FirstGroup and Department for Transport agreement on termination of two rail franchises December 10, 2020 FirstGroup plc has reached agreement with the Department for Transport on next steps for the South Western Railway and West Coast Partnership train operating companies, the latter of which comprises Avanti West Coast and the shadow operator for HS2 (together, Avanti). As announced on 20 September, these two companies are currently operating under Emergency Recovery Measures Agreements which were put in place by the DfT to provide continuity for rail passengers and the industry during the coronavirus pandemic. The ERMA for Avanti is in place to the end of March 2022 and the SWR ERMA is in place to the end of March 2021. Both can be extended by a further half year at the DfT’s discretion. As previously stated, the ERMAs required the train operators and the DfT to agree whether any payment is required to terminate the pre-existing franchise agreements, and if so how much, based on a pre- coronavirus trajectory financial model. The DfT and FirstGroup have agreed that no termination sum is required for Avanti, which commenced operations in December 2019 and was performing well prior to the pandemic. Agreement has also been reached for a termination sum for SWR, which requires a further FirstGroup contribution of £33.2m. This represents the Group’s share of parent company support and additional funding commitments under the franchise agreement, less amounts already paid into the operating company, and which will be paid at the end of the ERMA term. The full exposure to SWR performance bonds and parent company support has already been provided in the accounts. -

There were 316 appeals closed by passenger watchdogs in 2019-20 Q3, a decrease of 82.7% compared to the same quarter last year. This large decrease is due to many appeals being directed to the new Rail Ombudsman instead of Transport Focus or London TravelWatch. -

RAILWAYS ACT 1993 2018 PERIODIC REVIEW REVIEW NOTICE: STATION LONG TERM CHARGES TO: (1) the persons whose names are set out in Part 1 of Annex 1 to this Review Notice (the “Train Operators”); (2) the persons whose names are set out in Part 2 of Annex 1 to this Review Notice; (3) Network Rail Infrastructure Limited (“Network Rail”); and (4) the Secretary of State for Transport, the Scottish Ministers and the Treasury, together the “Addressees”. 1 General 1.1 This review notice (the “Review Notice”) is given in accordance with paragraph 4 of Schedule 4A to the Railways Act 1993 (the “Act”). 1.2 The Office of Rail and Road (“ORR”) has undertaken a review of: (a) the amount in respect of each station set out in the relevant annex of the Station Access Conditions which is referred to in the definition of “Long Term Charge” in the relevant Station Access Conditions (the “Long Term Charge”); and (b) the times at which, and the manner in which, those amounts are payable, (the “Review”). 1.3 ORR’s conclusions on the Review, and its reasons for those conclusions, are: (a) set out in a series of documents referenced in the document entitled “2018 periodic review final determination: Overview of approach and decisions – October 2018” and published by ORR on 31 October 2018, and in particular those documents referenced in Chapter 1 of that document1; and (b) hereby incorporated into this Review Notice. 1.4 By publishing this Review Notice and serving it on each of the Addressees, ORR is initiating the implementation of the Review. -

Avanti West Coast’s mission is to deliver an innovative railway service that generates nationwide prosperity and pride. There will be a seamless transition for your customers with the existing promotion and website going live on 8 December. To help explain about the change and new offer we’ve put together this factsheet which covers some frequently asked questions. What has changed/ what is changing? From the 8th December, Avanti West Coast, will operate the new InterCity West Coast rail franchise. However, there is no change for customers attending the NEC and ICC. Avanti West Coast will continue to offer 20% off selected Advance fares for all our NEC Group customers. Who is Avanti West Coast? Avanti West Coast is the new brand name for the InterCity West Coast rail franchise. The joint venture between FirstGroup and Trenitalia, First Trenitalia, will take over from Virgin Trains on Sunday 8th December. A range of enhancements are planned during the new franchise, including, more seats, simplified fares and more frequent services. North West Tim Shoveller, managing director, & Central North West & Central The North West & Central (NW&C) region is the backbone of Britain, the economic spine linking our main cities of London, Birmingham, Manchester and Liverpool. We connect workers with jobs, people with loved ones and goods to market. In year one of Control Period 6 (CP6) many people, particularly in the North and the Midlands, the railway industry did not work well. The result was that passengers did not get the reliable service they expect and deserve. This is not acceptable. It cannot continue. We are changing our business structurally and culturally to bring lasting improvements. NW&C’s three routes – North West, Central and West Coast Mainline South – were launched in September 2019, devolving key decision-making closer to the markets we serve in line with Network Rail’s Putting Passengers First (PPF) transformation.
