I. PROJECT BACKGROUND

1. The proposed Project aims to support Guangxi Zhuang Autonomous Region (GZAR) in the People’s Republic of China (PRC) to strengthen the integration of elderly care and health care to provide continued care for those in need.1 It will be the first project to be supported by international financial institutions for GZAR to strengthen elderly care services in the modality of public–private partnership (PPP) project. The subproject is aligned with the following impacts: integration of elderly care and health care established in GZAR.2 The subproject will have the following outcome: utilization of coordinated health care and elderly care services in GZAR increased.

2. The proposed Project will help GZAR develop an integrated elderly care and health care services through delivering three outputs: (i) Coordinated care services and facilities improved. Building four elderly care facilities in the municipalities of Hezhou and Nanning and a medical facility in Nanning. (ii) Public–private partnership (PPP) model for integrated elderly care and health care service provision developed. One elderly care facility will be built in Hezhou City under the PPP modality. (iii) Management and policy development capacities in promoting the integrated elderly and health care services developed. There are totally 5 subprojects (with 6 elderly care facilities) of which one subproject needs land acquisition. The subproject 2 on Elderly rehabilitation comprehensive nursing home of Nanning traditional Chinese medicine hospital includes development of two facilities, while the other subprojects will include one facility each An overview of the land acquisition and resettlement (LAR) impacts of the Project is presented in Table 1-1.

II. IMPACTS OF LAND ACQUISITION AND RESETTLEMENT

A. Summary of LAR Impacts

3. The land acquisition requirement for the Project is 170.79 mu (11.32 ha), comprising 74.14 mu (4.94 ha) of collectively owned and 95.65 mu (6.44 ha) of state-owned land.

4. 74.14 mu (4.94 ha) of collectively-owned land will be acquired for No.2 Nursing Home Comprehensive Rehabilitation Nursing Institution subproject in Hezhou City (Subproject 4) affecting 56 households in Xiadao village; of them 30 households with 144 persons are affected by land acquisition, 11 households with 88 persons by house demolition, and 15 households with 64 persons by land acquisition and house demolition. Land acquisition impacts are minimal as the households do not depend on land for their income and livelihood. An Resettlement Plan was prepared and will guide compensation calculation, payment, and resettlement assistance to those who were physically displaced.

5. 95.65 mu (6.44 ha) of state-owned land of other have been acquired by the local government more than two years before. At that time, the proposed ADB project was not in the development pipeline of the government.

6. One consolidated DDR was prepared covers Subproject 1, Subproject 2 and Subproject 3 in which land acquisition and resettlement were completed more than 5 years ago. Another separate DDR covers Subproject 5 that completed land acquisition and resettlement during the past 5 years.

7. Please find the project affected population in table 2-1 and summary of LAR impacts in Table 2-2.

8. The subproject site is located at Nanning Social Welfare Center (NSWC) which belongs Nanning Social Welfare Institute (NNSWI). The total area of the NSWC is 74 mu and the proposed ADB subproject will use 47.33 mu of land to reconstruct three elderly care centers after demolishing them. Please find the following figures about the current situation of the project site.

About 219 elderly live in three old buildings at the Nanning Social Welfare Center (NSWC), including 115 poor and government supported elderly persons who do not have family support, and 104 elderly persons who are not supported by the government (including 20 disabled elderly people). They are supported by their families and children. These 3 buildings which belong to the Nanning Social Welfare Institute (NNSWI) will be demolished and the land recovered will be used to reconstruct the nursing home for the elderly under the subproject. As the 3 buildings are very old and unsuitable to use as nursing facilities. The NNSWI noticed the elderly and their families in August 2018 to vacate the premises before the end of June 2019. The NNSWI has conducted a survey and consultations in February 2019 with the resident elderly and their families to ascertain their views and expectations. The survey and consultations revealed that there are 4 options available for the elderly inmates. (i) The 115 poor and government supported elderly persons who do not have family support will be resettled in other buildings within NSWC – at the Cihai Elderly Care Home. As these elderly persons do not have family support, they will continue to receive government subsidies. And they will shift to the new nursing center after project completion again with government subsidies. The subsidies will be directly paid from local finance office to the social welfare center. The elderly will not be required to pay additional fees. As a result, there will be no affordability issue. (ii) The NNSWI will help the 20 elderly persons who are totally disabled to move to a hospital or to a rehabilitation center at NSWC. They can come to the new center or continue to stay at where they moved. As a result, there will be no affordability issue regarding this group of inmates. (iii) Some elderly inmates have chosen to move to the new elderly care centers as the facilities at the existing centers do not meet their needs. The Nanning No.2 Social Welfare Center and the District Social Welfare Center will be completed in June 2019 and they expect to move to the new centers on priority basis without extra cost. (iv) A few elderly inmates plan to move to private sector facilities located close to their homes. Affordability is not an issue.

10. The due diligence and consultations with the elderly residents confirmed that the NNSWI has entered into agreements with all elderly and their families on the need for relocation and their preferred options to relocate. For options (i) and (ii) above which include elderly persons without family support and elderly who are disabled, the proposed relocation will not result in any additional rentals or payments, and they would continue to avail the government subsidies that are currently being provided. The NNSWI has agreed to provide transport facilities and nursing staff during the move to all 219 elderly inmates.

11. The affordability survey on elderly care service at the new nursing facility for the 104 inmates without government subsidies, but supported by their families was conducted by the Nanning Social Welfare Center. It found that: (i) 96% of the interviewed residents hope to come to the new nursing home once it is built. (ii) 41% of them get enough pensions to pay for the elderly care services (ECS) and stated that when the new facility is ready they will return to the new nursing facility on priority basis and will have sufficient funds to pay for ECS without any family or other support. (iii) At present, 38% of the elderly persons’ current pensions are not sufficient to pay fully for ECS. Therefore, they partially depend on their families to top-up the ECS costs. They have to depend partially on their families to pay for ECS in the future too at the new nursing home. Their children have promised that when the new nursing home is ready, they will send their parents to the new nursing facility as they have sufficient incomes to pay extra costs, if any, at the new facility. 21% of elderly persons who fully depend on their families for ECS services. Their children also have promised that when the new nursing home is ready, they would send their parents to the new nursing facility. They have sufficient income to pay for any extra costs at the facility.

12. During the survey, nurses at the center stated that most of the families of the inmates have two children each and all of the them said that they have the financial ability and willingness to pay the costs at the current center and at the new center. The current cost for the ECS ranges from CNY 2000 to CNY 3000 per month and the new center will increase the cost by 30% to 40% of the current price after five years. Then the cost will be about CNY 2600 to CNY 4200 per month per person. According to the related data published by Statistics Bureau of Nanning City, the average wage of employees in Nanning city in 2017 was CNY 5133 and the annual average increase rate is about 10%. It is estimated that the average wage of employees will increase to CNY 8267 in five years which will be sufficient to meet extra cost at the new nursing center. Meanwhile, the pension will also increase every year. In that case, both elderly people have pensions and without pensions could afford the new center.

IV. RESETTLEMENT DUE DILIGENCE OF SUBPROJECT 2

13. The sites of the two facilities proposed in this subproject belong to the Nanning Nursing School (NNNS) before it was relocated to a new site in 2016. After the relocation of the NNNS, the original school and its premises are vacant now. Only 3 staff members the gatekeepers and 2 cleaners are there to take care of the property. The total area of the original school was 31 mu and the proposed ADB subproject will use about 5 mu of land. This land area (5 mu) at present has three old buildings which will soon be demolished. In March 2019, the Nanning government has agreed to allocate 5 mu of land to Nanning Chinese Traditional Medicine Hospital (NNCTMH) to build an elderly care and medical treatment center. The mapping of subproject site has been started and the procedure of state-owned land use right transfer certificate is in progress. The PIE guaranteed to obtain the formal state-owned land use right transfer certificate before any construction action.

14. There are two staff dormitories in the vicinity of the subproject area. No LAR impacts are expected on the dormitories, located about 30 m from the proposed boundary of the subproject site. During construction period, the residents of the dormitories are expected to experience increase noise and dust pollution from construction activities and will be managed through environmental management plan provisions.

V. RESETTLEMENT DUE DILIGENCE REPORT ON SUBPROJECT 3

V.1 Basic information of the Subproject

15. The Hezhou No.1 Nursing Home Subproject is located within the Chengdong Affiliate Hospital of Hezhou People's Hospital in Chengdong District of Hezhou City (east to Binda No.1 Rd., south to Yeda Rd., west to Binda No.2 Rd., and north to Taibai Rd.). Guidong People’s Hospital (Subproject PIE) plans to construct a nursing home with 400 nursing beds for the elders. The planned land area of the subproject is 7098.86 ㎡( 10.64 mu). The buildings in the subproject area are: 1 nursing comprehensive building with 2 basement floors and 12 floors covering 21463.72 ㎡ of building area. 15353.23 ㎡ of built areas are for elderly care services, 498.06 ㎡ are for an office area, and 5612.43 ㎡ that include common area and other infrastructure supporting the building including kitchen and storage areas.

16. The subproject’s executive agency is the Project Management Office for ADB-financed Project (PMO) and the Implementing Agency is Hezhou People's Hospital. Total cost estimate of the subproject is 162.79 million Yuan. The construction period of the subproject is 90 months, i.e. from November 2018 to April 2026.

V.2 Current status of project site

17. The total construction land area of the Hezhou No.1 Nursing Home Project is 10.64 mu which previously belonged to Meiyi Village of Liantang Town of Hezhou City. This land was acquired by the government in 2010 for a five-star hotel project. In 2017, this land was allocated to Hezhou People's Hospital for the construction of No.1 Nursing Home Project. (Please find the state-owned land use right certificate below). Since then the current project site has been used as a temporary dormitory and an office for the construction unit of Hezhou No.1 Hospital.

V.3 Land acquisition review

V.3.1 Implementation agencies

18. Hezhou Municipal Government was responsible for leading, organizing and coordinating all land acquisition and resettlement activities of the subproject including the formulation of resettlement policies and internal resettlement monitoring.

19. Hezhou Natural Resources Administration Bureau was responsible for pre-checking, approving and allocating of land. The LAR office of Babu District was responsible for land acquisition and resettlement. Hezhou People’s Hospital was the applicant for land use for the subproject.

20. The representatives of the affected village - Meiyi Village of Liantang Town of Babu District of Hezhou City - coordinated with LA Office to conduct field investigations and confirmation, discussed the compensation schemes and started land acquisition.

V.3.2 Land acquisition process and procedure

21. Hezhou No.1 Nursing Home Project wanted to acquire 10.64 mu of land of Meiyi Village. The timeline of land acquisition and compensation payment is given below:

22. Hezhou Municipal Government applied to the Provincial Government of Guangxi Zhuang Autonomous Region for permission to use the land in 2009. (Request of Hezhou Municipal Government on 18th Batch of Conversion of Agricultural Land and Land Acquisition in 2009, HZB[2009]160).

23. On February 9, 2010, the Provincial Government of Guangxi Zhuang Autonomous Region approved the request of Hezhou Municipal Government. (Approval of the People’s Government of Guangxi Zhuang Autonomous Region for 18th Batch Urban Construction Land in 2009 of Hezhou City, GZTPH[2010]100).

24. In February 2010, the Land Acquisition and Resettlement working staff conducted baseline survey in Meiyi village of Liantang Town and conducted initial discussion with the affected persons (APs).

25. On March 8, 2010, Hezhou Land Resources Administration Bureau issued the announcement of land acquisition and compensation (Announcement of Hezhou Land Resources Administration Bureau on Land Acquisition and Resettlement Compensation, HGTGG[2010]12).

26. Starting from March 2010, the LAR staff conducted detailed measurement survey (DMS) in Meiyi Village of Liantang Town and disclosed the DMS results.

27. In December 2010, Hezhou Land Resources Administration Bureau signed land acquisition agreements with APs of Meiyi Village, and completed the payment of land compensation.

V.3.3 Land acquisition impact analysis

28. In 2010, the project acquired 10.64 mu of rural collectively-owned land of Meiyi Village of Babu District of Hezhou City, affecting 10 families or 48 persons. No house demolition was involved. V.3.4 Land Acquisition and Compensation

29. Land acquisition for the subproject was done in accordance with the Notice of Hezhou Municipality on Adjusting the Compensation Standards for Land Acquisition and Resettlement for Construction Projects within Urban Planned Areas of Hezhou City, Ref. HZF[2010]45).

30. The municipality assisted the affected families to establish bank accounts and to deposit the compensation and resettlement subsidies into the accounts. The compensations standards for permanent acquisition of collective land for this subproject are shown in Table 4 and Table 5 which were based on the AAOV and its multiplier.

31. The total compensation paid for land acquisition was 544137.24 Yuan. By the end of December 2010, all APs had signed their receipts and received compensation afterwards. Please find compensation details in table 6 shows.

32. The amount of compensation received by the affected villagers varied from CNY2,750 to CNY208,529. The compensation was mostly used in agricultural investment, and some villagers used them to build houses or deposited in banks or invested on business. V 3.5 Complaints and Grievances

33. The subproject established a transparent and effective channel for grievance redress. Hezhou Land Resources Administration Bureau was responsible for explaining to the APs all related issues of land acquisition. It also informed the APs about the appeal procedure to the villagers’ committee, Government of Liantang Town, LAR office of Babu District of Hezhou City, Hezhou Land Resources Administration Bureau, and the procedure of seeking court’s assistance to arbitrate disputes. All resettlement policies and compensation standards had been disclosed to the APs.

34. According to the office records, no grievances or complaints had been received by the authorities. Also, no judicial case related to resettlement had been filed.

V.4 Conclusion

35. The total construction land area of Hezhou No.1 Nursing Home Project financed by ADB is 10.64 mu located in Meiyi Village of Liantang Town of Hezhou City. The land acquisition and compensation payment were implemented in accordance with Notice of Hezhou Municipality on Adjusting the Compensation Standards for Land Acquisition and Resettlement for Construction Projects within Urban Planned Areas of Hezhou City, Ref. HZF[2010]45), a legal document formulated by Hezhou Municipal Government pursuant to Land Administration Law of the People's Republic of China, Methods of Guangxi Zhuang Autonomous Region on Land Administration, as well as the local conditions of Hezhou City. The LAR office of Babu District of Hezhou City completed the land acquisition and compensation activities by the end 2010. All compensations have been paid in full amount and in timely manner to the affected people and the compensation was paid based on the AAOV and its multiplier. There are no pending land acquisition and compensation issues.
