The Advisory Council on Equal Employment Opportunity was established in July 1991 to serve as an advisory committee to the Board of Supervisors regarding the implementation of the County's Affirmative Action Plan, to review the Affirmative Action Program and to recommend actions to facilitate attainment of the County's goal for affirmative action.

The Council is composed of 11 members and the IOC reviews nominations to all seats except those designated for County managers and labor unions. Terms of office for seats reviewed by the IOC are three years.

Recommendation

Accept report for the Fleet ISF for FY 2008-2009.

Background

At the March 15, 2004 meeting, the Internal Operations Committee directed the County Administrator to evaluate the feasibility of establishing a Fleet Internal Service Fund (ISF) for Fleet operations. Following CAO review and analysis of the ISF proposal, in December 2004, the CAO determined that the ISF was a practical method to ensure long-term vehicle replacement funding. However, due to budget cuts specifically targeting vehicle acquisition, it was recommended that the proposal not be implemented until planning for fiscal recovery would be possible.

ISF Initial Funding

The Board approved implementation of a Fleet Internal Service Fund (Fund 150100) as part of the FY 2008-09 budget adoption. The initial seed money for the Fleet ISF totaled $3.6 million. This amount represented about 50% of the total reserve for vehicle replacement in the General Fund. The seed money was to fund vehicle purchases for FY 2008-09 and working capital needs.

Lower Vehicle Age/Reduced Maintenance Costs

One of the major benefits of a Fleet ISF is that with regular vehicle replacements, the average vehicle age is lowered. For standard sedans, new vehicles are covered under warranty for their first 36,000 or three years. Older vehicles typically require more maintenance and repair. After just one year under the Fleet ISF, it is too early to measure any savings, if any, since vehicles are put into service throughout the fiscal year.

Rate Structuring

Vehicles in the Fleet ISF are charged three different ways: 1) actual cost for fuel; 2) variable cost based on mileage to cover maintenance and repair costs; and, 3) fixed cost to cover insurance, fleet overhead, and vehicle depreciation/replacement.

In FY 2008-09, the variable charge for maintenance and repairs totaled $1,864,127. ISF vehicles were charged $1,865,222 resulting in an overcharge of only $1,094 for variable costs. Some vehicle classes were overcharged based upon mileage while other vehicle classes were undercharged. Adjustments will be made to the mileage rates in FY2009-10 for each class of vehicle.

Initial Fleet ISF Goals

• Better planning – more focus on long-term stability and self-support • More accurate budgeting for departments • Equitable vehicle replacement standards for all departments • Newer fleet as older vehicles are replaced more frequently • Streamlined vehicle replacement process through single versus multiple requisitions • Increased resale value

Highlights

• 839 vehicles in the ISF comprised of 344 sedans, 114 patrol cars, and 103 cargo vans • More vehicles replaced for ISF classes – 108 for FY 08-09 versus 69 for FY 07-08 • Fewer agenda items and appropriation adjustments submitted • Fewer purchase orders processed due to consolidation (28 POs for 108 vehicles) • Sheriff replaced 72 vehicles of which 39 were patrol vehicles • Vehicles ordered, received, and put into service earlier in the budget year

Summary

Most of the goals for the ISF have been met or in the process of being met. The General Services Department will continue to develop accurate vehicle use information and analysis to document actual costs and potential cost savings from Fleet ISF operations.

RECOMMENDATION

ACCEPT this report from CAO staff on the status of the advisory body review, consider the findings and preliminary recommendations, and provide additional direction as appropriate. CONSIDER adoption of a “Sunset Review” process similar to that implemented by San Diego County, which requires regular self- evaluation of advisory bodies for need and effectiveness.

BACKGROUND

At the time this study began, there were approximately 85 boards, committees, and commissions that had been established by the Contra Costa County Board of Supervisors. Over two-thirds of these bodies were discretionary, and the remainder of the bodies were required by either state or federal law or a Joint Powers Agreement. In Resolution No. 2002/377, in adherence to the Maddy Act, the Board established a requirement that it review its advisory bodies every three years to identify which ones should be abolished or consolidated. The County Administrator’s Office completed the last review in 2005.

On March 6, 2007, the Board of Supervisors referred the matter of the review of its advisory bodies to the Internal Operations Committee. The purpose of the review is the evaluate whether the advisory bodies are working in a manner that is consistent with their mission, whether they work in accordance with County goals and objectives, and whether they receive an appropriate level of guidance and support.

On May 7, 2007, CAO staff presented its work plan for this study to the Internal Operations Committee. At that time, the Committee approved the work plan; directed staff to research other studies of boards and commissions; and directed staff to advise the advisory body members/commissioners about the study and invite their input.

- 1 - On September 24, 2007, CAO staff provided a status report on the study to the IO Committee. The advisory body members/commissioners were informed about the review during the July 31, 2007 Advisory Body Training conducted by CAO and County Counsel staff. On December 7, 2007 staff of the advisory bodies were provided a 35 question survey to distribute to members for their input.

On August 11, 2008, CAO staff provided findings and recommendations to the Internal Operations (IO) Committee for the 30 Phase I Discretionary bodies. On September 15, 2008, CAO staff provided findings and recommendations to the IO Committee for the 12 Phase I Mandated bodies. On March 11, staff provided findings and recommendations to IO related to 27 Phase II bodies. On June 23, 2009, staff provided the Board of Supervisors with a status report of the study, covering all bodies that had been reviewed by the IO Committee to that point. The Board considered the findings and recommendations and provided further direction to staff to abolish the Human Relations Commission and the Loan and Grant Review Panel and continue to look for consolidation opportunities. For a Summary of IO Committee and Board actions, see Attachments A and B.

The remaining steps in the study included:

1. Analysis of 11 Phase II Municipal Advisory Councils 2. Review of 4 Joint Powers Authorities 3. Results of research on advisory body reviews in other cities/counties

Final Phase II Findings and Preliminary Recommendations

Municipal Advisory Councils

With regard to the 11 Municipal Advisory Councils in existence at the start of the study (a 12th MAC was subsequently established on August 11, 2009 for the Alamo community), a comprehensive review of the MACs’ operations and functions has been performed by a subcommittee of the Board of Supervisors that was established on December 20, 2005. Over the course of several years, the Ad Hoc MAC Committee recommended policies to the Board for the purpose of improving consistency in the composition, powers, and operations of the County’s MACs. The final set of MAC Policies were adopted by the Board on December 16, 2008.

Given the comprehensive nature of the review by the Ad Hoc MAC Committee, the analysis of the 11 MACs for the purpose of this advisory body review was abbreviated. Staff’s single recommendation for the purpose of this study is the development of Bylaws for those MACs that are currently functioning without an adopted set or the amendment of existing Bylaws to make them consistent with, but not duplicative of, Board-adopted policies.

- 2 - Joint Powers Authorities

After examining the materials provided by advisory body staff, follow-up discussion with staff, and review of the member surveys, staff has concluded its review of the Phase II (District-specific or regional matters) JPA advisory bodies and submits recommendations and key findings on the attached matrix (Attachment C).

To prepare findings and preliminary recommendations related to these research areas, CAO staff reviewed the following items: Board Orders that established or modified the advisory body; Bylaws; meeting agendas and minutes from 2005, 2006, and 2007; attendance records for 2005, 2006, and 2007; the staff survey; and the advisory body member surveys. The advisory bodies that are shaded a darker color on the matrix did not respond to the staff survey or provide any supporting material. In general, these bodies were not staffed by County employees.

Research of Advisory Bodies Reviews, Advisory Bodies in other cities/counties

In August 2008, CAO staff enlisted the support of the Urban Counties Caucus to survey member counties about any board/commission reviews undertaken in the prior three years. The survey asked the following questions:

1) How did you determine which bodies are discretionary and which ones are mandated (by state and federal law)?

a) Do you have a list you can share with us?

2) In the course of your review, did your Board eliminate, suspend, or consolidate any bodies, and if so, which ones, and were any eliminated outright or by phase- out?

3) In analyzing the bodies, please define the evaluation criteria used in your review.

4) Was there a Survey done for staff and board/commission members; and if so, how was the survey conducted?

5) Did your Board examine what other counties have done with respect to evaluating advisory bodies?

6) How did you involve the public in the review process?

7) How much staff resources were dedicated to the undertaking?

- 3 - The Counties of Ventura and San Diego provided responses. Staff also received a report in May 2009 regarding Los Angeles County’s review of their commissions and committees. LA County retained a consultant to review the County’s 95 commissions; 11 were recommended for elimination. (See Attachment D.)

The most helpful idea to come out of the survey from San Diego is as follows:

On a yearly basis or prior to July 1, the Clerk of the Board sends out a “Sunset Review” notification to contact persons on one-fourth of all active Boards, Commissions, and Committees (BCCs). The Sunset Review process ensures that citizen advisory committees which are formed by the Board of Supervisors, pursuant to Federal or State mandate, County Ordinance, Joint Powers Agreements, Regulatory Code, Board Order, Board Action, or Board Resolution, are reviewed for need and effectiveness on a routine, scheduled basis.

The advisory committee shall, by December 1 of that same year, review the establishing ordinance, policy, or resolution; develop a recommendation for continuance, deletion, make any necessary revisions and provide a written report to the Clerk of the Board of Supervisors.

Contact persons listed for various advisory BCCs are responsible reviewing BCCs for need of continued existence and effectiveness in accordance with Board of Supervisors Policy A-74.

Clerk of the Board consolidates reports on those advisory boards and submit such report to the Board of Supervisors.

Staff also received an extensive amount of information from the City of Concord from a review of their commissions undertaken in 2004 to address options for streamlining and reorganization. Staff recommendations included streamlining the recruitment process, reducing the frequency of meetings, reducing commission size, lengthening the terms of commission members, and reorganizing various commissions to consolidate functions.

Finally, an intern from Supervisor Glover’s office, Dana Cruz, who spent part of his internship with the CAO’s office performed research on the various advisory bodies in each county in California. He created a hyper-linked spreadsheet that not only lists each body within each county but links the name of the body to the on-line information about body. (See Attachment E. Due to the extensive amount of data, only the cover page and summary sheets are attached.)

On a yearly basis or prior to July 1, the Clerk of the Board’s office sends out Sunset Review notification to contact persons on one-fourth of all active BCCs. The Sunset Review process ensures that citizen advisory committees which are formed by the Board of Supervisors, pursuant to Federal or State mandate, County Ordinance, Joint Powers Agreements, Regulatory Code, Board Order, Board Action, or Board Resolution, are reviewed for need and effectiveness on a routine, scheduled basis.

The citizen advisory committee shall, by December 1 of that same year, review the establishing ordinance, policy, or resolution; develop a recommendation for continuance, deletion, make any necessary revisions and provide a written report to the Clerk of the Board of Supervisors.

DATA COLLECTION PHASE Project Definition #1: Public-appointed members Commissions/Boards

• Board of Supervisors issued a directive to County Agencies/Departments to provide the County Executive Office a summary of all staff supported (mandated and non-mandated) advisory boards/commissions.

• The County Executive Office compiled the information to include Name of the Board/Commission; Appointing Authority; Formation Date; Mandatory Board (cite regulatory requirements); Discretionary or Non-Mandated Board; Purpose of the Board/Commission; Meeting Frequency of each Board/Commission and quorums; General Attendance in the last 5 years; and Associated Costs include estimates of staff time and related materials to staff the Board/Commission.

• The Summary Report was presented to the Board of Supervisors in October 2007. This 2007 Summary Report delineated 63 boards/commissions to which the Board of Supervisors appoint public participants. These 63 boards/commissions were created in a variety of ways (county ordinance, resolution, state and/or federal laws). To assist with the understanding of each one of these entities, appropriately referenced sources were cross-linked and compiled for each cited board/commission. The Report is available on-line at http://ceo.countyofventura.org/cob.

Project Definition #2: Compile a Summary of Board members as Appointed Members in Commissions/Boards.

• The 2008 Summary was compiled with general information pertaining to the various boards to which Board members serve as members. The current compilation is in addition to the October 2007 Summary of Boards, Commissions, Committees, and Districts to which the Board appoints public participants. Please note there are a total 12 boards included in that Summary because the Board, in addition to appointing a Board member, also appoints public participants. Thus, the County of Ventura has a total net count of 90 boards, commissions, committees, and districts.

BOARD/COMMISSION REVIEW PHASE In preparation for moving forward with a process for the Board to consider and review, staff categorized the boards/commissions into five review tracks: 1. Track 1: Local Recreation Advisory Boards 2. Track 2: Federal/State Mandated Commissions 3. Track 3: Locally Mandated Commissions (The authority of locally mandated commissions is the various County of Ventura ordinances.) 4. Track 4: Local Policy/Joint Powers Agreement Commissions (These commissions are formed under JPAs or upon Board’s actions) 5. Track 5: Independent Commissions (These commissions operate as independent commissions or special districts. These commissions were further aggregated into 2 sub- categories: federal/state mandated commissions and discretionary commissions.)

However, the Board discussed and identified 21 boards/commissions for further examination. Study sessions have been coordinated to present and delineate options for Board’s consideration.

2) In the course of your review, did your Board eliminate, suspend, or consolidate any bodies, and if so, which ones, and were any eliminated outright or by phase-out?

In July 2008, the Board considered and approved withdrawal from 2 commissions: Southern California Water Committee and Point Mugu Regional Airport Authority.

3) In analyzing the bodies, please define the evaluation criteria used in your review. The issues for these 21 boards varied. They are as follows: • The need to participate at a local level versus at the state-wide level. • Review cost efficiency. • The need for multiple airport commissions. • General review of the purpose of the commission. • Numbers of appointed members to the

I worked very closely with the Clerk of the Board to obtain a listing of boards/commissions as a baseline of all the boards/commissions. A business matrix was then created for board/commission staff to complete. I researched all relevant codes, requested copies of all board letters in archive, and organized all information into a summary matrix. Additional calls and 1:1 conversations with staff were also necessary to obtain the comprehensive information.

5) Did your Board examine what other counties have done with respect to evaluating advisory bodies? No. However, as the Management Analyst assigned to this project, I independently researched various county web-sites to get a sense of the various boards/commissions in the respective county.

6) How did you involve the public in the review process? With these 21 boards/commissions identified for further examination, I worked very closely with the board/commission staff to obtain input and feedback. We also attempted to schedule study sessions whereby the commission chairs would be available to answer questions raised by our Board of Supervisors.

7) How much staff resources were dedicated to the undertaking? As the analyst assigned to this project, dedicated time thus far is over 430 man-hours (including weekends). This dedicated time does not include meeting time with the Assistant County Executive Officer, Clerk of the Board or County Counsel.

SUBJECT: DEVELOPMENT OF POLICY GOVERNING SPECIAL REVENUES

At the July 20 meeting, the Committee directed staff to refer the draft policy on special revenues to the Finance Committee and County Administrator David Twa to receive their input.

The County Administrator provided his comments via email (attached for reference) to the Committee members on September 14. Mr. Twa’s suggested changes are shown below in blue.

The Finance Committee discussed the policy at its September 14 meeting but ran out of time and was unable to give full consideration to the policy. Consequently, the Finance Committee offered the following input, shown in red, but stated that it wishes to continue its discussion at a future Finance Committee meeting.

Primarily, the Finance Committee expressed an objection to the term “earmark”, wanted the definition of mitigation funds to be simplified; asked that the policy be clarified to indicate that it applies only to prospective new funds and not to funds that have already been allocated by the Board; and wanted any new allocations to be justified by measurable performance/benefit outcomes. These changes are reflected below.

The Internal Operations Committee also requested staff to provide a five year summary of special revenue funds that have diverted from General-Purpose revenues. Attached is a summary showing staff’s estimates of amounts that would have been available as General-Purpose revenues had they not been allocated by the Board to specific programs or communities. Mitigation and Community Benefit fees, as defined in the draft policy, are not shown as diversions from General-Purpose revenue because absent the funder, those revenues would not have otherwise been available for general purposes.

FINDINGS

1. As BOS membership has changed and County support staff has turned over, institutional knowledge about historical special revenues has been lost, philosophies between current Supervisors and their predecessors about allocating Community Benefit fees, e.g., Livable Communities Trust and Industrial Job Training & Education Fee, have changed, and new Supervisors often have very little information about the historic special revenues they have inherited within their Districts.

2. Many of the terms used to describe what we collectively refer to as “special revenues” are erroneously used interchangeably, causing confusion in the way certain funds are treated. For example, terms such as special Board Deleted: earmarks appropriations, mitigation fees, trust funds, special revenue funds, community benefit funds, area of benefit fees have been used interchangeably when they actually have distinct differences that indicate whether or not the source of funds are general purpose revenues and affect how much discretion the Board may have over their allocation.

3. The County policies that govern the allocation and expenditure of special revenues are:

a. the Process for Determining Compensation to Impacted Communities, to Be Paid by Benefitting Communities, as Mitigation for Waste Division adopted by the Board in 1989, b. the Policy Related to Practice of Allocating General Fund Revenue to Specific Communities or Programs adopted in 2005, and c. the County Budget Policy adopted in November 2006, all attached hereto for reference. d. specific procedures established by Order of the Board of Supervisors for a particular special revenue, e.g. Keller Canyon Mitigation funds, Crockett Cogeneration funds, West Contra Costa Transfer Station Mitigation funds.

4. 9. Special revenues are not, as a rule, highlighted and discussed during the annual budget deliberations because they are generally less discretionary than General Purpose revenues.

10. During times of severe fiscal crisis, programs funded with special revenues will be more insulated from budget reductions than programs funded from the General Fund.

11. While mitigation fees shall not be levied, collected, or imposed for general revenue purposes, nothing specifically prohibits the Board from expending mitigation fees to maintain or enhance mandated services if those services are consistent with the purposes of the mitigation fee.

RECOMMENDATIONS

1. Adopt the following definitions to be used in County policies with regard to special revenues:

a. Mitigation fee: Monetary exaction other than a tax or special assessment, whether established for a broad class of projects by legislation of general applicability, such as Area of Benefit mitigation fees (County Ordinance Code §913-2.404)1, Drainage fees, and Park Dedication fees, or imposed on a specific project on an ad hoc basis, that is charged by a local agency to the applicant in connection with approval of a development project for the purpose of mitigating the impacts of the project on the affected Deleted: defraying all or a portion of the cost of public improvements, public community. Examples of special revenue funds are those established for the purpose of financing schools, parks, or libraries.

d. Community Benefit Fee: Voluntary payment(s) made by a developer or project sponsor that benefit a defined community, either through capital or community program improvements. These funds, typically, have been intended for uses that will benefit the quality of life for the communities in which a project is approved. In the past, these funds have been identified for such uses as economic development, health care, education, infrastructure, transportation, etc.

e. Special Board Appropriation: A designation by the Board of Supervisors Deleted: Earmark dedicating a portion of one or more General-Purpose Revenue sources to a Deleted: specific program or activity, and/or to benefit a specific geographic area.

f. Special Revenues: Collectively, all of the preceding revenues.

2. Re-affirm Paragraph 5 of the County Budget Policy prohibiting special Board Deleted: the creation of new earmarks appropriations, which states, “The County will not directly allocate a specific General-Purpose Revenue source to specific programs/communities. The policy Deleted: would not apply to mitigation revenue that is derived from a project and intended to offset the environmental impacts from the project on the "host" community.”

3. Adopt a policy governing the Authorization for Mitigation and Community Benefit Fees and Their Allocation:

a. Affirm that revenues from existing fees are to be administered by the Supervisor serving in the district for which the fee was created, unless specified otherwise when the fee was established, and may require Board of Supervisors approval prior to expenditure. 4. Accept the compendium of current special revenue funds for FY 2009/10 and pursue opportunities to secure new mitigation and community benefit fees, where appropriate.

5. Amend the County Budget Policy, adopted in November 2006, to include the following new policy:

“Each February, Contra Costa County shall prepare and make a formal budget report to the Board’s Finance Committee detailing earned revenues and expenditures for all mitigation and community benefit fees, trust and special revenue funds, and special Board appropriations Deleted: Board-established earmark during the prior fiscal year. The report shall identify amounts that were funds diverted from General-Purpose revenue in order to satisfy a special Deleted: Board appropriation or other special revenue program. Child Care Affordability Fund: The diversion of General-Purpose Revenue (GPR) shown represents the special Board allocation of Transient Occupancy Tax (TOT) to a specific program and community. Absent the special Board allocation, this revenue would have been part of the GPR available to fund all County services. In FY 2007/08 and 2008/09, the CAO substituted restricted accumulated forfeiture revenue from the County’s Dependent Care Assistance Program (DCAP) for TOT revenue, increasing GPR in those years by $250,000 to help balance the County budget. There remains a small balance of DCAP forfeiture funds to fund the Child Care Affordability Program for perhaps one more year.

Contra Costa Futures Fund: The diversion of GPR shown represents amounts of TOT from the Renaissance Hotel appropriated and expended through the CC Futures initiative. Absent the special Board allocation, this revenue would have been part of the GPR available to fund all County services.

Contra Costa Transfer Station-Martinez Surcharge Fees: The diversion of GPR shown is that portion of GP surcharge revenue allocated by the Board to the Building Inspection Division (external to the County General Fund) for code enforcement activities. Absent the allocation to the special code enforcement services, this revenue would have been part of the GPR available to fund all County services. All other surcharge revenue is allocated to County departments in the General Fund.

Crockett-Rodeo Cogeneration/Unocal: The diversion of GPR shown is the estimated portion of property tax revenue allocated by the Board to the Crocket Community for community projects that is in excess to the amounts the County is contractually obligated to provide (estimated conservatively at $360,000 annually). Absent the special Board allocation, this revenue would have been part of the GPR available to fund all County services.

Keller Canyon Landfill Surcharge Fees: The diversion of GPR shown is that portion of GP surcharge revenue allocated by the Board to the Building Inspection Division (external to the County General Fund) for code enforcement activities. Absent the allocation to the special code enforcement services, this revenue would have been part of the GPR available to fund all County services. All other surcharge revenue is allocated to County departments in the General Fund.
