PO BOX 3393 PORT ELIZABETH SOUTH AFRICA 2 Fayslah Kun Munazarah Note by the Translator Fayslah Kun Munazarah , first printed in 1933 CE, in the Urdu language, is a thorough rebuttal of the verdicts of kufr issued against four senior Ulama of the Deobandi School. The baseless, slanderous fatwa of kufr was presented in the book, Husam al- Haramayn of Molvi Ahmad Rida Khan Barelwi. Sufficient details about the book are given in the author’s introduction. Due to the paucity of information on the subject in the English language, many Muslims in the English-speaking world were easily swayed towards the fallacious view propounded in Husam al-Haramayn due to the vigour with which the fatwa is propagated by its English-speaking proponents and the gravity of the allegations made. The book translated here provides a balanced, level- headed, point-by-point critique of the fatwa, demonstrating with complete clarity the deception of the original accusations against the Deobandi elders and their innocence from the heresies ascribed to them. -

The Reformers’ political program has failed both because their interpretation of the law has proven inadequate to deliver on its promises and because the instrument through which they chose to impose this interpretation—the institu- tion of the modern state—has proven inappropriate for the purpose. I hope to show here that this failure is due to the fact that the program of the modern Sunni Reformers rep- resents a double rupture with the past: first, the Reformers deliberately chose to sweep away the teachings of the estab- lished schools of law; second, they opted for the state rather than society as the means by which to impose their program. -

The decade leading up to the 1952 revolution was one characterized with a heightened state of popular mobilisation, much of which the Free Officers’ movement capitalized upon. Thus, in focusing on three of the Revolution’s main milestones; the resistance to the tripartite aggression on Port Said (1956), the building of the Aswan High Dam (1960- 1971), and the popular warfare against Israel in Suez (1967-1973), I shed light on the popular struggles behind the events. -

This verse is about coming of an alternative nation of apostates. Fakhr-Razi, introducing Abu Bakr as the only example of the verse, considers this verse to be the most compelling reason to prove his righteousness and tries to consolidate his view by other narrations. This descriptive-analytic study, focusing on the Fakhr-Razi’s view, first presents the five general views and arguments of each group regarding alternative tribe, then by validating documents of the traditions based on ‘Ammeh ( Sunni ) sources, proves that their narrational reasons are not authentic. Eventually, it will be proved that the first instance of the verse is Imam Ali (as) and his true companions, and the final example of the verse is Imam Zaman (AS) – may God hasten his reappearance- and his companions. -

The excellence of any field of study is determined by its subject. The subject studied here is Allah's Names, His Attributes and His actions, which are the greatest matters that can be known, therefore Tawhid of Allah's Names and attributes is the greatest of sciences. Some of the salaf said, “Whoever wishes to know the difference between the speech of the creator and of the creation, should look at the difference between the Creator and the creation themselves.” Different verses in chapters in the Qur'an vary with each other in excellence. This is because of the different subjects they deal with. Surah Al-Ikhlas equals one-third of the Qur'an because it is dedicated to describing Al-Rahman. One of the Salaf said, “Tabbat Yada Abi Lahab” is not like “Qul Huwallhu Ahad”. Ayat Al-Kursi is the greatest Ayah in the Qur'an as it is devoted to describing Allah, His Majesty and Greatness. Likewise Al-Fatiha is the greatest Sura in the Qur'an. It is based on the praise of Allah. 2. Teaching Allah's Names and Attributes is one of the greatest goals of the Qur'an The Quran in its entirety is simply a call to Tawheed. Ibn Al- Qayyim stated, “Every Sura in the Qur'an comprises Tawhid. In fact, I shall state an absolute: Every verse in the Qur'an comprises Tawhid, attests to it, and calls to it. -

The author will argue in this Article that it is indeed possible to reconcile Islam with a commitment in favor of democracy. The author will then present a systematic exploration of Islamic theology and law as it relates to a democratic system of government, and in this context, address the various elements within Islamic belief and practice that promote, challenge, or hinder the emergence of an ideological commitment in favor of democracy. In many ways, the basic and fundamental ob- jective of this Article is to investigate whether the Islamic faith is consistent or reconcilable with a democratic faith. As addressed below, both Islam and democracy represent a set of comprehensive and normative moral commitments and beliefs about, among other things, the worth and entitle- ments of human beings. The challenging issue is to understand the ways in which the Islamic and democratic systems of convictions and moral commitments could undermine, negate, or validate and support each other. Metode yang digunakan adalah kualitatif, sedangkan analisis data yang digunakan adalah content analysis yakni sebagai sebuah upaya menganalisis substansi pemikiran maqāşid al- sharīah, kemudian dikorelasikan dengan konteks kehidupan masyarakat sekarang. Hasil penelitian menunjukkan bahwa teori maqāşid al-sharīah yang digagas oleh Imam al-Syatibi telah menghadirkan shariah dalam wajahnya yang elastis. Maqāşid al-sharīah telah mentransformasikan teori-teori shariah ke dalam nilai-nilai kemanusiaan universal, seperti kemaslahatan, keadilan dan kesetaraan dalam kehidupan umat Islam. Hal ini setidaknya bisa dilihat dalam dua hal: pertama, maqāşid al-sharīah sebagai metode pengembangan hukum Islam. Pengembangan teori-teori maqashid al-shariah mengilhami filsafat hukum Islam dan menjadi pangkal berpikir serta analisis yang pokok untuk pengembangan pemikiran hukum Islam pada era globalisasi dan perubahan sosial sekarang ini.
