Friday, 4 June 2021] 98 No 20 – 2021] THIRD SESSION, SIXTH PARLIAMENT REPUBLIC OF SOUTH AFRICA MINUTES OF PROCEEDINGS OF NATIONAL ASSEMBLY FRIDAY, 4 JUNE 2021 1. The House met at 10:00. 2. The Deputy Speaker took the Chair and requested members to observe a moment of silence for prayer or meditation. 3. [10:02] The Deputy Chief Whip of the Majority Party, on behalf of the Chief Whip of the Majority Party, moved: That the House – (1) notes that on 25 July 2019, an Ad Hoc Committee to initiate and introduce legislation amending section 25 of the Constitution was established and mandated to complete its work and report to the House by 31 March 2020; (2) further notes that the committee has had several extensions to its deadline for reporting to the Assembly, with the latest being 31 May 2021, but ceased to exist before it could complete and report on its mandate; (3) re-establishes the Ad Hoc to initiate and introduce legislation amending section 25 of the Constitution with the same composition, mandate and powers as its predecessor (Minutes of Proceedings, 25 July 2019, p 68); (4) instructs the Committee to incorporate in its work the proceedings and all the work of the previous committee up to and including 31 May 2021; and (5) sets the deadline by which the Committee is to report to 30 August 2021. FIRST ORDER [10:05] Consideration of Report of Portfolio Committee on Home Affairs on Draft notice determining remuneration of Commissioners of Electoral Commission of South Africa (IEC) for 2020/21 (Announcements, Tablings and Committee Reports, 2 June 2021, p 9). Mr M S Chabane, as a member of the Committee, introduced the Report. There was no debate. Declarations of vote made on behalf of the Democratic Alliance, Economic Freedom Fighters, Inkatha Freedom Party, Freedom Front Plus, African Christian Democratic Party, United Democratic Movement, Good, National Freedom Party, African Independent Congress, Pan Africanist Congress and African National Congress. Report adopted and Draft Notice determining remuneration of Commissioners of Electoral Commission of South Africa (IEC) for 2020/21 accordingly approved. 5. SECOND ORDER [10:23] Consideration of Report of Portfolio Committee on Communications on Draft notice determining remuneration of councillors of Independent Communications Authority of South Africa (ICASA) (Announcements, Tablings and Committee Reports, 2 June 2021, p 45). Mr B M Maneli, as Chairperson of the Committee, introduced the Report. There was no debate. Declarations of vote made on behalf of the Economic Freedom Fighters, Inkatha Freedom Party, Democratic Alliance, Freedom Front Plus, African Christian Democratic Party, Good, National Freedom Party and African National Congress. Report adopted and Draft notice determining remuneration of councillors of Independent Communications Authority of South Africa (ICASA) accordingly approved. 6. THIRD ORDER [10:43] Consideration of Report of Standing Committee on Appropriations on Special Appropriation Bill [B 5 – 2021] (Announcements, Tablings and Committee Reports, 1 June 2021, p 48). FOURTH ORDER [10:44] First Reading debate – Special Appropriation Bill [B 5 – 2021] (National Assembly – proposed sec 77). BUSINESS SUSPENDED DUE TO TECHNICAL ERROR AT 10:52 AND RESUMED AT 10:58. Debate concluded. Bill accordingly read a first time (Democratic Alliance, Economic Freedom Fighters, Inkatha Freedom Party, African Christian Democratic Party and Freedom Front Plus dissenting). 8. FIFTH ORDER [11:46] Second Reading – Special Appropriation Bill [B 5 – 2021] (National Assembly – proposed sec 77). There was no debate. Question put: That the Bill be read a second time. Division demanded. The House divided. The Deputy Speaker announced that, the Speaker had determined that, in accordance with the Rules, a manual voting procedure would be used and that the whips would conduct a headcount of members in the chamber and on the virtual platform for the purpose of ascertaining quorum and voting. A quorum being present in terms of Rule 98(1), voting commenced. AYES – 205: (ANC – 201; Good – 1; NFP - 2; Al Jama-ah - 1). NOES – 136: (DA - 76; EFF - 37; IFP – 9; FF Plus - 10; ACDP – 4).
