VOTERS APPROVE ROAD BOND AMENDMENT IN A LANDSLIDE!

Voters approved a constitutional referendum Saturday, October 7, that will allow to issue up to $1.6 billion in bonds for highway and bridge construction in the state. The vote on the Roads to Prosperity Amendment of 2017 passed, earning nearly 73 percent of the vote with every precinct reporting late Saturday night, according to unofficial results from the West Virginia Secretary of State’s Office.

At a news conference after word of the victory circulated, an elated Gov. Jim Justice said the electorate has given its take on the state’s future, loud and clear. “The voters spoke, did they not? They spoke,” he said before the crowd of labor and industry representatives who supported the effort interrupted him with applause. “They spoke and I am so happy for our state in every single way.” Of the 1.2 million West Virginians registered to vote, more than 119,000 cast their ballots Saturday. The amendment won 54 counties. Ritchie is the only county to defeat the amendment.

A great coalition was put together under the banner of West Virginians for Better Transportation to educate voters on the Roads to Prosperity amendment. The coalition consisted of statewide industry organizations, American Council of Engineering Companies, organized labor, school teachers, statewide elected officials, higher education leaders, state and local chambers of commerce, newspaper editorial boards, state legislators of both parties and local officials who all banded together for the common goal of improving West Virginia's roads and highways. CAWV members and numerous others contributed to WVBT that allowed for a very effective campaign to promote the amendment, which included TV, radio, and newspaper, plus a heavy concentration on social media. First Lady Cathy Justice appeared in television ads, as did Coach Bob Huggins and Coach Dan D’Antoni. Basketball legend Jerry West recorded a call that went to 150,000 voters urging passage of the amendment.

Passage would not have been possible without the tireless efforts of Governor Jim Justice, West Virginia Department of Transportation Secretary Tom Smith, and West Virginia Department of Commerce Secretary Woody Thrasher. All three spent countless hours traveling to communities across the state to build up support for the Roads to Prosperity Amendment. Their efforts were instrumental in the amendment’s success.

A CAWV member sent the following after passage of Saturday’s bond referendum:

“The road bond passage margin is beyond my imagination. For all that [CAWV] did for this initiative, thank you. This will have a significant effect on my business for the most of the remainder of my career through direct sales of our products and services. Moreover, the plan, if well executed, should positively impact the state for the rest of my life.”

GOVERNOR CALLS SPECIAL LEGISLATIVE SESSION

Gov. Jim Justice issued a proclamation today calling for the West Virginia Legislature to convene in special session at 12 p.m. on Monday, October 16, to address legislation. Included in the special call is a bill exempting military retirement from state personal income tax and a bill increasing the amount of credit allowed against personal and corporation net income taxes for qualified historic rehabilitation expenditures.

According to Mike Hall, chief of staff for the Justice Administration, additional legislation including a bill that addresses Department of Transportation hiring policies, is currently being worked on and may also be presented next week or at another time in the very near future.

Monday’s special call coincides with the Legislature’s regularly interim meetings scheduled to begin Sunday, October 15, and running through Tuesday, October 17. Meetings of importance to CAWV members include the Joint Government Accountability, Transparency and Efficiency Committee which will probably discuss the actions and activities of the School Building Authority Monday at 8:00 a.m. Monday. This is a follow up on the committee’s August and September discussions on the use of construction management on school construction projects

The Joint Commission on Economic Development on Tuesday will feature “West Virginia Forward: Strategy for Economic Development and Job Growth.” This is the McKenzie Report detailing measures the state can take to move forward in jobs and development. The Select Committee on Infrastructure will meet Sunday but at press time there is no agenda posted. There is also no agenda for the Joint Legislative Oversight Commission on Department of Transportation Accountability meeting on Sunday. GOVERNOR JUSTICE APPOINTS D.R. "BUCK" JENNINGS TO HOUSE OF DELEGATES SEAT IN 53RD DISTRICT

Governor Jim Justice announced this week that he has appointed D.R. “Buck” Jennings of Thornton to the House of Delegates 53rd District seat filling a vacancy created last month following the passing of the Honorable Tony Lewis. Jennings is president of Jennings Legacy Builders and is married to his wife of 47 years, Evelyn. He is a longtime member of the Fellowsville Fire Department and is a paramedic and EMT instructor with RESA. Governor Justice will also be naming a new Senator to replace Sen. Ron Miller, who resigned to take a position with the Justice administration. Sen. Miller represented the 10th Senatorial District encompassing Greenbrier, Fayette, Summers and Monroe counties.

The committee will discuss programs and activities for the CAWV Midyear Meeting which will be held February 1– February 7, 2018 at the JW Marriott in Marco Island, Florida Program Committee Chairman Nate Orders is welcoming ideas for presentations and topics for the Monday and Tuesday morning General Business sessions. One topic under consideration by the committee is what effect West Virginia’s new medical marijuana law will have on contractors’ hiring and drug-free policies. GENERAL REVENUE COLLECTIONS IN SEPTEMBER ABOVE ESTIMATE

Department of Revenue Secretary Dave Hardy said he is “cautiously optimistic” about September revenue numbers. Revenue exceeded estimates in severance tax and corporate net income tax collections. However, numbers lagged in cumulative collections. According to a news release from the Department of Revenue, severance tax and corporate net income tax revenues put the state’s General Revenue Fund Collections $11.5 million above estimate and 3.5 percent above last year’s receipts. General Revenue Collections totaled $389.2 million for September.

Secretary Hardy said in the release that this is positive news for the state. Last month, Hardy said the state was behind estimates two months into the fiscal year but said September was the important month to watch. “It appears that we are gaining some ground in some critical areas,” Hardy said in the release. “This was an important month in terms of revenues and it didn’t disappoint. We are cautiously optimistic as we watch collections to continue to improve.” However, the state still is lagging in cumulative collections at $948.7 million, which is $7.8 million below estimate. The release said collections are $33.9 million ahead compared to where revenues were at this time last year. Personal income tax, consumer sales tax, tobacco product excise tax and state road fund collections fell short of estimates.

General revenue fund collection is important since many of the construction projects by state agencies are dependent upon funding from the state’s general revenue funds. Also, bonds for school, parks and water and sewer projects are paid for by lottery proceeds which also go into the general funds. Less dollars collected could result in a slowdown of future government construction contracts.

We are sorry to report the passing of Floyd M. Sayre, Jr. 87, who passed away Wednesday. Floyd was CAWV Executive Director from 1978 to 1983. The Beckley native returned to West Virginia following a professional career with the U.S. Chamber of Commerce in Florida, North Carolina and Beckley. He owned and managed a professional association and was the first in West Virginia to earn the Certified Association Executive (CAE) distinction by the American Society of Association Executives. Funeral service will be held at 2:00 p.m. Saturday, October 14 at Barlow Bonsall Funeral Home in Charleston. Visitation will be held today from 5 to 7 p.m. at Barlow Bonsall. The CAWV offers its sympathies to Floyd's wife, Ruth, and the entire Sayre family.

ARMSTRONG FLOORING TO EXPAND; ANNOUNCEMENT PART OF FEDERAL ECONOMIC GRANTS

An expansion project to create a distribution center at Armstrong Flooring’s manufacturing plant in Beverly could bring up to 50 new jobs, officials announced Wednesday. The expansion will add 85,000 square feet to the local facility, which is the largest pre-finished hardwood flooring plant in the country. Made possible by a $2.5 million grant from the U.S. Economic Development Administration, the project was announced by U.S. Sen. Shelley Moore Capito, R-W.Va., along with federal, state and local officials, the Randolph County Development Authority and Armstrong leaders.

The distribution center project also is expected to help retain 60 existing jobs and generate approximately $16.2 million in private investment, officials said. Opened in 1989 along Route 250 south of Beverly, the Armstrong facility produces flooring from oak, hickory and maple and currently employs more than 600 people. Plans call for the new construction to begin in the summer of 2018 and be completed in the summer of 2019.

The project will enable Armstrong to consolidate storage of its finished flooring products at the plant, instead of shipping product to off-site distribution centers. Additional space also will be available for potential future expansion of manufacturing capacity, officials said. Dominic Rice, senior vice president of global operations and manufacturing for Armstrong Flooring, said the company continuously works on ways to enhance and streamline its operations, and this expansion will be a great step forward.

ANTICIPATE WHAT CAN HAPPEN

Regardless of the belief that accidents “just happen,” they do not. One phrase used repeatedly by those involved in an accident is, “I never saw him.” Another is, “I would never have thought that this would happen.” The sad part about these statements is that, in a way, they are true.

During an accident investigation, those involved and witnesses many times share the same story. “They just didn’t think that the task being performed held any danger.” One key factor can be found in every statement. Either the workers or supervisors didn’t think or they didn’t anticipate the possibilities of risk.

Accidents can be greatly reduced and even eliminated if time is taken to plan for the possibilities of an injury or accident before taking on a job task. The following points can help if you will make them part of your safety culture.

* Ask yourself. WHAT IF? What if someone is behind that vehicle that’s about to back up? What if the tension on that part that is being forced out releases suddenly, can it strike someone? What if the load being lifted falls, would someone be in harm’s way if it did? What if someone comes along on the job site long after workers have left for the day, could they be harmed by walking into a hole, unseen in the dark that was dug and left unguarded?

* Look around. KNOW THE ENVIRONMENT. Stop and take a moment to think about where workers are and where they are going. Going out on the job site can be very dangerous if you do not know what hazards are out there every day. This is construction work. The landscape changes, work progresses, job tasks are constantly changing. What was being performed yesterday, three days ago or last week is going to change. Look around.

* Communicate changes. TELL OTHERS. If on a multi-contractor project, you will see things changing that you have no responsibility for and have no control over. But those changes may create a new hazard for workers. Warn workers of hazards created by others. An accident can many times be eliminated if everyone knows what conditions exist on the job site. Staff can avoid the hazard or plan the necessary safety precautions to work near the hazard.

These ideas seem simple. ANTICIPATING WHAT MIGHT HAPPEN and knowing the work environment can go a long way toward keeping everyone safe.

FEDERAL GRANTS ANNOUNCED FOR WV PROJECTS TO HELP COALFIELD COMMUNITIES

Eight West Virginia projects will receive a total of about $8.2 million in funding from the federal Economic Development Administration as part of a new initiative to support economic development in areas hit by the coal industry’s decline, the U.S. Department of Commerce announced Wednesday.

The 2017 Assistance to Coal Communities initiative will distribute $30 million to back 35 projects in 15 states, according to a news release. The funding for West Virginia projects looks to address a variety of needs, from infrastructure improvements and a facility expansion to bolstering staff and purchasing equipment.

The Randolph County Development Authority will receive $2.5 million to expand Armstrong Flooring in Beverly, the release and a separate announcement by Armstrong Flooring said. The 85,000-square foot expansion of the solid wood floor manufacturing facility will allow the company to store finished products at the plant rather than offsite, the company said. “We are looking forward to this expansion that will improve and streamline our distribution capabilities at the Beverly plant, which manufactures hardwood flooring to ship throughout the U.S.,” said Dominic Rice, senior vice president of global operations and manufacturing, in the company release.

The Flatwoods Canoe Run Public Service District will receive $1.478 million to make water infrastructure improvements for the Weyerhaeuser manufacturing facility in Braxton County, the EDA release said. The forest products company has roughly 164 full-time employees.

The Mingo County Redevelopment Authority will receive $1.392 million to provide water service to the Hatfield-McCoy Trail and the “Twisted Gun Gap development,” the release said. Jeff Lusk, executive director of the Hatfield McCoy Regional Recreation Authority, said that project will focus on private development, such as cabins and campgrounds, surrounding the Twisted Gun Golf Club in Mingo County to be connected with the Hatfield-McCoy Trail system.

“Public utilities like water and electricity are such an important part of attracting new lodging to the Twisted Gun Gap area,” he said. To see the full list of project funding, click here.

TCC TESTIFIES ON NEED FOR AN INFRASTRUCTURE BILL

This week, Jim Roberts, president & chief executive officer of Granite Construction, testified on behalf of the AGC co-chaired Transportation Construction Coalition (TCC) at a hearing, “Building a 21st Century Infrastructure for America: Highways and Transit Stakeholders’ Perspectives,” in front of the House Transportation & Infrastructure Subcommittee on Highways and Transit. The hearing was an opportunity for the TCC to share the transportation construction industries priorities as Congress and the administration work toward an infrastructure proposal. The TCC testimony stressed the need to include a permanent fix for the Highway Trust Fund as part of any federal infrastructure effort, allocate any new funding for federal highway and transit programs among existing programs, continue providing tools that encourage the use of public-private partnerships. Mr. Roberts and the TCC also encouraged the committee to fix the Highway Trust Fund as part of comprehensive tax reform.

Additionally, the TCC offered three specific recommendations to improve the environmental review process:

 Require a merger of the National Environmental Policy Act and Clean Water Act 404 permitting processes

 Allow the monitoring, mitigation and other environmental planning work performed during the NEPA process, and included the final Environmental Impact Statement / Record of Decision, to satisfy federal environmental permitting requirements, unless there is a material change in the project

 Develop a reasonable and measured approach to citizen suit reform to prevent misuse of environmental laws

AGC and our partners in the Transportation Construction Coalition will continue to push for an infrastructure proposal that among other things provides a long term solution to the Highway Trust Fund and expedites the delivery of infrastructure projects. USDOT WITHDRAWS LOCAL HIRE RULE

The Department of Transportation (DOT) last week issued a notice to withdraw a proposed rule and end the pilot program that allowed states to require contractors to meet local hire mandates on federal-aid highway and federally assisted transit contracts. The Obama Administration proposed the permanent rule change in March of 2015 and, while the rule change was pending, created a pilot program allowing states to move forward with local hire requirements. The pilot program was initially in place for one year but just prior to the end of the Obama term, the Department extended the pilot program for an additional five years. AGC opposed this rule from its inception and discussed its opposition in a meeting with Transportation Secretary Chao early in her term and in letters to the Department. Last weeks’ notice to end the pilot program is a win for AGC members.

The Safety Edge is designed to help save lives by allowing drivers who drift off highways to return to the road safely. Instead of a vertical drop-off, the Safety Edge shapes the edge of pavement to 30 degrees, allowing drivers to re-enter the roadway safely.
