DEPARTMENT OF INSURANCE Records: 1883-current Cubic ft.: Approx. # of Items: HISTORICAL NOTE An act approved February 15, 1864, required insurance companies to be certified by the territorial auditor and make annual reports to him. Legislation approved February 25, 1873, extended the duties of the Auditor with reference to inspection and investigation of insurance companies and required the assent of the attorney general before a certificate was issued to a company. On March 31, 1899, an act was passed which repealed earlier laws and created a bureau of insurance with the Governor as insurance commissioner and a deputy commissioner for the actual work. That law was declared unconstitutional because it violated the state constitution relating to taxation. In 1903 the Auditor was empowered to appoint an insurance deputy. The Legislature of 1913 repealed existing insurance laws and enacted a complete insurance code. That code provided that the Governor, Auditor and Attorney General should constitute the State Insurance Board and appoint a secretary to be known as an insurance commissioner. The duties of the Insurance Board were given to a Bureau of Insurance in the Department of Trade and Commerce by the Civil Administrative Code of 1919. The bureau was made the Department of Insurance in 1933. The laws were revised in 1947. Presently the Department of Insurance regulates and examines insurance companies including licensing and examination of agents, foreign insurer admittance; periodic examination of companies; automobile, property and liability rate approval; policy form approval; rating and claims practice investigations; and complaint investigations. The department is divided into ten divisions: Financial Examination, Market Conduct Examination; Legal; Property and Liability; Life and Health Insurance; Agents Licensing; Consumer Affairs; Office Services; Insurance Fraud Prevention; and Medical Professional Liability. DEPARTMENT OF INSURANCE 2 The Fire commission, since 1974 a function of the State Fire Marshal’s office, was created by the Legislature April 3, 1909. Its duties were transferred in 1919 to the Division of Fire Prevention in the Department of Trade and Commerce. In 1933 it became a division of the Department of Insurance. The division of Fire Prevention of the Department of Insurance was funded by fire insurance companies operating in the state, and was responsible for the investigation of fires and inspection of buildings for the prevention of fires. SCOPE AND CONTENT NOTE This collection is arranged into six subgroups: 1) Administration; 2) Insurance Company Files, 1883-1985; 3) Licensing and Certificates of Authority; 4) Division of Fire Prevention, 1910- 1966; 5) Rules and Regulations, 1944-1965; and 6) Annual Reports of the Department of Insurance. The company files of Subgroup Two include are arranged into two Series: 1) Company files, 1883-1985; and 2) Annual Statements, 1883- 1933. Series One includes correspondence, constitutions, by-laws, rules and regulations, reports to the Department of Insurance, incorporation documents, dissolution records and court proceedings relating to each individual company. Series Two of this subgroup includes annual financial statements of insurance companies, 1883- 1933. Starting with 1934, the annual statements were microfilmed by the Department and originals are no longer accessioned by the Archives. The Annual statements indicate the condition and affairs of each company doing business in Nebraska. Information relating to capital stock, income, receipts and disbursements, assets, liability, etc. are included in the reports. Included are summaries of all mortgages owned, lands, stocks and real estate owned, losses and claims paid, etc. The dates of incorporation and commencement of business and the addresses of various insurance companies home offices can be gleaned from these reports. Also, company officers, directors and trustees are recorded. Subgroup Three, Licensing and Certificates of Authority registers insurance companies authorized to transact insurance business in Nebraska as well as the type of insurance sanctioned, i.e. liability, life, burglary, etc. The Fire Prevention Subgroup contains information on the Fire Commission law, 1910-1911; Annual Reports, 1911-1966; and a Proclamation of the Governor, October 1922.
