MINUTES OF A MEETING OF THE GENERAL PURPOSE AND PLANNING COMMITTEE OF THE BAY OF TOWN COUNCIL, HELD ONLINE (VIA ZOOM) AT 6:30PM ON TUESDAY 25 TH AUGUST 2020

47/20 Welcome and Apologies for Absence:

The Chair welcomed members to the meeting. Apologies for absence were received from the Clerk, Mrs T Earley.

48/20 Declarations of Interest :

Members were reminded that they must declare the existence and nature of any personal and/or prejudicial interests. None were declared.

49/20 Promenade Road/Beach Works/Public Participation:

The Assistant Clerk submitted a letter and photographs from a resident and an email from Cllr Pearson with regard to the finished works and traffic issues. An email from Traffic Network Manager, CBC and an email forwarded from Cllr Parry had been emailed to members earlier in the day, for information. The Assistant Clerk also informed the members that she had spoken to Cllr Parry.

In accordance with Standing Orders, members of the public may be permitted to speak regarding any item on the agenda. The Chair invited the members of the public to use this public participation session to make any additional comments to those already submitted to members. Jo Nuttall thanked the Committee for letting her attend and taking the issue seriously. She felt that there should be no parking on that stretch of road apart from disabled parking bays for residents on the opposite side of the road. Chris Coxon added that there were 3 major issues: the pedestrian crossing, the reduction in width of Rhos Road and the inadequate sea defences. He also said that residents wanted the white lines reinstated, traffic calming and 20mph along the stretch between Rhos Point and Fortes which would help to reduce the speed of traffic.

It was proposed and seconded to invite a Traffic Officer from Conwy CBC to attend a future Committee Meeting to address the Members. The Members of the public were informed that they would be able attend the meeting.

The Chair thanked the members of the public and they retired from the meeting. Resolved to invite a Traffic Officer, Conwy CBC to attend a future Committee Meeting to address the members.

50/20 Minutes :

Resolved to approve and sign, as a correct record, the minutes of the last meeting, held on 28 th July 2020.

51/20 Training on .pdf files:

The Chair welcomed Louise Austin to the meeting. Louise gave a brief presentation to members on how to annotate .pdf files. It was noted that the Louise will send out a short instruction note into the use of Adobe software for both PCs and iPads, in due course. Louise was thanked for her presentation.

52/20 Sub-Committees:

The Assistant Clerk submitted, for consideration, the Terms of Reference for the sub- committees that report to the General Purpose and Planning Committee: a) Bonfire Sub-committee b) Christmas Lights Sub-committee

Resolved to re-appoint the sub-committees.

53/20 Conwy CBC: a) The Assistant Clerk submitted: (i) TTR for Peulwys Road, from 30/9 to 30/3/21 (Carriageway Resurfacing) (ii) TTR for Road from 7/9 to 9/9(Welsh Water Works) (iii) TTR for Llanrwst Road to Pwllycrochan Avenue from 1/9  5/9 (Carriageway Resurfacing) b) An update from Conwy CBC regarding Playgrounds.

Members noted all the Conwy CBC documents.

54/20 BT Phone Removal :

The Assistant Clerk submitted notification from Conwy CBC regarding the removal of a BT phone box in Old Colwyn. Cllr Bob Barton informed the members that he had been in communication with OCRA (Old Colwyn Residents Association) before the CoVid-19 lockdown restrictions about the possibility of installing a defibrillator in the phone box, which would be for use, but this would require BT leaving the electricity supply in the box. Concern was expressed over the cost of future upkeep, maintenance and electricity fees of the phone box.

Resolved to wrote to the local authority to ask for an extension to the decision deadline, in order for the discussion between OCRA and Cllr Barton to recommence once OCRA reconvene their meetings. 55/20 Lady Diana Garden :

At the request of Cllr Jeff Pearson, the maintenance of the garden was considered, as it was felt it was looking untidy and needed urgent attention. The Rhos Rotary Club had a service level agreement with the Town Council to maintain the garden. Members appreciated that during CoVid-19 Lockdown, work in the garden would have been difficult.

Resolved that the Assistant Clerk write to Rotary to ask them when they intend to restart work at the lady Diana Garden and to report back to the Committee.

56/20 Planning:

a) The Clerk submitted, for consideration, the planning applications received from CCBC. Resolved to submit observations on these applications, as detailed in Schedule A attached.

b) Resolved to receive a copy of the Planning Decisions issued by CCBC for the period 27/7/2020  06/08/2020.

c) Planning Aid : The Assistant Clerk submitted a newsletter and asked if any of the members had been on the online training portal as some members had reported a problem with receiving the log-in details. The Assistant Clerk had done the training and reported that it was very informative. The Assistant Clerk was asked to request the details again and forward to members.

d) Conwy RDLP: Members noted the email from Conwy CBC regarding any impact that CoVid-19 has had on policies /practises. Members sadi they would complete the survey individually.

e) Members noted the appeal refusal notice for Nant Uchaf Farm, Nant y Glyn, .

Good morning.

I apologise for the delay in my response.

I have been in consultation with local members looking at various options to reduce the congestion and it is proposed to take forward the restriction shown on Drawing L/1/02/20/9A, copy attached.

Consideration was also given to including a prohibition of loading marked with kerb blips. However, should there be any objections to the prohibition of loading the objections, if they were further that 15 metres from a junction, would need to be resolved by a public enquiry.

The risk of the objection been upheld at the enquiry is considerable as we would need to have evidence that vehicles loading and unloading were causing a significant problem. To introduce a prohibition of loading to prevent parking by disabled drivers is not deemed a legitimate reason and the advice is that a prohibition of loading must not be used for that purposed. If the objections are up held it is likely that we would not be able to introduce any restriction. It is, therefore, proposed that a prohibition of waiting is introduced. If there are objections they can be considered by our Portfolio Member and if it is decided they are introduced they will be monitored and consideration given to further interventions if it is found that disabled drivers are parking on the yellow lines.

Access protection road markings will be reinstated across each section where there is a dropped kerb. Any driver that parks on the access protection road marking will be liable to Penalty Charge Notice (Parking ticket) for parking adjacent to a dropped kerb, which includes vehicles displaying a blue disabled badge. The police also have the powers to issue Fixed Penalty Notices to any driver found causing an actual obstruction to another vehicle from entering and exiting their property

I am not sure if you are aware but the Town Council is discussing the issue of the Rhos on Sea Promenade Works tonight at the General Purposes and Planning Meeting . Cllr Roger Parry telephoned me today to say that he has been working with you to try & alleviate the issues particularly in regards to traffic. Cllr Parry has told me that the plan is to install yellow lines along the roadside which will stop any vehicles parking and unloading including disabled (blue badge) holders. Cllr Parry said that this would be done within 4 months. Cllr Parry was happy for me to report this to the committee this evening.

Please can you confirm this please and also that it is in order for me to report this to the Committee tonight. If you have anything extra to add, I will make sure that is reported as well.

Further to our meeting this week I am pleased to report that, thanks to the intervention of the portfolio holder Cllr Greg Robbins, the local authority has agreed to the installation of an additional section double yellow lines in front of properties 89 to 99 on the promenade in addition to access protection road markings (white lines) across each section where there is a dropped kerb.

In addition to the above, any driver that parks on the access protection road marking will be liable to Penalty Charge Notice (Parking ticket) for parking adjacent to a dropped kerb, which includes vehicles displaying a blue disabled badge. The police also have the powers to issue Fixed Penalty Notices to any driver found causing an actual obstruction to another vehicle from entering and exiting their property.

The local authority is proposing to add these changes to a Traffic Regulation Order currently being drafted by its legal officers for the Bay of Colwyn Town Council area but, as I advised when we met, orders can take a number of months to come into effect.

I submitted a Covid-19 bid to WG some months back for shelter cleaning, signage and floor markers. Good news - weve been awarded some monies (to be used across the county). As part of this I am planning to clean every CCBC owned shelter, add bilingual keep a social distance signage and paint floor markers.

I hope to be able to undertake this work within the next couple of weeks.

The County Borough of Conwy (Disabled Persons Parking Places) (No.1) Order 2020

The Conwy County Borough Council proposes to make an Order under Sections 1, 2 and 4 and Part IV of Schedule 9, of the Road Traffic Regulation Act 1984, the effect of which will be:-

1. To designate the lengths of road specified in Schedule 1 to this notice as a Disabled Persons Parking Place for the exclusive use of vehicles displaying a valid Disabled Persons Badge and a Residents Permit. 2. To revoke the restrictions specified in Schedules 2, 3, 4 and 5.

Exceptions will be provided in the proposed Order to permit waiting for the purposes of works of maintenance, repair and the like.

A copy of the proposed Order together with a map showing the lengths of road to which the Order relates and a statement of the Council's reasons for proposing to make the Order may be examined on the Council website. Requests for paper copy documents can be made by contacting 01492 575492.

This is a summary of the procedures that the Town Clerk/Assistant follow, when notified that a planning application relating to the Bay of Colwyn area is on the agenda for a forthcoming CCBC Planning Committee site visit/meeting. 1. On receipt of either the e-mail notification of a site visit (which usually takes place the day before the Planning Committee meeting), or the agenda for a Planning Committee meeting, the Clerk/Assistant will forward this to all members of the GP&P Committee, for information.

2. If any member wishes to attend the site visit and/or Planning Committee meeting, they will notify the Clerk/ Assistant as soon as possible. Please note that only one member can officially represent the Town Council at the site meeting and priority will be given to a member from the ward/community the application site falls within.

3. If a member wishes to speak at a Planning Committee meeting, in support of residents in his/her ward, they will notify the Clerk/Assistant as soon as possible, so that permission can be sought from CCBC.

4. If a member wishes to speak on an application not within his/her ward , the reason for this should be given and the request should be approved by members from the relevant ward, prior to any request being submitted to CCBC.

Please note: the number of speakers at a Planning Committee meeting are restricted and it may be better to allow a spokesperson for the residents affected by the application to be given this opportunity.

A request to speak should not normally be made where there is nothing to add to the views already expressed in the Town Councils observations, unless it is felt that these have not been adequately acknowledged or addressed in the planning officers report.
