CTC then moves to collection on its debt. When joint and several liability applies, CTC usually begins collection against both of the ex-spouses. CTC tries to collect its debts against any and all possible parties up until the time the debt is satisied. CTC may pursue collection in a manner that attempts to seek recovery in the quickest and most eficient manner possible. This can result in CTC pursuing a debtor that is easier to locate as opposed to one that is more dificult. This can also result in CTC pursuing a debtor that has a current ability to pay the debt, rather than a debtor that does not have a current ability to pay. Due to joint and several liability, CTC can collect from either formally married spouse when the borrowers divorce after the CTC loan is made. A Colville Tribal Court of Appeals case ( # AP07-002) states that CTC can collect its debt in full against a previously married borrower that has joint and several liability with CTC, notwithstanding contrary language in a divorce decree. As this opinion correctly notes, by its very nature a divorce decree relates only to the rights and responsibilities of the former husband and wife to each other, and cannot effect a relationship with a third party over a prior debt of the marriage. Any Colville member that is going through a divorce should be sure to discuss with their appropriate advisor the topic of responsibility for debts during the marriage. Moreover, it may be wise to ensure that a divorce decree has language discussing what remedies are available when a divorced spouse fails to pay on a debt to a third party (including perhaps a reduction in any divorce alimony, or a return of property previously given to the other spouse).
