PRIVATE CARTS

The right to use a privately owned golf cart on the is currently granted by the Club and is a non-assignable license and personal right. The Club may terminate the license and right at any time.

Privately owned golf carts to be used on the golf course must be approved annually by the Head PGA Golf Professional or General Manager for appearance and for compliance with other standards as may be determined by the Club.

All private golf cart owners shall be required to sign a release of liability, which holds the Club harmless as a result of any loss or damage relating to the owner’s operation if the golf cart. Each year, a Sun City Shadow Hills resident who owns a private golf cart and wished to use it on the golf course shall be required to provide the Club with proof that the operation of the golf cart is covered by a liability insurance policy of the resident with a combined single limit of at least $300,000 per occurrence for personal bodily injury, including death and property damage. A Sun City Shadow Hills resident using a private cart will be held fully responsible for any and all damages caused by the misuse of the golf cart by the Sun City Shadow Hills resident or his/her guest(s). The Sun City Shadow Hills resident shall reimburse the Club for any and all damages the Club may sustain by reason of misuse, including without limitation, damage to other golf carts and property of the club.

Privately owned golf carts must be battery powered, rear wheel and four wheels. The maximum width of a golf cart must not exceed 48” Shadow Hills will establish an annual trail fee for each season. The annual trail fee is non-refundable and NOT transferable. The annual trail fee for privately owned golf carts may be prorated with the approval of the Head Golf Professional or General Manager. Private golf cart owners must complete and sign the release of liability, provide proof of liability insurance, have the cart approved for usage, and pay the annual trail fee before the cart is permitted to be used on the golf course. An identification number and yearly decal will be issued for the cart when the release of liability, proof of liability insurance and payment are received. The identification number and yearly decal is to be placed on the cart by the Golf Shop Staff. If enrolled in the Trail Fee Program you will get $6.00 off when using your cart or riding with another private cart (3.00 off for twilight or 9 holes.) If using a Shadow Hills Cart you will not get the trail fee discount.

Residents with private golf carts may ride with each other but may not loan their golf cart to other golfers. Residents paying the annual trail fee must check in at the golf shop prior to beginning play, unless prior arrangements have been made with the Head PGA Golf Professional or General Manager . Golf Cart traffic on the course is restricted to nine and eighteen hole rounds of play. Starting times must be scheduled as provided herein.

A maximum of two (2) riders and two (2) golf bags per golf cart is allowed. A maximum of two (2) golf cars per foursome is allowed (exceptions may be made during the months of June through September by the Golf Professional or staff on Duty). Privately owned golf cars that become disabled or immobile on the golf course shall be removed only by authorized Golf Club personnel if available. In the event your private cart should need to be driven, towed, etc. by an employee of Shadow Hills Golf Club, LLC, the Golf Club and all employees will not be liable for any damage to your private cart while in the employee’s control, or after the private cart is parked. Owner of the cart will be responsible for all repair and maintenance of the cart. The Shadow Hills Golf Club employee will be only allowed to take nonfunctioning private carts as far as the private cart parking area in Shadow Hills Golf Club’s parking lot. The owner of the cart will be responsible for removing the Private Cart from Shadow Hills Golf Club property in a timely manner.

When a resident is no longer paying the annual trail fee for a private golf cart, all Club decals must be removed from the golf cart. Private golf carts without a current trail fee decal will not be allowed access to the golf course. Shadow Hills Golf Club will not allow a resident to pay and use a private golf cart on a per round basis. Residents with private golf carts are required to ensure that only licensed drivers who will operate the cart in a safe and prudent manner and in accordance with any and all government regulations operate their private carts. Privately owned golf carts shall be driven on the golf course only in the process of playing a round of golf.

GENERAL GOLF CART RULES

The use of golf carts on the golf course is mandatory for all players. Shadow Hills Golf Club golf carts shall be assigned at the Golf Shop at the time of registration. Only Shadow Hills Golf Club golf carts provided by the club or carts licensed to operate on club property will be permitted on the course. Shadow Hills Golf Club golf carts are restricted to use on the golf course and practice areas. No Shadow Hills Golf Club cart shall be removed from the club property at any time without prior approval from the Head Golf Professional or General Manager.

Golf carts shall be operated only by persons with a valid automobile driver’s license. No more than two (2) persons and two (2) sets of golf clubs per golf cart are permitted at any time. Golf carts shall remain on cart paths when required by the Golf Shop. Unless on a golf cart path or with a disability flag, all golf cars shall not be driven within thirty (30) yards of any greens. Golf cart traffic and directional signs must be obeyed at all times. Golf carts are operated at the risk of the operator. The cost of repairing any damage to golf carts or the golf course resulting from improper operation will be charged to the resident in whose name the operator is playing at the time the damage occurs. Violation of these golf cart rules may result in immediate suspension of playing privileges and ejection from the golf course.

Golf Carts without a Trail Fee may be driven from the resident’s home to the golf club, but must remain at the “designated golf cart” parking space in the parking lot. Private carts without a Trail Fee are not allowed to come through the golf course gates by the cart staging area.

Private Golf Cart Agreement

I have read and understand the Shadow Hills Golf Club “Golf Rules and Regulations” in relation to privately owned golf carts. I promise and further agree to hold Shadow Hills Golf Club free and harmless from damage or claims of any nature whatsoever that may arise from or through my use of said cart. I represent that I am familiar with the operation and use of said golf cart and that I have read the instructions and that I can operate and control the same in accordance with the said instructions. No minor under 16 years of age can drive this cart on Shadow Hills Golf Club Facilities. The term of this agreement is from October 15, 2012 through October 13, 2013.
