More specifically is the case in the implementation of the above method wherein the mujtahids were unable to get two hadiths incongruent over a particular issue, whereas there could never be contradictions amongst the hadiths. This paper examines the concept and application of al-Tawaqquf in Mukhtalif al-Hadith according to hadith scholars. The research is conducted via data collection methods sourced from literature review. Data from various major hadith compilations and the Ulum al-Hadith are analyzed based on deductive and inductive methods. The findings show that the al-Tawaqquf concept is based on several principles. Applying it becomes compulsory in the event of failure to resolve inconsistencies among hadiths. In those situations the mujtahid and his inability is blamed, and this does not absolve other mujtahids from continuing their efforts. This research also proves that the al-Tawaqquf methodology is not only one solution to solve the discrepancies amongst hadiths but is one of the methods engaged by hadith jurists when they cannot reconcile contradictions.

The author will argue in this Article that it is indeed possible to reconcile Islam with a commitment in favor of democracy. The author will then present a systematic exploration of Islamic theology and law as it relates to a democratic system of government, and in this context, address the various elements within Islamic belief and practice that promote, challenge, or hinder the emergence of an ideological commitment in favor of democracy. In many ways, the basic and fundamental ob- jective of this Article is to investigate whether the Islamic faith is consistent or reconcilable with a democratic faith. As addressed below, both Islam and democracy represent a set of comprehensive and normative moral commitments and beliefs about, among other things, the worth and entitle- ments of human beings. The challenging issue is to understand the ways in which the Islamic and democratic systems of convictions and moral commitments could undermine, negate, or validate and support each other. Article History: Received: 5 April 2021; Accepted: 14 May 2021; Published online: 22 June 2021 Abstract: In Islamic sources, whether interpretive, narrative or historical, the Ahl al-Bayt (PBUT) are mostly referred to with high reverence, and graceful trait are attributed thereto. yet, their commemoration in one of the most glorious works of early Arabic literature, namely Kitab al-Aghani, is of paramount significance. Attributed to the 10th-century Arabic writer Abu al- Faraj al-Isfahani (also known as al-Isbahani), it is claimed to have taken 50 years to write the work. Considering that he is a descendant of the Marwanis, mentioning the virtues of the Ahl al-Bayt (PBUT) in this book further highlights their legitimacy, making everyone awe in praise. Further, the claims cited in the work have been mostly backed by referring to other Sunni and possibly Shiite sources. With a descriptive-analytical approach, the purpose of this study was to introduce the Ahl al-Bayt (PBUT) in the Kitab al-Aghani, while pointing out issues such as the succession of Ali (PBUH), the succession of Imam Hassan (PBUH) and Messianism of Mahdi (PBUH). In order to conduct hearings for disputes within Muslim families in Indonesia, due to lack of legislation for self-evidence, Islamic Court (Peradilan Agama) which has jurisdiction over such matter had to applied evidence laws of Civil Court inherited from the colonials. Over than 150 years, Indonesian Civil Code (KUHP), HIR and RBG have been applied as a source of primary laws in Indonesian Court until now (writing this Thesis ) there is no initiative yet to improve it especially on law of evidence. It’s because making of human been, no guaranteed to tellMalaya that there are not mistakes in all those laws. In order to identify these laws, Researcher has to identify and study on how compatible are they with the meaning of Islamicof evidence. It is recognized not as a valid book and is not classified as invalid books. It is entirely due to the way of Sahih Ibn Khuzaymah’s presentation of the totality of hadith studies; an unusual and uneducated way by the majority of hadith writings in the III century hijriyah. It is different from Sahih al-Bukhārī and Sahih Muslim which has become the ultimate reference to the highest authority of the validity of a narration. This paper will describe the uniqueness of the internal Sahih Ibn Khuzaymah. The uniqueness contained in the logic of preparation, systematics of writing and methodological tools that used in the analysis of matan and sanad. The Spirit of Ease in Shari’ah Let me state from the outset that Shari’ah is all about ease and the removal of hardship for people in order to facilitate things for them. Shari’ah , as it has been articulated by eminent jurists, has the sole objective of catering to the welfare of people in both worlds. Consequently, practicality, balance, ease, and removal of hardship are all valid principles that have always been used as the criteria for providing rulings for people, according to changing times and circumstances. The Qur’an and the Prophetic Sunnah have reiterated this principle throughout. Allah says, “Allah intends to bring for you ease; and He does not wish to make things hard upon you.” ( Qur’an: 2:185 ) and "He did not appoint for you any hardship in this religion: the way of your ancestor Ibrahim" ( Qur’an: 22:78 ).
