113/2005 Statement by the Presidency on behalf of the European Union concerning the elections in Liberia Brussels, 14 October 2005

The European Union is pleased to note that the elections in Liberia on 11 October have been considered by international observers, in particular the European Union Election Observation Mission (EU EOM) in its preliminary assessment, to have so far been peaceful and generally well administered. The elections mark an important step forward in returning Liberia to a normally functioning state. The European Union congratulates the people of Liberia for turning out in large numbers to demonstrate a clear commitment to peace and democracy, and a desire to move on from the period of the conflict that has beset their nation.

The European Union calls upon all political contestants to continue to demonstrate the responsibility they have shown throughout the process so far and to accept the democratic decision of the Liberian people. The European Union reaffirms its intention to continue to support Liberia on its path towards a stable democratic future. The EU EOM will remain in country to observe all remaining aspects of the election process, including a second round if this is required.

Statement by the Presidency on behalf of the European Union on freedom of expression in the Democratic Republic of Congo (DRC) Brussels, 17 October 2005

The European Union is concerned about freedom of expression in the Democratic Republic of Congo (DRC). Between January and August 2005 Journalistes En Danger (JED) reported 37 cases of imprisonment of journalists, compared with 23 similar arrests in the whole of 2004.

The right to freedom of expression is fundamental to democracy and a fundamental freedom laid down in the Universal Declaration on Human Rights, as well as in the International Covenant on Civil and Political Rights and African Charter on Human and People's Rights, to which the Democratic Republic of Congo is a State Party. Freedom of Expression is also a requirement for the realisation of the Millennium Development Goals.

The EU supports the principles contained in the UN Declaration on the Rights and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognised Human Rights and Fundamental Freedoms, adopted by the UN General Assembly in 1999.

The protection of freedom of expression will be of paramount importance in the run-up to elections in DRC. The European Union supports the work of the Haute Autorite des Medias (HAM). The HAM plays a key role and the EU encourages it to monitor the media objectively and impartially in the run-up to elections to ensure that all parties have equal access to airtime and to prevent hate media. HAM has a particular role in monitoring the output of the state-owned Radio Television Nationale Congolaise (RTNC) to ensure that no single political party has privileged access to its airwaves to the detriment of others. To this end the EU encourages the HAM to ensure that terms of access to the RTNC and coverage provided by RTNC respects the principals of impartiality and equality. It further urges the HAM and all parties to do their utmost to prevent language inciting ethnic or other tension from being used during broadcasts on all media channels.

The EU notes with concern the recent disputes between HAM and the Ministry of information. The EU would like to underline the importance that both entities work together in a positive way respecting their own and each others roles and boundaries. The EU further notes the important role of other Congolese organisations in the regulation, the organisation and the protection of the media and of journalists, namely the Observatoire des Medias Congolais (OMEC), L'Union Nationale de Presse Congolaise (UNPC), and Journalistes en Danger.

The EU encourages and supports efforts made by all sections of the media and government to ensure freedom of expression and prevent persecution of journalists.

116/2005 Statement by the Presidency on behalf of the European Union on the Senegal-Gambia border dispute Brussels, 19 October 2005

With regard to the current border closure affecting Senegal and the Gambia, the European Union welcomes the ECOWAS decision to undertake mediation in the dispute.

The European Union believes that the dispute is in the interests of neither Senegal nor the Gambia, and that its continuation will have a negative economic impact regionally. A well-functioning and efficient transport route over the Gambia River would benefit the entire region economically, and would further be in line with ECOWAS principle of free movement of goods.

Declaration by the Presidency on behalf of the European Union on the final days of the election campaign in Azerbaijan Brussels, 28 October 2005

The forthcoming parliamentary elections in Azerbaijan will be a decisive test of the strength and direction of Azerbaijan's democratic development. The EU continues to follow the election campaign with great interest and concern. The EU has noted the findings of the OSCE/ODIHR interim reports, and also the statement issued by the pre-electoral mission of the Parliamentary Assembly of the Council of Europe on 13 October 2005.

The EU welcomes the positive aspects of the election campaign so far, including improved candidate registration procedures and the active engagement of the Government of Azerbaijan with the OSCE/ODIHR Election Observation Mission (EOM). The EU also takes note of the Presidential Resolution of 25 October, which could address some of the concerns of the OSCE/ODIHR EOM.

However, the EU notes that there are a number of concerns that need to be addressed urgently in order for the election campaign to meet international standards. The EU urges the Government of Azerbaijan to ensure that freedom of assembly is fully respected, including in the regions. The EU encourages all sides to resume the dialogue on all issues related to freedom of assembly and calls on the authorities to fully respect the rights of all candidates to conduct their election campaigns as provided by law. In this regard, the EU is concerned at the widespread detentions made on 16/17 October in order to prevent supporters of an opposition candidate from their attempt to greet him at Heydar Aliev International Airport, and will continue to follow subsequent developments closely.

As the EU has made repeatedly clear, there is no place for violence or intimidation in an election campaign. While recognising the need to keep public order, the EU is deeply concerned by the excessive use of force used by some police officers against demonstrators at recent public rallies. For their part, opposition parties should not provoke violent confrontations with the authorities.

The EU is also concerned by reports that there are serious irregularities with the voter ID system. The EU hopes that a speedy solution will be found to overcome the problems identified by the OSCE/ODIHR EOM. In order to increase public confidence in the electoral process, the EU urges the authorities to examine without delay all complaints referred by the Central Election Commission to the Public Prosecutor for investigation and to prosecute those found to have circumvented the law. The EU also urges the authorities

to ensure that all candidates are able to gain equal access to the electronic media and that media coverage of the campaign is unbiased.

The EU firmly believes that Azerbaijan can meet its international obligations and commitments if the political will exists. The EU stands ready to assist Azerbaijan in fulfilling its international commitments, both within the OSCE and other international organisations, and within the framework of the European Neighbourhood Policy. The EU continues to offer its full support to the OSCE/ODIHR EOM.

Declaration by the Presidency on behalf of the European Union concerning the situation in Togo Brussels, 25 October 2005

The European Union has taken careful note of the detailed report on recent human rights violations in Togo, drawn up by the fact-finding mission dispatched to the country by the High Commissioner for Human Rights. The contents of that report confirm the seriousness of the abuses and violence, which have left very many people dead and entailed inhumane and degrading treatment and the destruction of property, directed in particular against some European Union member states.

The European Union reiterates its condemnation of acts of violence, from whatever source, and calls on the Togolese authorities to deal thoroughly and fairly with the issue of human rights in Togo, in keeping with the undertakings given in 2004, by prosecuting those responsible for such violence so as to end any sense of impunity. Bringing them to justice will help to restore confidence in the rule of law and encourage the return of refugees, in order for Togo to engage in a sincere process of national reconciliation.

The European Union here renews its call for a genuine dialogue which involves all political forces in the country, is clear in form and in content and serves to establish an electoral framework acceptable to all. The European Union notes that, while some efforts have already been made, the greater part of the work has still to be done.

Lastly the European Union points out that it stands ready to support action by the Government and the President to implement the twenty-two undertakings, in compliance with the Council Decision of 15 November 2004, and that it urges all of Togo's political forces to work to have firm and resolute steps taken to that end.

Declaration by the Presidency on behalf of the European Union on publication of the Poverty Reduction Strategy Paper for Bangladesh Brussels, 25 October 2005

The UKn in its present capacity as holder of the Presidency of the European Union has the honour to present the following statement on behalf of the European Union's Member States and the European Commission to confirm the European Unions long-term partnership with Bangladesh.

The European Union commends the Government of Bangladesh for its commitment to poverty reduction and its commitment to the Millennium Development Goals (MDGs) as set out by its ambitious and comprehensive strategy "Unlocking the Potential: National Strategy for Accelerated Poverty Reduction".

The Poverty Reduction Strategy provides a realistic picture of the development challenges in Bangladesh and acknowledges upfront the role of NGOs and private sector in realising the MDGs. The Strategy's analysis reflects the multidimensional nature of poverty for Bangladesh and correctly seeks to build on past gains, stop slippage and address implementation. This will help build on the remarkable progress already made by Bangladesh on macroeconomic stability, growth and human development.

The Poverty Reduction Strategy rightly identifies weak governance, poor human security, and violation of some human rights as significant challenges to improving the livelihoods of poorest and women, and to stronger economic growth. Corruption hinders service delivery, and this holds back growth and progress on development. These issues also constrain the successful implementation of Government plans. Likewise political and ethnic violence, as well as recent bomb attacks, add to human insecurity and are significant threats to continued development. The European Union hopes the Government of Bangladesh will demonstrate its commitment to addressing all these issues during implementation of the Strategy.

The European Union commends the Government of Bangladesh's efforts to consult international partners and sections of civil society during the drafting of the Poverty Reduction Strategy. However the European Union notes with disappointment that full political participation in the PRSP process was not achieved. The European Union looks forward to stronger cross-party engagement during implementation of the Strategy and continued commitment to the Strategy beyond the next elections in 2007.

Bangladesh continues to confront fundamental development challenges. The European Union values its partnership with Bangladesh and looks forward to a successful implementation meeting on 15-17 November. We stand ready to support Bangladesh in this challenging process.

Declaration by the Presidency on behalf of the European Union on Nepal's media ordinance Brussels, 28 October 2005

The EU is deeply concerned about the actions of the Government of Nepal to impose and enforce repressive restrictions on the media in Nepal. Amendments contained in the new Media Ordinance infringe upon the right to freedom of expression.

The EU condemns the seizure at gunpoint of radio equipment from the Kantipur FM station in Kathmandu by the security forces.

As the EU Troika said publicly during its 4-6 October visit, the people of Nepal want a proper functioning democracy with power vested in the people. Freedom of expression - including access to FM news - is a fundamental prerequisite for an effective democracy.

The Nepalese people have the right to live in a society characterised by respect for human rights and the rule of law. The EU calls upon the Government of Nepal to uphold the fundamental rights guaranteed by the Constitution of the Kingdom of Nepal and allow the people of Nepal their right to freedom of expression.

Statement by the Presidency on behalf of the European Union on government of Zimbabwe's rejection of an humanitarian assistance Brussels, 7 November 2005

The European Union notes the statement issued by the UN Secretary-General on 31 October on Zimbabwe.

The European Union shares the UN's concerns over the grave humanitarian situation in Zimbabwe caused by the Operation Murambatsvina ("Drive out Trash") evictions. Like the UN Secretary-General, it is dismayed that the Government of Zimbabwe has not accepted the urgent humanitarian needs set out in the report of the Secretary-General's Special Envoy, and has declined aid for those Zimbabweans left homeless and destitute by recent events.

The European Union calls on the Government of Zimbabwe to work with the UN and the international community to get aid and shelter to those in need as a result of Operation Murambatsvina. It urges the Government of Zimbabwe to implement all the recommendations of the Special Envoy's report. The European Union reiterates its call on Zimbabwe to respect human rights, in particular as expressed in the report of the Secretary-General's Special Envoy on Human Settlement Issues in Zimbabwe.
