Writing this thesis at the LSE has been an adventure and the greatest privilege. 5 Abstract: The thesis analyses the conditioning factors of Canada’s and Japan’s bargaining power in the multilateral trade negotiations of the Uruguay Round and Doha Development Agenda (DDA). It deals with two related research questions. The central question of this research is: to what extent and why did Canada’s and Japan’s bargaining power decrease from the Uruguay Round to the DDA? This question is related to the following auxiliary research question: what are the conditioning factors of Canada’s and Japan’s bargaining power during the Uruguay Round and DDA, and to what extent have these factors changed from one round to the other? While the thesis includes a general overview of their negotiation profiles, it analyzes specific, detailed case studies of the profiles of these countries in anti-dumping and market access/NAMA negotiations in both rounds. The hypothesis of this research is that Japan and Canada have lost bargaining power from the Uruguay Round to the DDA because of changes in the following conditioning factors: economic power; activity in country coalitions and groups; interests groups and decision-making structures on the domestic level; ideational power; and foreign policy objectives. In addition, the importance of the position of the preferences a country in the spectrum of the overall membership of multilateral trade negotiations is examined. The thesis finds that this hypothesis is partially confirmed. Canada and Japan have mainly lost bargaining power owing to a relative decrease in their economic power, a lower profile in central negotiation groups as well as coalitions, and due to domestic politics. Ideational power and especially foreign policy objectives can be considered less relevant.     August 20, 2012 Prepared: NGO Network for the Elimination of Racial Discrimination (ERD Net) Submitted: The International Movement Against All Forms of Discrimination and Racism – Japan Committee – IMADR-JC To the CERD Secretariat: We are pleased to submit the report concerning the hate speech against minority communities in Japan hoping that this could contribute to the CERD thematic discussion on hate speech of August 30, 2012. The report covers the propaganda of hate speech and dissemination of derogatory messages against some minority communities in Japan, namely Buraku, Zainichi Koreans and migrants. The present report does not cover the other minority communities such as Ryukyu-Okinawans and the Ainu, but we believe that a similar manifestation would be demonstrated against them when they face the challenge of hate speech. When we discuss about the hate speech in Japan, it is nothing but only a problem under no control. The main reasons rest with the absence of criminal code that prohibits and sanctions racist hate speech. Unless a committed hate speech has some connections or implications to other crimes, there is no legal means that forces an immediate halt of such act. Hate speech could constitute an illegal act under the civil law and only when it is aimed at specific individuals. As indicated in several cases contained in this report, perpetrators of hate speech have been arrested, charged and convicted for the crimes of defamation, forgery of private documents, damage to property, and etc. that are not intended to sanction hate speech. Racially motivated acts are only sanctioned as petty crimes under the present law in Japan, thus, conviction of such acts is less effective in terms of prevention of crimes.

    SPAIN.DOC 11/23/2010 3:49 PM INTEGRATION MATTERS: RETHINKING THE ARCHITECTURE OF INTERNATIONAL DISPUTE RESOLUTION ANNA SPAIN* ABSTRACT International law promotes global peace and security by providing mechanisms for the pacific settlement of international disputes. This Article examines these mechanisms and their place in the architecture of the international dispute resolution (“IDR”) system. The Article identifies three core deficiencies of the IDR system that limit its effectiveness and capacity. First, the international legal system has prioritized the development of adjudication over other forms of dispute resolution; the judicialization of international disputes and the proliferation of courts and tribunals evidence this. However, adjudication is limited in its capacity to resolve disputes that involve non-state parties and extra-legal issues. This is concerning because empirical studies show that international conflict is increasingly intra-state, and involves non-state actors and extra-legal issues. Second, states prefer mediation to adjudication as a method for resolving disputes that occur in the context of inter-state conflict. Yet the role and value of mediation have been underappreciated, and it lacks institutional support under international law. Third, the current architecture of the IDR system promotes single method approaches, which can foster fragmented IDR approaches that separate legal issues from extra-legal ones, despite their interconnected nature. Institutions provide the incentive structure of an economy; as that structure evolves, it shapes the direction of economic change towards growth, stagnation, or decline. Douglass C. North “Institutions” (1991) Introduction In a happy coincidence of theory and practice, Douglass North wrote his seminal essay on “Institutions” at almost precisely the same time that the WTO was first proposed. “Institutions are the humanly devised constraints that structure political, economic and social interaction,” he wrote (1991: 97), and “consist of both informal constraints (sanctions, taboos, customs, traditions, and codes of conduct), and formal rules (constitutions, laws, property rights)” that CHAPTER 14 human beings have devised throughout history “to create order and reduce uncertainty in exchange.” That is as good a definition as any of the purposes of the WTO, which may be further distinguished according to its two halves. The WTO is at once an institution staffed by international civil servants and an organization to which members belong. While it is the organizational half of the WTO that is chiefly responsible for writing new rules, the institutional half not only facilitates those negotiations but also administers agreements, monitors the members’ compliance with the rules, and promotes the capacity of the developing members to participate more effectively in the organization and to take advantage of the opportunities that a more open market affords.

    20 Years After JNR Privatization ○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○○ Kazuhiko Tezuka The Railway Technical Research Institute (RTRI) assumed responsibility for the research and development (R&D) activities previously conducted by Japanese National Railways (JNR). It conducts R&D in a variety of fields, including structures, rolling stock, electrical power, signal communication, environment, energy, and human sciences. The institute has contributed to the development of the JR group of companies and railways in Japan in general by achieving success with a range of projects, including maglev, increasing the speed of shinkansen and conventional trains in harmony with the environment, strengthening ground equipment, reducing maintenance costs and taking measures to prevent accidents and natural disasters.
