European Parliament – is the voice of the people, directly elected.

Council of Ministers – represents the national interests of 27 governments and decides on foreign policy.

High Representative – decides on foreign policy

European Commission – 27 Commissioners are guardians of the European treaties.

European Council – 27 Heads of State and Government provide strategic guidance under the chairmanship of the President of the .

Here we look at some of the stories that have made the headlines in the UK since the last European Parliament elections in June 2009. We look at people (Joe Biden, , Thabo Mbeki; Paul McCartney); at policy-based stories (bank data transfer; hedge funds; food labelling; working time; industrial emissions); and at petitions dealt with in the European Parliament (bats; sewage; sheep-tagging; vitamin supplements).

PEOPLE

Joe Biden The US Vice-President spoke to the European Parliament’s plenary session in May 2010, almost 25 years to the day since former President Ronald Reagan addressed MEPs to mark the 40th anniversary of the end of World War Two. The Vice-President focused on common challenges facing the USA and the EU, including the financial crisis and the fight against terrorism. One of the contentious issues he addressed was the SWIFT agreement on transferring European bank transaction data to the US (see policies below).

Tony Blair/Thabo Mbeki The European Parliament’s committees regularly invite guests to give evidence as they prepare their legislative reports. Often these are academic experts or representatives from 28

01_2010-5128_EN-text.indd 28 20/01/11 10:59 industry or campaigning bodies. In two cases in the last 12 months, this has involved former heads of government. Tony Blair appeared before the Development Committee in March 2010 to update MEPs on his latest work on the Middle East peace process; also in March 2010, former South African President Thabo Mbeki spoke to the Foreign Affairs Committee in his capacity as chair of the African Union’s panel on Sudan.

Sir Paul McCartney In December 2009, Sir Paul McCartney attended a hearing on climate change and launched his campaign for meat-free Mondays. This is not European Parliament policy and not all MEPs would subscribe to this campaign. But his appearance in Brussels demonstrated how the European Parliament attracts major public figures when itis discussing issues of global importance.

POLICIES

SWIFT – bank data transfer to the USA The SWIFT anti-terrorist agreement on bank data transfers to the USA was blocked by MEPs in a vote in February 2010, due to concerns about data protection and human rights. SWIFT allows US authorities access to bank transactions undertaken by EU citizens who wish to enter the USA. Following February’s vote, MEPs negotiated various safeguards and won an undertaking that the EU will start work in the second half of 2010 on a European data processing system that precludes the need

01_2010-5128_EN-text.indd 29 20/01/11 10:59 to transfer data in bulk to the USA. With these new clauses in place, the European Parliament then approved the overall agreement with the USA in July 2010.

Hedge funds, bank bonuses and financial supervision In the wake of the financial crisis, MEPs have been dealing with a whole raft of legislative proposals affecting the financial services sector. In July 2010, MEPs approved some of the strictest rules in the world on bankers’ bonuses; they also toughened rules on the capital reserves that banks must hold to guard against any risks from their trading activities. In autumn 2010, the European Parliament also took a firm position on regulation of hedge funds and private equity, along with their 1st reading of proposals to overhaul the whole system of supervising the EU’s financial services sector.

Food labelling – red light for traffic light labels A June 2010 vote on a new EU food labelling Regulation followed months of lobbying from all sides: food and retail sectors; consumer groups; women’s groups; farmers. In the end, a majority of MEPs voted against a traffic light labelling system for indicating levels of salt, sugar and fat. Instead, the European Parliament opted for guideline daily amounts, nutrient profiles and tightened up the rules on country- of-origin labelling. This was Parliament’s 1st reading. At the time of writing, negotiations are ongoing with the Council of Ministers on the final text of the new rules.

01_2010-5128_EN-text.indd 30 20/01/11 10:59 Food labelling – no ban on ‘half a dozen eggs’ The same vote on the same legislation led to a second spate of stories, this time alleging that the MEPs’ vote would mean a ban on selling eggs (or bread rolls, fish fingers etc) by the dozen. Sometimes votes on complex legislation lead to different legal interpretations of what was agreed. On this occasion, the European Parliament’s rapporteur German MEP Renate Sommer could not have been clearer: “There will be no changes to selling foods by number. Selling eggs by the dozen, for example, will not be banned”.

Working Time for lorry drivers The Working Time Directive always attracts the UK media’s attention. This time it was the specific directive covering the road transport sector. At issue was whether to include self- employed drivers in the scope of the directive, and in particular whether to make a distinction between genuine and ‘fake’ self-employed (the latter driving for the same employer but under a self-employed regime). MEPs in the plenary in June 2010 voted to include all self- employed drivers on health & safety grounds. This reversed an earlier committee stage vote from September 2009, showing how delicately balanced the politics of the European Parliament can be.

Industrial emissions – power stations to pig farms Large combustion plants (including fossil fuel power stations) will have until July 2020 to

(Some older plants may not even have to meet the targets at all, as long as they close by the end of 2023). The new Industrial Emissions Directive brings in tougher limits for air pollution; it will cover large combustion plants and around 52,000 industrial and agricultural installations with a high pollution potential, from refineries to pig farms.

PETITIONS

The work of Parliament’s Petitions Committee is a great source of stories, especially in local media.

Local campaigns: Since July 2009, the Petitions Committee has received evidence from a wide range of local campaigns, including: bats’ habitats in Bath and Radstock; sewage treatment in Chepstow; and the closure of Sheffield Airport.

National campaigns: Two national campaigns have appeared before the Petitions Committee in the last year raising problems with the implementation of existing EU laws on: sheep- tagging; and vitamins/mineral supplements.

Personal cases: Individuals affected by Spanish urban development laws have continued their campaign; as have many individuals with claims on access to benefits or pensions in another EU Member State and other free movement questions.

What is the budget of the European Parliament?

The budget for the European Parliament in 2010 was €1.61bn. This covered staff costs, buildings, MEP travel allowances and expenses, and included the costs of translating documents into the EU’s 23 working languages. It also included the cost of moving MEPs and staff between Brussels and Strasbourg.

Why does the EP have 3 homes and what does it cost to go to Strasbourg every month?

The EU Treaty stipulates that the European Parliament shall meet in Strasbourg. With parliamentary committees – and some sessions of the full parliament – meeting in Brussels, and with part of its staff working in Luxembourg, Parliament currently has three homes. Most UK MEPs oppose this situation but unless there is a change to the Treaty, there is nothing MEPs can do about it.

The additional cost of dividing the Parliament’s business between Brussels and Strasbourg amounts to about €10m for each of the 12 plenary sessions a year held in Strasbourg.

A new Statute for Members of the European Parliament came into effect following the last European Parliament elections in June 2009. The Statute sets the monthly salary for all MEPs at 38.5% of the basic salary of a Judge in the European Court of Justice (ie about €7,800), ending the pay disparities between Members, who previously received the same salaries as members of their national parliaments.

Under the new system, MEPs’ salaries are paid by the EU. They pay income tax to the EU budget plus, in the case of UK MEPs, additional taxation to HMRC so that they pay the same level of taxation overall as any other UK resident on that pay scale.

When the new Statute was introduced, MEPs had the option to stay on the old system, whereby MEPs earn the same basic salary as a backbench member of the House of Commons (£65,738 in 2010). A number of MEPs from the UK chose to retain the former salary system.

As well as travel expenses for attending official meetings of the Parliament and its committees, MEPs are entitled to a number of allowances to cover the costs of office administration and support staff. Under a reform of the Parliament’s expenses system in 2009, MEPs’ travel expenses are no longer refunded on a flat-rate basis. Instead, all MEPs now have their expenses reimbursed on the basis of actual costs incurred. 34

The European Parliament at present employs around 700 full time translators and 430 staff interpreters.

18 new MEPs – but when?

The European Parliament will gain a further 18 Members under the Lisbon Treaty. These new MEPs will come from 12 different Member States, one of them being from the UK. Germany will lose 3 seats under the Treaty, but this will only take effect after the 2014 European elections.

The increase in the total number of MEPs to more than 751 means a Treaty change is required (called a Transitional Protocol). All 27 Member States must ratify the Treaty change before the increase take effect.

The UK government asked the Electoral Commission to recommend which of the

01_2010-5128_EN-text.indd 36 20/01/11 10:59 12 UK electoral regions should be given the additional seat, ensuring that the ratio of electors to MEPs is as uniform as possible. On 26 October 2010 the Electoral Commission recommended that the extra seat should be allocated to the West Midlands region.

The government will implement this recommendation in the forthcoming European Union Bill.

The seat will be filled by reference to the election results in the West Midlands region at the June 2009 European parliamentary elections as if the extra seat had been available in those elections. Based on the valid votes cast that day, the Conservatives will get the extra seat.

Even after the Bill has come into force, the extra UK MEP, as well as the other 17 new MEPs from the rest of the EU, will only be able to take up their activities once all the Member States have ratified the Transitional Protocol and all the 12 Member States affected have completed the relevant procedures.

Summary of the electoral system in the UK for European Parliament elections

A system of proportional representation for the European elections was introduced in the United Kingdom in 1999.

• There are 12 regional constituencies, which return from 3 to 10 MEPs.

• Ballot papers contain the names of all candidates, listed by party.

• Seats are allocated to parties in accordance with their share of the total vote in the constituency (with the exception of Northern Ireland – see below: How to Become an MEP).

• Within the parties, seats are allocated in the order shown on the list.

For , Scotland and Wales, the nomination of candidates and placing them in order on the list is a matter for the political party concerned. (This is known as the closed-list system; an open list, or preferential, system allows the voter a say over the order of candidates within each list.) Each party has its own internal selection procedure.

Northern Ireland, like the , uses the system.

Anyone wishing to form a new party (which must be registered with the Electoral Commission), or to stand as an independent candidate, needs to contact the electoral office of the local council. Nominations have to be accompanied by a deposit of £5000 (per list, or per individual candidate). This deposit is refundable to those polling at least 2.5% of the vote in that region.

Where an MEP resigns or dies in mid-term, the next person on that political party’s list from that electoral region is invited to take up the seat. For Northern Ireland a new Statutory Instrument was published in March 2010 (Number 1175) to clarify when a political party can nominate the replacement MEP and when a by-election would be needed.

• It is not possible to be a member of a national parliament at the same time as being an MEP – so when was elected to the House of Commons in May 2010, she automatically gave up her seat in the European Parliament.

• It is illegal to stand for the European Parliament in more than one member state (although it is possible for a UK citizen to stand in another EU member state and for a non-UK EU citizen to stand in the UK).

• EU citizens who are disqualified from standing under their own national rules may not stand in the UK (this applies, for example, to police officers in Hungary, to TV directors in Spain, and bank directors in Austria, but does not apply to Ireland or Commonwealth countries).

• European elections: Citizens of all European Union countries are entitled to vote in European Elections in another EU country provided they are resident in that country. This applies to UK citizens living in another EU country and vice-versa. Citizens may only vote once, however.

• Local elections: For local elections, the same rules apply – an EU national resident in the UK who applies to go on the electoral register may vote in UK local elections; a UK national resident in another EU country can register to vote in local elections in that country.

• General elections: For general elections, EU nationals resident in the UK are not entitled to vote. The exceptions to this are Irish nationals and citizens of EU member states which are also Commonwealth countries: ie Malta and Cyprus.
