  • Penguin Group (USA) Inc. V. Steinbeck
[Edited. You can read the full opinion here.] Penguin Group (USA) Inc. v. Steinbeck 537 F.3d 193 (2d Cir. 2008) SACK, Circuit Judge: This is an appeal from an order of the United States District Court for the Southern District of New York (Richard Owen, Judge) granting summary judgment to the appellees Thomas, Steinbeck and Blake Smyle based on the court's conclusion that a "notice of termination" given in 2004 that purported to terminate, pursuant to the Copyright Act, 17 U.S.C. § 304(c) and (d), the 1938 grant of copyright licenses by the author John Steinbeck, was valid. We consider on appeal whether an agreement entered into in 1994 between Steinbeck's widow and the publisher terminated and superseded the 1938 agreement, and, if so, whether the termination notice is therefore ineffective. Because the termination right provided by section 304(d) pursuant to which the 2004 termination notice was issued applies only to pre-1978 grants of transfers or licenses of copyright, and because the 1994 agreement left intact no pre-1978 grant for the works in question, we conclude that the 2004 notice of termination is ineffective. The 1994 agreement remains in effect. BACKGROUND Grants of Licenses of Copyright On September 12, 1938, the author John Steinbeck executed an agreement with The Viking Press (the "1938 Agreement") that established the terms for the latter's publication of some of Steinbeck's best-known works, including The Long Valley, Cup of Gold, The Pastures of Heaven, To A God Unknown, Tortilla Flat, In Dubious Battle, and Of Mice and Men, in all of which Steinbeck held the copyright.

Thomas M. “Thom” Steinbeck, SP4, USA SP4 Thom Steinbeck was assigned to AFVN as a Newscaster at the Key Station in Saigon and then in Tuy Hoa in 1968. The following is from an on-line obituary. Born: Aug 2, 1944 Died: Aug 11, 2016 NEW YORK, Aug 13 Thomas Steinbeck, the eldest son of novelist John Steinbeck and, later in life, a fiction writer who fought bitterly in a family dispute over his father’s estate, died Thursday at his home in Santa Barbara, California. He was 72. The cause was chronic obstructive pulmonary disease, his wife, Gail Knight Steinbeck, said. John Steinbeck, the author of East of Eden, The Grapes of Wrath and other works, was one of the most prominent 20th-century American writers, receiving the Nobel Prize in Literature in 1962. Thomas Steinbeck, who bore a striking resemblance to his father, was approaching 60 when he published his first fiction, a collection of stories called Down to a Soundless Sea, in 2002. Steinbeck said that many of the stories, about settlers on the California coast in the late 19th and early 20th centuries, were derived from folk tales and legends he heard growing up. He later published two novels, The Silver Lotus and In the Shadow of the Cypress, which also took place on the Northern California coast near Monterey, the setting for his father’s novels Cannery Row and Tortilla Flat. Steinbeck gained perhaps his widest attention in 2004, when he and a granddaughter of John Steinbeck began a lengthy battle for intellectual property rights to Steinbeck’s written works that they said rightfully belonged to the author’s direct descendants.

Journal of American Studies 14 (2013): 51-62 ISSN 1896-9461 DOI: 10.12797/AdAmericam.14.2013.14.04 Katarzyna Hauzer Institute of English Studies Jagiellonian University, Krakow, Poland So This Is Peace? The Postwar Ventures by John Steinbeck, Irwin Shaw, and Robert Capa This paper is an attempt to analze literary ventures by John Steinbeck, Irwin Shaw and Robert Capa in which text and pictures make their own commentary. A Russian Journal (1948) is an unusual record of “the great other side of Russia,” wherein Steinbeck and Capa struggle to present the Soviet Union deprived of its ideological context. The authors make a sweeping journey through the USSR, portraying the landscapes and ways of life of ordinary Russians who were emerging from the rubble of WWII with the hope of peace‑ ful coexistence of capitalism and communism in the atomic decade. The challenging task of demarcating culture with politics produced an intriguing travel narrative in which the power of observation is inherent in Steinbeck’s insights into Russia’s cultural landscapes and its memories of war, not in its Cold War state of mind. Similarly, Shaw and Capa take up a delicate task, reporting on the labyrinths of war in a newly developing state in the Middle East. Report on Israel (1950) is a powerful depiction of several wars at a crossroads where verbal assessment and photographic artistry often compete with one another. The spirit behind A Russian Journal and Report on Israel is a reminder of the postwar era’s insta‑ bility and the human dimension of political changes.

On the lighter side, I must say thank you to the wonderful procrastinations I was able to create: Dodger gam~s, the Pub, that uncontrollable Frisbee, those long thought-provoking lunches, and watching that inimitable fellow we deemed the "Coke Man," are all most certainly a part of this paragraph. To these, and to all the many other diversions that allowed me to .look busy while I did very little, I am most grateful. To the RTD for making my life utterly miserable as I tried to commute to school each day, and to all the automobiles and filth producing industries that make the air in Los Angeles so outright disgusting, I am additionally grateful because these are the sorts of things that drive a person to finish a thesis so he can then leave. On a more serious note, to Leroy the custodian, for being himself and for placing things into perspective, I extend a warm thank you and a smile.
