the villagers group. The external monitoring thinks that: keeping such large fees at the basic level is also a risk. The Monitoring Group hopes that the resettlement departments could seriously supervise the villagers group to spend these fees on the public welfare services and the development of production.  There exist some grave conflicts in consequence of different local construction compensation policies. In order to maintain stability of the society, the local government promises to replenish the unpaid compensations in the proper time; those unpaid part concerning the land requisition and land surface attachments, which has been deposited at the financial accounts of the local government, shall be supplemented after the improvement of relevant policies.

RIFCIU- SWJTU 5 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project 1. Overview 1.1 Basic situations of the project Central Sichuan Roads Development Project contains four aspects, including (1) Ya-Lu expressway at the length of 239.8km, (2) direct connection line for 20km; (3) local supplementary road at the length of 678km to enhance the benefits of rural area; (4) transformation of passenger transportation center at Yingjing, Hanyuan, Shimian and Mianning County. 158km of the local road (total 678km) shall be directly connected with the expressway and constructed at the same time as well; the land requisition and resettlement shall also be carried out; thus the 158km of the local road is considered as “the road that is directly in connection with the local”. For the other 520km of the local road, most of it is within the scope of the current expressway, which shows that there would be almost no land requisite or resettlement. Sichuan Provincial Government has promised to the Asian Development Bank that should there be any land requisite or resettlement when constructing these local roads, the affected people will get the same compensations and other assistance as provided in the resettlement plan. For the transformation of the current passenger transportation center, there will be no land requisite and none business will be affected (for the purpose of convenient transportation, the business operations are not permitted at the passenger transportation center); should any influence happen, the affected people will get the same compensation and other assistance as provided in the resettlement plan. Most of local roads are not involved in the land requisition, thus this report shall only contain the monitoring on the resettlement arrangement for Ya-Lu expressway. Once the local road project has been confirmed and contains the land requisition, the resettlement arrangement office will provide the specialized resettlement arrangement plan and the external monitoring institutes will conduct the monitoring according to the agreement. Ya’an-Lugu expressway (hereinafter referred to as “Ya-Lu expressway”), at the length of 239.8km, is part of the expressway from to as well as part of main road of west from Lanzhou (Gansu) to Mohan (Yunnan). The established express way will improve the road network in Sichuan Province, promote the local economic and improve the conditions of the area. 1.2 Construction progress The Project has been carried out according to the planned progress. Until 31st day of August, 2008, the weighted value of the actual accomplished project in the whole progress is 31%; the land requisition and resettlement is finished by 90%; the roadway construction is finished by 21%; the local road for the expressway’s convenient construction is finished by 30%. Compared with the target at the end of 2008, the construction progress has being going forward as planned, that is, the roadway construction has been accomplished by 80.5%, culvert 76%, drainage and prevention construction 88%; bridge pile foundation 77%, upper structure 30% and tunnel 56%. 1.3 Resettlement progress Since the construction project has gone well, the land requisition and resettlement is also carried out strictly according to the plan. Until the end of August, 2008, the

The Project has already affected 29 towns, 93 administrative villages as well as 5 counties (districts), that is, Yucheng district, Yingjing County, Hanyuan Countyy, Shimian County and Mianning County of Liangshan Prefecture. Until the end of August, 2008, this project has requisitioned various lands as 1075.27ha, which is 106% of the planned requisition size. This land requisition involves 5 counties, 29 towns and 102 administrative villages; 60828 people have been affected in which the farmers account for 15865. The demolishment of 200589.89m2, which amounts to 97% of the original planned size, has affected 1545 households with 6746 people. 1.4 Monitoring and evaluation After accepting Yaxi Company’s authorization to carry out the independent monitoring and evaluation of the resettlement of Central Sichuan Roads Development Project, Research Institute of Foreign Capital Introduction and Utilization of Southwest Jiaotong University has drawn up the Independent Monitoring and Evaluation Outline to confirm the scope, content, monitoring target, working method and progress of the Project. Later, the Monitoring Group went to the full lines to collect monitoring and evaluation information and data. Based on the characteristics of long line and deep influence, the Monitoring Group has conducted the monitoring for the whole progress of the implementation of the resettlement project. Besides by holding symposiums with leaders of the affected towns, villages and groups, the team has also expanded the ratio of paying a visit to the households, been focused on investigating the places where most of land has been requisitioned, and conducted the sampling survey as well. The purpose of the investigation is to figure out the changes of people’s production and living before and after the land requisition as well as various compensation standards and fund appropriation; thus we could decide whether the affected people has come up to the target which shall be supported as stipulated in the resettlement arrangement plan, discover the problems occurring in the implementation process, give the feedback to related resettlement institutes as well as point out relevant improvement suggestions. 2 Monitoring of the Project’s Impact 2.1 Overall monitoring of the project’s impact According to the resettlement plan, 5 counties (districts), 29 towns and 102 administrative villages will be affected by the land requisite and construction demolishment, including 3 towns of Yucheng district (Duiyan, Guanhua and Babu); 4 towns of Yingjing County (Qinglong, Yanzhu, Fucheng, Longcanggou (combined by Shizhi and Huangyi)); 8 towns of Hanyuan County (Shuangxi, Jiuxiang, Tangjia, Fuchun, Hexi, Shirong, Qingfu and Xiaobao); 6 towns of Shimian County (Yonghe, Xinmian, Huilong, Zaiyang, Caluo and Liziping), and 8 towns of Mianning County (Tuowu, Yihai, Caogu, Chengxiang, Linli, Houshan, Shilong and Lugu). This project shall need to requisite permanently various land at the size of 1016.926ha, involving 5 counties, 29 towns and 9393 administrative villages. In the area where the land requisition and demolishment will be carried out, there are various houses at the size of 207,312m2, in which the brick-concrete structure occupies 42049m2; brick-wood structure 90391m2; timber structure 74873m2. 929 households shall be demolished, affecting 3412 people and 56 villages will be involved. The statistic number of demolished houses has contained the number of enterprises demolished.

According the actual accomplishment of resettlement, until the end of August, 2008, 5 counties (districts), 29 towns and 102 administrative villages has been affected by the land requisite and construction demolishment, including 3 towns of Yucheng district (Duiyan, Guanhua and Babu); 4 towns of Yingjing County (Qinglong, Yanzhu, Fucheng, Longcanggou (combined by Shizhi and Huangyi)); 8 towns of Hanyuan County (Shuangxi, Jiuxiang, Tangjia, Fuchun, Hexi, Shirong, Qingfu and Xiaobao); 6 towns of Shimian County (Yonghe, Xinmian, Huilong, Zaiyang, Caluo and Liziping), and 8 towns of Mianning County (Tuowu, Yihai, Caogu, Chengxiang, Linli, Houshan, Shilong and Lugu). The statistic number of demolished houses has contained the number of enterprises demolished. Until the end of August, 2008, this project has actually demolished 200589.89m2, which amounts to 97% of the original planned size, has affected 1545 households with 6746 people. Details are specified in Table 2-2 as follows. During the construction period, the project will need to temporarily occupy the land 5214mu/347.8ha, in which the paddy field occupies 14%, unirrigated farmland 32% and non-cultivated land 54%. The statistics have not been fully finished yet; we will emphasize it in next monitoring report. 2.6 Monitoring of fragmentary tree and grave The affected fragmentary trees mean various fragmentary trees surrounding the

However, the statistics have not been fully finished yet; we will emphasize it in next monitoring report. 3 Compensation Standard and Compensation Monitoring 3.1 Compensation Policy Monitoring The compensation follows three principles, namely, in accordance with the Land Administration Law, Land Management Law implementing regulations and the Regulations on the Administration of Demolishment and Relocation in cities; follow the Compensation standard of land, young crops approved by Ministry of Land and Resources and the Compensation standard of ground attachments approved or to be proved by the provincial government; In line with the compensation standard in the Resettlement Arrangement Plan jointly approved by The Asian Development Bank and Yaxi Company. These three principles share the same spirit, which is to ensure the full and quick recovery of the affected to the prior production levels and living standards. Replacement cost will act as an objective criterion to measure the reasonableness of the compensation standards. 3.1.1 Policy Foundation The Major policy foundation of the resettlement, land requisition and demolishment in this project are as follows: (1) Ya’an City ◆ The Official Replay of Sichuan Provincial People’s Government on the adjustment of compensation for young crop, ground attachments in Ya’an City. As the calculation of the Output value of different types of land, different building replacement cost of varied buildings are carefully conducted by following related state and local laws and regulations, the compensation standards for different counties, districts, towns and townships vary from each other. The details are as follows: 3.2.1 Monitoring of compensation standard in Ya’an City  The Monitoring of land requisition compensation standard The land requisition compensation in Ya’an includes the compensation for land, resettlement and young crops, Though the Plans and the actual compensation standards for each county, district and township is different, the compensation plan is in line with the standards, in no case the compensation is lower than the standard plan, See more details in Table 3-1.

The compensation for the temporarily occupied land in Ya’an City during the construction includes compensation for young crops, trees or plants and land using fee. The planned compensation standard is RMB 3,200 yuan/ mu for irrigated land, RMB 2000 yuan/ mu for arid land, RMB 1,000 yuan/mu for forestland and RMB 1,000 yuan/mu for the rest types. The constructor is responsible for the rehabilitation of the temporarily occupied land. The actual compensation followed the planned standard. Source: governmental documents of the affected counties and districts  Demolishment standard monitoring According to the new decision of the provincial government, during the land demolishment and resettlement, the living standard of the affected must not be lower than prior and the livelihood of the affected must be guaranteed in a long run. The local government should adjust the level of compensation which can no longer meet the standards according to the local economic and social development in a timely manner and report to the provincial government for approval. In that spirit, On August 13th this year, Ya’an people’s municipal government approved the proposal from its Yucheng District, Yingjing County and Shimian County in which higher Compensation standard of housing, relocation of the tombs, and some other ground attachments are suggested. The new standard has already taken effect. (See detailed adjustment in table 3-3). Due to its special circumstances, the compensation plan for Hanyuan County is still in the pipeline, yet the new standard will be applied to those demolished prior to the adjustment. Attachment 4 is the new compensation standard of Shimian County.

Source: governmental documents of Mianning County. 3.2.3 Conclusion of Compensation Standard Monitoring By adopting various ways such as going through original transfer slips at Yaxi Company and the local coordinate office, visiting the affected people, the monitoring group has done a detailed survey on the implementation of standards for compensation. The results of the survey proved that the counties along the road all implemented the compensation plan in accordance with the Resettlement Arrangement Plan and the adjusted standards by the government. It is worth mentioning that Ya’an municipal government is planning to re-compensate the affected by new standards for the smoothness of the resettlement work and the interests of immigrants. 3.3 The general situation and channels of fund appropriation In the course of the field investigation, the monitoring group holds the channels of fund appropriation as an important content of the monitoring. By taking a stepwise method, the monitoring group checks the time and amount of the funds allocated from the Yaxi Company to the payee, then checks the funds transferred from the payee to the grass-roots level; then as the last step, checks the payments and

By doing so, the Group can confirm that Yaxi Company has allocated the compensations for young crops and fixtures, land requisition and other kinds in full to the dedicated accounts of the relevant local government departments according to their land demolishment budget. Receiving the money, local government departments then cash the compensation to the appropriate people and settle the accounts with Yaxi Company with payment documents. Up to now, the compensation for young crops and fixtures, land requisition and other kinds allocated from Yaxi Company has reached RMB 546.43 million yuan. 420.430 million yuan has been distributed to the indemnities already. 126 million is still in the accounts waiting to be compensated out. More details can be found in table 3-9. The slow progress of the payment of compensation money during the first half of this year has caused the stay of large amount of money in the dedicated accounts of local governmental departments, which, in this June, is warned by the Sichuan Provincial Auditing Authority. Many facts have contributed to this problem. As the land requisition has not completed, a large number of houses are still in queue for demolishment, but the funds from Yaxi Company to the local fiscal accounts are allocated according to the compensation budget approved by the Ministry of Land and Resources and the provincial government. The compensation standards of expressway projects, large-scale irrigation projects and local construction projects are not in accordance. (The compensation standards of expressway projects are far higher than that of other project). Due to this, local authorities need time to develop specific policies to balance the divide. Also, according to the policies, a certain percentage of the compensation fund will be set aside for the collective organizations, the large scale land requisition for expressway project also contributed to the large amount of reserving funds. In order to make good use of this money, local authorities need time to develop proper ways for the management. In order to solve these listed problems, many policies are formulated and implemented by the related counties to promote speed the flow compensation funds. However, some counties are still faced with problems resulted from the conflict in compensation policies. In order to maintain social stability, Local authorities promise that the unpaid compensation will be paid in full in future. No appropriation of the funds in the local fiscal accounts was found by the provincial auditing authority since this June. By looking at Ya’an and Liangshan’s allocation channels of the compensation fund, we can find some differences. In Liangshan Prefecture, the compensation of land requisition and demolishment is transferred directly from Yaxi Company to the commercial banks in Liangshan, then according to the list of compensation provided by the Mianning County’s land, migration and forestry authorities, the bank directly deposit the compensation in the back accounts of the affected individual and collective. The prefecture, county and township government are not involved in the distribution. Their work is funded separately. In Ya’an, The compensation from the Highway Company is paid to the municipal finance. Then the fund is transferred to the Rural Credit Cooperative (or other backs) to the order of the Land Bureau. Then the bank would pay the affected farmers by way of bank book. But the method adapted by Shimian County is special. According to the documents of People’s Government of Shimian County (SFF [2007] No. 25), Currency resettlement and land re-allocation are both applied. After the land requisition, new land is allocated to the affected farmers so that their

Currency resettlement is applied and one-time compensation is paid to the villagers if this level cannot be reached. The gap between the handsome actual compensation standard and low one-time compensation standard has caused the detention of large amount of land requisition compensation in the accounts of the affected groups of villagers. The comparison between the county’s ratified actual compensation standard and one-time compensation standard can be found in Table 3-10. The act of using the land requisition compensation, as well as the land re-allocation, should be stressed in the future monitoring. Working expenses shall be paid by the Owner separately. At the same time, to the affected villages and groups of villagers who are assigned with new land, the compensations are used to develop the agricultural production or public welfare. In some counties, the arable land per capita is of small size, some farmers even lost their land after the land requisition. Yet there’s no policy regarding the resettlement of this kind of villagers. Also, in some counties, the compensation for land requisition is still far away from the affected, in some other cases, compensation remains in the collective village level but no specific land adjustment plan is drafted. We can see from the above that although progresses are made due to the hard work of the Owner of the project and local government departments involving resettlement, further effective actions need to be taken to take care of the affected villagers who lost their land in the requisition and to complete the land readjustment work. By adapting a variety of ways such as holding conversaziones, interviewing key informants, taking field investigation, the Monitoring Group investigated the resettlement result of the affected villages and groups of villagers. On the whole, the work of Demolishment and resettlement is difficult. The main reason for the slow pace of the work during the earlier stage is the excessive price surge from last year to now. The compensation by the Compensation standard of auxiliaries on ground approved by the provincial government in 2006 is no longer enough for the rebuilding of new houses, which caused the unwillingness to demolishment. Also, it is hard for the relocated households to find a place with good surroundings and convenient transport and water supply to rebuild their new homes. This year’s snowstorm and the earthquake in Wenchuan all brought great difficulties in purchasing materials; some villagers are not unified on the resettlement position. Beside, many segments such as site choosing, geological survey, geological hazards assessment, planning, design, evaluation, construction of public facilities are involved in the process, which all leads to the long construction period. To solve the listed problems, Yaxi Company adapted the following methods. (1) Readjust the compensation standards. According to the new decision of the provincial government, during the land demolishment and resettlement, the living standard of the affected must not be lower than prior and the livelihood of the affected must be guaranteed in a long run. The local government should adjust the level of compensation which can no longer meet the standards according to the local economic and social development in a timely manner and report to the provincial government for approval. In that spirit, On August 13th this year, Ya’an people’s municipal government approved the proposal from its Yucheng District, Yingjing County and Shimian County in which higher Compensation standard of housing, relocation of the tombs, and some other ground attachments are suggested. The new standard has already taken effects (See detailed adjustment in the table below). Due to its special circumstances, the compensation plan for Hanyuan County is still in the pipeline, yet the new standard will be applied to those demolished prior to the adjustment. Mianning County is also framing its new compensation standard. (2) The relocation of schools. Three primary schools and two middle schools along the expressway shall be relocated including one middle school and one primary school for nationalities in Shimian County, one primary school for nationalities in Mianning County, one middle school and one primary school in Hanyuan County. As the government and the people along the expressway are all have a very tight budget, the school houses, teaching facilities are all old and

RIFCIU- SWJTU 19 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project dilapidated, If the house demolishment is performed in accordance with the general standard of compensation for average housing, the compensation is far from sufficient to meet the needs of rebuilding the schools (the compensation can only cover half of the cost). In order to support the development of education in ethnic minority areas and poverty stricken mountainous areas, Yaxi Company decided to provide compensation to the schools which would be enough to cover the cost of building new schools in which the requirements of the locals could be met. In this way, the 5 schools all have started their building of new campuses. In order to give place to the expressway construction site as early as possible, some schools rented classrooms in other places by using the transitional compensation provided by Yaxi Company. Because the classroom building of Xichong primary school for nationalities is too old Yaxi Company funded the earthquake-endangered school to move into portable dwellings so that the students can continue their study. (3) House demolishment compensation in urban areas. The planned interchange of the expressway has to pass through the county town of Shimian County due to the narrowness of the terrain, thus 10 villages, groups of villagers and a total of 700 houses need to be demolished. The residents of these houses includes local farmers, laid-off workers, urban residents and immigrants of Pubugou Power Station, the housings are owned by collective or individuals. The majority of households living in poverty here so the resettlement work are difficult to conduct. First, it is difficult for the residents to find appropriate places for rebuild their homes, second, housing structure and build time varies greatly and solo standard cannot apply to all and satisfy the residents. Thirdly, if the value assessed by the intermediary agencies is in strict accordance with the real value of the housings, then the compensation for these households would be low. To resolve these contradictions, Shimian County Government has drawn up a set of legitimate and practical policies in line with the company such as: “The temporary transitional arrangement for resettlement of urban residents of Ya-Lu Expressway, Sichuan Section”, “Opinions on Demolishment and resettlement compensation in the planning area of Ya-Lu Expressway, Sichuan Section” and “The implementation plan for the demolishment and resettlement in the planning urban area of Shimian County”. After careful selection, The Yaxi Company appointed an intermediary company with assessment qualification and experience to carry out the resettlement with the Shimian County Government. The resettlement program funded by Yaxi Company includes the construction of embankments for the new homestead, displacement of earth and stone to build good houses for the relocated residents. By careful planning and designing, the new home for the residents are environmental friendly, energy saving, green, and with good public facilities. As a result of the successful relocation program, the living condition of these residents has been greatly improved. (4) Actively help the relocated households to get new homestead. For the resettlement of families dispersed, the local government actively coordinated their efforts to get new homesteads for them. In compensation, in addition to the part approved by the provincial government, the relocated households or individuals also get compensation for infrastructure construction costs. For those comparatively larger scale house-building projects, Construction units also arranged construction machinery to help the work. Also, help were sent by

For those who cannot find a homestead, local authorities would provide centralized re-location in accordance with the principle of voluntary, Also, great attention was attached to the environment and safety of the centralized re-location spots by the local authorities. Qualified designers and constructors were employed to perform the planning and design, geological survey, geological disaster assessment, as will as housing structure design. Bidding and supervision procedures are adapted to make sure that new homes are energy saving and green. Roads, water, electricity, telephone, television lines are connected into the resettlement areas, these completed facilities can meet the production and daily life needs of the farmers. The new living environment has provided the villagers with living conditions better than before. The land acquisition and demolishment work, roads, electricity, water pipes, phone lines, television signal transmission lines, sewage facilities on public part of the land are all funded by the Yaxi Company and is not counted in the demolishment compensation budget to the affected. At present, more than 80 rural households in Babu township of Yucheng District is planning to move into a centralized resettlement area, of which planning and design has passed the assessment in September. Yingjing County also set up three centralized resettlement areas in Qinglong Township where the planning and design has completed and geological survey, geological disaster assessment and structure design are on the way. Of the three areas, on is under construction and the other 2 are also looking at the start in October. The planning and design, geological disaster assessment and structure design have already conducted on 5 centralized resettlement areas in the planned 6 in Hanyuan County. Also, the centralized resettlement area set in Shimian County is under planning. In order to complete the demolishment and make room for the expressway construction, Yaxi Company has provided very generous transition compensations to the affected. 4.1.2 Sample survey of the affected counties, towns, townships, villages and groups of villagers The following will introduce a sample survey of the resettlement of the affected counties, towns, townships, villages and groups of villagers. The basic situation of the affected can be found in Attachment 3. ● Hanyuan County ◆ Chen Dengfu, Deputy Director of the Highway Project Coordination Office of the Land Bureau, Hanyuan County The land requisition, resettlement demolishment introduced by Mr. Chen: In general, after the land requisition, the affected farmers would be assigned with new land in their resettlement. Land compensation has been paid to the village collective, and compensations of young crops have been to the relocated households. To these villages whose arable land per capita is small, one-time currency resettlement is applied. After the demolishment, the affected farmer can move into the centralized resettlement areas designed by the land bureau and build their new homes there, or they can also find: homesteads by their own.

After topographic survey, geological hazards assessment, planning and design, ground level, the centralized resettlement area can be provided to these affected in the first half of 2008. ◆ Mr. Kangliang, the chief of Tangjia Township, (13438688488), Mr. Zhang Jianxin, Member of the party committee (13981628399)  Basic conditions of the township: No large area of orchards, farmers also plant apples, pears, peaches, grapes with vegetables. The town is famous for rice and garlic. The income per capita for the villagers in the township is about 3240 yuan.  The land requisition and resettlement condition: 636.33 mu of land is inside the land requisition red line, almost all irrigated land, and arid land only takes up 15 mu of the total. With a 0.5 mu arable land per capita, the villagers’ land lost in the requisition will be exchanged with farm land nearby. The scale of the centralized resettlement area can hold 55 households but some of the households may want to move to other places. 27 of the planned 113 building demolishment have been completed and 11 of them have already been admitted to their new home. The construction of new home for the centralized will begin in August 2008.Land acquisition compensation fee had not yet paid to the villagers. ◆ Deputy Chief of Shuangxi Town, Xue Yuhua About 5 households, 18 migrates are from the requisitioned area of Pubugou Power Station to seek refuge with relatives and friends in Shuangxi town. The resettlement allowances of the requisitioned 220 mu land are distributed directly to the farmers via bank (Rural Credit Cooperative). The local authorities only help with the payment stage. The land compensation has not yet paid. The compensation standard is 18540 yuan per mu for land resettlement, 1659 per mu for young crops. Most of the 9 relocated households are now living in Mulan Village. The new homes are built since September 28th, 2007 and 8 have already moved into the new house. The Transition fee for each household is 260 yuan per month. Allowance of resettlement is 385 yuan per person. ◆ Zhang Yi, Party Secretary of Qingfu Township. My town is in the flooding area of the building power station, so 1045 households and 5307people are relocated, including those 3666 people relocated to the five counties and more than 20 towns in Municipality. The rest population is resettled inside the territory of the county. Compensation for land requisition and young crops, allowance of resettlement are all not yet been cashed. ● Mianning County ◆ General office of the Yaxi Company’s administration office in

Director Mr. Chenqing: this project is related to 8 towns, townships and 25 villages of Mianing County. According to the agreement between Yaxi Company and the local government, the land requisition and demolishment fall to the work extent of the local government under the supervision of Yaxi Company. The usage of the fund: The fund is transferred to a commercial bank in Liangshan Yi autonomous prefecture, then cash to the relocated households while the work expense is funded separately. Most of the requisitioned land are compensated expect a few for the Land ownership dispute. ◆ Mr. Zhang Youfu, chief of Land use section, Bureau of Land and Resources , Mianning County. 13881569196 For the eight land requisition related towns, their Arable land per capita are not balanced. The number for the three Yi nationality villages is 2.8 mu while Lugu Town only got 0.5 mu. The compensation of land requisition is directly cashed to the affected villagers and they can buy shops for a better quality of life. According to the documents of Sichuan Provincial Government No.39, Land requisition compensation is allocated to the farmers by the Land authorities. The adapted method is as follows: compensation is allocated by the land bureau vie banks while village and township cadres help to identify the relocation household. The compensation is cashed if the amount is less than 2000 yuan, otherwise, a bankbook would be given to the compensated. Since the start of compensation on June 4th, 2007, nearly 80 million yuan has already distributed. Some Personal from Bureau of Land and Resources are involved in this work, they are: Lin Yi (Deputy Director), Yang Yanli, Chief of the planning Section, Zhao Qiong, chief of Cadastral Section, Zhang Youfu, Chief of Land Use Section and Sha Zhengrong, Lu Zhihua and Wang Xiaofeng. ◆ Mu Jia, Director, The Bureau of Forestry The compensation of forest land requisition involves compensation for forest, compensation for forest land, the allowance of resettlement and Forest Vegetation Restoration Subsidy, in which, Forest Vegetation Restoration Subsidy has to report to the provincial level, so only the rest three are compensated to the affected individuals and collectives. Most of the compensations, which are not distributed due to the land ownership dispute, will be distributed after the settlement of these disputes. ◆ Mr. Huang Jianhua, Deputy Director of Migration Bureau According to the documents of Mianning County government (2007 No.20), Government signed contract with every relocation household respectively according to the three different housing types, namely brick-wood structure, civil structure and brick-concrete structure. Migration Bureau printed checkout sheets for every household according to the type of their demolished housing. Currency resettlement is applied

The homestead, which is 60 m2 per person, has to be confirmed by the land resource bureau. 80% of the housing demolishment compensation is paid in advance and the rest part paid after the resettlement. Up to now, more than 150 households have moved into new house and 31 million has been compensated. The personals of the Migration Bureau involved in this work are: Wang Ning (director of the bureau), Huang Jianhua (deputy director), and Liu Shichun, Niao Kaifa, Su Zhengxiang, Wan Jianglong, Shen Dehua, Mao Jianying, Zou Shuhua, Li Qiong, Yang Jinju, Chen Zhaomin and Lu Xipu. ◆ Zhu Dan, Secretary of the Communist Youth League of Lugu Town, Mianning County  Basic conditions of the Town: The town of Lugu is the biggest town in Mianning County with a area of 95.7 Square Kilometers and 8955 mu arable land. The town governs 6 administrative villages, 4 residential committees and 59 groups of villagers with a population of 26,066 people. Chengkun Railway, No. 108 National Highway and Yapan Highway passed the territory of the town. In 2006, the town realized a gross domestic product of 118.670 million yuan, agricultural output value reached 21. 36 million yuan and industrial output valued 134.07 million yuan. Farmers’ per capita net income reached 3014 yuan.  Condition of Land requisition and demolishment: Lugu town’s coordination group of 14 is headed by the Party secretary, and assisted by the deputy secretary and Zhudan. The land requisition is related to Wangjiaci, Datian and Wuyi Village and 16 groups of villagers. 688.5 mu of land is requisitioned including 202.5mu of irrigated land and 0.85 mu of arid land. 490 households are affected. The demolishment of the three villages affected the living of 17 households, involving 2352 m2 homestead land, 580 m2 of brick buildings and 1782 m2 of half-timbered buildings. The requisition also includes trees and wells which affected 142 households. The length of the expressway in the town is about 2.8 kilometers and the length of the two side paths is about 1 kilometers. 5,547,062.15 yuan has already cashed as the compensations of young crops and the land Requisition. Currency resettlement is applied and the compensations directly go to the affected. No new land will be allocated to the farmers. Since the average arable land per person in only 0.5 mu in this area, the requisition would make 100 households to loss of their land. Now policy is drafting for the future of these farmers. After the demolishment, Farmers have to find homestead by their own. Up to now, only three households have found the suitable homestead. Since the compensation for homestead is only 26.5 thousand per mu, the 14 households who don’t have land cannot afford the market price of 100 thousand per mu. The government and the Owner of the expressway are actively taking measures to solve this problem for the farmers. ◆ Mr. Guo Yuangang, Chief of Shilong Township government,

National Highway 108 runs its length throughout the township. The five administrative villages namely Shuangqiao, Mingzhu, Heping, Shilong and Gaojian Village and the 25 groups of villagers are the home to the 3449 households and the 15,308 population. After relocating to the Houshan Township bypass in October, 2002, The Township government now is 24 kilometers away from the county town. While agricultural output value accounts for 60% of the total, industrial output value accounted for 30% and tertiary industries 10%. The per capita net income of farmers is 2782 yuan.  Condition of Land requisition and demolishment: The length of the expressway to be built in this township is 4.78 kilometers. Land requisition affected 3 villages (Gaoyan, Shilong and Heping Village) and 15 groups of villagers. 292.75 mu of arable land, including 124.97 mu of irrigated land and 167.78 mu of arid land is requisitioned. Currency resettlement is applied and the compensations directly go to the affected. No new land will be allocated to the farmers. There are 24 households in Gaoyan village need to be relocated, of which 13 have their own homesteads, 6 can find new homestead by their own and 5 cannot. So the township government will relocate the 5 households together. Consultations will he held for the specific plan. Detailed name list of the affected can be found in Table 4-1.

Covering an area of 193 square kilometers, the town governs 8 administrative villages, 4 communities and 87 groups of villagers (or residents) with a population of 36,506 and 11,943 households, in which 14,050 people are non-farming population. The population mainly consists of Han, Yi, Tibetan and Hui ethnic groups. National Highway 108 runs its length throughout the town. Chengxiang Town enjoys the advantage of convenient irrigation thanks to the three rivers run though its region. The 18,351 mu arable land mainly produces Rice, wheat, corn, rapeseed, potato, and vegetables. The per capita net income of farmers was 3400 yuan in 2006.  Condition of Land requisition and demolishment: Land requisition related to 3 villages and 17 groups of villagers. So a coordination group is set up, in which Chen Shipeng acted as the head, Lu Ajia (Yi nationality, Female) acted as the deputy. (13981506516)Mr. Wang Jianguo (13550432713)  Basic conditions of the Township: Covering an area of 42.8 square kilometers, Linli Township is ten kilometers away from the county town to the southeast. National Highway 108 runs its length throughout the township. With its three administrative villages namely Fengshou, Linli and Gaoyao village and 15 groups of villagers, the town owns a population of 5,648 and 1257 households. Residents here are mainly Han nationalities, and some belong to Yi and Tibetan ethnic groups. The town also has 4697 mu of arable land. The total value of GDP of the township in 2007 added up to 28.64 million yuan and farmers’ net income per capita is 2,841 yuan in 2007.  Condition of Land requisition and demolishment: Land requisition in Linli village mainly involves the requisition of forestry land, which shall be allocated to the groups of villagers, then to the villagers respectively. The allocation has not yet performed due to the absence of related official documents from the county level. ◆ Ms. Mu Xingzhi, (Tibetan) Chief of Caogu Township, Mianning County. 13881554329  Basic conditions of the township: Covering an area of 122.83 square kilometers, The Caogu township is located 22 kilometers away from the county town to the northeast with National Highway 108 runs its length throughout the township. The whole township is located in the Alpine zone with an altitude of 1960 meters at the location of the township government. With a population of 6,185 and 1,397 households, the Yi nationality inhabited township has 3383 mu of arid land (984 mu of irrigated land included) with it 3 administrative villages and 19 groups of villagers. 70% of the township’s land is covered by forestry. In 2007, the total value of GDP added up to 18.98 million yuan, including 13.2687million contributed by the first industry, 3.237 million from the secondary and2.473 million from the tertiary industry. Farmers enjoyed a of 2,223 yuan net income per capita in 2007.  Condition of Land requisition and demolishment: Land requisition affected 3 villages and 19 groups of villagers. 153519.31 square meters of land is requisitioned including 18489 square meters of arable land. More than a million of the compensation for forestry land has already cashed. Because of the collective ownership of the forestry land, the Township authority is making distribution plans. Only 53 households are affected and only one family has problem exchanging for homestead.

As the land purchase price is lower than the compensation for house prices, all the affected farmers can find their ideal homestead for house building. ◆ Yu Zhenghua, (Yi Nationality), Chief of Yihai Township, Mianning County.  Basic conditions of the township: Yihai Township is 38 kilometers away from the Mianning County town to the north. The town is famous for the “Yihai lake alliance” in the national revolution period of . The location of the township government is 2080 meters high above sea level. The township covers an area of 128.46 square kilometers with a population of 4571. With its 6393.1 mu arable land and three administrative villages namely Yihai, Yanjin and Nepa, the major agricultural output of the township are Potatoes, corn, pepper and walnut.  Condition of Land requisition and demolishment: Land requisition affected 3 villages and 17 groups of villagers. More than 40 households in Yihai Village, Dayanjin Village and Lepa Village need to be relocated and 688.5 mu of land is requisitioned. All the compensation goes to the affected families directly. No farmer would lose land after the demolishment due to the abundant land resource in the area. As the land purchase price is lower than the compensation for house prices, all the affected farmers can find their ideal homestead for house building. ◆ Mr. Qiu Jinlin (yi nationality), Chief of Tuowu Township, Mianning County  Basic conditions of the Township: Sitting on the left bank of , Tuowu Township is located in the north end of the county with an area of 263.2 square kilometers. People Yi nationality consisted 98% of the 3,340 population. National Highway 108 runs its length throughout the township. The sitting place of the township government is 48 kilometers away from the county town to the south. With its 9485 mu arable land and four administrative villages namely Tuowu, Sangu, Huangjiaba and Luba, the major agricultural output of the township are Potatoes, buckwheat, oats and pepper. The total value of GDP in 2007 added up to 17.65 million yuan and farmers’ net income per capita is 2,607 yuan in 2007.  Condition of Land requisition and demolishment: 14 kilometers of the expressway runs though the township, affecting 3 villages and 8 groups of villagers. More than 40 households need to be relocated and 530 mu of land is requisitioned. Only 11 households are Han people in the 3,411 residents of the 4villages of the township. As there are still land ownership disputes between the groups of villagers, the forestry compensation is not yet paid.

General conditions collected by field research are listed below: ◆ Liziping Township  Basic conditions of the Township: The township, which is located in the southern part of the county, 37 km from the county seat, covered an area of 512 mu in size. The minimum altitude in the township is 1400 meters and the maximum altitude is 1880 meters high, the location of the township government is 1470 meters high above sea level. The township has two ethnic groups, 7 administrative villages and 24 groups of villagers. Liziping has 1088households and 4193 residents, of whom 15 households, 52 people are Han people. There are 220,000 mu of forestry area, and 2170 mu of arable land  Condition of Land requisition and demolishment: 4 villages in the township are affected: namely Yuangen village, Lizi village, Menghuo village and Gongyi village. Yuangen village is a seriously affected village. The project requisitioned more than 300 mu of arable land and returned more than 500 mu farmland to forestry.167 households are affected. By following the resettlement principle “land re-allocation as the major method, currency resettlement as a supplement”, the affected villagers’ per capita land area is now no less than the originally contracted land area. The land requisition work inside the project Red Line framework has been completed and 90% of the compensation has been paid out to farmers. 79 relocation households, 79, 390 people are affected by the demolishment.  Yuangen Village Altogether 113 mu of land will be requisitioned, with compensation standard of 34839 yuan/ mu. The compensation fee has been transferred to the village, which will be further transferred to each family at 14000 yuan/mu with 600 yuan/mu of young crops compensation fee. All village families have received the above compensation fees by Spring Festival 2008. There are 36 families that have been resettled, among which 17 have been demolished in Sep. 2007 and received compensation fee.

RIFCIU- SWJTU 29 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project The reserved collective compensation fee will be used in following aspects: (1) Infrastructural construction such as water, electricity and road. (2) Exploration of 100 mu wasteland for orange plantation to increase farmers’ income. (3) Reserved for festival activities (4) Reserved for helping poor families; Allowance of 50-100 yuan for primary students from poor families. (5) Allowance of 150-200 yuan per year for elders over 60 until death  Menghuo Village There are 76 families (about 300 people) involved by land requisition, including 80 mu of dry land, 7 mu of forestation land and 600 mu of forests. The requisition did not have great impact on plow land. Compensation standards are the same as Yuangen Village. Demolishment influenced 1 family that has not moved. Villagers have different opinions on the reserved part of compensation, which will probably be used for snow disaster compensation and poverty help. Caluo village  Briefing Caluo Village is located 17 km to the south of Shimian County, with National Highway No. 108 across the village. It covers an area of 76.3 km2, with minimum latitude of 1100 m and maximum latitude of 1180 m. Altogether there are 4 nationalities, including 5 subordinate villages and 32 villager groups. There are 1198 families (3981 people), among which 2253 are Han, 1480 are Yi, 245 are Tibetans and 3 are Bai nationalities. There are 2073 males and 1908 females including 804 female labors. There are 5986.5 acres of forests, 1565 mu of plow land, among which 500 mu are paddy field, 1043 are dry land and 2700 are mulberry field.  Requisition and Demolishment The project involves 3 villages—Shangli, Fulong and Nanya Villages, among which Nanya Village is particularly influenced. The expressway has started construction, which is 12 km in total length including 4 mark sections. The priority of requisition resettlement is land transfer, to ensure the plow land remains the same. If it fails to reach the standards, currency resettlement should apply, with the compensation standard of 38157 yuan/mu. Farmers shall receive compensation fees as 17000 yuan/mu for paddy field, 15000 yuan/mu for dry land, 15000 yuan/mu for reforestation. Compensation for young crops will be 800 yuan/mu for paddy fields and 600 yuan/mu for dry land. Compensation fees have been transferred to village. There are 62 families (about 244 residents) are involved. There is only one

There are 16 families in Fulong Village, among which 11 families have moved. The remaining 5 families have started building their new houses and will move after completion.  Fulong Village There are 120 families whose land has been requisitioned. Compensation fee for paddy fields as 16000 yuan/mu have been received while the additional 1000 yuan/mu is still to receive. Compensation fee for dry land as 8000 yuan/mu was received from Sept to Oct. 2007 while the additional 7000 yuan/mu is still to receive. Reforestation compensation has not been received. 60% of the farmer families have received requisition compensation fee. There are 7 families that need to move, with their new houses under construction. The remaining half compensation fee will be received when the new houses are completed.  Nanya Village There are altogether 60 families involved, 340-359 mu land permanently requisitioned and 40 mu temporarily requisitioned. Maximum requisition for one family is 10 mu. Compensation fees have been transferred to farmers as 16000 yuan/mu for paddy field and 8000 yuan/mu for dry land in Nov 2007, with the additional fee still to receive. There are more than 50 farmer families influenced in the demolishment (18000 m2 in total), 60% of which has been completed. The remaining houses are under construction with half compensation fee received. According to village cadres, 70% of the houses will be completed in March, and 30% will be completed within 2 months. Huilong Village  Briefing Huilong Yi Nationality Village lies in southeast of Shimian County, covering 22 km2, including Huilong, Liangqiao, Shilong, Yeping, Lianhe and Zhuma villages and 33 villager groups with residents of Yi, Han, Liang and Hui nationalities. There are 2034 families (6114 residents), including 3045 males and 3069 females. There are 2280 minorities, accounting for 37.3% of the total population.  Requisition and Resettlement The road is 2 km in the village, with Liangqiao Village involved. There are 2 groups involved—Luojiaping Group and Shangjidu Group. This village is a provincial-poverty one, with 2000 minorities and 2 Yi Nationality group. Shangjidu Village is involved in the project. There are 49 families that are involved in the project, with requisition standard as 41475 yuan/mu. Farmers shall receive compensation fees as 21000 yuan/mu for paddy field, 16000 yuan/mu for dry land, 16000 yuan/mu for reforestation. Compensation for young crops will be 800 yuan/mu for paddy fields and 600 yuan/mu for dry land. Compensation

RIFCIU- SWJTU 31 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project fees have been distributed to farmers. 50% of grave compensations have been received. Forest requisition index has been published with compensation standards undefined. There are 19 families that need to move, who will be collectively resettled by government. The new houses haven’t started construction while the demolishment contracts have been signed and half the compensation has been received. The other half compensation will be received after moving. There are 5 families renting houses (rent 350-400 yuan/month) with their own demolished. Villagers claim that it is difficult to rent house and solve breeding problems. Xinmian Town  Briefing Xinmian Town lies in the County, covering 153.6 km2, including 6 villages and 32 villager groups, 4 residence communities and 21 resident groups. There are 8923 families of Han, Yi and Tibetan nationalities, with a total population of 39311 (31958 are town residents and 7353 are rural residents). The subordinate villages and groups are allocated along No. 108 National Highway and Lu-Shi Highway.  Requisition and Demolishment The part within the town is 6 km long, with 3 mark sections, 2 villages (Dongqu Village and Shunhe Village) and 5 communities (Yanzi, Laojie, Xinjie, Chuanxindian and Caobapai Districts) involved. Dongqu Village is particularly influenced in the project. Requisition standard is 49770 yuan/mu. Farmers shall receive compensation fees as 24000 yuan/mu for paddy field, 17000 yuan/mu for dry land, 16000 yuan/mu for reforestation. Compensation for young crops will be 800 yuan/mu for paddy fields and 600 yuan/mu for dry land. Compensation fees have been distributed to 200 farmer families in Shunhe requisition program while in other villages and districts requisition has not begun. There are 684 families that need to move and 190 families that move twice. Full-scale measurement has been carried out in Shunhe Village with 2 public notices of compensation standards. Zaiyang Village  Briefing Zaiyang Village lies in the north bank of , 15 km from Shimian Town, bordering 4 villages—Fengle, Meiluo, Yingzhen and Yonghe, covering an area of 24 km2. There are 4 administrative villages—Pingyang, Mafu, Nianzi and Sanming Villages. There are 20 villager groups—7 in Pingyang Village, 4 in Mafu Village, 5 in Nianzi Village and 4 in Sanming Village. There are 1764 rural families at the end of 2004, with a total population of 5700 among which Han accounts for 97%, Yi 1%, Tibetan 1.5% and Bai 0.5%. At the end of 2004, there are 3823 mu of plow land, among which 2008 mu are paddy field, 1815 mu are dry land and 1219.4 acres are forests. In average, each residents own 0.7 mu land, including

Pingyang Village No.1 Group is involved, which is no dismissed. This group is particular in the following aspects: (1) Waterfall power plant immigrants (2) Hukou is not local while house and land belong to this group (3) Non-rural residents with local land and house. Therefore, according to specific conditions, local government planned 4 ways of resettlement that have been completed, including self-solution, elderly insurance and career solution. Due to historical reasons, there is only compensation for young crop and grave compensations, exclusive of land and house compensations. Yonghe Village  Briefing Yonghe Village lies in the east of Shimian Town, covering 76 km2, with local government in Yulong Village, 7 km from Town. There are 5 administrative villages, 26 villager groups in various nationalities. There are 1765 farmer families with a total population of 6273. There are 4608 mu of plow land in total—0.76 mu per person.  Requisition and Demolishment There are 34 farmer families involved, among which 1 family has moved and 33 still remained. Compensation fee standards will accord to the town level, which farmers haven’t received yet. There are over 300 families involved in requisition which includes mainly paddy fields (about 200-300 mu), gardens (100 mu) and forests (20-30 mu). Requisition in Yulong Village accounts for majority of the process. Requisition compensation standards are 40000 yuan/mu for plow land and 34000 yuan/mu for dry land. Farmers get 22000 yuan/mu for paddy field and 17000 yuan/mu for dry land. Now, requisition is still at public notice, while farmers still haven’t received compensation fees. Compensation fee for young crops are 800 yuan/mu for paddy fields and 600 yuan/mu for dry land. As for temporary requisition, there are 30-40 mu. There is difference in the requisition compensation standards in three towns while the compensation for attachment and house demolishment is the same. Fourthly, owners should allocate compensation to Requisition Office, through which the compensation fees are delivered to villages and farmers. Xu Guangyi—Duiyan Town People’s Congress Council Chairman(13908169640)  Briefing The village covers 45 km2, including 11 villages among which 6 are mountainous, where reforestation can receive compensation of 230 yuan/mu. There are 4412 families with a total population of 14000. Plow land covers 10880 mu. Annual net income per person in 2007 is 4219 yuan per person.  Requisition In August 2006, the measurement of requisition started, including land, attachement and house, after which measurement was made known to public. After hearings of involved residents, the procedure repeated. There are altogether 182 mu requisitioned, with 316 families involved. According to compensation standards (plow land: 29604 yuan/mu, non-plow land: 14402 yuan/mu). Requisition has now completed and compensation fees have been distributed with no reserved fund for village groups. The fund was distributed in the following flow: Yaxi Company Account—State Land Resource Bureau Account—Collective Account of Urban Credit Bank—Personal Accounts of Involved Farmers.  Demolishment Demolishment has not started yet. There will be 18 families that need to move, mainly in Kanpo and Hulu Villages. Mr. Huang Xuegui 13795855528 Secretary of Kanpo Village Requisition: There are 10.08 mu land that are permanently requisitioned, including 9 mu of plow land, with 11 families (40 residents) involved. Compensation standards are 29604 yuan/mu and compensation for young crops is 800 yuan/mu. In June 2007, 0.26 million yuan was transferred to village, which was furthered transferred to local residents. Demolishment: There are 10 families that are involved, which have not moved. The involved residents have difficulties in finding a new place to build their houses while the compensation is insufficient as the price construction materials goes up. The involved residents used compensation fees to repair houses and pay for education and medical bills. One family purchased a car; one family opened a car wash store and one family opened a restaurant with the compensation fee received.

RIFCIU- SWJTU 34 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project There is only one family that has found a new place to build house. There are 2 residents that worked 20 days in construction site. There are no new stores and restaurants because of construction unit and no rent demands. State Land Station Chief, Guanhua Township, Guanhua Town The section of Ya-Lu Expressway within Guanhua Township is 7.8km. There are 4 villages and 12 groups involved—No.1, 2 Groups of Zhousha Village, No. 1, 2, 3, 4 and 5 Groups of Shangheng Village, No. 1, 2 and 5 Groups of Guanhua Village and No. 2 and 3 Groups of Yuanjia Village.  Requisition There are 429.5 mu land that are permanently requisitioned, including 314.02 mu of plow land and 125.48 mu of non plow land. There are altogether 270 families involved with a total population of 1080. Temporary requisition covers 203 mu. Construction unit signs agreements with State Land Bureau, Town and Village respectively. Then villager groups and construction unit sign agreements with involved residents. At last, construction units pay compensation to farmers according to standards. Compensation standards: permanent—25050 yuan/mu; temporary—1516 yuan/mu. Progress: Now, permanent requisition in Guanhua Village is finished. There might be a small amount of requisition due to change of plan. Demolishment There are altogether 829.42m2 of demolishment, with 10 families involved. 148 graves are supposed to be moved. Villagers select their own places to build houses. Now 7 families have moved and received compensation fee as 25050 yuan/mu. 4 families haven’t moved and village groups are helping them to find a place to build their houses.  Compensation Fund Distribution Procedure: Construction unit and village will confirm the requisition area, report to state land management bureau and submit to Yaxi Company. Yaxi Company will pay compensation to state land bureau, which will transfer the fund to collective account of rural credit band. Then the compensation fee will be distributed to involved farmers in the form of deposit book. Payment: The majority of compensation has been distributed. Still inner disputes made compensation unable to be distributed in No. 5 Village Group of Guanhua Village. There are 38.58 mu land requisitioned, 27 families involved and a total compensation of 0.4 million yuan.  Resettlement Compensation will be directly paid to village residents and village groups will no more adjust plow land. Shangheng Village, Guanhua Mr. Gao Jun, Director(13408351972)

RIFCIU- SWJTU 35 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project There are about 50 mu land requisitioned, including plow land and waste mountain, with 5 groups (20 families) involved. Compensation standard is 245000 yuan/mu (including 800 yuan/mu young crop compensation). Reforestation compensation will deduct young crop compensation while compensation for waste mountain is just half of reforestation. June 20th, 2007, resettlement agency published requisition and in July compensation has all been distributed, through discussion in village groups. The compensation was distributed directly and fully to residents with no reserved funds in village groups. The involved residents are quite satisfied with the distribution methods. Yingjing Town Requisition Principal—Director Lan; Yingjing Town, Demolishment Principal—Director Zhu  Demolishment 203 families in Yingjing Town should move and another 9 families should move after change of path. Due to one-year delay in construction, the solution combines demolishment and construction at the same time. Except for Qinglong Village, residents in other villages are scattered. Compensation will be distributed to residents. In June 2007, all applicant residents were checked. Due to the price rise, Yingjing Government reported the difficulties in building houses to Municipal Government. Through adjustment, the new plan has been finalized and published. The new compensation standard raised 100 yuan/m2 for brick-concrete house, 80 yuan/m2 for brick-wood house and 60 yuan/m2 for mud-wood house. There are 7 families and 16 stores demolished. In resettlement area, there will be compensation for residents—850 yuan/m2. 42 farmer families outside the red line apply for moving.  Resettlement There are three resettlements in Qinglong Village: 1 is cattle farm that resettles 34 families. 65 families in Group No.1 and 2 in Boxiang Village should move and 34 will be collectively resettled. The land has been leveled off while the location is still to be decided by farmers. The second resettlement is Hongyan Group of Wannian Village, with 7 families that need to move. The third resettlement is No. 4 Group of Boxiang Village, with 32 families that need to move. 16 will be collectively resettled, while the plan is still in negotiation. 212 families will move, among which 191 have been demolished. The fund will be transferred to farmers’ accounts through check. Scattered farmers can find new places to build house, but farmers are faced up with the price difference. Now, 61 farmer families have built new houses and 56 families are still building. The rest families are supposed to be collectively resettled. 7 families still have problems in house base in Hongyan Group, Wannian Village, among which 6 families have signed agreements with

RIFCIU- SWJTU 36 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project government and expected to build new houses in material farm. Fund appropriation procedures Measurement—checking—fund appropriation—peasants’ accounts The removal of all the relocated households, from the land requisition at the initial stage to the new-house-building at the final stage, is supervised and managed by the house-removing agency of the county. The land requisition and house-removing work of Xingjing County went on with great difficulties at the initial stage. It was after the 5.12 earthquake that the work went into a new stage, for many peasants feared that their old, brick-wood structure houses would collapse in the aftershocks and they would get even less in this case. The removed substances go to the households, and a fee of 3000 yuan/person (to fund the three accesses and site leveling) is paid to people who choose scattered resettlement. Those who choose centralized resettlement would not get this fee, since their three accesses and site leveling is funded by the Owner (in accordance to the new countryside standards) Typical case: A household enjoying the five guarantees in Bo Xiang is a mental patient and disabled person. And his new house is built with the help of government. Now it has been finished. The affected enterprise: Dairy farm of Qinglong Village is a private enterprise, whose factory buildings cover an area of 2 mu and whose grass occupies an area of 6 mu. Houses and cows have now been removed, but the rebuilding and production restoring meet with great difficulties. Resolutions are currently under discussion. Preferential policies: People with certification of disability can obtain a subsidy of 2000 yuan/ person. This policy only aims at the disabled persons and this fund comes also from the compensation fund; the elders over 80 years old can receive a subsidy of 3000 yuan /person. Permanent land requisition: The total area of the permanent land requisition of Xingjing County is 2972.506 mu, including 1303.011 mu of farmland, 1524.205 mu of woodland, 99.778 mu of orchard, 4.69 mu of other types of field land. At present the supplemented land has not been included in this sum total, and the related department is adjusting the number of land requisition and the adjustment plan has not been out. Procedures of land requisition: Substance investigation—public notification—application for recheck in written form within 10 days—land transfer—notice of land transfer—bank accounts— household list—recheck. Each production team has a detailed list, and the household must confirm their information and sign their names on the beadroll when they receive money. At present,12 households ask for land recheck.

RIFCIU- SWJTU 37 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project Typical case: Liu Xingchang, a rural household in Yangwan village of Long CanggouTownship, was not at home at the first time of investigating, and the team leader acted as his proxy and signed his name. He had once submitted the application, but the county government didn’t receive it. Now he submits the application again, and the result of the first measurement is 0.22 mu, that of the second measurement is 0.249 (regretful after signing), and that of the third is 0.198 mu. He is still complaining, but the result of the third measurement will be taken as the standard since this measurement is done by an accurate measuring instrument. The problem of forest land converted from farmland: The forest land converted from farmland is counted as forest land in the process of substance investigation, but as farmland in other processes. There is a big gap between the compensation standard of forest land and that of farmland, which has evoked strong objection. After a discussion between the Yaxi Company and the city land bureau, a reinvestigation was carried out in the first half of the year 2008, and the forest land converted from farmlandland would be counted as farmland at the confirmation of the team leader and rural households. This work has been completed in the Qinglong Township, Yanzhu township and Fucheng township, and that of the longcanggou township is still under way. The owners of tea gardens of Hongyan Team and Qiaoliang Team in Wannian village of Longgou township request that their tea gardens be compensated according to garden land standard instead of woodland standard. However, the tea trees are few and scattered, so the compensation will be calculated according to the number of the trees. Typical case: Lianhua Village of Yanzhu Township asks for no compensation for their batardeaus, ditches and roads, but requests that the constructing team do careful measurement, draw a chart for use in future restoration, restore them if possible and compensate for those that cannot be restored. Temporary land requisition: The total area of temporary land requisition is 1086.57 mu, most of which is forest land. The C4 bid section, with a requisitioned land of 210 mu, and the C2 bid section, with a requisitioned land of 226 mu, have completed most of their land requisition. The requisitioned land in the C5 bid section is 36 mu and that of the C6 is 76 mu. The land requisition in C3 bid section, which covers 12.6 kilometers in all, is very complex. Four construction teams are working in this section and the total investment amounts to 830 million. Most of the households are unsatisfied with the compensation standard of temporary land requisition. A household of Qinglong village, for example, has been refusing the temporary land requisition, and it remains unsettled now. A village head of Longcong, hoping to undertake the expressway project, threatens to refuse the temporary land requisition after his attempt is rejected. The lack of legal regulation in the field of temporary land requisition results in great difficulties on the part of the construction teams.

RIFCIU- SWJTU 38 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project Fund appropriation of temporary land requisition The fund is allocated directly to the group, instead of via the county and village, and the substance investigation is done in individual households by staff sent directly from the county. Qinglong Township has distributed the fund to individual households. The other three townships have distributed the young-crop compensation to the groups from the township, and then to individual households. Land compensation of these three townships comes first to the county, and is then distributed to individual households. Typical case: Wang Xu and Li Junfeng, villagers in Guihua group of Qinglong Township, own a stattered orange land of 1.08 mu and 1.22 mu respectively. The compensation standard of these orange lands was 4480yuan/mu according to orange fixture standard when the land was first taken into the requisition. Wang Xu and Li Junfeng, however, didn’t accept this standard and asked for a standard of 8000yuan/mu. Then the city department invited a qualified organization to assess the land, and the result is 7600yuan/mu. Wang Xu and Li Junfeng accept the price but think that this is the annual output value of their orange land and the total compensation should be 27-30 times of this value. The related county departments have negotiated with them for about 30 times, yet the problem remains unsettled. The source and usage of fund of the resettlement agency Three percent of the land requisition and resettlement fund goes to the resettlement agency, one percent of which can be used by the house-removing agency. The county would establish achievement checking system for townships, villages and groups, and the fund would be allocated according to the achievements. The establishment of centralized-resettlement house site: In centralized-resettlement spot, each household is allowed 50 square meters per person for residence, 30 square meters of which for housing, 20 square meters of which for public area. The rural households pay the resident land fee according to the original house compensation standard, and the ground leveling fee is checked by the resettlement agency and paid by the Owner. Longcanggou village; shichun (Tel: 13608263368), vice secretary of the village government Sunjiujian the leader of military office of Longcanggou Village Secretary Shi says, this village covers 4 bid section, C3, C4, C5, C6, and most of households have been removed. Now the rural households can not find resident land for their building of new houses, then problems emerge. The affected households in the township amount to 31, 3 of which remain unremoved. Those who have finished their removal all choose scattered resettlement, and people have to find resident land by themselves. The land requisition is 1315 mu, and temporary land requisition, two times of permanent land requisition, is about 2600 mu. The temporary land rent is 1581yuan/year, woodland is 3000yuan/2years, and the price of non-cultivated-land is half that of the cultivated land. The guarantee fee of recultivation for cultivated land, is 10000yuan and for non-cultivated-land is 5000yuan. Yangwan village and

RIFCIU- SWJTU 39 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project Wanlian village have a dispute over the junction of the two villages. The area involves is 25 mu and the fund amounts to over 400,000 yuan. Now the township has opened a special account to keep this fund and plans to allocate it to these two villages when this dispute is solved. All the demolished households are required to buy social insurance, but only few households do it. Governments of many townships choose to draw part of the public accumulation funds from the compensation to buy social insurance for them. Liu xingqun (Tel: 15983528309), Head of the Happy Village, Longconggou Township Survey: the income sources of this village are as follows: picking up bamboo shoots on the mountains and selling them at the markets; working at coal factories; planting bamboos and trees and going out for business (now five households engaging in trade and three households selling stone material). The average annual net income is 2000yuan /person. Most of the women in the village stay at home, collecting bamboo shoots; about 60 women have gone out for work. The permanent land requisition of Ya-Lu Expressway affects two village groups in this village: 41 households in Lianhe Group and 15 households in the 28th Group. No demolishment occurs in the village. C3 bid section project temporarily occupies the land of the 29th village group in the process of construction, but the exact area is unknown; and the related compensation is paid directly to households by the project contractor. Compensation standard Compensation of land requisition:22100 yuan /mu; Compensation of the young crops: 800 yuan/mu. Compensation distribution In November 2007, about 700,000 yuan of the land requisition compensation was allocated at a time. A meeting was then held among the villagers to discuss the plan of compensation distribution; all agreed to allocate all the funds to the affected households according to compensation standards. In January 2008, Lianhe group has finished allocating the funds (through remitting money to the accounts of households), But the 28th group has not distributed the funds, due to the fact that some households, not at home when measuring the land, had asked other people to act as their proxy in land measurement, but now cast doubts on the area of the land when land compensation is to be distributed. Among those who work near the village, there are about 300 labors who are mainly engaging in transportation of sand and stone and construction of earth-retaining wall for Ya-Lu Expressway, with a daily wage of 50yuan);. 2. Livestock breeding (this village is mainly engaged in longhaired hare breeding and there are 5000 hares in all. Besides, each household breeds 1-2 pigs); 3. Production and processing of bamboo and wood; 4. Traditional planting. The survey of land requisition and demolishment: The compensation standard of land requisition is 22136yuan/mu and young crops is 800yuan/mu. The related policies are notified through wall notices by the County Land Bureau. The related compensation has been allocated from county to village and then to households. The village no longer keeps the compensation of land requisition, but the compensation of public land of 0.4 mu (6000 yuan/mu), including collective ditch and road etc, is kept in the village for public welfare undertaking, and the expense procedures of which must be discussed by village representatives and submitted to the township head for approving. Tianba Villager group: four mus of land in this group have been requisitioned by the Ya-Lu Expressway (The requisition has been completed and the compensation allocated in place), and three households have not been demolished. The land will not be adjusted after requisition, and the compensation will be allocated directly to the affected households. Fucheng township Nie Daquan, head of the township(tel:13981625030) Huang Qin, deputy secretary of the Party committee of the township (tel:13056593210) General stiuation of the Fucheng country: The Fucheng Township, with 3 villages and 27 villager groups, covers an area of 15 square kilmmeters. It has 3,200 mu of cultivated land and a population of 5,300. The per capita income last year was more than 3,900 yuan, a 522-yuan increase compared with the year before. The Fucheng Township is mainly agricultural and the farmers’ income comes from three main sources. The first is agriculture,which takes about 30%of the total income. The second is labour export,which includes transportation and temporary jobs outside. There are seventy to eighty buses and trucks engaging in the transportation of passengers,vegetables, bamboos and woods and more than 1,100 people work outside, half of whom work near the county town and the other half work in the regions of Jiangsu, Zhejiang and Guangdong. The third is breeding and planting industry, which includes the breeding of rabbit, pig, chicken, sheep and cattle, especially the breeding of long-wooled rabbit which is sold far to the regions of Jiangsu and Zhejiang provinces.Meanwhile, more than 2,000mu of bamboos are planted. Qinglong Township Mr. You, head of the township Mr. Liu, deputy head of the township General stiuation of the Qinglong Township: Situated in the southeast of the country town, the Qinglong Township has 4 administrative villages and 38 villeger groups. It covers an area of 51.2 square

It has a population of 6,390, among whom the agricultural population is 6,008 and the number of labour force is 3,882. The per capita income last year was 3,750yuan. Basalt, limestone, copper mine, forest and fruit trees(78,000 mu in total) are the main natural resources.The farmers’ income comes from three main sources: agriculture(which takes up 5%--10% of the total income), temporary jobs outside and doing business(relying mainly on the national artery 108 to do the service industry such as operating shops and auto repair garages). Land requisition and demolishment 1) Requisition: Procedures: In March, 2006, the public notice of construction was promulgated in; In July, 2006, the first round of social inquiry was carried out (with a social inquiry group organized by the county and formed by representatives from every village group); In 2007, material check and the requisition of area about the auxiliaries on ground were notified (by means of posting public wall notices and holding meetings in villager groups). Rechecks were carried out under the request of villagers with objection. In August,2007,the investigation and check about the land and material were carried out again in order to get agreement with the people. Funds were then allocated and land handed over. Fund appropriation procedure: Expressway Company—Yingjing Bureau of Finance—City Economy and Trade Credit Cooperation—individuals Compensation standard: Cultivated land: 25,296yuan per mu; uncultivated land: 12,134yuan per mu; yong crops: 800yuan per mu;forest: 3,000yuan per mu(If the forest is smaller than 0.2 mu, the compesation is given according to the accurate number.) 2) Demolishment The number of households involved in the demolishment is 151, among whom 53 households have been demolished. Five households have set up new houses and more than ten households are building houses.A questionnaire has been sent to each of the rest ninty-eight households, with the aim of investiging their choice about resettlement(whether they would like to be resettled together or separetely). Demolishment Procedure: the social investigation began in the year 2006; the House Demolishment Coordination Group went to the township to recheck the investigation group in May, 2007; Agreements were signed with with rural households in September, 2007. Resettlement funds were paid to each household and the resettlement was carried out earlier than the date scheduled. There is barely any natural resourse in the village and the forest is not yet fully grown up.The per capital income last year was 3,100yuan.The farmers’ income comes mainlu from 2 sources: temporary jobs outside and planting and breeding industry such as the breeding of rabbits and pigs. Land requisition Ten villager groups are involved. The compensation standard of the land area was notified in May, 2007. Demolishment Among the 19 households involved, 15 have been demolished, and still 4 remain undemolished. Among the 15 households who have been demolished, 3 have bought other farmers’ old houses and 8 are living temporarily with their relatives or friends. Eight households have built their own houses (five of whom built houses on their own land and 3 bought land from other people). The rest four households remain undemolished because of the road inconvenience and the lack of agreement among their family members. 4.1.3 Sample survey of affected households The Monitoring Group has done sample surveys on about 425 affacted households.Attachment 2 shows their detailed information. Picture 2: Monitoring Group are talking with affected households 4.2 Monitoring of Infrastructure Restoration The infrastructure affected by this project includes: changing the route of road; changing the course of water conservancy; changing the route of lines; changing the course of communication cable and transmission lines, etc. According to the agreement reached by the Yaxi Company and the local government, the rebuilding of the affected infrastructure must follow the two principles as follow: first, the principle that rebuilding should go before demolishment in order not to disturb production and people’s daily life; second, the principle that the rebuilding should be of the original rank and quality in order not to lower the infrastructure standard of the affected area. The investigation of the Monitoring Group shows that the two principles have been fully carried out and the local government is satisfied with the rebuilding of the infrastructure. 4.3 Monitoring of the Restoration of Temporary Land Requisition Compensation for temporary land requisition used in the process of construction is paid according to the actual number used in the construction process, and the compensation fee is usually paid according to a season’s loss. Special cases allow special policy. Temporary land use in the process of construction. The construction company first decides the exact area of land to be used, then applies for permission directly from the land management department at the county (city) or district level. The land management department at the county (city) or district level and the construction company together choose the land, decide the land type, and check the auxiliaries on ground. After the signing of temporary land use agreement and land recultivation agreement, the land management department at the county city) or district level will then appropriate the land to the construction company. Land should be returned to the village and be recultivated at the expiration of the agreement. Compensation for temporary land use is paid according to the annual yield of the same kind of land. If annual yield cannot be counted, agreement could be reached after proper negotiation. The Monitoring Group has learned that temporary land use is very frequent in the process of project construction, and all such uses are compensated according to relevant standard. No objections are found on the part of the affected villages or

Monitoring of Resettlement Agency 5.1 General monitoring of the resettlement agency The successful resettlement work of the Yaxi Expressway Project depends on a powerful resettlement agency. The site information of the Monitoring Group shows that both the road construction department and local government enforcement department have set up a complete top-down resettlement management system with experienced cadre equipings and effective rules and regulations. Yaxi Company has special liaison people to deal with the requisition and demolishment affairs. They are responsible for checking the resettlement work done by relevant departments, coordinating with the local government, receiving the resettlement officers from Asian Development Bank, contacting with the independent external monitoring organization and checking resettlement report. Coordination and communication is vital to the resettlement agency of the Yaxi Expressway Project, a complex system involving the participation of various departments at various levels. Great attention is paid to the coordinating work by the Yaxi Company, Ya’an City and Liangshan State, who hold meetings frequently and exchange information with each other timely. Once a problem occurs, they would soon find resolution and solve the problem. They would print their jointly-made decisions in the form of conference records and have them distributed to resettlement departments at different levels, which has helped prompt the progress of the resettlement work. 5.2 Monitoring of the Owner’s resettlement agency Yaxi Company has set up a comprehensive department (the resettlement office), which is responsible for the overall management of resettlement. Every county or district’s management department has two or three people who come from the comprehensive department to deal with the management of resettlement. Their major task is to help and urge the county (district) to do the initial investigation on requisition and demolishment, to design and enforce the plan of resettlement and compensation, and to help in the coordination work in the process of requisition and demolishment. Government of every county and district has set up relavent leader groups and offices to deal with it. Here are two samples: A) Yingjing County has set up a coordinating commander department, with the county governor Qiu Deyong as the leader, three vice county governors as vice leaders, and leaders of all bureaus and townships involved as members. Meanwhile, a sub-office is set up in the office of the county government, and Yang Zeke, the director of the county government’s office, acts as the director of the sub-office and handles the daily affairs. B) Mianning County has set up a coordinating commander department, with the secretary of Mianning County Zhou Bin and the county governor Zhao Yong as leaders, two vice county governors as vice leaders, and leaders of all bureaus and townships involved as members. Meanwhile, a sub-office is set up in the office of the county government, and Chen Zhi, the director of the county government’s office, acts as the director of the sub-office and handles the daily affairs. 5.4 Measures to strengthen the capacity of the department A. Departments and organizations at all levels are made up of two parts: specialized technical personnel and administrative officials, all of whom possess certain specialization and administration quality; B. Chief Staff from departments and organizations at all levels are organized to join in professional training, in order to get a better understanding of the national resettlement policy and the related requirements of Asian Developing Bank and improve professional quality and policy management ability; C. Full guarantee in terms of finance and facility; D. A data base is established to strengthen information feedback and keep the

An external monitoring mechanism is established and an early-warning system is set up. 6. Monitoring of the Implementation of the Resettlement Plan 6.1 Monitoring of implementation procedure A. Monitoring of land requisition and compensation Land requisition and compensation is carried out with the coordination of various organizations. The procedure runs as follows; A. The project designer provides a planning map of land use and decides the exact scope and quantity of land use. B. Yaxi Company entrusts Ya’an city and Liangshan autonomous government to handle materials about land requisition and finish the task of land requisition C. The application of land use gets approval. D. The project designer lays line on spot according to the planning map of land use. E. The Yaxi Company assists the related coordinating and leading group offices(headquarters), the resettlement departments of the related counties(municipalities, districts), and the related villages(residential committees) to ascertain the area and quantity of land requisition of every household. F. The coordinating and leading group offices (headquarters) at the county (city, district) level sign land requisition contract with related county (town, sub-district) resettlement working groups and villages (residential committees) G. A step-by-step legal procedure goes on. H. Compensation fund is paid and land transferred. I. Land is used in the construction. B. Monitoring of production, resettlement and restoration After resettlement compensation fund is allocated as planned, the production, resettlement and restoration work is then carried out by the village committee. Backout old fercilites 6.2 Monitoring of processing planning The processing of this project of demolishment and resettlement is carried out according to the construction planning progress. The concrete construction progress abides by regulations as follows: A. Houses should be demolished in stages and finished before the accomplishment of local project; B. Being available on 3 months’ notice for demolishment ,after the notice no less than 3 months should be given to the resettled people by the terminate of demolishment .the affected people may stay at their formal houses before the complement or rebuilding; C. The duration of rebuilding could be prolonged under the consultation of; D. Land requisition should be finished before the operation t\each section of project; E. Land adjustment and distribution should be finished during the season change of crops; F. The recovery of rebuilding of specific facilities should be finished before the operation of various projects and resettlement; G.. Remove the unused facilities. 6.3 Monitoring of fund appropriation 6.3.1 Monitoring of allocation rules A. All the expenses with respect to requisition and demolishment are included in the overall calculation of project .The compensation fund and other fees are paid to related organizations and people through county (district) construction cooperating and leading group office(headquarter) of the Project or bank payment under Yaxi Company; B. Houses compensation fund will be paid by installment before resettled people begin to build new houses; C. Land and other facilities compensation fund will be paid 3months before the requisition; D. Yaxi Company will set up financial and supervisal organizations at various levels to ensure that demolishment and resettlement can be implemented smoothly, so that all funds are paid on time.

The investment will be paid directly to various specific project authorities by Yaxi Company, through bank 7. Public Participation and Channel to Complain 7.1 Public participation The public participation of the project is reflected in two aspects: 1. Participation during the preparation of project; 2. Participation during the construction of project. The standards of test of the public participation are: 1. degree of comprehension of the public about the policy of demolishment and resettlement. The sooner and exacter comprehension prove the higher degree of participation; 2. public have a say about each policy of demolishment and resettlement. The more power they own to criticize and suggest about all kinds of policies, the higher the degree of participation is. The contents and ways of public participation embody following points: 1. negotiation; 2.issuing notice (making policies known to public through media, notice and alike; 3.participation in the survey of the substance loss and social

The affected counties of the project are all counties passed through by No. 108 national highway. People are independent and individual, and they have the courage and gift to protect their own interests .All these make degree of participation high. The monitoring group has understood during the observation that the value and effect of project, the quantity and time of demolishment as well as requisition, the compensation standard which are the most concerned content of the resettled people are widely propagated. By notice which is no less than twice put on the center of the village all affected villages are informed of every compensation standard and fund appropriation Three problems receive most concerns: firstly, the plan and expenses of land compensation fund, secondly, the plan of resettlement of man power, thirdly, parterre. Expenses of fund which give the most concerns are different in each county. In Mianning County, all the compensation fund is paid to affected households, and land is not adjusted .In other counties, village conference will be held to decide how to distribute and use the requisitional fund after the arrival of it .In the process of use of fund, the village committee is under the supervision of villager Monitoring Group which is elected by the villagers .Each expense of fund should be posted publicly to be examined by the villagers. These methods are taken to guarantee that the distribution and expense express the will of the majority of the villagers. Monitoring Group has not found the misuse of resettlement fund or any complain about it Emphasis is also on the plan of manpower resettlement like job-hunting or internal transfer, which is inseparable interest of the affected. Monitoring Group has understood in many districts that the resettled people along the line still pay much emphasis on internal transfer which reflects the mode of living that they live on earth at present .In general, in the process of resettlement of overpopulation, voluntary method is accepted. The party concerned can choose the most suitable plan among the several choices. On contrary, some counties do not adjust land should pay much attention to the resettlement of people who lost their lands The choice of parterre is very important to peasants especially people along line .On the one hand, it connects with their living habits. For example, they are willing to live with their partriarchal members of the same family name, or they may prefer to live in the area close to their contracted land. On the other hand, it has some relations with living environment and quality. For example, basic facilities such as water, electricity and road are necessary and also the new parterre need be close to road. In addition to their emphasis on parterre and the limited choice of parterre, all these factors including peasants’ unrealistic comparison cause contradiction and conflicts of the arrangement of parterre among the affected. There are still some successful cases in some counties. Combining the characteristics of the small number of left land, the government seeks for other better parterres, plan uniformly, let people build new houses by themselves, and provide peasants with basic facilities. These practices fully satisfy resettled people’s demands. It not only avoids causing necessary conflicts but also fit the demand of establishing new socialist countryside. Yet the demands of the affected are out of the consideration in some districts, resettlement method is too easy and finding of parterre is all by themselves

Monitoring Group think the key focus of the resettlement is parterre problem, and they hope related agency take positive action to resolve the paeterre problem of the affected 7.2 Channel to complain In the process of land requisition and personnel resettlement, if they meet any difficulty in production and life or doubt and dissatisfy the compensation and resettlement, the affected people can report and appeal them by means of following 5 channels: 1. the Owner; 2. independent external monitoring agency; 3.headquarter or coordinating group at all levels; 4. complain letter and request handling office of local government; 5.lawsuit. (1). The Owner The Owner is the debtor and user of land, so they are on duty to solve all kinds of problems referring to demolishment .requisition and resettlement. The Monitoring Group has known on the spot that administrations are established by the Owner, Yaxi Company in each county. More than 3 full-time comprehensive coordinating officials whose name and phone number are given to all the affected villagers are employed in every administration .The Owner gives the information to the Monitoring Group that they have accept a great deal of visits and complains directly and has solved many demands of the people during more than one year. Some cadres of the towns tell us that they are used to seek help from expressway authority instead of local government, because it is much better and more direct to confer to the terminal authority who is responsible for it. (2). Independent external monitoring agency During the implementation of project, this agency should go to the spot to observe constantly and in details of the affected villages and singles. Many leaders of grass-root government and resettled people prefer to believe in and ask for help from independent external monitoring agency because of their special identity. These situations often occur when the Monitoring Group takes field observation. All the time they collect these received dissatisfaction and complains which will become the key point of the next-time observation, then feed them back to Yaxi Company and local government. (3). Headquarter or coordinating group at all levels Headquarter or coordinating group at all levels are the contractors of the project requisition and resettlement as the delegate of local government. They are responsible for all the questions occurred during the requisition and resettlement. The Monitoring Group understands on the site observation that specialized working group who is responsible for the project are organized under headquarter and coordinating group at all levels. The phone number of the working group is disclosed to the public. The resettled people look the working group as their own officials and spokesman of their interests, so they can get the most help from headquarter or coordinating group when difficulties come. According to the reflection of the officials of expressway authority, when meeting attended by expressway authority and local authority is held, they could feed suggestions collected back to expressway authority and urge them to resolve the problems as soon as possible .If problems belong to the power of headquarter and coordinating group, the officials will accept complains directly and give resettled people a quick and perfect answer .If grass-root authority’s jobs are reflected as problems, they will send specialized officials to go to the grass root to observe,

Complain letter and request handling office and lawsuit are valid channels to complain, but by now there has no such a case need to be solved through lawsuit during the process of project 8. Conclusion, Problems and Proposal 8.1 Conclusion of the monitoring and evaluation The work of demolishment and resettlement of the Yaxi Expressway Project is carried out smoothly in accordance with the fixed time and procedures. Up to the accomplishment of the field investigation carried out by the Monitoring Group in August 2008, 97% of the demolishment and resettlement plan has already been finished. No serious problems occur in the process of demolishment and resettlement, thanks to the meticulous preparation work, the operative plan-making, the extensive participation of the public and the active work of the resettlement agency. All measures for resettlement are well carried out and every step of the resettlement is carried out strictly according to the plan. The existing problems discovered in the first phase of the monitoring are paid great attention to by the Owner and the local government, and the following measures are taken, which would be effective in improving the living condition of the affected people and accelerating the progress of resettlement. Adjustment of the Compensation Standard: On August, 13th, the Ya’an municipal government has given permission to Yucheng district, Xingjing county, Shimian County to adjust the compensation standard on part of the auxiliaries on ground such as the movement of houses and tombs according to the specific situation. The adjusted compensation standard is now in force. The standard adjustment of the Mianning County is now under way and will come out soon. The Hanyuan Countyy, because of its particular situation, is still in its initial stage of deciding the concrete compensation measures. After the adjustment of compensation standard, all the houses demolished prior to it will be repaid according to the new standard. The Demolishment of Schools: It involves the resettlement of three primary schools and two middle schools. Among them, there is one ethnic middle school, one primary school in the Shimian County; one ethnic primary school in Mianning County; one primary and one middle school in Hanyuan Countyy. The Yaxi Company, after proper negotiation with the local government, has agreed to compensate a mount of money that would suffice the building of a new school that can satisfy the present teaching needs. In this way, these five schools are now engaged in the construction of their new schools. In order to supply the construction site for the building of the expressway, some schools have already adopted the method of renting classrooms with Yaxi Company supporting the money. The poor, old Xichong ethnic primary school becomes a dangerous building after the Wenchuan earthquake and the Yaxi Company provides money and enables the school to move into the mobile houses so that the students can continue their study. Compensation for the Demolishment of Urban Planning District: With the coordination of the Yaxi Company, Shimian County government has worked out a set of workable policies and methods: Temporary Methods on the Resettlement of Urban Residents in Ya-Lu Expressway Shimian County

RIFCIU- SWJTU 53 ABD Loan Project (2181-PRC) Evaluation Report on External Monitoring of Resettlement for Central Sichuan Roads Development Project Planning Area; Proposal on the Demolishment and Resettlement compensation of the Ya-Lu Expressway Shimian County Planning Area; Plan on the Demolishment and Resettlement of the Ya-Lu Expressway Shimian County Planning Area.The Yaxi Company, after comparison and selection, has hired an experienced intermediary company which has the capability to assess the value of the house asset and land to cooperate with the Shimian County government. Under the unified planning of the county government and with the financial support from the Yaxi Company, centralized relocation and settlement is carried out, with river embankment built, public facilities designed and built. The new houses are environment friendly and energy saving, providing the resettlers a living condition better than they used to have. The relocation this time will greatly improve the living quality of the poor. Actively Engaged in the Demolished Household’s House Sites: To scattered resettlers, the local government will try their best to help to solve the problem of house site. Apart from the compensation standard prescribed by the provincial government, there will be some additional infrastructure construction fee paid per person or per household as a kind of compensation fee. For some farmers whose construction of house sites is of great difficulties, the unit in charge of the construction will organize or send people to help in leveling the ground. For those who can’t find the house sites, the local government will give them centralized relocation according to their willing. The local government attaches great importance to the safety and environment protection of the centralized relocation sites. Qualified companies are invited to the relocation sites to do planning and designing, geological disaster assessing, and building structure design. Biddings and supervisions are done in due process of house building, ensure that the relocation sites are environment friendly, energy saving, greenery up to standard and have access to road, water supply, electricity, telephone, television lines. Facilities are built to satisfy the production and life needs of the farmers. The new environment and living conditions will be superior to before. The land requisition, demolishment, connection of power, water, phone line, TV signals transmission line, sewage drainage system of the common part are funded by Yaxi Company with no occupation of the farmers’ resettlement compensation fee. The Monitoring Group comes to the following conclusions: ① All the information collected so far leads to a clear conclusion: both the land-requisition-affected people and the demolishment-affected people have been properly resettled. Up to now, no household is found to have been poorer or put into a worse living condition because of this project. This conforms to the general resettlement policy objectives of the Asian Development Bank and the Chinese government. ② No compensation standard of the resettlement and demolishment is lower than the standard prescribed in the Resettlement Plan. Meanwhile, various measures have been taken by the Owner and the local government to cope with the rising commodity prices and keep the living standard of the affected households. This project also gives special care to the vulnerable population, which is well received by the resettlers. ③ The housing condition of the resettlers is improved. The road construction project has provided those resettlers who used to live in very simple houses a

The compensation given by the road party, together with the resettlers’ own savings, enables them to build houses which are much wider and comfortable than before, hence a satisfactory result. ④ Compensation is paid on time by the expressway party. No reduction or appropriation of the resettlement fund is found on the part of the local government. The timely and full arrival of the fund ensures the smooth-going of the resettlement. ⑤ Resettlement agencies at various levels, especially that of the local governments, have done a lot of meticulous and careful work for the resettlers. 8.2 Problems and proposal While confirming the good points of the resettlement project, we should also point out that there are some unsatisfactory aspects in this process. The following are the main problems found by the Monitoring Group and suggestions to these problems. 1. In some individual counties, land-lost Peasants appear in great numbers after the land requisition. It is very hard for the peasants, especially the old-and-middle-aged, in those remote mountainous areas, to be self-employed or start their own business. After some years, mere survival would pose problems to these people. Thus the Monitoring Group suggests that the local resettlement agency and the Owner hold a discussion and supply these people with rural-to-urban resettlement and endowment insurance or in other appropriate resettlement manner to ensure their living standard in future would not degrade. . 2. In some individual counties, only pay part of the compensation is paid to those who are affected, and the rest of the money is kept in the villager group to be used jointly. Keeping a large sum of money in the villeger group is risky, and the Monitoring Group hopes that the resettlement agency will give careful supervision on this amount of money, making sure that it is used in public welfare production development. 3. In some individual counties, great conflict between different compensation policies causes the hidden danger of social instability. In order to maintain social stability, the local government has promised that the unpaid amount will be paid in full at a proper time in the future. And the unpaid compensation for the land requisition and auxiliaries on ground are now deposited in the exclusive finance account of the county government, and will be paid fully after the complementation of the relative policies. 8.3 Arrangement for the next phase The Monitoring Group will focus on the following issues in the report of the next phase: Focus on the total sum of the temporary land, forest and compensation amount; Focus on the implementation of the demolishment compensation standard; Focus on the new-house-building of the centralized-resettlement households and the implementation of the house sites of the scattered-resettlement resettlers; Focus on the implementation of the resettlement policy on those land-lost
