Since the late 1940s, Australia’s involvement in activities in the orbital space environment has been framed largely by national security considerations. Space activities are the heart of Australia’s alliance with the United States and have provided Australia insights into global space activities not available to other small and middle powers. An economic development narrative, which has been poorly articulated over many years, also exists. Persistent calls by industry advocates and enthusiasts for a succession of Australian Governments to invest in a civil and commercial space industry have largely been ignored. The Australian Space Agency was established in 2018 with an economic rationale based on figures that are weak and ill-defined. The agency has been established, ostensibly, to encourage private investment in a domestic space industry that may come to represent about 1% of the global space industry. A domestic space industry is not essential to the dominant security narrative, but is dependent on assured and secure access to services and data that satellites provide. Orbital space is a profoundly dual-use environment in which military and non-military payloads share orbits and technologies. Commercial interests, with proposals to launch very large constellations into Low Earth Orbit, are challenging the paradigm that space activity is the almost exclusive preserve of nation states. To ensure ready access to orbital space in the future, the international community - including Australia - must deal with a range of threats including that of space debris in the Low Earth Orbits (LEO). The Space Agency could become Australia’s lead organisation for space security matters, helping to protect economies, national and global, that are increasingly reliant on secure and assured access to the services provided by satellites. The thesis focusses on the period from November 2007 to the end of March 2019. The evidence from this period appears to support the hypothesis that Australia is obligated to invest in the security of the orbital space environment. ISSN 0035-9173/20/010046-12 Sixty years of Australia in space Kerrie Dougherty Space Humanities Department, International Space University, Strasbourg, France Email: [email protected] Abstract Australia’s involvement in space activities commenced in 1957, at the beginning of the Space Age, with space tracking and sounding rocket launches at Woomera. By 1960, Australia was considered one of the leading space-active nations and in 1967 became one of the earliest countries to launch its own satellite. Yet by 1980, Australia’s space prominence had dwindled, with the country lacking both a national space agency and a coherent national space policy. Despite attempts in the latter part of the 1980s to develop an Australian space industry, the lack of a coherent and consistent national space policy and an effective co-ordinating body, left Australia constantly “punching below its weight” in global space activities until the Twenty First Century. This paper will briefly examine the often-contradictory history of Australian space activities from 1957 to the announcement of the Australian Space Agency in 2017, providing background and context for the later papers in this issue. Background IPAN has emerged from the wider peace movement and, according to its website – www.ipan.org.au – is “a network of organisations from all regions of Australia who are united by our support for an independent Australian foreign policy based on peaceful resolution of conflict”. At its first AGM, held in July 2015 and attended by 40 groups, a Brisbane Declaration affirmed: Australia urgently needs an independent foreign policy that de-escalates regional tensions. Australia’s alliance with the USA should be re-assessed in view of US adventurism and drawing Australia into its strategic plans. The US ‘pivot’ to Asia/Pacific increases the likelihood of war. The Australian Government unfettered level of military spending is to be deplored. We will build links with peace movements in our region.

There is an urgent need for a legal environment for orderly performance and growth of space sector not only because of the interest shown by private sector but also because space activities need participation from private sector agencies as well. Objective To promote and regulate the space activities of India by encouraging the participation of non-governmental/private sector agencies under the guidance and authorisation of the government through the Department of Space. Legal Provisions Internationally, the outer space activities are governed by treaties and principles evolved under UN Committee on Peaceful Uses of Outer Space (UNCOPUOS). The Committee on the Peaceful Uses of Outer Space (COPUOS) was set up by the UN General Assembly in 1959 to govern the exploration and use of space for the benefit of all humanity: for peace, security and development. India is also a party to the Outer Space Treaty, 1967. Constitution of India provides for implementation of international treaty obligations, vide Articles 51 and 253. The "space" as a subject is not mentioned in the Union List. However, Parliament retains residuary legislative power in respect of "any matter not enumerated" in any of the three lists. Currently, space activities are regulated by policies like Satellite Communication Policy, 2000 and Remote Sensing Data Policy, 2011. 1/2 Background The lack of independent private participation in space is because of absence of a framework to provide transparency, timelines on licensing, issuance of authorisation and continuous supervision mechanism (in accordance with the Outer Space Treaty), among others.
