ii/31 EB XECUTIVE SUMMARY

The tenth quarter report of the External Monitor provides a record of direct observation on IRC WG activities such as public meeting, contract making and payment process, relocation process, grievance process and identifies other issues related to RP implementation.

During the quarter, the IRC WG had organized a public meeting to inform AHs about contract making in section and to distribute plots on resettlement for AHs in , and Preah Sihanouk province.

Up to now, IRC WG has completed the detailed measurements surveys (DMS) for the railway project. Final DMS results totally is 3,812 AHs, comprising 942 AHs in Poipet section, 318 AHs in Missing Link section, 839 AHs in Northern Line section, 207 AHs in Southern Line section, 1,268 AHs in section and 238 AHs in station. To ensure that the DMS was conducted accurately by IRC WG, EMO has mobilized two social enumerators to check the results. About 20% of 3,812 AHs were selected randomly from the DMS list that was provided by IRC. EMO checked the DMS results with affected people about number, type and size of private and community trees, crops, land, other assistance and amount to be paid. There is no major problem or mistake was found during that time.

During the tenth quarter, IRC WG starts making contract with AHs in Poipet section, but the result will be presented in next quarter report. So the same as previous report up to now, there are 1,361 AHs signed their contracts, comprising 839 AHs in Northern Line, 318 AHs in Missing Link and 204 AHs in Southern Line (see table 5 for more detailed results). 186 BRTO have also signed their contracts which are comprised 147 in Northern Line section and 39 in southern Line section. There is no complaint letter lodged or any payment process during the monitoring period.

During this monitoring period, EMO also observed on payment process which conducted by IRC WG in northern and southern line. Up to 15 July 2010, 1,361 AHs and 186 BRTO (318 AHs in Missing Link, 839 AHs and 147 BRTO in Northern Line, 204 AHs and 39 BRTO in southern line) received payments for their compensations. The total amount for cash compensation is USD 285,574.46, comprising USD 133,220.05 for structures compensation, USD 40,473.41 for tree compensation, USD 66,006.00 for other allowances and USD 45,875.00 for BRTO.

On the other hand, EMO also observed on draw lots and plot distribution process, which were organized by IRC WG, of 3 resettlement sites where locate in Battambang, Pursat and Preah Sihanouk province.

iii/31 I.B INTRODUCTION

A. The Project

1. TheB Project primarily involves rehabilitation of the existing railway networks consisting of (i) 338 km section of the Northern Line linking Phnom Penh with Sisophon; (ii) 264 km of the Southern Line linking Phnom Penh with the port city of , and (iii) a 6-km branch line from Phnom Penh station to the petroleum depot facilities at Ton Le Sap River. The project works also include reconstruction of another 48 km of the Northern Line – called the “missing line” – from Sisophon to Thai/Cambodia border at Poipet, which was removed during the civil war of 1970s. The reconstructed line will re- establish the railway connection with .

B. Project Impacts

2. DuringB the PPTA period, it was estimated that about 2,629 Households (AHs) will be affected by the railway rehabilitation project. The detailed types and severity of impacts among AHs are described in table 1 below. In addition to the above number of affected households, there are also bamboo rail transport operators that will lose their source of livelihood once the railway lines are rehabilitated; 189 operators are currently operating along the whole line.

3. AB survey team was mobilized by the ADB and IRC to survey and consult affected households and prepare Addendum to the approved RP 2006. For this purpose, the tasks of the survey team included the following: (i) reviewing the data base (from the IOL of the 2006 approved RP) of project affected households (AHs) to determine how many AHs would need relocating; (ii) looking for possible relocation sites and assessing their suitability in terms of being able to accommodate all landless AHs in a given locality, availability of public services, ability of the AHs to continue with their present sources of livelihood, environmental stability, etc; and (iii) determining the relocation options of the AHs. The survey team in March and June 2007 located as result in table 2:

InB among of 1,418 AHs in Banteay Meanchey, Battambang, Pursat and Preah Sihanoukville who needed relocation. 822 of them were in the master list of AHs of the approved 2006 RP which covers ten provinces and cities; the other 615 were newly identified AH 1 but have been ascertained to be living in the COI even before the conduct of the IOL 2006.

5. TableB 3 below contains an implementation schedule of the updated RP in Northern Line/Missing Link, Samraong station, Southern Line and Poipet section. The URP in Poipet and Phnom Penh section is still in process. The detailed activities are described in Annex 1.

IV.B STATUS OF ACCOMPLISHMENT DURING THE MONITORING PERIOD

4.1B EMO’s Activities:

7. BasedB on IRC WG activities in the quarter, EMO has focused their duties in Poipet section, northern and southern line. IRC WG has already completed the detailed measurement survey (DMS) for the project (see more detailed information in section 4.2). There was also a contract making, payment process and relocation to resettlement sites conducting in the quarter period. Below activities were accomplished by EMO during the monitoring period:

8. 4.1.1B Direct observation on Contract making and Payment process: During the eighth monitoring period, EMO mobilized two staffs by using observation checklist to capture information during contract making process together with IRC WG as they performed their activities. On 12th July 2010, there was a public meeting at Mong Chin pagoda, Sangkat Poipet, Poipet town, Banteay province. The meeting purpose is to inform AHs about contract making process in Poipet Section. The meeting was chaired by Mr. Sar Chamrong, a Chairman of Banteay Mean Chey Provincial RSC with 868 participants (about 520 females and 348 males) were attended. The participants comprised 26 from ICR, Consultant, EMO, PPRSC and 842 AHs from Sangkat Poipet (244 AHs from Kbal Koh village, 125 AHs from Poipet village, 236 from Palilay village and 237 from Kilometer Leh 4). For more detailed information, please see in annex 2.

9. FollowingB the public meetings, IRC staff carried out house-to-house measurements of assets to be lost and updated the inventory. Members of the PRSC also took an active part in the negotiation process. A number of concerns were raised by the APs with regard to compensation, particularly replacement value for lost assets and resettlement. APs were assured that they would be paid compensation at replacement cost as per the entitled matrix, which was earlier disclosed to the affected people/community. Negotiation process has done in Public Meeting to inform about the

4/31 compensation rate, other allowances and grievance procedure. In general aspect, the process was conducted in free participation and transparency manner.

th 10. TheB contract making is started on 13 July 2010 and will finish in August 2010. In average, IRC WG has completed about 20 AHs per day. The actual number of AHs who signed contract will be presented in next quarter.

11. ThereB were some payments conducted in the quarter period. The payment was made in public and monitored by IMO. All APs are satisfied with the compensation amount for the loss of assets, because the compensation rate is made at replacement cost reflecting market prices. There is no major problem during the payment conducting. For more detailed information and schedule of payment process, please read in section 4.2.2 and annex 3. th th 1- FromB 07 to 25 May 2010, IRC WG and Local Authorities have made payment for 839 AHs and 147 BRTO in northern line.

th rd 2- FromB 24 May to 03 June 2010, IRC WG and Local Authorities have made payment for 204 AHs and 39 BRTO in southern line.

5/31 12. 4.1.2B Observation on relocation process: Up to the present 3 resettlement sites, which locate in Battambang, Pursat and Preah Sihanouk province, were completed develop and IRC distributed it to AHs. EMO have also observed on the draw lot process that were organized by IRC at different place as follow: th 1-B On 15 May 2010, there was a Public Meetings at Prey Kaun Sek village, Sangkat Auchar, Battambang town which were organized by IRC WG and LA. Purpose of the meeting is to draw lots for selecting plot at the new resettlement site. The meeting was chaired by Mr. Chheang Chhor Line, Team Leader of IRC WG. It started from 8:00 to 12:00. There were 44 AHs, who are living in Battambang station in Sangkat Tuol Ta Aek, Battambang town, participated in the meeting.

th 2-B On 19 May 2010, there was a Public Meetings at Kapah village, Chheu Tom commune, , which were organized by IRC WG and LA. Purpose of the meeting is to draw lots for selecting plot at the new resettlement site. The meeting was chaired by Mr. Suon Rin Dy, Vice Governor of Pursat province. It started from 9:00 to 11:00. There were 33 AHs, who are living in Chheu Tom and Svay Sar commune (in Krakor district, Pursat province), participated in the meeting.

nd 3- OnB 02 June 2010, there was a Public Meetings at Sangkat Leh Mouy, Preah Sihanouk town, Preah Sihanouk province which were organized by IRC WG and LA. Purpose of the meeting is to draw lots for selecting plot at the new resettlement site. The meeting was chaired by Mr. Ich Sok Muny, Team Leader of IRC WG. It started from 8:30 to 11:00. There were 31 AHs, who are living in Sangkat Leh Mouy (Preah Sihanouk town, Phear Sihanouk province), participated in the meeting.

13. 4.1.3B Focus group interview: EMO Team (one team leader and one social enumerator) has conducted 2 Focus Group Interviews, with AHs who relocated to resettlement site, to receive quality data and supplement the information gathering from SES. The FGI was moderated by team leader with using a semi-structure questionnaire. FGI was organized in different target groups as follows: th 1)B On 05 July 2009 at 14:00 in Kapas village, Chheu Tom commune, Krakor district, Pursat province with 13 AHs (6 males and 7 females). During the FGI, EMO found some issues: i) all of 3 pumping wells provided to AHs on the site were broken (2 wells can not pump water and other one can pump, but water quality is not good); ii) drainage culvert, locates across access road, is too small size. It can not relief rain water during the rainy season. It causes to flood an access road and creates a danger to children when they go to school; and iii) having an electricity connection problem, because it costs USD 80 per household.

th 2)B On 06 July 2010 at 9:30 in Prey Kaun Sek village, Sangkat Au Char, Battambang town, with 13 AHs (9 males and 4 females). During the FGI, EMO found some issues: i) there is no water pipe system. It is very difficult in dry season; ii) there is no electricity source in the resettlement site area; and iii) the owner of land, which is along the access road to the site, hedged a wire concrete pole on the access road. It could make accident for driving, particular in the night time.

ResponseB from IRC to the issues at Battambang resettlement site: Some actions were taken by IRC to response the mentioned issues. The action is described as follow: th 1)B On 4 March 2010, IRC have issued a letter to ask the Governor of Battambang province helping in connection water and electricity supply to the resettlement site which organized by IRC in Prey Kaun Tasek village. th 2)B On 13 July 2010, there is a meeting between IRC, Governor of Battambang province and other relevant departments such as electricity authority, Battambang water authority … etc. The meeting purpose is to find out the solution for connecting electricity and water supply to the resettlement site. All participants agreed to push the work as soon as possible.

4.2B Achievable IRC’s Activities:

17. UpB to 15 July 2010, 1,361 AHs and 186 BRTO (318 AHs in Missing Link, 839 AHs and 147 BRTO in Northern Line, 204 AHs and 39 BRTO in southern line) received payments for their compensations. The total amount for cash compensation is USD 285,574.46, comprising USD 133,220.05 for structures compensation, USD 40,473.41 for tree compensation, USD 66,006.00 for other allowances and USD 45,875.00 for BRTO. VII.B RECOMMENDATION

22. InB general, RP implementation went smoothly. However, some corrective should be taken to ensure more effective implementation of resettlement in the future. Therefore, the EMO recommends that:

-B IRC should try to connect water supply as soon as possible, because AHs will met difficulty in next dry season.

-B IRC also should alert to LA in Banteay Mean Chey province for taking their responsibility to the resettlement site, because some accessories of pump well were stolen.

-B IRC should recruit and mobilize NGOs/agency for income restoration in northern line, because AHs are relocated to the sites.

First, Mr. Try Narin, Governor of Poipet town, greeted all participants. Then, he reported about process of RP implementation. The process divides in three steps:

- Step 1: DMS conducting;

- Step 2: Contract making; and

- Step 3: Payment and relocation.

Mr. Try Narin added, in Poipet town there 942 AHs, comprising 588 AHs will relocate to new RS. He also asked all AHs have to corporate with IRC WG for making their contracts and after that they have to follow the contracts by relocate all affected properties from COI to allow construction work is smoothly going.

Thereinafter, H.E. Sar Cham Rong, Chairman of BMC PRSC, said the railway crosses ten provinces namely Kampong Saom, Kampot, Takaev, Kampong Speu, Kandal, Phnom Penh, Kampong Chhnang, Pursat, Battambang, Banteay Men Chey. There is another railway from Phnom Penh to Vietnam and continue to China. He continued that affected structures and trees will be compensated following to your contracts which will be done by IRC WG and all AHs. On behalf of local authority, he is very happy and supports the compensation procedure. He also mentioned that the compensation payment was very slowly because IRC need to send AH name list to Government and ADB to getting approval for compensation.

Relate to the project benefit, H.E. Sar Cham Rong expressed when the railway completed construction work it will make easier on trading exchange, agriculture, industry, tourist and more investors coming. So our country will be developed.

Then, Mr. Li Borin, Director of Railway department, stated the railway divided in two directions: 1) from Phnom Penh to Kampong Saom and 2) from Phnom Penh to Poipet. At the first study, we decided to construct first in Poipet section, but the contractor has asked to construct Kampong Saom first because they need the railway to transport construction material for the project. He also added the railway from Batdeung (Cambodia) to Long Minh (Vietnam) was studied by Chinese consultant and the study will be finished in Dec. 2010. The project cost is about USD 600 to 700 millions.

Mr. Borin said Thai Government prepared railway from Aranh district (Thailand) to Thai- Cambodia border. He mentioned Cambodia and Thai Government discussed already about concrete and bar lay (steel) bridge construction that will follow to the principal during King Sihanouk time: each country has to spend 50% about Thai Bath 130 millions.

Next, Mr. Sim Samnang, Deputy Director of RD/MEF, informed Cambodia Government has got a loan USD 100 millions from ADB for the project. Today, IRC WG will distribute a document which states on compensation rates to all participants. He also reported in Poipet section there are 942 AHs comprising 588 AHs will relocate to new RS at Kilometer #4, Sangkat Poipet and Poipet town. The resettlement site is about 12 hectares, including some infrastructures such as pumping well, toilet, drainage and lateral access road.

Mr. Sun Sokny, multilateral project chief/MEF, informed to the participants on contract making schedule that IRC WG will start to make contract first from tomorrow (13 July 2010) with AHs in Kilometer #6. Therefore, all AH heads have to be ready for making contract with IRC WG.

19/31 Mr. Chea Sarin, Local Resettlement Consultant, added on involuntary resettlement policy that the project study team has tried to minimize project impact as much as possible. In case they could not avoid it the project will compensate to all AHs. He continued that the project impact is tow main types: 1) affected on properties such as houses, fences, wells, bridges and trees, and 2) affected on household income such as jobless which will regain by income restoration program. The program will be conducted by independent agency that will interview with severely AHs to find out what kind of jobless and what skill that people need? He also explained the participants about a grievance mechanism. AHs can make their complaints through Grievance Committee via local authorities, IRC WG and EMO.

Question and answer:

1- Mrs. Kean Phaon, living in Steung Boat village: My land was affected about 3.5 meters and rest 1.5 meters long. The land owner where is behind mine does not allow me to continue living there. Where can I live?

H.E. Sar Cham Rong responded that there are one law and two sub-decrees for complying with the project.

- Land law states that who are living in ROW is violated of penal code.

-B First sub-decree on Land and Property Acquisition and Addressing Socio- Economic Impacts caused by State Development Projects.

-B Second sub-decree No. 197, limits that National ROW from 20 to 30 meters for both sides from axis of road. Government does not use the law and sub- decrees with AHs, but will apply only the project policy.

Finally, Mr. Chheang Chhor Line, Team Leader of IRC WG/MEF, responded to Mrs. Kean Phoan that her house was affected only 1 meter and she can chief it back. If she has such problem, IRC WG will re-examine for her during the contract making process.

1.8.3 Krong Preah Sihanouk: On 01 June 2010 at 09:00 am, there was a compensation payment in Phum Pir, Sangkat Leh Mouy, Krong Preah Sihanouk. In the Krong there are 169 AHs came from 2 Sangkats namely Sangkat Mouy and Sangkat Pir. All AHs in the district received their compensation payments.
