Application for EC Jamunia UG (Phase – II) 1.0. Preamble The project report for Jamunia UG Coal Mine Project, Tehsil Amarwara, district , Madya Pradesh was prepared in November 2008 for a target capacity of 0.72 MTPA with a capital investment of 127.5223 Crores which was approved by WCL Board vide letter no. WCL/BD/SECTT/BM-216/2009/2219 dated 16.02.2009 and subsequent approval of WCL Board for 0.828 MTPA peak capacity vide letter no. WCL/BD/SECTT/BM-219/2009/2425 dated 21.08.2009.

Based on the aforesaid approved Project Report and consequent to our Form-1 application, TOR was granted vide MoEF letter no. J-11015/67/2009-IA.II (M) dated 15.04.2009 for 0.72 MTPA with a peak production of 0.828 MTPA over an ML area of 407 ha. The project was having a forest land of 74.7 ha. Subsequently EC was granted for Jamunia UG Mine Phase-I project for normative capacity of 0.72 MTPA and peak capacity of 0.828 MTPA in a ML area of 332.30 ha (407-74.70) without any forest land (Phase-I) vide MoEF’s letter no. J-11015/67/2009-IA.II(M) dated 31.12.2012 based on the recommendation of EAC in its meeting held on 27-28th August 2012 at New Delhi.

Now the stage-I FC for 54.639 ha of forest land involved in the aforesaid project has been secured vide MoEF’s letter no. 8-47/2017-FC dated 03.01.2018. Detailed clarification on quantum of forest land vis-a-vis Stage-I FC has been given at Point No. 5.0.

Based on the above, i.e. Stage-I FC approval and aforesaid EC for Phase-I, this application is being submitted for grant of EC for Jamunia UG (Phase-II) (dovetailing Phase-I). The details are submitted as below:-

2.0. Status of Mining Plan

The Project report (including Mining Plan with the MCP) has since been recast in Sept 2015 and the same has been duly approved by WCL Board in its 279th meeting held on 18.07.2016 vide item no. 279/C-9 for capacity of 0.84 MTPA with an estimated capital requirement of Rs. 409.8748 crores.

3.0. Justification for Phase-II

In this regard, reference is drawn to the minutes of 55th Expert Appraisal Committee (EAC) (Thermal & Coal Mining) meeting held on 27-28th August 2012 at New Delhi. The relevant portion of the minutes is reproduced below:-

1. The proponent informed that the total land requirement for proposed Jamuniya Underground project is 407.00 ha. Out of which 74.70 ha is forest land and the balance is non forest land. The break-up of total land requirement as submitted in the EIA/EMP is summarized as below:-

2. The proponent had informed that there is no forest land required under Surface right/All right. The application for forestry Clearance under FC Act, 1980 has already been submitted and registered vide No.CWA/MMM/2012-82 dated 05.05.2012 and the proposal is presently with the MP State Government. Now in view of the recommendation of EAC, the EC requires submission of Stage-1 Forest Clearance, which may take considerable time and there is urgent need for increase of coal production to meet the growing demand of power in the country. The proponent had suggested an alternative proposal which include, inter alia, (i) in the first phase, EC is solicited for the project without forest land i.e. with some production capacity in a ML Area of 332.30 ha; (ii) Public Hearing has been conducted for the entire project land i.e. 407.00 ha (iii) all issues regarding environmental aspects in the proposed underground project has been addressed and presented before EAC(T&C); (iv) There is no change in the mining method; (v) Since there is no forest land under Surface/All right the initial mining activities namely incline drivage can start after EC. The Incline drivage (two nos. of 840 m each) and sinking of air shaff (194 m depth) will take about 3 years. Thereafter, the main dip development can start below non-forest land along with development of panels namely Panel 6, 14, 15 & 16 also below non-forest land which will take another 3-4 years. Therefore, during these 6-7 years’ time, the Stage-1 Forest Clearance is likely to be obtained, and once the Stage-I Forest Clearance is received, fresh EC application will be made for annexing additional land (i.e. forest land only) within the same capacity. In view of our above submission EC for proposed Jamunia UG project for a normative capacity of 0.72 MTPA & peak capacity of 0.828 MTPA in a ML Area of 332.30 ha without any forest land in the first phase may kindly be granted. 3. The Committee recommended for granting Environment Clearance to Phase – I project. However, the proponent was asked to seek EC for phase – II activities after the approval of forest land. ”

As seen from the above, the EAC had recommended for granting EC for Phase-I project. Accordingly EC was granted for Phase-I without forest land vide letter dated 31.12.2012.

In the aforesaid minutes, EAC had also asked WCL to seek EC for Phase-II activities after the approval of forest land.

Now the approval of forest land (Stage-I FC) has been secured vide MoEF&CC’s letter dated 03.01.2018 (Copy of the same is enclosed as Annexure - IV). Hence this application for Phase – II is being made. 4.0. Public Hearing & Compliance Status

5.0. Land Acquisition

The Total Land involved in this project is about 299 hectares (291.57 ha under All Rights and 7 ha under Surface Rights) as per this Recast Project Report for Jamunia U/G Mine. The breakup of 299 ha of land is approximately 246 ha of Tenancy Land, 5 ha of Government Land & 41 ha of Forest Land required for the Project and 7 ha Tenancy Land required for Township.

The Project Report for Jamunia U/G Mine was approved by WCL Board on 22.02.2014 in which the total land provision was 376.94 hectares. Accordingly the acquisition of 376.94 hectares land is in final stage.

Out of 376.94 ha land, 299 ha land is actually required for Recast Project Report for Jamunia U/G Mine prepared in September 2015. The remaining 77.94 ha land to be acquired under Jamunia U/G Mine will be utilised in Expansion Project Report for Urdhan-Magrahi O/C Mine. The cost of 77.94 ha land will have to be transferred from Jamunia U/G to Urdhan-Magrahi O/C Report later on.

The breakup of land requirement as per RPR 2015 for 376.94 ha is summarized below:

Accordingly, the Total Land required for Jamunia U/G Mine is 376.94 hectares, out of which 310.638 hectares would be acquired under All Rights, 7.00 hectares under Surface Rights and 59.302 hectares under Mining Rights (Forest Land).

As per actual acquisition, the land break up has been changed. Out of total 376.94 ha, 315.301 ha would be acquired under under All Rights, 7.00 ha under Surface Rights and 54.639 ha under Mining Rights (Forest Land).

In this Recast Project Report, the rehabilitation of Jamunia bastis / village are not proposed as only development has been considered beneath these villages taking angle of draw into consideration. However, In the Expansion Project Report for Urdhan-Magrahi O/C Mine submitted to WCL (yet to be approved), the rehabilitation of Jamunia bastis / village have been proposed, as overburden dumping has been proposed on the above land.

Accordingly, the stage-I FC has been secured for 54.639 ha. 6.0. Subsidence Management

Since underground mining method of coal extraction has been adopted in this mine and working is below 100 m depth, it is anticipated that no serious damage to the landscape and land use pattern will occur in this region.

In underground mining the damage to surface land occurs because of subsidence, which takes place during depillaring operation. However, the magnitude of subsidence depends on various factors viz.

i) Thickness of the seam ii) Percentage of extraction iii) Depth of the working iv) Width of the working v) Dip of the seam vi) Method of working vii) Goaf Support. viii) Nature of overlying strata. ix) Geological disturbances x) Surface topography etc.

Regarding subsidence prediction, a study has already been carried out in the adjacent project i.e. Dhankasa UG having same mining method and similar geo – mining condition and the same is reproduced below.

SUBSIDENCE MANAGEMENT

4. However, it is anticipated that, Forest may not be considerably affected by subsidence only the trees falling on the edges of the subsidence zone and surface cracks may get tilted or dislodged.

5. The Dhumka dhanna village and electric transmission are not likely to be affected by subsidence.

6. Close subsidence monitoring could be done over the panels while carrying out extraction in the upper seam-II (packet).The impact of subsidence and effectiveness of mitigative measures would be reviewed before the starting of depillaring in the lower seam –IV (combined).

7. Necessary corrections in subsidence estimation will be done.

Caving is proposed as method of extraction in this report. The depth of the mine varies from around 105m to 280m. The surface topography is hilly in nature and major portion is covered with forest. Subsidence Prediction studies were carried out by CMPDI (HQ) in July 2006. As per this study, the maximum anticipated subsidence over the mining area at the end of the mine life is 2.935m. The maximum possible slope and tensile strain likely to occur over the mining area are 39.39 mm/m and 20.96 mm/m respectively over panel IX. The perennial Gunor river and the seasonal Junapani nalla are unlikely to be affected by subsidence because sufficient barrier or solid coal pillars are proposed to be left vertically below and within 35o angle of draw from the river / nalla. The seasonal Dhankasa nalla is likely to be affected by a maximum of 0.084m subsidence and 0.80 mm/m tensile strain near panel I in Seam-IV (Combined) which is well within the permissible limits. The other small seasonal streamlets over the mining area are likely to be affected by a maximum of 2.640m subsidence and 19.38 mm/m tensile strain. Thus, due care has to be taken while extraction is done below them, such as avoiding extraction during monsoon and filling up the cracks developed in the streamlets bed, when dry, to avoid inrush of water below ground in the rainy season.

It is anticipated that the forest may not be considerably affected by subsidence. Only the trees falling on the edges of subsidence zones and surface cracks may get tilted or dislodged. After 20 years of mining some stretches of forest roads running over the mining area are likely to be affected by a maximum of 1.412m subsidence and 6.90mm/m tensile strain. Bhumka Dhana village and the electric transmission line are not likely to be affected by subsidence. It is recommended that while carrying out extraction in the upper Seam-II (Packet), close subsidence monitoring should be done over the panels. The impact of subsidence and effectiveness of mitigative measures should be reviewed before starting depillaring in the lower Seam-IV (Combine). On the basis of observed data, necessary correction in subsidence estimation may be done, if necessary.

While estimating the seam-wise extractable reserves, angle of draw of 35o has been considered. It is proposed to acquire the surface area affected due to subsidence and fence it to prevent unauthorized entry. The working of the mine has been planned considering the Subsidence prediction Studies carried out by CMPDIL. The liquidation plan has been prepared with the recommendations of the study. As per the study, except over the panel, the values of tensile strain likely to occur over the entire forest area after extraction of both the seams are below the permissible limit of 20 mm/m as prescribed by MOEF. To restrict the tensile strain within the permissible limit of 20 mm/m in the forest area, a time lag of about 5 years is to be maintained between extractions of successive panels in superimposition. This will allow the strata to settle before the extraction of lower seam. The magnitude of the cumulative slope/tilt is not likely to cause falling of trees as it will take place in two steps and at an interval of 5 years. It would be pertinent to mention here that the panel No. 9 in Seam – II packet will be developed and extracted in the 9th and 10th year while the same panel in Seam – IV combined will be developed and extracted in the 19th /20th & 21st year. This is in line with the Subsidence Prediction Report (an interval of more than 5 years which will significantly reduce the chances of tilting of trees). From the study report it is seen that the surface topography of the mining area is undulating with hills and valleys. The ground elevation varies from 720 m to 890 m i.e. difference of elevation of 170 m. For such terrain, the maximum anticipated subsidence of 2.935 m is unlikely to affect the drainage pattern of the area.

The depth of working in proposed Jamunia UG will vary from 108 m to 284 m with same set of seams. Therefore, it can be concluded that, the impact due to subsidence on surface at proposed Jamunia UG will be similar to Proposed Dhankasa UG and as such the impact on the drainage pattern of the area and on forest will be insignificant. While estimating the seam-wise extractable reserves, angle of draw of 35o has been considered. It is proposed to acquire the surface area affected due to subsidence and fence it to prevent unauthorized entry. Capital provision for compensatory afforestation and crop compensation has also been made in the PR. The subsidence cracks which reach the surface will be packed tightly with soil and mud and non-carbonaceous debris and regularly dozed so that topography does not change substantially and artificial water bodies are not created. 7.0. Land Reclamation / Management

Since underground mining method of coal extraction has been proposed in this mine, it is anticipated that no serious damage to the landscape and land use pattern will occur in this region. The detailed control measures to be adopted for controlling the subsidence as far as possible is being discussed here. The following measures and precautions shall be taken.

1. Around the depillaring area, co-related on the surface, protective bunds and garland drains shall be laid so that no water from surface enters the subsidence area, and through the cracks to the working area. 2. The surface cracks shall be sealed up by using shale, clay or other suitable material. 3. Depressed portions shall be leveled up using soil or clay or other suitable material.

There is statute to guide the development of seams below permanent structures, water bodies, etc so that the stability of the same is not endangered and also the safety of workings and workers below ground is ensured. In the project /mine under consideration the development of the seam has been planned in accordance with the statute.

It is also a statutory requirement to monitor subsidence regularly. For this purpose, grid pillars are located 30 m apart at the surface over the working panels land at intervals of 50 m beyond. Level sections are taken every quarter and plotted. These will provide information regarding progress of subsidence till stability or equilibrium conditions are reached.

The above mitigative measures, stipulations and their enforcement result in effective monitoring of subsidence.

Any cracks or potholes formed consequent to underground coal extraction would be filled up from time to time. However, the entire operation will be carried out strictly in accordance with the permission of DGMS & related guidelines. Regular monitoring will be carried out & records will be maintained as per statute. 8.0. CSR Activities in Pench Area For the Last 5 Years

WCL as a responsible corporate organization in Central India is playing a significant role in developing the region around its mines in the States of & .

WCL takes up various infrastructural development works in the surrounding area covering the felt needs of the local community. Total expenditure incurred for various works undertaken by WCL in Pench area during last five years is given below. Jamunia UG mine falls in Pench Area, as such different CSR activities will continue to be undertaken including Jamunia UG.

As directed through memorandum No. 55011-01-2009-CPAM of Government of India, Ministry of Coal, Shastri Bhawan, New Delhi dated 27/08/2009, Mine Closure Plan has to be enclosed with all PRs / EMPs. In the Annexure to this memorandum, guidelines for preparing the Mine Closure Plan and assessing the capital cost of mine closure have been specified.

Mine Closure cost has been computed based on the recent guidelines circulated by Government of India, Ministry of Coal, Shastri Bhawan, New Delhi. The closure activities will include subsidence survey for a period of 3 years after mine closure, filling of subsidence cracks, fencing of caved out area and post-project monitoring for a period of 3 years after mine closure.

Taking the recent guidelines into consideration, the Mine Closure Cost in this Recast Project Report for Jamunia U/G Mine works out to Rs. 4.47/t. The detailed calculations are tabulated as under:

10.0. Present Proposal (Phase-II including Phase-I)

As detailed out in Para 2.0., the original plan has been recast and the Recast PR (including mining plan) has been duly approved by WCL Board in its 279th meeting held on 18.07.2016. A copy of the Board approval is enclosed as Annexure – III. As explained earlier, EC for Phase-I (0.828 Peak in 332.30 ha) is already in place. Now EC is being for Phase-II dovetailing Phase-I based on the aforesaid approved recast PR.

The present proposal is based on the aforesaid approved Recast PR vis-à-vis the actual acquisition and Stage-I FC with the following parameters:- i). Land Area - 376.940 ha a). Tenancy Land – 308.585 ha b). Govt. Land – 13.716 ha c). Forest land - 54.639 ha ii). Capacity - 0.72 MTPA (Normative) and 0.828 MTPA (Peak)

However, normative capacity has increased from 0.72 MTPA to 0.84 MTPA and peak capacity has increased from 0.828 to 1.05 MTPA in the recast approved PR. Now since, TOR was granted for normative 0.72 MTPA & Peak 0.828 MTPA and Public Hearing was completed against the aforesaid TOR capacity, therefore under Phase-II, the production capacity is proposed same i.e. 0.72 MTPA (normative) and 0.828 MTPA (Peak). However, although the TOR was accorded for 407 ha and Public Hearing completed for 407 ha, the land area solicited for Phase-II is 376.94 ha (which is within 407 ha).

c. Status of other activities:

I. Consent to Establish for Jamuniya UG for a capacity 0.828 MTPA in Mining Lease area 332.30 ha have been obtained vide no. 2977/TS/mine/MPPCB/2015 dated 02/05/2015 from MPPCB. II. 194.94 ha of tenancy land is under physical possession from 186 Nos. of landowners. III. Stage – I forestry clearance for Diversion of 54.639 Ha. of Revenue Forest land in favour of M/s Western Coalfields Limited for Jamunia Pathar under Ground Coal Mining Project in West under the Chhindwara Forest Division, Madhya Pradesh State has been accorded by MoEF, New Delhi vide their letter No: F. No. 8-47/2017- FC dt: 3rd January, 2018. IV. Service building i.e. Manager’s office with toilet has been constructed. V. Work Order vide No: WCL/Pench/SO/E&M/WO/219/16-17 dt: 07/07/2016 was issued to M/s Sawan Associates, Electrical Contractor and Supplier, Katol Road, Nagpur for erection of 33KV, 1.8 Km overhead line of H beams 152X152 mm, 37.01 Kg.mt, 13m long supports with Dog Conductor with average span of 70m, power supply arrangement at Jamunia UG mine has been awarded and the work has been accomplished. VI. One substation is under construction. VII. As per the PRP, drivage of Incline and sinking of air shaft is to be completed in 2 yrs. time from 2nd to 3rd yr. and it has been presumed that coal production will start from 4th yr. onwards. VIII. Incline drivage work has been awarded to M/s Singh & Sons contractor, Nagpur vide work order No: NGP/WCL/CIVIL/1056 dt: 12-13/08/2015. In pursuance of the work order the contractor commenced inclines drivage work from 25th Nov. 2015. It will take another 2 yrs. time to complete incline drivage work. IX. Progress of Incline No. 1 is around 137 m and incline No. 2 is around 129 m. Progress is hampered due to non-possession of land for installation of drive head. Progress of Incline No: 1 has been stalled due to encounter of loose strata material and approved support design is awaited. Estimate as per approved design prepared by CMPDIL, Ranchi and is under approval stage. X. Proposal for air shaft is under scrutiny.

12.0. Submission

Therefore, Environmental Clearance is solicited for Jamuniya Underground Phase-II project for a normative capacity of 0.72 MTPA and peak capacity of 0.828 MTPA in a ML area of 376.94 ha (dovetailing Phase-I and including forest land 54.639 ha) located in Pench-Kanhan Coalfield, district Chhindwara, Madhya Pradesh.

MINUTES OF THE 55 th EXPERT APPRAISAL COMMITTEE (EAC) (THERMAL & COAL MINING) MEETING HELD ON 27 th -28 th AUGUST 2012 IN ANNEXE I & II,SCOPE CONVENTION CENTRE, SCOPE COMPLEX, LODI ROAD, NEW DELHI.

COAL MINING PROJECTS

The 55 th meeting of the reconstituted EAC (T &C) was held on 27 th -28 th August 2012 in Fazal Hall, Scope Convention Centre, Scope Complex, New Delhi to consider the projects of coal mining sector. The list of participants of EAC and the proponents is at Annexure-1 and 2 respectively. The Committee, while welcoming the new Member Secretary & Director Dr. Manoranjan Hota, bid farewell to Dr. T. Chandini, Member-Secretary & Director who has been given other assignments in the Ministry. The Committee had appreciated her constructive contribution for smooth and effective functioning of the Committee. Dr.Chandini also thanked the Committee for all the support in discharging her duties within the framework of EIA notification.

Confirmation of the minutes of the 53 rd meeting of EAC (T&C) held on 18 th-19 th July 2012 was confirmed.

1. Expansion of Coal Washery (2.4 MTPA to 3.6 MTPA) of M/s Hind Energy & Coal Beneficiation (India) Pvt. Ltd., located in village Hindadih, dist. Bilaspur, (EC based on TOR granted on 23.09.2010)

The proponent made the presentation. It was informed that the proposal is for expansion of the Coal washery at village Hindadih, district Bilaspur from the present 2.4 MTPA capacity (dry process) to 3.6 MTPA, whereby an additional unit of 1.2 MTPA using wet process would be added within existing plant premises. EC was granted for the existing washery vide MOEF letter dated 24.06.2008. The expansion has been necessary as many of the clients (end users) have sought washed coal with an ash content of about 34% which the dry process is not able to meet. The expansion washery would be established within 6 months. It was informed that the dry process technology involving mainly deshaling and crushing and sizing and removal of non-coal material helps reduce the ash content from 45-47% to 39%. The source of raw coal 1.2 MTPA with 46.21 % ash content would continue to be Gevra-Dipka mines of M/s SECL located at a distance of 30-40 km and others to whom the company has entered with MOU. The washed coal would be 0.78 MTPA with 35.42% ash content. Rejects would be 0.42 MTPA with 59.81% ash. It was informed that coal transportation is by rail from Gevra Railway Siding to a private Railway Siding located at a distance of about 6-7 km from the washery unit. Railway siding would be completed in 3 years time. It was informed that raw coal would be transported by rail up to Gevera railway station and a dedicated railway siding is proposed to be laid at Gatora railway station and from there by road in covered trucks up to site. The land for railway siding has already been acquired at Gatora. DPR & drawing have already been approved by South Eastern Central Railways. Proponent has asked extension till March 2014 for laying railway siding due to some policy decision from Ministry of Railway and extension granted by MoEF upto March 2014. Washed coal from the plant would be transported by road in covered trucks directly to customer either by road up to Gatora and from there by rail to the customer. The mode of transportation of washed coal with rejects would be depending on the MOU with customer, which either by road or rail transports. The entire quantity of coal rejects of 0.42 MTPA would be given to M/s Ind. Synergy Ltd. A MOU has been signed with M/s Ind. Synergy Ltd regarding utilization of washery rejects. Rejects and middling would be transported to M/s Ind. Synergy Ltd. by Rail which operating an integrated steel plant at Raigarh, Chhattisgarh. Rejects would be earlier stored in pucca plate form. The washery has Zero discharge. The effluent from the plant would lead to the thickener

from the MPPCB along with the video recording (CD) of the public hearing so as to enable the EAC to deliberate further.

3. The Committee, after discussions, decided to further consider the proposal upon receipt of the aforesaid details.

7. Wanoja OCP (0.50 MTPA normative and 0.575 MTPA peak in an ML area of 485.46 ha) of M/s WCL, located in Tehsil Warora, dist. Chandrapur, Maharashtra (Further consideration of TOR)

1. The project was earlier considered in EAC meeting held on 24-25.2.2010 & 28-29.04.2010.

2. Based on the presentation and deliberations, the Committee was of the view that most of the project area (455.46 ha) is on agriculture land with a single crop. Cotton is the main crop being cultivated in the area. The life of the mine is only about 10 years. The Committee was of the opinion that there would be about 300 inhabitants who are depending on this land for agriculture and their livelihood, will loose their land. The Committee desired that a Social Cost Benefit analysis should be carried out to see the viability of the mining activities. The Committee also desired that opinion of NEERI, Nagpur should be obtained in this regard.

3. The Committee after discussions decided to further consider the proposal upon receipt of the aforesaid details.

8. Chhinda OCP Expansion (0.18 MTPA to 0.65 MTPA in the existing ML area of 106.68 ha) of M/s Western Coalfields Ltd., Tehsil Parasia, dist. Chindwara, M.P. (Further consideration of EC based on TOR)

1. The above cited project had already been recommended for EC. The Proponent had informed that the work order of Base line data collection has already been given to CMPDI for the year 2012- 13 by vide letter dated WCOLI/MUKH./Parya/17-A/548 dated 14.08.2012. The proponent should furnish the seasonal data PM 2.5, PM 10 as specified in the TOR. The proponent should also submit the work order.

2. The Committee after discussions decided to further consider the proposal upon receipt of the aforesaid details.

9. Jamuniya UG (0.72 MTPA to 0.828 MTPA) of M/s Western Coalfields Ltd.,, dist. Chindwara, M.P.

1. The proponent informed that the total land requirement for proposed Jamuniya Underground project is 407.00 ha. Out of which 74.70 ha is forest land and the balance is non forest land. The break-up of total land requirement as submitted in the EIA/EMP is summarized as below:-

2. The proponent had informed that there is no forest land required under Surface right/All right. The application for forestry Clearance under FC Act, 1980 has already been submitted and registered vide No.CWA/MMM/2012-82 dated 05.05.2012 and the proposal is presently with the MP State Government. Now in view of the recommendation of EAC, the EC requires submission of Stage-1 Forest Clearance, which may take considerable time and there is urgent need for increase of coal production to meet the growing demand of power in the country. The proponent had suggested an alternative proposal which include, inter alia, (i) in the first phase, EC is solicited for the project without forest land i.e. with some production capacity in a ML Area of 332.30 ha; (ii) Public Hearing has been conducted for the entire project land i.e. 407.00 ha (iii) all issues regarding environmental aspects in the proposed underground project has been addressed and presented before EAC(T&C); (iv) There is no change in the mining method; (v) Since there is no forest land under Surface/All right the initial mining activities namely incline driavge can start after EC. The Incline driavge (two nos. of 840 m each) and sinking of air shaff (194 m depth) will take about 3 years. Thereafter, the main dip development can start below non-forest land alongwith development of panels namely Panel 6, 14, 15 & 16 also below non-forest land which will take another 3-4 years. Therefore, during these 6-7 years time, the Stage-1 Forest Clearance is likely to be obtained, and once the Stage-I Forest Clearance is received, fresh EC application will be made for annexing additional land (i.e. forest land only) within the same capacity. In view of our above submission EC for proposed Jamuniya UG project for a normative capacity of 0.72 MTPA & peak capacity of 0.828 MTPA in a ML Area of 332.30 ha without any forest land in the first phase may kindly be granted.

3. The Committee recommended for granting Environment Clearance to Phase – I project. However, the proponent was asked to seek EC for phase – II activities after the approval of forest land .

10. Internal Discussion on ‘Environmental Clearance for ‘Slurry Washery Projects’ under the EIA Notification 2006.

The committee has desired to be apprised with a brief note on the subject, which could be discussed in the subsequent meeting.

11. Internal consideration of Letter dated 18.06.2012 from M/s Ltd. on deleting Mohanpur OCP from Revised application for TOR for Cluster-4 Group of 4 mines located in Raniganj Coalfields, dist. Burdwan, W.B, considered in EAC (T&C) meeting held on 21 st -22 nd February 2012.

The EAC in its meeting held on 21-22 February, 2012, M’S ECL had included Mohanpur OCP as a part of the cluster-4. At the same time, MoEF had also separately received intimation from the Ministry of Coal stating that Mohanpur OCP would be expanding by 25% during the current year, then a separate application would be required to be made for Monaharpur OCP expansion for 1.5 MTPA under clause 7(ii) of the EIA Notification 2006. The Committee had earlier decided that a clarification be obtained from M/s ECL in this regard before considering the grant of the ToR. The Committee considered the information and desired that a self explanatory note be prepared for consideration in the next Committee.

This is with reference to letter No 43011/16/2009- CPAM dated 04.03.2009 for Terms of Reference, which was granted vide MOEF letter dated 15.04.2009 and with reference to-application for environmental clearance based on the prescribed Terms of Reference vide letter No. WCL/HQ/ENB/8- G/629 dated 21.10.2009 and letters dated 09.03.2010, 12.07.2011 and 17.08.2011 on the above• mentioned subject. Tlie Ministry of Environment & Forests has considered the application. It has been noted that the proposal is for opening a new underground coalmine of 0. 72 MTPA & peak capacity of 0.828 MTPA in a ML Area of 332.30 ha of which, 325.305 ha is tenancy land. 9.0 ha is Govt.land and no forest land is involved in the present proposal. 316.24 ha is all right land and 7.0 ha is land for surface right. is required for shaft and surface infrastructure like CHP, building and colony. The mine is located at about ~3 km from the viable tiger corridor and is f1ank[by Mandia North and Mandia s.~mth UG mines. 1 River Pench flows 1.5-2.5 km from the southern an western boundaries of the lea~e area. Mining methodology is Board & Pillar and continuous miner. T working depth is about I 94m-400m bgl. Grade of coal is C to E and B to D in the lower seams. Since there is no forest land under Suiface/All right, the C7/-· _.;,. initial mining activities namely incline driavge can start after EC. It was informed that it is proposed to acquire it (all rights).Mineral transportation would be by road to railway siding proposed at a distance of 15 km at Parasia railway siding (existing Railway Siding of WCL) and by rail thereafter to the linked sponge iron plant located at a distance of 400km. belt conveyors_ for coal transportation. No R&R is involved. CSR would be undertaken at Rs 10 /T of coal. A budgetary provision , of Rs 5/tonne_ of coal. has been made under the CSR for undertaking socio-economic· activities for the adjoining villages .. Life of the project is about 3 7 years. Public Hearing was held on 30.7.2009. The capital cost of the project is Rs.127.5223 crores.

2. The Ministry of Environment & Forests hereby accords environmental clearance to the above• mentioned Jamuniya underground coalmine Project Phase -I of Mis Western Coalfield Ltd. for a normative Production capacity of 0.72 MTPA & peak capacity of 0.828 MTPA in a ML Area of 332.30 ha, without any forest land, under the provisions of the Environmental Impact Assessment Notification, 2006 and subsequent amendments thereto and under MOEF Circulars there under subject to the compliance of the terms and conditions mentioned below: ·

A. Specific Conditions:

(i) . Regular monitoring of subsidence movement on the surface over and around the working area and impact 011 {:<1rnral drainage pattern, water bodies, vegetation, structure, roads, · and surroundings shall be continued till movement ceases completely ln case of observation of any high rate of subsidence movement, appropriate effective corrective measures shall be taken lo avoid loss of life and material. Cracks shall be effectively plugged with ballast and clayey soil/suitable material. (ii) 'rf subsidence is found exceeding the permitted limits, then the landowners shall be adequately compensated with mutual agreement of the landowners.

(iii) Mining shall be carried out as per statuette at a safe distance from the river/nallah flowing adjacent to the lease boundary.

(Iv) High root density tree species shall be selected and planted over areas likely tobe affected by subsidence.

(v) Coal Extraction shall also be optimised in areas where agricultural production is continuing. Some pillars shall be left below the agricultural land. No depillaring & coal extraction should be carried out below habitation, H.T. Lines & beneath road, water bodies

(vi) Subsidence shall be monitored closely and if subsidence is found exceeding the permitted limits, then the landowners shall be adequately compensated with mutual agreement with the landowners. , (vii) 3-tier plantation should be developed 2 km stretch of road from the mine using native species

(viii)Garland drains (size, gradient and length) around the safety areas such as mine shaft and low l) lyirig areas and sump capacity shall be designed keeping 50% safety margin over an above the peak sudden rainfall and maximum discharge in the area adjoining the mine sites. Sump capacity shall also provide adequate retention period to allow proper settling of silt material.

(ix) Water sprinkling system shall be provided to check fugitive emissions from loading operations, conveyor system, haulage roads, transfer points, etc. Major approach roads shall be black topped _ __and pf~p_erly maintained. · (x) Transportation. of coal from the· mine torailway siding -proposed at a distance.of.15 km at Parasia _ railway siding (existing Railway Siding of WCL should be by 20T mechanically covered trucks.

(xi) A progressive afforestation plan· shall be· prepared and implemented over the mine lease area acquired and shall include areas under green beit development, areas along roads, infrastructure, along ML boundary and township etc, by planting native species in consultation with the local DFO/Agriculture Department.

(xii) Regular monitoring of groundwater level and quality shall be carried out by establrsning a network of exiting wells and construction of new peizometers. The monitoring for quantity shall

Jamuniya_EC 2 be done four times a year in pre-monsoon (May), monsoon (August), post-monsoon (November) and winter (January) seasons and for quality in May. Data thus collected-shall be submitted to the Ministry of Environment & Forests and tot eh Central Pollution Control Board quarterly within one month of monitoring. (xiii) Acid Water Treatment Plant, volume of water to be treated and disposal of brine should be provided. · ·

(xiv) Mine discharge water outside the ML shall be monitored, particularly for TDS and treated to conform to prescribed levels before discharge into the natural environment.

(xv) The Company shall put up artificial groundwater recharge measures for augmentation of groundwater resource, in case water table shows a declining trend. The project authorities shall meet water requirement of nearby villagers) in case the village wells go dry due to dewatering of mine.

(xvi) Besides carrying out regular periodic health check up of their workers, 10% of the workers identified from workforce engaged in active mining ·operations shall be subjected to health check up for occupational diseases and hearing impairment, if any, through an agency such as NIOH,Ahmadabad within a period of one year and the results reported to this Ministry and to DGMS. (xvii) The user agency. shall contribute on proportionate basis, the amount required for implementation of the Habitat Restoration of Pench-Satpura Tiger corridor plan to be prepared by the NTCA for rejuvenation· and restocking of the flora-fauna found in the viable corridor to ensure · the long-term survival of the tiger population and the mitigative measures to eliminate/minimise the adverse impact of the transportation of coal to be extracted from the Pench-Kanhan coal fields on the viable corridor. .

(xviii) The mining in the existing mines would be phased out after expiry of the current mining lease arid after reclamation of mined over area. The operating mines may be analysed and monitored · for compliance of conditions, having bearing with movement of wild life until such time they are closed/phased out ·

(xix) Project specific CSR for an amount of Rs5/Tonne of coal production should be provided for the activities under CSR undertaken for the neighboring villages shall be for not less than Rs 10 per tonne of coal and the progress made thereon shall be uploaded on the company annually on the company website. Monitoring of the impacts of activities under CSR shall be carried out periodically. · ( .. ,_l (xx) A Final Mine Closure Plan along with details of Corpus Fund shall be submitted to the Ministry of Environment & Forests 5 years in advance of final mine closure for approval. · (xxi) Corporate Environment Responsibility:

a) The Company shall have a well laid down Environment Policy approved by the Board of Directors. b) The Environment Policy shall prescribe for standard operating process/procedures to bring into focus any infringements/deviation/violation of the environmental or forest norms/conditions. · c) The hierarchical system or Administrative Order of the company to deal with

d). To have proper checks and balances, the company shall have a well laid down system of reporting of non-compliances/violations of environmental norms to the Board of Directors of the company and/or shareholders or stakeholders at large.

B. General Conditions:

(i) No change in technology and scope of working shall be made without prior approval of the Ministry of Environment and Forests.

(ii) No change in the calendar plan including quantum of mineral coal and waste being produced shall be made.

(iii) Four ambient air quality monitoring stations shall be established in the core zone as· well as in the · buffer zone for monitoring PM10, PM2.5, S02 and NOx. Location of the stations shall be · decided based ·on the. meteorological data, topographical features and environmentally and ecologically sensitive targets in consultation· with the State Pollution Control Board. Monitoring of heavy metals such as Hg, As, Ni, Cd, Cr, in RSPM etc. shall be carried out at least once in six months.

(iv) Data on ambient air quality (PMIO, PM2.5, S02 and NOx and heavy metals such as Hg, As, Ni, Cr, etc) and other monitoring data shall be regularly submitted to the Ministry including its Regional Office at Bhopal and to the State Pollution Control Board and the Central Pollution Control Board once in six months. Random verification of samples through analysis from independent laboratories recognised under the EP Rules, 1986 shall be furnished as part of the compliance report.

(v) Adequate measures shall be taken for control of noise levels below 85 dBA in the work environment. Workers engaged in blasting and drilling operations, operation of HEMM, etc shall be provided with ear plugs/muffs.

(vi) Industrial wastewater (workshop and wastewater from the mine) shall be properly collected, and treated so as to conform to the standards including for heavy metals before discharge prescribed 1 under GSR 4 22 (E) dated 19 h May 1993 and 3 l" December 1993 or as amended from time to time. Oil and grease trap shall be installed before discharge of workshop effluents.

(vii) Vehicular emissions shall be kept under control and regularly monitored. Vehicles used for transportation of the mineral shall be covered with tarpaulins and optimally loaded.

(viii) Monitoring of environmental quality parameters shall be carried out through establishment of adequate number and type of pollution monitoring and analysis equipment in consultation with the State Pollution Control Board and data got arialysed through a laboratory recognised under EP Rules, 1986.

· (ix) Monitoring of outlet points should be carried out and records of same should be maintained and submitted'to theRegionalOffice ofthe MOEF as part of the Compliance Report .

. ~ . ' (x) Personnel working in dusty areas shall wear protective respiratory devices and they shall also be provided with adequate training and information on safety and health aspects. Occupational health surveillance programme of the workers shall beundertaken periodically to observe any contractions due to exposure to dust and to take corrective measures, if needed.

Jamuniya_EC ~ 4 (xi) A separate environmental management cell, withsuitable qualified personnel shall be set up under the control of a Senior Executive, who will-report directly to the Head of the company.

(xii) The funds earmarked for environmental protection measures shall be kept in separate account and shall not be diverted for other purpose. Year-wise expenditure shall be reported to this Ministry and its Regional Office at Bhopal.

(xiii) The Project authorities shall advertise at least in two local newspapers widely circulated around the project; one of which shall be in the vernacular language of the locality concerned within seven days of the clearance letter informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution control Board and may also be seen at the website of the ministry of Environment & Forests at http://envfor.nic.in

(xiv) A copy of the environmental clearance letter shall be marked to concerned Panchayat/Zila Parishad, Municipal Corporation or Urban Local Body and local NGO, if any, from whom ar.y suggestion/representation has been received while processing the proposal. A copy of the clearance letter shall also be displayed on the company's website.

(xv) . A .copy of the clearance letter shall be displayed on the website of the· concerned State Pollution . Control Board. The EC letter shall also be displayed at the Regionai Office, District 'Industry Centre and Collector's Office/Tehsildar's Office for 3_0 days.

(xvi) The clearance letter shall be uploaded on the company's website. The compliance status of the stipulated EC conditions shall also be uploaded by the project authorities on their website and updated at least once every six months so as to bring the same in the public domain. The monitoring data of environmental quality parameters (air, water, noise and soil) and critical pollutants such as PMI 0, PM2.5, S02 and NOx (ambient and stack if any) and critical sectoral parameters shall also be displayed at the entrance of the project premises and mines office and in corporate office and on the company's website.

(xvii) The project proponent shall submit six monthly reports on the status of compliance of the stipulated environmental clearance conditions (both in hard copy and in e-mail) to the respective Regional Office of the MOEF, the respective Zonal offices of CPCB and the SPCB.

(xviii) The Regional Office of this Ministry located at Bhopal shall monitor compliance of the stipulated conditions. The Project authorities shall extend full cooperation to the office(s) of the Regional Office by furnishing the requisite data/ information/monitoring reports. ·

(xix) The environmental statement for each financial year ending 31st March in Form-V is mandated to be submitted by the project proponent tot the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be uploaded on the company's website along with the status of compliance of EC conditions and shall be sent to the respective Regional Offices of the MOEF by E-mail.

3. The Ministry or any other competent authority may stipulate any further condition for environmental protection. · 4. . Failure to comply with any of .the conditions mentioned above may result in withdrawal of this clearance and attract the provisions of the Environment (Protection) Act, IQ86: s· .. The above conditions: will be -tinforced inter-alia.: under the provisions of the Water (Prevention & • I Control of Pollution) Act, 1974, the Air. (Prevention & Control of Pollution) Act, 1_981, the Environment (Protection) Act, 1986 and the Public Liability Insurance Act, 1991 along with their Jamuniya_EC 5 amendments and Rules. The proponent shall ensure ·to undertake and provide for the costs incurred for taking up remedial measures in case of soil contamination, contamination ~f gro. ndwater and surface water, and occupational and other diseases due to the mining operations.

Sub: Diversion of 54.639 ha of Revenue Forest Land in favour of M/ s. Western Coalfields Limited for Jamunia Pthaar Under Ground Coal Mining Project in West Chhidwara District under the Chhindwara Forest Division, Madhya Pradesh State. Sir, . I am directed to refer to the State Government of Madhya Pradesh's letter No. F- 1/FP /MP /MIN/10885/2015/10-11/1634 dated 13.06.2017 on the subject mentioned above seeking prior approval of the Central Government under Section-2 of the Forest (Conservation) Act, 1980 and to say that the proposal has been examined by the Forest Advisory Committee constituted by the Central Government. ·

2. After careful examination of the proposal of the State Government and on the basis of the recommendations of the Forest Advisory Committee, in-principle/ Stage-I approval pf the Central Government is hereby granted for diversion of 54.639 ha of Revenue Forest Land in favour of M/ s .. Western Coalfields Limited for Jamunia Pthaar Under Ground Coal Mining Project in West Chhidwara District under the Chhindwara Forest Division, Madhya Pradesh State, subject to the following conditions: · (i) Legal status of the diverted forest land shall remain unchanged; (ii) No opening and breaking of land for mining will be done in Forest Area. In case of any damage to surface by way of underground work, the company shall pay all damages and recoveries; (iii) The forest clearance will be for 20 years from the date of issue of final stage-II clearance; (iv) The User Agency shall maintain the boundary of the mine with greenbelt of at least three rows of trees of local species; · (v) The whole forestland in the mining lease area will be planted with local species in consultation and association with pie forest department at the cost of user agency. The user agency will prepare afforestation scheme for surface area and submit before stage-II clearance · and deposit the fund in compensatory afforestation fund managed by CAMP A; (vi) The User Agency shall take adequate protection measure not to damage any nala/ river/ small stream/ dams during the underground mine and shall maintain the

/ \, \ mine with green belt of 50 meter with at least three rows of trees on both side of nala /river/ small stream; (vii) The rights of the peoples allotted under FRA, 2006 shall be settled by following due procedure prescribed under The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, whichever applicable. The provisions of FRA 2006 shall be complied by the State Government; (viii) The user agency will provide the certified copy of approved 3D modelling for the project depicting the maximum tensile strength as per the approved 3D modelling and the width of surface cracks as per the approved 3D modelling; ·

(ix) The ground area over the mine shall not be allowed to be used for construction of residential buildings; (x) State Government shall ensure that green cover on the ground over the underground part of mine shall be maintained as forest and supplemented by plantations in gaps at the cost of user agency; (xi) The User Agency shall transfer online, the admissible Net Present Value (NPV) of the forest land being diverted under this proposal, as per the orders of the Hon'ble Supreme Court of India dated 28.03.2008, 24.04.2008 and 09.05.2008 in Writ Petition (Civil) No. 202/1995 and the guidelines issued by this Ministry vide its letter No. 5- 3/2007-FC dated 05.02.2009. The requisite funds shall be transferred through online portal into Ad-hoc CAMP A account of the State Concerned; · (xii) At the time of payment of the Net Present Value (NPV) at the then prevailing rate, the User Agency shall furnish an undertaking to pay the additional amount of NPV, if so determined, as per the final decision of the Hon'ble Supreme Court of India; (xiii) Fencing, protection and regeneration of the safety zone area [7.5 meters strip shall be kept within the mining lease boundary and area of the-safety zone shall be part of the total area -of mining lease as per the Ministry's guidelines dated 27.05.2015 ] shall be done within three year at the project cost from the issue of Stage-II Clearance. Besides this afforestation on degraded forest land to be selected elsewhere measuring one & a half times the area under safety zone shall also be done at the project cost; The degraded forest land (DFL) so selected ,will be informed to the MoEF & CC with shape files and afforestation will be done within three years from the date of Stage-II clearance and maintained thereafter in accordance · with the approved Plan in consultation with the State Forest Department; (xiv) Any fund received from the user agency under the project and deposited in the State Forest Department account, except the funds realized for regeneration/ demarcation of safety zone, shall be transferred through online portal into Ad-hoc CAMP A account of the State Concerned; . (xv) The User Agency shall obtain the Environment Clearance as per the provisions of the Environmental (Protection) Act, 1986, if required; (xvi) No labour camp shall be established on the forest land; (~vii) The User Agency shall provide fuels preferably alternate fuels to the labourers and S- the staff working at the site so as to avoid any damage and pressure on the nearby forest areas; (xviii) The boundary of the diverted forest land, mining lease and safety zone, as applicable, shall be demarcated on ground at the project cost, by erecting four feet l ./ j I · high reinforced cement concrete pillars, each inscribed with its serial number, distance from pillar to pillar and GPS co-ordinates; (xix) The concurrent reclamation plan as per the approved mining plan shall be executed by the User Agency from the very first year, and an annual report on implementation thereof shall be submitted to the Nodal Officer, Forest (Conservation) Act, 1980, in the concerned State Government and the concerned Regional Office of the Ministry. If it is found from the annual report that the activities indicated in the concurrent reclamation plan are not being executed by the User Agency, the Nodal Officer or the concerned· Addl. Pr. Chief Conservator of Forests (Central) of Regional Office, may direct that the mining activities shall remain suspended till such time, such reclamation activities area satisfactorily executed. (xx) The layout plan of the mining plan/ proposal shall not be changed without the prior approval of the Central Government; ., (xxi) The forest land shall not be used for any purpose .other than that specified in the proposal; - (xxii) The forest land proposed to be diverted shall under no circumstances be transferred to any other agency, department or person without prior approval of the Central Government; (xxiii) No damage to the flora and fauna of the adjoining area shall be caused; (xxiv) Any tree felling shall be done only when it is unavoidable and that too under strict supervision of the State Forest Department; (xxv) The user agency will abide by the applicable recommendations of the State Government; (xxvi) The State Covernment shall complete settlement of rights, in terms of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, if any, on the forest land to be diverted and submit the documentary evidence as prescribed by this Ministry in its letter No. 11-9/1998-FC (pt.) dated 03.08.2009 read with 05.07.2013, in support thereof; (xxvii) The User Agency shall prepare a list of existing village tanks and other water bodies with GPS co-ordinates located within five km. from the mine lease boundary. This list is to be duly verified by the concerned Divisional Forest Officer.· The User Agency shall regularly undertake desilting of these village tanks and other water bodies so as to mitigate the impact of siltation of such tanks/water bodies. A detailed plan for desilting of identified ponds and water bodies to be prepared in consultation with forest department and shall be submitted to MoEF & CC before· Stage-II approval; (xxviii) The User Agency shall submit the annual self - compliance report in respect of the above stated conditions to the State Government, concerned Regional Office and to this Ministry by the end of March every year; · · (xxix) Any other condition that the concerned Regional Office of this Ministry may stipulate, from time to time, in the interest of conservation, protection and · development of forests & wildlife; ,(xxx) The user agency shall comply all the provisions of the all Acts, Rules, Regulations, .__, . , Guidelines, Hon'ble Court Order (s) and National Green. Tribunal Order(s) pertaining to this project, if any, for the time being in force, as applicable to the project; ·~·

(xxxi) In compliance of the Rule 41 of the Mineral Conservation· and Development Rules, 1988 the restoration of flora in the entire lease area will be done in such a manner so as: (a) To cause least damage to the flora of the area held under prospecting license / mining lease and the nearby areas. (b) Take immediate measures for planting in the same area or any other area selected by the Controller General or the authorized officer not less than twice the number of trees destroyed by reason of any prospecting or mining operations. (c) Look after them during the subsistence of the licence/lease after which these trees shall be handed over to the State Forest Department or any other authority as may be nominated by the Controller General or the authorized officer; and · (d) Restore, to the extent possible, other flora destroyed by prospecting or mining operations. (xxxii) The details of such number of trees to be felled on forest as well as non-forest area in the lease and plantation of double the number of trees in the lease area or outside will be provided to the concerned Divisional Forest Office, and the Concerned Regional Office of the Ministry who will monitor such plantation efforts by the company; and · (xxxiii)The user agency should ensure that the compensatory levies (CA cost, NPV, etc.) are deposited through challan generated online on web portal and deposited in appropriate bank online only. Amount deposited through other mode will not be accepted as compliance of the Stage- I clearance;

After receipt of compliance report on fulfilment of the conditions mentioned above, the proposal shall be considered for final approval under Section-Z of the Forest (Conservation) Act, 1980. Transfer of forest land shall not be effected till final approval is granted by the Central Goverrurtent in this regard.

(a) Project Report of Jamunia UG for capacity of 0.72 Mty. on Partial Hiring of I Equipment with a total capital investment of Rs.127.5223 crores (Rupees one ) hundred twenty seven crores, fifty two lakhs, twenty three thousand only), subject to availability of a consumer agreeing to pay a price which yields 12% IRR at 85% capacity utilisation.

(b) Acquisition of land and subsequently taking up the initial mine development work \ at an estimated. expenditure of Rs.43.306 crores (Rupees forty three crores, thirty lakhs, sixty thousand only) (i.e. Rs.25.8047 crores for land, Rs.14.3833 crores for Mine Development work and Rs.3.1180 crores for roads and culverts). \
