As guidance to mankind in safeguarding all their wordly matters and dealing, Allah has sent down His Divine Law (Shariah) through His Prophets and Messengers. All existing laws, even though drafted by human being but with the intention to benefit mankind, are considered as Syariat of Allah. In order to conduct hearings for disputes within Muslim families in Indonesia, due to lack of legislation for self-evidence, Islamic Court (Peradilan Agama) which has jurisdiction over such matter had to applied evidence laws of Civil Court inherited from the colonials. Over than 150 years, Indonesian Civil Code (KUHP), HIR and RBG have been applied as a source of primary laws in Indonesian Court until now (writing this Thesis ) there is no initiative yet to improve it especially on law of evidence. It’s because making of human been, no guaranteed to tellMalaya that there are not mistakes in all those laws. In order to identify these laws, Researcher has to identify and study on how compatible are they with the meaning of Islamicof evidence. This is important, in order to identify any shortcoming that may exist whether There is a shortage in it both in terms of legislation or its impact in solving the case for the betterment of such laws. However, this study only involving Muslim properties including cases of Inheritance, Wills, Gift and Endowments.According to Ibn al-Qayyim, Whatever of evidence that may disclose the justice is received. Therefore, interpretation on the law of evidence by judge strongly influence how far of evidence which was not mentioned in the legislation could be Universityused by judges. This is because, in the property cases, evidence that used as listed by law is more less than criminal cases. In order to achieve this objective, few methodologies can be used such as scurutinising and analyzing of existing laws, go on to ensure that they are compatible with the books written by Islamic Scholars (Ulama). After going through such analysis, Researcher concludes that even if the laws are not v contradicting with the Shariah law, there is still a need for a more thorough study so as to ensure its relevance to date, there is still so much more to be done . Sebagai panduan kepada manusia dalam mentadbir urusan mereka di dunia ini, Allah telah menurunkan syariah-Nya melalui Nabi dan Rasul-Nya. Apapun undang-undang yang ada, sekalipun digubal oleh manusia yang tujuananya untuk kebajikan, itu adalah Syariat Allah. Untuk mendengar pertikain keluarga orang Islam di Indonesia, disebabkan belum mempunyai undang-undang keterangan sendiri, Pengadilan Agama sebagai yang berbidangkuasa atas itu telahpun menggunapakai undang-undang keterangan bagi Mahkamah Sivil hasil peninggalan penjajah. Lebih 150 tahun, Kitab Undang-Undang Hukum Perdata, HIR dan RBg, telah digunapakai sebagai sumber Undang-Undang di Peradilan di Indonesia, sampailah sekarang, belum ada inisiatif dari berbagai pihak untuk membuat satu tindakan perbaikan terhadapnya khasnya berkenaan undang-undangMalaya keterangan.Untuk mengenalpasti undang-undang ini, Penyelidik cuba membahas kesesuaiannya dengan hukum keterangan Islam. Ini penting, untukof mengetahui apakah wujud kekurangan di dalamnya baik dari segi perundangan mahupun kesannya dalam menyelesaikan kes, yang perlu diperbaiki untuk kesempurnaannya. Kajian ini bagaimanapun hanya melibatkan kes-kes kehartaan orang Islam yang meliputi kes Pusaka, Wasiat, Hibah dan Wakaf. Apapun Keterangan yang dapat menzahirkan keadilan menurut Ibn Qayyim al- Jawziyyah adalah diterima. Oleh itu penafsiran Keterangan yang dibuat oleh Hakim sangat mempengaruhi sejauhmana keterangan yang tidak disebutkan dalam PerundanganUniversity dapat digunakan oleh Hakim. Ini kerana dalam kes-kes kehartaan, Keterangan yang digunakan sebagaimana disenaraikan oleh Undang-undang lebih sedikit dibandingkan dengan kes-kes jenayah. Untuk mencapai matlamat ini, beberapa metodologi digunapakai seperti pembacaan terhadap undang-undang yang sedia ada serta menyepadankannya dengan kitab-kitab yang dikarang oleh para Ulama. Setelah melalui pembacaan yang telah dibuat oleh Penyelidik, sekalipun undang-undang ini iii secara amnya tidak berlawanan dengan hukum syarak tetapi untuk pengkemaskinian terhadap undang-undang ini masih banyak ruang kosong yang perlu diiisi. The author will argue in this Article that it is indeed possible to reconcile Islam with a commitment in favor of democracy. The author will then present a systematic exploration of Islamic theology and law as it relates to a democratic system of government, and in this context, address the various elements within Islamic belief and practice that promote, challenge, or hinder the emergence of an ideological commitment in favor of democracy. In many ways, the basic and fundamental ob- jective of this Article is to investigate whether the Islamic faith is consistent or reconcilable with a democratic faith. As addressed below, both Islam and democracy represent a set of comprehensive and normative moral commitments and beliefs about, among other things, the worth and entitle- ments of human beings. The challenging issue is to understand the ways in which the Islamic and democratic systems of convictions and moral commitments could undermine, negate, or validate and support each other. Article History: Received: 5 April 2021; Accepted: 14 May 2021; Published online: 22 June 2021 Abstract: In Islamic sources, whether interpretive, narrative or historical, the Ahl al-Bayt (PBUT) are mostly referred to with high reverence, and graceful trait are attributed thereto. yet, their commemoration in one of the most glorious works of early Arabic literature, namely Kitab al-Aghani, is of paramount significance. Attributed to the 10th-century Arabic writer Abu al- Faraj al-Isfahani (also known as al-Isbahani), it is claimed to have taken 50 years to write the work. Considering that he is a descendant of the Marwanis, mentioning the virtues of the Ahl al-Bayt (PBUT) in this book further highlights their legitimacy, making everyone awe in praise. Further, the claims cited in the work have been mostly backed by referring to other Sunni and possibly Shiite sources. With a descriptive-analytical approach, the purpose of this study was to introduce the Ahl al-Bayt (PBUT) in the Kitab al-Aghani, while pointing out issues such as the succession of Ali (PBUH), the succession of Imam Hassan (PBUH) and Messianism of Mahdi (PBUH). The Spirit of Ease in Shari’ah Let me state from the outset that Shari’ah is all about ease and the removal of hardship for people in order to facilitate things for them. Shari’ah , as it has been articulated by eminent jurists, has the sole objective of catering to the welfare of people in both worlds. Consequently, practicality, balance, ease, and removal of hardship are all valid principles that have always been used as the criteria for providing rulings for people, according to changing times and circumstances. The Qur’an and the Prophetic Sunnah have reiterated this principle throughout. Allah says, “Allah intends to bring for you ease; and He does not wish to make things hard upon you.” ( Qur’an: 2:185 ) and "He did not appoint for you any hardship in this religion: the way of your ancestor Ibrahim" ( Qur’an: 22:78 ).

    A CONTROVERSY ABOUT THE AUTHORITY OF KHABAR AL-WAHID WITH SPECIAL REFERENCE TO AL-SHAFITS VIEWS Dr. Abdul Karim AH* Abstract This article attempts to elaborate the different views of different madhhabs about the authority of khabar al-wahid in general, with special reference to al-Shafi'i's points of view. DEFINITION Literally, khabar al-wahid {pi. akhbar at-ahad) means a tradition or report going back to one single authority.1 Its synonyms are khabar al-'mfirad and khabar al-khassah.2 However, scholars of hadith have widened the meaning, in terpreting khabar al-wahid as what is narrated or reported by one or two au thorities from one or two authorities back to the Prophet, or what is narrated by a number less than mutawatir? Normally, the scholars of hadith divide reports into mutawatir and ahad. Mutawatir hadith is that narrated by a group of reliable and trustworthy indi viduals from a group of trustworthy persons going back to the Prophet. There is no exact number that institutes tawatur. Some say three, some say four while others say twenty. Al-Shafi'i himself refuses to specify the exact number of re porters at any particular level of the isnad that make a hadith mutawatir* ♦Lecturer, Academy of Islamic Studies. There has been a serious ignorance on prophetic hadith which are rich in Islamic thoughts and rules and that is the prohibition of publishing the hadith from Prophet Muhammad (peace be upon him). The contemporary scholars and hadith writers believe that hadith had not been written until the end of first Hegira century. Therefore, there have been efforts to justify this prohibition of publication of hadith by using legal and rational evidences. Nonetheless, there exist some drawbacks in them and according to what was mentioned, this cultural error may not be connived.
