Summary Draft Resettlement Plan

1. Introduction

The Integrated Ecosystem Management and Environmental Protection of the Baiyangdian Lake Catchment Project comprises seven categories including 22 subprojects: (i) wastewater treatment (13 subprojects); (ii) water supply (3 subprojects); (iii) reforestation (2 subprojects); (iv) water resources reallocation (1 subproject); (v) watershed rehabilitation (1 subproject); (vi) clean energy (1 subproject) and (vii) flood control (1 subproject).

Among the 22 subprojects, there are 17 subprojects involving some land acquisition and resettlement impacts. The IAs, with the assistance from design institutes, have prepared 3 full resettlement plans (RPs) and 14 short resettlement plans (RPs), which have been prepared based on ADB procedures and requirements. Table 2.1 provides more details. All affected persons (APs) will be eligible for compensation and assistance. The Municipal Government issued an announcement about the eligibility cut-off date for compensation and assistance, which is effective as of 31st March,2007. Once the detailed drawing of each subproject is finalized, the RPs will be updated if necessary to reflect any design changes.

2. Policy and Legal Framework

The legal framework and policies that have been used for the preparation of the resettlement plans for the Project include the following:

Having consulted local governments and affected persons, the project implementing agencies (IAs) adopted a set of compensation standards based on the replacement cost and general practice in the project districts and counties. The resettlement principles established for the Project are:

- Involuntary resettlement should be avoided or minimized where feasible; - Compensation and entitlements provided for the APs should be able to at least maintain, or improve their “pre-project” standard of living; - No matter whether they have legal entitlements will All APs be compensated and assisted; - Where land per capita after land acquisition is not sufficient to maintain livelihood, compensation by cash or through land replacement and other income-generating activities will provided for; - All APs will be adequately informed on eligibility, compensation mode and standards, livelihood and income restoration plans, project timing, and will be involved in RP implementation; - No land acquisition will take place unless replacement land or sufficient compensation are given to APs; - The EA and independent/ third party will monitor compensation and resettlement operations; - Vulnerable groups will receive special assistance or treatment to ensure then to better off. APs should have the opportunities to benefit from the Project; - RP should be combined with overall county/city/district planning; - RP budget should be adequate and cover full aspects.

For land acquisition, land compensation fee will be paid to the affected village committees and village committees will choose the best way to use the compensation fee through discussion with APs and the other villagers. The resettlement subsidies due to land loss will be paid directly to affected households. Compensation for young crops, auxiliaries, and other assets will be paid directly to their owners. Compensation for the loss of residential housing and enterprises will be paid directly to the owners and will be based on the agreements signed with them as provided in the component RPs. The payments will be made in cash according to the appraised value of the property.

3. Resettlement Impacts

Local officials, affected village leaders and APs were closely consulted during the feasibility study stage in order to try to avoid or minimize land acquisition and resettlement through scheme selection, and the optimized option among the alternatives was recommended.

The proposed Project will affect 41 villages in 1 development zone, 3 county-levelled cities and 11 counties of Baoding Municipality (see Table 3.1). In total, 4,508 persons in 1,042 households will be affected directly by land acquisition and/or house demolition, and 4,397.8 mu of land, of which 1,070.26 mu is classified as cultivated land, will be permanently requisitioned. Among the permanently requisitioned land, 867.135mu is basic farmland. In addition, 2,166.742 mu of land will be occupied temporarily during the - D-0-3 - construction phase. Houses to be demolished as individual residential building will be 2,299.08 m2. Nine Enterprises will be affected with house demolition of 2,783.44m2.

- D-0-8 - 4. Five Subprojects Without Land Acquisition and Resettlement

4.1 Anxin County WWTP II

An on-site review was conducted and the land use certificate was examined. Anxin county WWTP II is an extension project on basis of WWTP I. And WWTP I was completed in 2005 with land acquisition of 105 mu completed in 2002, and the land was an earth borrow pit for a brickyard, which had been closed for 8 years. Compensation was paid to Zhongliu village and there are no complaints. Moreover farmers have benefited from the use of treated water for irrigation and the current WWTP I employs 12 staff including local people for security and maintenance. There are no remaining problems with land acquisition and resettlement for WWTP I. The present sewage-collection system can meet the requirement of WWTP II, the construction of extended WWTP is on the acquired land, and the drainage system of treated water is the same as WWTP I, so there is no resettlement required, and there are no directly affected persons. There seems to be no other problems with the land use. After reviewing the environmental and socioeconomic benefit the component will create, the conclusions are that there will be no risk associated with this component. Please see Figure 3-1.

4.2 Wenquancheng WWTP

Wenquancheng is a county-status special area directly under BMG, it was established in 1992 through requisitioning wasteland from Xiong County, and Anxin County and currently it is developing. The land WWTP will acquire is still wasteland and state-owned. And there are no infrastructures and ground attachments on the land. So the subproject will not result in negative impacts to locals. After reviewing the environmental and socioeconomic benefit the component will create, the conclusions are that there will no risk associated with this component. Please see Figure 3-2.

4.3 Dingzhou City Water Supply Project

An on-site review was conducted and the land use certificate was examined. The water supply company acquired 56.39 mu in 1994 where there are 13 wells, of which 4 wells are being used currently. In this project, water supply volume is designed to increase from 11,000 m3/d to 50,000 m3/d, another 6 wells of the existing ones will be used. The project will use 33.15 mu within the company’s site for the water collection project, water transmission project, water distribution project, electric supply and distribution project, automatic control system and relevant auxiliary project. The land used by water distribution pipelines upgrading project is along the roadside. The pipeline network will temporarily disturb some households and shops along the road. The implementation agency will take effective measures to avoid and minimize the disturbance. Therefore there is no resettlement required, and there are no directly affected persons. There seems to be no other problems with the land use. After reviewing the environmental and socioeconomic benefit the component will create, the conclusions are that there will be limited or no risk associated with this component. Please see Figure 3-3 and Figure 3-4.

4.4 Reforestation for Angezhuang Reservoir

The subproject involves 18,466.7 ha, containing artificial planting, mountain closure and attached projects. The land involved is collective-owned mountainous area. Currently, 30% of the land is undeveloped and 70% of contracted by farmers to plant ecological and economic trees. When the farmers singed the contract for artificial tree planting, the Yi County Forest Bureau has signed an agreement with them on the species composition and the agreement is still valid during the project and even after the project, so there are no adverse impacts to farmers. After reviewing the environmental and socioeconomic benefit the component will create, the conclusions are that there will be no land acquisition or income loss from the subproject. Please see Figure 3-5 and Figure 3-6.

4.5 Baiyangdian Lakeside Reforestation

The land the reforestation subproject acquires is along the Baiyangdian dykes, which is state-owned and managed by Anxin County Water Conservancy Bureau. According to Flood Control Law of PRC, it is banned for anyone to construct any buildings and constructions irrelevant with flood control within flood control area, so there are no structures and personal assets in the affected area. And under the management of Anxin County Water Conservancy Bureau, it is also not allowed to plant crops in the affected area. There seems to be no other problems with the land use. After reviewing the environmental and socioeconomic benefit the component will create, the conclusions are that there will be no risk associated with this component. Please see Figure 3-7 and Figure 3-8.

5. Resettlement and Rehabilitation

To minimize the resettlement impacts on APs and restore their living standards, detailed programs of restoration and relocation have been included in the RPs. APs can choose the program that suits their requirements.

Different schemes for income restoration will be carried out according to the economic characteristics of the affected villages. As to land acquisition, most households in the affected villages are living in the fringe areas of affected municipality/zone/city/county/township, where the persons are only partially engaged in agricultural activities, and family members earn their incomes through outwork or other activities that often contribute the greater portion of their income. The main income restoration strategies and measures are cash compensation, provision of employment opportunities during project construction and operation, and provision of training and employment information. Contracts will be signed with the village committees and APs to confirm the APs’ acceptance of the use of funds and the proposals. Through these measures, the APs should earn stable incomes that fully restore their living standards.

Compensation for housing and other structures demolished will be at replacement cost. Displaced persons will have the options to purchase residential houses, get a replacement house, or rebuild their houses on housing plots provided for them without charge.

In addition, more attention will be paid to the compensation and rehabilitation of vulnerable groups.

6. Resettlement Cost and Fund Management

Land acquisition and resettlement are estimated to total CNY 378.84722 million (18.69% of the total project investment), including contingencies, taxes, and fees. This land acquisition and resettlement cost will be part of the project cost and will be funded by Baoding Municipal Finance Bureau. The RPs for the 17 sub-projects all contain a detailed budget and a compensation entitlement matrix. Compensation funds will be paid and used according to the compensation policies and standards defined in the RPs, under the supervision of the internal monitoring agencies and regular review by the external monitoring agency. Detailed measurement surveys will be conducted in each affected village and enterprises, and the compensation contracts will be negotiated and signed with the village committees, households and enterprises owners.

- D-0-12 - 7. Information Disclosure, Participation and Grievance Procedures

The APs were fully consulted and informed during the preparation of the RPs. Local representatives participated in planning meetings, interviews, focus group discussions, public consultation workshops, and community consultations, and their comments and concerns were integrated into the RPs. Most of the RPs were distributed to the affected districts and villages in Dec. 2006, and the resettlement information booklets were also disseminated to the APs in Dec. 2006. In accordance with ADB’s Public Communications Policy, the draft RPs will be posted on the ADB Web site in June, 2007 before loan appraisal. The project IAs will set up project resettlement agencies to supervise implementation, continue the public consultations, monitor progress, and deal with grievances. The grievance redress procedures are well established; they are explained in the resettlement plans and referred to in the resettlement information booklets.

8. Institutional Responsibilities

The Baoding Project Management Office (BPMO) for the Integrated Ecosystem Management and Environmental Protection of the Baiyangdian Lake Catchment Project will be retained for the proposed Project and will also assume the overall responsibility for resettlement. The IAs for the project components will take charge of resettlement compensation payment and supervision as part of their functions. The BPMO will coordinate the planning, implementation, financing, and reporting of land acquisition and resettlement.

9. Monitoring and Evaluation

RP implementation will be subject to internal and external monitoring, as described in the RPs. The IAs will supervise the implementation and monitor the progress quarterly to ensure compliance with the provisions of the RP. Each resettlement agency within the IAs, will undergo capacity building during the resettlement; the resettlement staff training programs and budgets are included in the RPs. BPMO will hire an independent agency for semi-annual monitoring during the resettlement implementation and annual evaluation of land acquisition and resettlement activities until 2 years after the completion of land acquisition and resettlement. External monitoring reports will be forwarded directly to both the BPMO and ADB.

10. Resettlement Supervision Milestones

The resettlement implementation schedule is based on the individual sub-project preparation and construction timetable. Under this schedule, before land acquisition, the detailed land acquisition plan and agreements required under PRC regulations will be approved by local land administration agencies, which are accepted by the APs. If there are any significant changes in land acquisition, resettlement impacts, or entitlement, the RP for that component will be updated to reflect the change, and the changes made will be disclosed to the APs and submitted to ADB for approval before land is acquired or civil works commence. Table 10.1 shows the resettlement supervision milestones.
