Water will be provided by the District’s Northern Regional Water Treatment Plant.

WHEREAS, the Logan County Public Service District estimates that the project costs will be approximately $2,710,000, It is proposed that the project will be financed by a Small Cities Block Grant of $1,500,000, Infrastructure Fund Grant of $4 10,000 and an Ifiastructure Loan of $800,000 at zero (0) percent interest for 40 years. WHEREAS, the utility anticipates no change in rates for its customers as a result of ths project.

1 I. INTRODUCTION

Logan County Public Service District was created in 1975 to provide water and wastewater service to the majority of the rural areas of Logan County (See Appendix A). In 1979, the District's boundaries were reduced slightly when the communities of Clothier and Mufflin were officially removed to be included within the boundaries of the Boone County Public Service District (formerly known as the Spruce Fork Public Service District).

By Order dated May 5, 1994, the Logan County Commission expanded the District's boundaries to include the Huff Creek area of Wyoming County. This expansion was approved by the Public Service Commission of West Virginia by Final Order dated October 18, 1994 (PSC Case No. 94-0403-PWD-PC).

By Order dated November 7, 1994, the Logan County Commission expanded the District's boundaries to include the Harts Creek area of Lincoln County. This expansion was approved by the Public Service Commission of West Virginia by Final Order dated May 3, 1995 (PSC Case No. 94-1065-PWD-PC). Copies of these Orders are included in Appendix B.

By Order dated October 6, 1997, the Logan County Commission expanded the District's boundaries to include the Verner and Spice Creek areas of Mingo County. This expansion was approved by the Public Service Commission of West Virginia by Final Order dated April 2, 1998 (PSC Case No. 97-1370-PWD-PC).

The Logan County Public Service District boundaries currently include all of Logan County except: the municipalities of Logan, Chapmanville and Man; the Buffalo Creek Public Service District; and the Clothier and Mufflin areas which, as stated earlier, are in the Boone County Public Service District. Also included are the Huff Creek area of Wyoming County, the Harts Creek area of Lincoln County, and the Verner and Spice Creek areas of Mingo County.

Since its creation in 1975, the District has worked diligently to provide public water and wastewater service to the unserved or under served areas within its boundaries. To date the District has enjoyed some success; however, several areas are still in need of safe, reliable drinking water and wastewater service.

The District currently owns and operates eight (8) separate water systems that provide service to approximately 9,526 customers. The District also owns and operates one (1) wastewater system serving approximately 1,066 customers. The District operates, through an agreement with the Eastern Wyoming Public Service District, one (1) water system in the Mullens, Itmann, Route 16 and surrounding areas of Wyoming County which serves approximately 1,246 customers. The following is a brief description of each of these water systems:

1 NORTHERN REGIONAL WATER SYSTEM- The Northern Regional Water System is named for the District's new 2,800 gallons per minute (upgradable to 5,600 gallons per minute) Northern Regional Water Treatment Plant which began operations in late 2002. The service area includes all areas formerly included in the District's Big Creek, Trace Fork, Island Creek and Justice/Phico Water Systems. The original Island Creek and Justice/Phico Water Systems were purchased from the former J. C. Evans Utilities in 1992. The remaining systems were originally built and/or extended through the construction of fifleen (1 5) major projects from 1979 to the present. The distribution system consists of twelve (12) water storage tanks, nine (9) conventional booster stations, four (4) booster stations with bladder tanks and distribution lines. The system currently provides service to approximately 6,025 customers in the Town of Mitchell Heights and the unincorporated areas of Monitor, Wilkinson, Monaville, Switzer, Sarah Ann, Cow Creek, Whitman Creek, Bradshaw Hollow, Pine Creek, Trace Fork, Banco, Big Creek, North Fork, Kitchen, Stone Branch, Limestone Branch, Daisy, Toney, Green Shoals Branch, Ferrellsburg, Harts, Sawmill Road, Justice Addition, Henlawson, Upper Crooked Creek, Pecks Mill, Phico, Godby Heights, Godby Branch, Pigeon Roost, Mill Creek, Hewett Creek, Barker Fork, Gore Fork, Hainer Branch, Rocklick Branch, Garrett Fork, Atenville, Big Harts Creek, Little Harts Creek and Sand Creek.

GREENVILLE WATER SYSTEM- The original Greenville Water System was constructed in 1985 with major extensions in 1987,1989,1990,1994 and 1999. The system consists of a 700 gallons per minute treatment plant, six storage tanks, two booster stations and distribution lines. The system currently serves approximately 1,789 customers in the communities of Greenville, Landville, Bruno, Christian, Huff Junction, Green Valley, Mallory, Davin, Mineral City, Claypool, Combs Addition, Gillman Bottom, Cooks Addition, Taplin, Earling, Elk Creek, Verner, Spice Creek, Huff Creek, Campus, Cyclone and Lacoma.

RUM CREEK WATER SYSTEM - The original Rum Creek Water System was constructed in 1984 with major extensions in 1990, 1992 and 1994. It consists of two booster stations, two storage tanks and distribution lines. Water for the system is purchased from the Logan Water Board. Approximately 308 customers are currently served by the system in the communities of Rum Junction, Lyburn, Dehue, Neibert, Madison Creek, Rita, Orville and Yolyn.

MUD FORK WATER SYSTEM - The Mud Fork Water System, constructed in 1984, consists of distribution lines only. Water for the system is purchased from the Logan Water Board. Approximately 140 customers in the community of Upper Mud Fork are currently served by the system.

STOLLINGS WATER SYSTEM - The Stollings Water System was purchased in 1992 from the former J.C. Evans Utilities. A major extension and upgrade project was completed in 1996. The system consists of two conventional booster stations, one booster station with bladder tanks, two storage tanks and distribution lines. Water for the system is purchased from the Logan Water Board. Approximately 6 14 customers are currently served by the system in the communities of Stollings, McConnell, Melville, Sunbeam, Fort Branch, Red Campbell, Wanda, Ethel, Freeze Fork and the Logan County Airport.

2 SUNSET COURT WATER SYSTEM - The Sunset Court Water System was purchased from the former J.C. Evans Utilities in 1992. It consists of two booster stations with bladder tanks and distribution lines. Water for the system is purchased from the Chapmanville Water and Sewer Board. The system currently serves approximately 157 customers in the communities of Airport Road, Sunset Court, Conley Branch and Hidden Valley.

RIDGEVIEW ESTATES WATER SYSTEM - The Ridgeview Estates Water System was acquired in 1998 from the Ridgeview Estates Association. It consists of one booster station, one storage tank and distribution system. Water for the system is purchased from the Chapmanville Water and Sewer Board. The system currently serves approximately 30 customers in the Ridgeview Estates Subdivision.

CRAWLEY CREEK WATER SYSTEM - The Crawley Creek Water System was constructed in 2000 and consists of two storage tanks, one booster station and distribution lines. Water for this system is purchased from the Chapmanville Water and Sewer Board. Approximately 463 customers in the communities of Crawley Creek, Canoe Branch, Striker Fork, Brushy Fork, Tims Fork, Three Forks of Crawley, and the Chief Logan State Part Conference Center are served by the system.

EASTERN WYOMING PSD WATER SYSTEM - Logan County Public Service District entered into an agreement on August 30,2001 to provide operation, maintenance and management services for systems owned by Eastern Wyoming Public Service District. The Stephenson Water System currently provides water service to approximately 1,246 customers in the City of Mullens and unincorporated areas of Black Eagle, Corinne, Beechwood, Allen Junction, Wyco, Iroquois, Stephenson and Itmann. The original system was constructed in the 1940's but has recently been significantly upgraded. The current system consists of a 1,400 gallons per minute ground water treatment plant, three tanks with total storage capacity of 900,000 gallons, 75,670 feet of 16-inch and smaller diameter mains, fire hydrants, valves and other related items.

In addition to the eight (8) water systems owned and operated by Logan County PSD, six (6) other entities own and operate water systems in Logan County (See Table 1 as follows).

3 The District takes great pride in the quality of its operations. It has established programs to monitor such critical, but often overlooked, aspects of its operations such as water accountability, meter testing, inventory control, vehicle 0 & M expense, etc. To extend the life of its systems and improve reliability the District has developed and implemented an aggressive preventive maintenance program. The meter testing and vehicle 0 & M expense programs are computerized and the water accountability and preventive maintenance programs are on schedule to be computerized in the near future. The District has computerized and integrated its payroll, billing system and other financial records. The computer system is networked and sized to handle projected growth for many years. Hand held meter readers are used to reduce manpower requirements and improve accuracy. Meters are being converted to “touch read” and “radio read” as funds allow to further improve accuracy and efficiency. Approximately 7,000 of the District’s meters have been converted to date. The District has, for the previous several years, been making decisions based upon its twenty-year plan in order to prepare for expansion into additional areas.

The District Board has a combined total of over 40 years of service and is comprised of highly motivated business oriented individuals. The District employs a Certified Public Accountant as its General Manager. It’s Staff of 33 includes two Class IV, one Class 111, two Class 11, and two Class I Water System operators; one Class I1 Wastewater System operator and has over 400 years of combined water and wastewater system related experience.

District personnel are experienced in the planning and implementation of extensions to its systems. Since its creation in 1975, the District has completed twenty-eight (28) major water projects (See Table 2 as follows). Applications for funding were prepared by District personnel and the majority of the administration was done by District personnel. On several projects District personnel provided technical services including preliminary design, design review, shop drawing review, construction inspection, coordination and closeout, etc. Essentially all of these projects were completed on time and within or below budget.

The District owns a significant amount of construction equipment including: one Caterpillar 307 B Excavator; one Kubota Model KH 170L Excavator with rock hammer; one New Holland 555 E Backhoe; one Case Model 480E Backhoe; two Kubota Model B20 Backhoes; one Kubota B2 1 Backhoe; one Case TL 1000 Hand Trencher; one American Auger H- 12 Boring Machine capable of doing 4,8 and 12-inch bores; one Sullair 130 DPQJD Air Compressor; one Chicago Pneumatic CP 90 Air Compressor with Jackhammer and Road Mole; one 1-Ton Dump Truck; one 2-Ton Dump Truck; four equipment trailers as well as such smaller items as demolition saws, compactors, welders, etc. The District’s service fleet includes sixteen various sized vehicles. Each of these vehicles is fitted with a Motorola Max Trax 100 radio which, when used in conjunction with the base station located at the main office, maintains an excellent line of communication between all employees throughout the District’s service area.

The District maintains a dedicated construction crew, which works full-time on “in house” projects to upgrade and extend its systems. To date several projects have been completed using this approach (See Table 5 as follows). Each of these “in-house” projects was designed, bid and constructed by District staff with District equipment. This has been a very successful program, which the District intends to continue. Several additional “in-house” projects are presently in various stages of planning, design and construction.

In 1975, it was estimated that approximately thirty percent of residents of Logan County had access to a safe reliable public water source. At that time, the Logan County Commission identified the need to establish an entity to provide water and wastewater service to the remaining unserved and undeserved areas of the County. Logan County PSD was cieated to be that entity and was delegated the responsibility of achieving the Commission’s goal of providing safe, reliable water and wastewater service to all residents of Logan County. Since its creation, the District has taken this responsibility very seriously; accordingly, it has adopted the Commission’s goal as its own.

To accomplish its goal, the District has adopted the strategy of identifying as many potential projects as possible, then pursuing funding for all of them at the same time. Projects and potential funding sources are “matched” based upon each project’s perceived qualifiers. For example, when it became apparent that Abandoned Mined Lands (AML) monies could be used to fund water projects, the District identified approximately fourteen (1 4) projects in areas where significant pre-law mining had occurred and submitted AML Applications for each. Similarly, projects serving low to moderate income areas were “matched” to the Small Cities Block Grant (SCBG) program, projects representing an enhanced potential for economic growth were “matched” with the Appalachian Regional Commission (ARC) or Economic Development Administration (EDA) programs, etc. If funding is not forthcoming from the initial source, an alternate source is identified and pursued. This aggressive approach has worked well in Logan County; however, it requires a great deal of hard work and flexibility.

A major obstacle to the achievement of the District’s goal was the existence of numerous privately owned water systems in the county. These systems varied greatly in size and provided marginal to substandard service. To date twenty-nine (29) of these systems have been acquired by the District (See Table 6 as follows). Holden Water System 2006 Replaced The proposed Upper Little Harts Creek Water Extension Project will provide potable water service to approximately 97 potential customers (290 persons) in the Lincoln County communities of Little Harts Creek, Harvey Fork, Mudlick Branch, Gartin Fork and Laurel Fork. The project will connect to an 8-inch main (Atenville Water Project) along County Route 68 and extend along County Route 68 and 68/1 in easterly and southerly directions, respectively. Branch lines will be extended along County Route 68/2, 6813 and 68/4. Water for the area will be produced by Logan County Public Service District's Northern Regional Water Treatment Plant. Location, Project and System Maps are included in Appendix C.

The project consists of the construction of approximately 30,100 linear feet of 6-inch and smaller diameter water main, one 90 gallons per minute booster station, one 95,000 gallon water storage tank, fire hydrants, valves, individual customer meters and other related appurtenances. Construction and project costs are estimated to be $2,321,000 and 2,710,000, respectively.

The information in this report is offered to assist in obtaining approval for a new water system to serve the Upper Little Harts Creek area of Lincoln County. Details of the project are contained in later sections of this report.

9 11. CURRENT SITUATION

All residents and businesses within the project area currently obtain their water from privately owned wells. Logan County Public Service District’s Northern Regional Water System abuts the project area and was designed to facilitate the future extension of potable water service into this area. The Northern Regional Water System will provide water to the area through an 8- inch main which is located along County Route 68 at the beginning of the project area.

Water for the Upper Little Harts Creek Water Project will be produced by the District‘s new Northern Regional Water Treatment Plant. This plant was completed in late 2002 and includes sedimentation, upflow clarification, filtration and disinfection. Site plans and diagrams of the treatment plant are included in Appendix D. The plant has a rated capacity of 2,800 gallons per minute and is easily upgradeable to 5,600 gallons per minute. It is currently operated approximately 8 hours per day and is in excellent condition. The source of raw water is the which has adequate flows for the District’s current and future needs.

The Upper Little Harts Creek Project area currently has approximately 97 potential residential and small commercial customers. The residents in the area complain of water quality and quantity problems. Complaints include allegations that the well water contains iron, corrodes pipes and fixtures, stains cloths, has a strong sulfur odor and tastes bad. Many residents utilize home treatment units in an effort to improve the quality of water. The District has received several reports that wells in the area get low or go dry during certain times of the year. In 2005, to document the condition of the private wells in the project area, the District interviewed and tested well water at 80 potential customer’s homes (a summary of the interviews and testing results is included in Appendix E).

Logan County Public Service District will own and operate this extension of its system. 11 HI. FUTURE SITUATION

Based upon Projections Using State Short and Long Term Migration Averages (Year 2000 average birth and death rates, and the 1995-1990 inmigration and outmigration rates) obtained from the Regional Research Institute, West Virginia University, the population of Lincoln County is projected to increase through the year 2025. It is important to note that the project is in an area of Lincoln County which is experiencing growth due to the availability of suitable land. Accordingly, it is anticipated that the population within the project area will increase slightly within the next 25 years. It is believed that the availability of a potable water supply for the area will result in the construction of new homes and some additional commercial development. Any additional water demand in the project area will be supplied by the District's Northern Regional Water Treatment Plant.

Average potential water demand for the project area will be around 14,550 gallons per/day (97 cust. X 150 gpd/cust.). This represents additional operating time of the Northern Regional Water Treatment Plant of around 6 minutes per day. Peak usages, as per the Draft WV Health Department Design Standards, are expected to be around 100 gpm; however, the duration of these peaks should be short lived and will be offset to a certain extent by the storage capacity of the system.

12 IV. ALTERNATIVES

The existing conditions described in the previous sections clearly indicate that a non- action plan is not a viable alternative. Several alternatives exist for replacing the water supplies of the communities in the project area. The alternatives include bottled or trucked water, the provision of individual home water treatment systems, the replacement of wells, the extension of an existing public water system into the area, or the construction of a new treatment, storage and distribution system for the area.

The provision of bottled water, trucked water or individual home water treatment systems were not costed out. The logistics of delivering bottled or trucked water over a long period of time, and the inconvenience for the customer to utilize such water for cleaning, bathing, etc., makes this alternative impractical. Home treatment units are not reported to be completely successful at removing all the contaminants reported to exist in wells within the project area. Also, home treatment units would have to be maintained and replaced over the period of time until ground water quality significantly improves.

The replacement of wells within the study area is not a feasible solution. Residents have indicated that poor ground water quality is consistent throughout the study area. New wells drilled would likely produce the same poor quality water as current wells.

The Logan County Public Service District has an existing water system located adjacent to the Upper Little Harts Creek Project Area. Hence, there are two viable alternatives for supplying a potable water source to the residents of Upper Little Harts Creek; Alternative 1 - extend the existing water system adjacent to the project area and Alternative 2 - build a new water treatment facility. Alternative 1 is the only economically feasible possibility for supplying a potable water source to the Upper Little Harts Creek Project. A new water treatment plant would not be a feasible alternative since an existing potable water supply exists with adequate capacity and is in close proximity to the proposed project.

13 V. PLAN SELECTION and PUBLIC PARTICIPATION

Based upon the information available, it is concluded that extension of the existing water system to serve the project area is the least costly and most reliable alternative available.

Selection of this alternative was a logical conclusion based upon the options available. The only option which provided satisfactory service to the area is the extension of a new water system adjacent to the project area. Because adequate capacity exists in the District's Northern Regional Water System adjacent to the project area, the construction of a new treatment system was deemed a significant and unnecessary added cost.

Citizen participation and public input for the project will be obtained following funding agency requirements. Additional public input will be requested in conjunction with flood plain notices and during the construction permitting process.

14 VI. ENVIRONMENTAL INFORMATION

In order to assess the potential environmental impacts of the Upper Little Harts Creek Project, the District has requested comments from the following state and federal agencies:

Comments received from these agencies (See Appendix F) will be incorporated into a Environmental Assessment Report to be provided at a later date.

Negative environmental impacts of the projects will be minimal. Unavoidable adverse impacts such as erosion and sedimentation will be minimized through the use of silt fences, straw bales, and other available technologies. Disturbed areas will be graded, seeded and mulched as soon as practical after construction. Dust, mud and other conditions will be minimized by regularly sweeping and damping roadways. Noise pollution will be controlled as much as possible through the proper operation and maintenance of equipment and scheduling of work.

The 100 year flood elevation of the small streams within the project area were not readily available. No flood sensitive components such as tanks or booster stations will be located in the 100 year flood plain. Components such as water lines, fire hydrants and meters which may be located within the flood plain will be of such a design that potential flood damage will be minimal if not non-existent.

PLANT CHEMICALS:

During the year ended June 30,2006, the Northern Regional Treatment Plant produced approximately 412,242,000 gallons of water. During this same period, $68,910 worth of chemicals were used. This equates to a chemical cost of approximately $0.17 per thousand gallons of water treated.

It is estimated that the Northern Regional Treatment Plant will initially produce an additional 4,4 16,000 gallons of water per year to meet the demand of the Upper Little Harts Creek Water System. At a cost of $0.17 per thousand gallons, the plant chemical cost will be:

TREATMENT PLANT ELECTRICITY:

During the year ended June 30,2006, the Northern Regional Treatment Plant produced approximately 4 12,242,000 gallons of water. During the same period, electric bills totaled $107,496. This equates to an electrical cost of approximately $0.26 per thousand gallons of water treated.

It has been estimated that approximately 4,416,000 additional gallons of water per year will be produced to serve the Upper Little Harts Creek Water System. At a cost of $0.26 per thousand gallons, the plant electrical cost will be:

BOOSTER STATION ELECTRICITY:

The proposed Upper Little Harts Creek Booster Station will pump all of the water used by the Upper Little Harts Creek Water System. Assuming an average monthly usage of 4,000 gallons per customer and using 15 percent unaccounted for water for leaks, fire fighting, line flushing, etc., the booster station will pump an average of 368,000 gallons of water per month (80 cust. x 4,000 gal./mo./cust. x 1.15). The proposed booster station will have a rated capacity of 90 gallons per minute and the motors will be 15 hp. The additional electricity expense for the Upper Little Harts Creek Booster Station is calculated as follows:

At 90 gpm, the pump will run: 368,000 gal./mo./90 gpm/60 min./hr.=68.1 hr./mo. @ 15 hp, that's 68.1 x 15 = 1,021.5 hp-hours/mo. Converting to kilowatt hours: 1,021.5 hp-hourdmo. x 0.7457 = 761.7 kwh/mo. @ $0.10 kwh/nio.: 761.7 x 0.10 = $76.17/mo. Or $76.17/mo. x 12 = $914.04/year, say $920/year

STORAGE TANK ELECTRICITY:

The Upper Little Harts Creek Water Project includes the construction of one (1) water storage tank. An electrical service will be provided at the tank location to power the telemetry system (minimal usage). The District currently has several such electrical services at its various tanks, repeaters, etc., and the monthly electricity cost averages approximately $10.00 per month per service. Total revenue requirement for the system will be the total of the estimated O&M Expense plus the Bond Payment/Coverage. Coverage is expected to be 15 percent.

It is estimated that the District's annual O&M expenses will increase by $1 8,500 as a result of the construction of this project.

It is anticipated that the District will have to borrow $800,000 at zero (0) percent interest for 40 years to complete project financing. Using a coverage requirement of 15 percent of annual bond payments, the Bond Payment/Coverage requirement is calculated as follows:

It is estimated that approximately 80 percent of the 97 potential customers will initially connect to the system (See Customer Listing in Appendix H). It is estimated that the average monthly bill for these 80 customers will be approximately $33.16, this equates to a total increase in annual revenues of approximately $31,830 (80 x $33.16 x 12).

Completion of the proposed project described herein will result in an increase in operation and maintenance expense of approximately $8,400 per year. Debt Service and coverage is expected to be approximately $23,000 per year. Additional revenues resulting from the system have been estimated at $3 1,830 per year. This equates to an annual surplus as a result of this project of approximately $430. It is therefore concluded that this project is feasible and self sustaining.

The District's last general rate increase was in 2003. The Public Service Commission of West Virginia (PSC) approved the rates by Final Order dated June 30,2003 in Case No. 02-1399- PWD-42T. The effective date of the increase was July 15, 2003. The District has since increased rates through Case No. 03-2015-PWD-30B which were PSC approved by Final Order dated December 28,2004. The effective date for the new rates was December 28,2004. Under the District's current tariff, the minimum bill is $16.93 per month for 2,000 gallons usage. The average monthly bill for 4,000 gallons usage is $33.16. A copy of the tariff is included in Appendix I.

Design of the system is complete. The District has begun to obtain the necessary construction permits for the project (See Permit Summary/Status Form in Appendix J). It is anticipated that the project period will be approximately 20 months. A project schedule detailing the critical project steps is included as Appendix K.

It will be necessary to acquire two (2) parcels of land for this project for the tank and booster station. It will be necessary to obtain approximately 16 rights-of-way. The number of required rights-of-way has been minimized by locating waterlines on WV Division of Highways right-of-way whenever possible. Acquisition is underway (See Appendix L).

The public health benefits to be derived from the project include those associated with improved quality of drinking water. The bulk of the wells in the project area are Contaminated with high levels of iron, manganese, etc. The construction of the system will eliminate the potentially harmful ingestion of these contaminates. Additionally, many individual home lots within the project area are small which increases the probability that private wells could be contaminated by septic systems. This project will provide an alternate source of water so that individual wells can be abandoned; thereby, significantly reducing this potential hazard.

Case No. 94-1065-PWD-PC On November 9, 1994, the Logan County Commission filed a petition requesting the Commission's approval.for enlarging the boundaries of the Logan County PSD into the southern portion of Lincoln County generally referred to as the Harts Creek area. Included in the documentation was an Order 5, 1994 Order of the Logan County Commission proposing the enlarge- ment and an October 6, 1994 Order of the Lincoln County Commission ac- cepting the proposed enlargement. On December 20, 1994, Mr. Robertson filed the Initial Joint Staff Memorandum, with attached memorandum from Mr. Knurek. Commission Staff stated that it was reviewing this matter, and, upon completion of its review, would make its final recommendation. Finally, Mr. Robertson recommended consolidation of this matter with Case No. 94-0899-PWD-PC. On January 11, 1995, Mr. Robertson filed an Initial and Final Joint Staff Memorandum, with attached memorandum from Mr. Knurek. Mr. Robertson stated that it is the view of Commission Staff that the Logan County Commission has substantially complied with the requirements of Code S16-13A-2 and that hearing should be held in Logan County or in both Logan and Lincoln Counties. ORDER IT IS, THEREFORE, ORDERED that the petitions of the Lincoln County Commission and the Logan County Commission filed, respectively, on.Octo- ber 10, 1994, and November 9, 1994, be, and they hereby are, granted, and the October 5 and 6, 1994 orders of said County Commissions authorizing the dissolution of the Ranger-Harts Public Service District and the expansion of the boundaries of the Logan County Public Service District into the Harts Creek area of Lincoln County be, and they hereby are, approved. Re: Upper Little Harts Creek Water Extension Project

Dear Mr. Boggs:

The Lincoln County Commission recently submitted an application for a Small Cities Block Grant for the Upper Little Harts Creek Water Extension Project. To document the existing water conditions within the project area, the County Commission authorized Logan County Public Service District to survey the potential customers within the project area and perform certain testing on their wells. Of the 105 potential customers, 80 were interviewed and had their well water tested. The results of the interviews/testing are summarized on the attached Well Survey/Testing Summary. A map is also attached which identifies each of the interviewhesting sites. Based upon the survey/testing, the following observations were noted:

1) 13.9 percent (1 1 of 79) of those interviewed indicated that they experienced water quantity problems.

83.8 percent (67 of 80) of those interviewed indicated that their water looked bad.

3) 62.3 percent (48 of 77) of those interviewed indicated that their water smelled bad.

4) 56.3 percent (40 of 71) of those interviewed indicated that their water corrodes pipes and fixtures.

5) 85.7 percent (66 of 77) of those interviewed indicated that their water stains sinks, toilets, etc. Jim Boggs May 24,2005 Page 2 of2

6) 35.4 percent (28 of 79) of the wells tested were positive for total coliforms.

7) 10.1 percent (8 of 79) of the wells tested were positive for E-coli. This indicates the presence of fecal material in the wells.

8) 55.0 percent (44 of 80) of those interviewed indicated that they utilize a home treatment unit to attempt to improve water quality.

9) 92.5 percent (74 of 80) of those interviewed indicated that they would connect if public water service was available.

In the District's opinion, it is clear that the need exists for a new public water system

I in the Upper Little Harts Creek area of Lincoln County. Additionally, public support for the project is overwhelming, Please forward this information to the West Virginia Development Office as a supplement to the previously submitted Small Cities Block Grant Application.

A search of office site files located no known archaeologicalsites within the proposed project area. Our records do indicate that site 46Lcl19, a prehistoric habitation site with a historic component, is located within several hundred feet of proposed line locations. However, according to submitted information, a majority of the proposed construction activities will be confined within previously disturbed areas andor existing road rights-of-way, where in our opinion, it is unlikely that there are any intact archaeological deposits. In our opinion, there are no archaeological sites located within the proposed project area that are eligible for or listed in the National Register of Historic Places. If, however, cultural materials are encountered during construction, all activity within the discovery area shall cease and our office shall be contacted immediately.

Re: Upper Little Harts Creek Water Project

Dear Mr. Roberts:

This responds to your information request of September 2,2005 regarding the proposed Upper Little Harts Creek Water Project in Logan County, West Virginia. These comments are provided pursuant to the Endangered Species Act (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.).

Only one federally listed species could occur in the project area, the endangered Indiana bat, (Myotis sodalis). The federally listed endangered Indiana bat may occur in the project area and could conceivably be adversely affected by the project proposal. The Indiana bat may use the project area for foraging and roosting between April 1 and November 15. Indiana bat summer foraging habitats are generally defined as riparian, bottomland, or upland forest, and old fields or pastures with scattered trees. Roosting/maternity habitat consists primarily of live or dead hardwood tree species which have exfoliating bark that provides space for bats to roost between the bark and the bole of the tree. Tree cavities, crevices, splits, or hollow portions of tree boles and limbs also provide roost sites.

The US. Fish and Wildlife Service (Service) has determined the number of acres of suitable foraging and roosting habitat on the West Virginia landscape available to each Indiana bat, versus the total acreage of forest. On that basis, we have determined that small projects, outside of a five-mile radius of a hibernaculum or known capture site, affecting 17 acres or less of suitable forested habitat, will have a very small chance of resulting in direct or indirect take of the species, and therefore these effects are considered discountable.

If less than 17 acres of Indiana bat maternity habitat will be impacted by this project then no further consultation under the Endangered Species Act is required. If more than 17 acres will be disturbed, then you should contact this office to discuss project options. Should project plans Mr. Rick Roberts, P.E. 2 November 18,2005 change, or if additional information on the Indiana bat becomes available, this determination may be reconsidered.

DELAYED PAYMENT PENALTY The above schedule is net. On all accounts not paid in full when due, ten percent (10% will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate.

TAP FEE The following charges are to be made whenever the utility installs a new tap to serve an applicant.

A tap fee of $100.00 will be charged to customers applying for service before construction is completed adjacent to the customer's premises in connection with a certificate proceeding before the Commission. This pre-construction tap fee will be invalid after the completion of construction adjacent to the applicant's premises that is associated with a certificate proceeding.

A tap fee of $250.00 will be charged to customers applying for service outside of a certificate proceeding before the Commission for each new tap to the system.

RECONNECTION $25.00 To be used whenever the supply of water is turned off for violations of rules, non- payment of bills or fiaudulent use of water.

RETURNED CHECK CHARGE A service charge equal to the actual bank fee assessed to the District or a maximum of $15.00 will be imposed upon any customer whose check for payment of charges is returned by their bank due 10 insufficient funds.

LEAK ADJUSTMENTS $0.97 per 1,000 gallons of water is to be used when a bill reflects unusual water consumption which can be attributed to eligible leakage on customer's side of the meter. Dear Mr. Tilley:

The Division of Natural Resources hereby grants to you for a term of 25 years, from the date hereof, a License and Right of Entry to construct, replace, cover, repair, operate, maintain, use and remove four-inch (4") and six-inch (6") water pipelines at seven (7) different locations along Little Harts Creek, Harvey Fork, Laurel Fork, Mudlick Branch and Garlin Fork, Harts Creek District, Lincoln County, West Virginia, as shown located and highlighted in red on the map attached hereto as Exhibit A.

This License and Right of Entry is subject to the following terms and conditions:

7. No in stream work during the fish-spawning season (April l-June 30).

2. The pipeline must be buried at least three-feet (3')

3. Any stream bed disturbance should be restricted to the immediate area. In stream use of equipment should be kept to a minimum.

4. All shore areas disturbed by this operation must be reshaped, seeded and mulched immediately upon completion of work. The prompt establishment of vegetative cover will reduce future damage from high water levels.

5. Green concrete must not be put in the stream (highly toxic to aquatic life).

6. Amount of stream side vegetation disturbed should be kept to a minimum.

' 7. Best management practices should be followed; measures such as hay bales must be used to reduce downstream siltation. Logan County Public Service District P-09-V/22-0170 Page 2 February IO, 2009

8. Any plastic pipeline less than four-inch (4") in diameter shall be encased in a metal conduit.

9. The State's issuance of this Right-of-Entry does not provide for the applicant to work outside the requested boundaries nor does the State assume any liability for the applicant's/landowner's construction activities. By accepting this Right-of- Entry, the applicantllandowner assumes liability for any/all damages caused by this activity to both upstream and downstream landowners.

10. Work should be completed as quickly as possible during low flows in designated work areas only.

11. A404 Permit may be required from The U.S. Army Corps of Engineers. You may contact them at 304-399-521 1 or 412-395-7152.

Guidelines of Best Management Practices for Sediment and Erosion Control as outlined by the Section of Water Resources, Division of Environmental Protection must be followed. Copies of those guidelines are available from the Section of Water Resources, Telephone No. (304) 926-0440.

The issuance of this License and Right of Entry by the Division of Natural Resources does not preclude the necessity to obtain a permit from the Corps of Engineers or any other state or federal permits which may be required by law, nor does this License and Right of Entry negate the need to comply with the West Virginia Water Pollution Control Act and/or the State Environmental Quality Board's administrative regulations, applicant is also responsible for determining if the proposed activity is located within an identified flood plain and it is the applicant's responsibility for contacting the local governmental agency in charge of that program and obtaining a flood plain development permit for it. This License and Right of Entry does not grant any rights or privileges, or permission to enter upon or to cross the property of any other person, nor is permission granted to remove any material that lies upon the property of any other persons. Work should be completed in as brief a period as possible and within one year from the date of this letter. In the event you fail or refuse to comply with any of the terms or conditions herein, this License and Right of Entry will be canceled and considered null and void and the Division will reject further applications.

As required by Section 106 of the National Historic Preservation Act, CULTURE & HISTORY as amended, and its implementing regulations, 36 CFR 800: "Protection of Historic Properties," The Cultural Center we submit our comments. 1900 Kanawha Blvd., E. Charleston, WV Architectural Resources: 25305-0300 According to the information submitted the booster station will be approximately 8' tall, 17' long and 12' wide, the storage tank will be approximately 20' in diameter-and 33' feettall. Both the Phone 304.558.0220 booster station and tank will be enclosed in a 10' chain link fence for security reasons. It is our Fax 304.558.2779 understanding that the cut stone wing walls identified on Sheet 8 will not be effected. Archaeological Resources: Thank you for submitting the DVD of the project area. It was very informative. A search of office site files located no known archaeological sites within the proposed project area. Our records do indicate that site 46Lc 1 19, a prehistoric habitation site with a historic component, is located within several hundred feet of proposed line locations. However, according to submitted information, a majority of the proposed construction activities will be confined within previously disturbed areas andor existing road rights-of-way, where in our opinion, it is unlikely that there are any intact archaeological deposits. In our opinion, there are no archaeological sites located within the proposed project area that are eligible for or listed in the National Register of Historic Places. If, however, cultural materials are encountered during construction, all activity within the discovery area shall cease and our office shall be contacted immediately.

Re: Logan County Public Service District - Water Operations Rule 42 Exhibit for Upper Little Harts Creek Water Extension Project

Dear Mr. Baisden:

This exhibit is a compilation of financial information as prescribed by Rule 42 of the Public Service Commission of West Virginia Rules of Practice and Procedure for the Filing of Targs. This exhibit is the basis for a recommendation for the water rates set forth to meet current operational requirements, needed capital improvements, the continued operations of the District’s water operations and for the pending project. We have prepared this report based on billing and other financial information for the District as of June 30, 2008 and we included the revenues requirements for the proposed project estimated to cost $2,710,000. The anticipated funding for the proposed project consists of a Small Cities Block Grant of $1,500,000, Infrastructure Fund Grant of $410,000 and an Infrastructure Fund Loan of $800,000 at zero (0) percent interest for 40 years. As a result of the extension project, 78 new customers (80% of 97 potential customers) will be added to the customer base and we estimated their monthly usage at 3,900 gallons.

Based on our review, we recommend no increase to the District’s current rates and charges at this time. The District’s current rates are sufficient to provide a Going Level cash flow surplus of $36,360 with debt service coverage of 137.49%. The minimum bill, based on 2,000 gallons of water usage per month, currently is $16.94 and a monthly bill based on 4,000 gallons is $33.16. Incorporating the revenue requirements for the proposed project and 78 new customers at 3,900 gallons of usage per month produces a Proforma cash flow surplus of $34,241 with debt service coverage of 136.86%.

LOGAN COUNTY PUBLIC SERVICE DISTRICT Application for a certificate of convenience and necessity to construct upgrades to its water treatment facilities.

NOTICE OF FILING

On June 11, 2009, Logan County Public Service District (“District”) filed an application, duly verified, for a Certificate to construct certain additions and improvements to its water treatment facilities in Logan County. The application is on file with and available for public inspection at the Public Service Commission, 20 1 Brooks Street, in Charleston, West Virginia.

The proposed project will provide potable water service to approximately 97 potential customers (“290 person”) in the Lincoln County communities of Little Hearts Creek, Harvey Fork, Mudlick Branch, Gartin Fork and Laurel Fork. The project will connect to an 8-inch main (“Atenville Water Project”) along County Route 68 and extended along County Routes 68 and 68/1 in easterly and southernly directions, respectively. Branch lines will be extended along County Routes 68/2,68/3 and 68/4.

The proposed project consists of the construction of approximately 30,100 linear feet of 8- inch and smaller diameter water main, one 90 gallons per minute booster station, one 95,000 gallons storage tank, 20 fire hydrants, valves, meters and other related appurtenances. Water will be provided by the District’s Northern Regional Water Treatment Plant.

The District estimates that the project costs will be approximately $2,710,000.00. It is proposed that the project will be financed by a Small Cities Block Grant of $1,500,000.00, Infrastructure Fund Grant of $410,000.00 and an Infrastructure Loan of $800,000 at zero percent interest for forty years.

The District anticipates no change in the following current rates for its customers as a result of the project:

The requested rates and charges are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing.

Pursuant to W. Va. Code 524-2-1 1, IT IS ORDERED that Logan County Public Service District give notice of the filing of said application, by publishing a copy of this order once in a newspaper duly qualified by the Secretary of State, published and of general circulation in Mingo, Boone, Wyoming, Lincoln and Logan Counties, making due return to this Commission of proper certification of publication immediately after publication. Anyone desiring to protest or intervene should file a written protest or notice of intervention within 30 days following the date of this publication unless otherwise modified by Commission order. Failure to timely protest or intervene can affect your right to protest aspects of this certificate case, including any associated rate increases, or to participate in future proceedings. All protests or requests to intervene should briefly state the reason for the protest or intervention. Requests to intervene must comply with the Commission’s rules on intervention set forth in the Commission’s Rules of Practice and Procedure.
