    How serious is the international community of states about human rights standards for business? commentary by Miriam Saage-Maaβ Vice Legal Director & coordinator of Business & Human Rights program European Center for Constitutional and Human Rights July 2012 Recent developments have shown one more time that the struggle for human rights is not only about the creation of international standards so that the rule of law may prevail. The struggle for human rights is also a struggle between different economic and political interests, and it is a question of power which interests prevail. 2011 was an important year for the development of standards in the field of business and human rights. In May 2011 the OECD member states approved a revised version of the OECD Guidelines for Multinational Enterprises, introducing a new human rights chapter. Only a month later the United Nations Human Rights Council (UNHRC) endorsed by consensus the UN Guiding Principles on Business and Human Rights.1 These two international documents are both designed to provide a global standard for preventing and addressing the risk of business-related human rights violations. In particular, the UN Guiding Principles focus on the “State Duty to Protect” and the “Corporate Responsibility to Respect” in addition to the “Access to Remedy” principle. This principle seeks to ensure that when people are harmed by business activity, there is both adequate accountability and effective redress, both judicial and non-judicial. Der Deutsche Bundestag stellt fest: Die Anwendung des § 25 des Aufenthaltsgesetzes (AufenthG) durch die Länder steht nicht in Einklang mit dem Ziel des Gesetzgebers, die Kettenduldungen ab- zuschaffen. II. Der Bundestag fordert die Bundesregierung daher auf, folgende Maßnahmen zu treffen: 1. Die Bundesregierung sorgt gegenüber den Bundesländern bis Ende März 2006 für eine Klarstellung in den vorläufigen Anwendungshinweisen des Bundesministeriums des Innern, die dem Ziel des Gesetzgebers entspricht. Hierin sind insbesondere die Zumutbarkeit einer Ausreise sowie die beson- dere Situation in Deutschland aufgewachsener Kinder und Jugendlicher zu berücksichtigen. 2. Die Bundesregierung legt dem Deutschen Bundestag zeitnah einen Gesetz- entwurf zur Änderung von § 25 Abs. 5 AufenthG vor, der der Intention des Gesetzgebers gerecht wird, wenn auf dem vorgenannten Weg keine Ände- rung der Praxis der Bundesländer zu erreichen ist.     Materials of the President's Personal File Among Nixon Presidential Materials, 1969-74 The Presidential historical materials of the President's Personal File are in the custody of the National Archives and Records Administration under the provisions of Title I of the Presidential Recordings and Materials Preservation Act of 1974 (P.L. 93-526, 88 Stat. 1695) and implementing regulations. In accordance with the act and regulations, archiv1sts reviewed the file group to identify personal and private materials (including materials outside the date span covered by the act) as well as non-historical items. These materials have been returned to former President Richard M. Nixon or the individual who has primary proprietary interest. Materials covered by the act have been archivally processed and are described in this register. Items which are security classified or otherwise restricted under the act and regulations have been removed and placed in a closed file. A Document Withdrawal Record (GSA Form 7279) with a description of each restricted document has been inserted at the beginning of each folder from which materials have been removed. A Document Control Record marks the original position of the withdrawn item. Employees of the National Archives will review periodically the unclassified portions of closed materials for the purpose of opening those which no longer require restriction. Delnevo, PhD, MPH Objectives: The US Food and Drug Administration (FDA) issued new requirements to strengthen and increase the size of cigar warnings. Although these requirements were challenged in court by the cigar industry, and later struck down, cigar manufacturers had the option of voluntarily complying during the injunction. In this study, we examined voluntary warning compliance on a sample of discarded cigar wrappers. Methods: Warnings were examined on a sample of 1352 discarded cigar wrappers and packs obtained from 15 census tracts in Oakland, California in February 2019. Warnings were coded for new requirement compliance (ie, sized at 30% or more on front and back of pack). Results: Overall, 67.3% of wrappers displayed compliant warnings – other wrappers had smaller warnings only on the front (30.6%), only on the back (1.5%) or no warning (0.4%). Cigar warning placement was significantly associated with brand (p < .01), cigar type (p < .01), and unit size (p < .01). The prevalence of warning compliance was at least 90% for 6 brands but ranged from 0% to 65% for others. Compliance was lowest for cigarillos (62.1%) and packs of 3 (27.6%). Conclusions: Strengthening cigar warnings can help increase their ef- fectiveness, but cigar manufacturers may not voluntarily implement changes fully. Continued surveillance and renewed regulatory efforts are warranted. Key words:
