– havingregardtotheDeclarationof18June2005bytheHeadsofStateorGovernmenton theratificationoftheTreatyestablishingaConstitutionforEurope,attheconclusionof theEuropeanCouncilof16and17June2005,

Whereas

A. TheTreatyestablishingaConstitutionforEuropewassignedbytheHeadsofStateand GovernmentofthetwentyfiveMemberStatesoftheEuropeanUnionon29October 2004,andconfirmedagainbytheEuropeanCouncilinitsDeclarationof18June2005,

B. TheConstitutionwasdraftedbytheEuropeanConventionwhich,comparedtoprevious procedurestopreparenewtreaties,achievednewlevelsofopenness,pluralismand democraticlegitimacy,

TheEuropeanParliamentendorsedtheConstitutionbyamajorityofovertwothirdsas"a goodcompromiseandavastimprovementontheexistingtreaties…[which]willprovide astableandlastingframeworkforthefuturedevelopmentoftheEuropeanUnionthatwill allowforfurtherenlargementwhileprovidingmechanismsforitsrevisionwhenneeded" initsResolutionof12January2005,

D. ThereformsforwhichtheTreatyestablishingaConstitutionforEuropeprovidesare intended,interalia,tocopewiththeconsequencesoftheenlargementoftheUnionon1 May2004,andthesuccessofthisandfutureenlargementswillbeinjeopardyunlessa constitutionalpackageisratified,

E. ThirteenMemberStates 1,representingamajorityofthe MemberStatesoftheUnion, have sinceratifiedtheConstitutioninaccordancewiththeirownconstitutionalrequirements, includingbymeansofareferenduminbothSpainandLuxembourg,

F. Franceandthe,followingreferendumsheldon29Mayand1June2005 respectively,havefailedtoratifytheConstitution–withtheresultthattheratification processhassubsequentlystalledinmostoftheremainingtenMemberStates,

G. UnderArticle48oftheTreatyonEuropeanUnion,theConstitutionwillnotenterinto forceunlessanduntilitisratifiedbyallMemberStates,

H. Declaration30annexedtotheTreatyEstablishingaConstitutionforEurope,statesthat'if 2yearsafterthesignatureoftheTreatyEstablishingaConstitutionforEurope,fourfifth oftheMemberStateshaveratifiedandoneormoreMemberStateshaveencountered difficultieswithproceedingwithratification,thematterwillbereferredtotheEuropean Council',

I. ItisnecessarytorespectthoseMemberStatesandtheirpeopleswhichhaveratifiedthe Constitutionaswellasthosewhichhavenot,andtoanalysecarefullythereasonsforthe negativeresultsinFranceandtheNetherlands,

J. TheNovotesappeartohavebeenrathermoreanexpressionofdissentatthepresentstate oftheUnionthanaspecificobjectiontotheconstitutionalreforms,but,paradoxically,the resultoftheNoesistomaintainthestatusquoandblockreform,

K. TheEuropeanCouncilconfirmedthisanalysisbytakingtheview,initsDeclarationof18 June2005,that‘theseresultsdonotcallintoquestioncitizens’attachmenttothe constructionofEurope’butthat‘citizenshaveneverthelessexpressedconcernsand worrieswhichneedtobetakenintoaccount’;theEuropeanCouncilthereforedecidedon a‘periodofreflection...toenableabroaddebatetotakeplaceineachofourcountries, involvingcitizens,civilsociety,socialpartners,nationalparliamentsandpoliticalparties’; theheadsofgovernmentagreedthatinthefirsthalfof2006theywould‘makeanoverall assessmentofthenationaldebatesandagreeonhowtoproceed’,

M.TheEuropeanCouncil,however,failedtogiveaclearfocustotheperiodofreflectionor todefinethemethodsandtheframeworkfordrawingconclusionsfromthisdebate,and hassincebeenseentolackboththepoliticalwillandthecapacitytostimulateand managetheEuropeandialogue,

N. Theabsenceofanagreementonthepolicychallengesandbudgetarymeansofthe enlargedUnionfortheperiod20072013furtherunderminesthepresentandfutureUnion,

O. Theperiodofreflectionhasstartedwithdebatesonthecontextratherthanthetext,with issuessuchasthefutureoftheEuropeansocialmodel,Europeaneconomicprospects,the speedofenlargement,themediumtermbudgetandthesinglemarketinservices,all featuringprominently,

P. TheCommissionhaspublisheditscontributionontheperiodofreflectionwiththeaimof restoringpublicconfidenceintheEuropeanUnionbysupportingnationaldebatesand promotinginitiativesatcommunitylevel,butthisshouldnotpreventallofEurope’s politicalinstitutionsfrommakingacombinedeffortorfromexercisingleadershipwhich takesseriouslythestrategicimportanceoftheConstitutionandthepoliticalrealityofthe preconditionsuponwhichitssuccessdepends,

Q. Thenationalparliamentshavedeclaredtheirsupportforaseriesofjointparliamentary meetingsthatwill'stimulate,steerandsynthesize'theEuropeandialogue 1,

1. ReaffirmsitsconvictionthattheTreatyofNiceisnotaviablebasisforthecontinuationof theEuropeanintegrationprocess;

2. Confirmsitscommitmenttoachievingwithoutunduedelaya constitutionalsettlement whichstrengthensparliamentarydemocracy,transparencyandtheruleoflaw,anchors fundamentalrights,developscitizenship,andenhancesthecapacityoftheenlargedUnion toacteffectivelyathomeandabroad;fearsthatwithoutsuchaconstitutionalsettlementit willnotbepossiblefortheUniontoexpectthesupportofitscitizens,tomaintainthe momentumofintegrationandtobecomeacrediblepartnerinworldaffairs;recallsits endorsementoftheTreatyestablishingaConstitutionforEuropeasachievingthese objectives;callsalsoontheEuropeanCouncilofJune2006solemnlytodeclarethesame commitmenttoaconstitutionalsettlementonthefutureofEurope;

3. StressesthatitisnotpossibletofurtherenlargetheUnionaftertheaccessionofBulgaria andRomaniaonthebasisoftheTreatyofNice;

4. RecallsthatthepoliticalproblemsandinstitutionalweaknessthattheConventionwasset uptoaddresswillpersist–and,indeed,growunlessanduntilthereformsenshrinedin theTreatyestablishingaConstitutionforEuropearebroughtintoforce;

6. ResistsproposalstoestablishcoregroupsofcertainMemberStateswhilethe constitutionalprocessisstillintrain;deploresanysuggestionthatcoalitionsofcertain MemberStatescouldbeformedoutsidetheEUsystem;pointsoutthatformsofenhanced cooperationshouldpromotetheachievementoftheUnion'saims,preserveitsinterests andreinforcetheprocessofintegration,andbeopentoalltheMemberStatesatanytime; alsostressesthatthesepossibleformsofcooperationshouldnotbeimplementedtothe detrimentoftheeffortsbeingmadetoarriveataConstitutionforEuropewithoutundue delay;

7. WarnsthatastrategybasedontheselectiveimplementationoftheConstitutionrisks destroyingtheconsensusthatachievedabalancebetweentheinstitutionsandamong MemberStates,therebyaggravatingthecrisisofconfidence;

8. Notesthatthereareonlyalimitednumberofdemocraticreformsthatcanbeintroducedat thisstagewithouttreatychangebutbyrevisionofrulesofprocedureorinterinstitutional agreement–suchastransparencyoflawmakingintheCouncil,introductionofaformof citizens’initiative,improvementstothecomitologyprocedure,fulluseofthe'passerelle' clausesinthefieldofjusticeandhomeaffairs,andthemorerigorousscrutinybyeach nationalparliamentofitsgovernment'sconductofEUaffairs;

9. Proposestousethecurrentperiodofreflectiontorelaunchtheconstitutionalprojecton thebasisofabroadpublicdebateaboutthefutureofEuropeanintegration;resolvesthat thisEuropeandialogue–whoseresultsshouldnotbeprejudged–shouldaimtoclarify, deepenanddemocratisetheconsensusaroundtheConstitutionandaddresscriticismsand findsolutionswhereexpectationshavenotbeenmet;

10.WelcomesthebeginningsofabroaddebateabouttheUnion'spolicydirectionbutstresses thatthismusttakeplacewithinthecontextofovercomingtheconstitutionalcrisis,and thatpolicyprescriptionsatEUlevelmustrelatedirectlytotherules,powersand proceduresoftheEUinstitutionsaswellastothecompetencesconferredontheEUby theMemberStatesandshouldidentifytheissuesthatarecommonthroughoutEurope;

11.Suggeststhatthisnewdialogue,whichshouldbeseenasachancetopromoteEuropean democracy,shouldbeconductedandcoordinatedacrosstheUnion,structuredbycommon themesandinrealisticstagesaccordingtoanagreedframeworkforevaluation,and designedtoleadtodecisivepoliticalchoices;

12.InsiststhatthepublicdebatebeengagedwithinboththeEuropeanandthenational framework; warnsthatnarrowlyfocussednationaldebateswilldolittletochangenational stereotypes,andalsothat animposeddialoguewithoutpoliticalgoalswouldbecome nebulous,evenvacuous,therebygivingrisetoincreaseddisaffectiononthepartof Europeancitizens;

13.ProposesthattheEuropeanParliamentinvitenationalparliamentstoaseriesof conferences–‘ParliamentaryForums’–inordertostimulatethedebateandtoshape,step

14.Recognisesthecriticalimportanceforthe EuropeanUnionandinparticularfor Parliamentofavoidinganothersetbackin theconstitutional process;commitsitself thereforetoplayingaleadingroleintheEuropeandialogue,inparticularbypublishing ‘EuropeanPapers’oneachofthebigissuesfacingtheUnion,whichmaybeusedasa commonEuropeantemplateforthenationaldebatesandwhich,togetherwith contributionsfromnationalparliaments,shouldbeusedasthebasisforthedeliberations oftheParliamentaryForums;

15.Recognisesthatitisstrategicallyimportantforpoliticalinstitutionstoencourageapro activeattitudeonthepartofthemedia(inparticulartelevision,thepressandlocalradio) andtoenlistthemforthepurposeofpublicisingandintensifyingthedebate;

16.ProposesthatthefirstParliamentaryForumbeconvenedinthespringof2006,inadvance oftheJunemeetingoftheEuropeanCouncil,inordertohearreportsfromtheFrenchand DutchParliamentsabouttheirsuggestionsforawayforward andtodiscuss,onthebasis ofthisResolution,thestructureoftheEuropeandialogue,theaimofthisForumbeingto makecomprehensiverecommendationstotheEuropeanCouncilabouthowtheUnion shouldproceedtofindthewayoutofthecrisis;

17.Proposesthatthefirst Parliamentary Forumshouldidentifyalimitednumberofpriority questionsaboutthefutureofEuropeandthegovernanceoftheUnionwhichshouldbe addressedinsubsequentForumsandinthebroaderpublicdebate,suchas:

(i) whatisthegoalofEuropeanintegration?

(ii) whatroleshouldEuropehaveintheworld?

(iii) inthelightofglobalisation,whatisthefutureoftheEuropeansocialand economicmodel?

(iv) howdowedefinetheboundariesoftheEuropeanUnion?

(v) howdoweenhancefreedom,securityandjustice?

18.Believesthatarichdebateonthesefundamentalissueswillopenupnewperspectivesfor Europeanintegrationandpreparethegroundforreformofthecommonpoliciesinthose areaswheredissensionexists;

19.Believes,moreover,thattheEuropeandialoguewillonlyovercometheconstitutional crisisifitengagesnotonlyeachEUinstitutionbutalsonationalandregionalparliaments, localgovernment,politicalparties,socialpartners,civilsociety, theacademiccommunity andthemedia;putsparticularvalueinthisregarduponpracticalcontributionsfromthe EuropeanEconomicandSocialCommitteeandtheCommitteeoftheRegions;

20.RequestsMemberStatestoorganisealargenumberofpublicmeetingsandmediadebates onthefutureofEurope'Citizens'Forums'atnational,regionalandlocallevel,

21.ExpectspoliticalpartiestogivemuchmoreprominencetotheEuropeandimensionin boththeirinternaldebatesandelectoralcampaigning;

22.Wouldwelcomecitizens'petitionsthatcontributetoshapingthedebate;

23.UrgestheUnion togive muchgreaterprioritytoculturalandeducationalpolicyinorder togivelifetotheConstitution’sformulaof‘unityindiversity’;

24.PointsoutthataEuropeandialoguewillbeimpossiblewithoutadequatefunding,and reiteratesitsbudgetaryproposalforincreasedfundingofthePRINCEprogramme;inthis regard,urgesarapidsettlementoftheFinancialPerspectiveoftheUnionfortheperiod 20072013;

25.Suggeststhattheconclusionsoftheperiodofreflectionshouldbedrawnatthelatestin thesecondhalfof2007,andthatacleardecisionbereachedatthatstageabouthowto proceedwiththeConstitution;

26. NotesthatthereisintheoryanumberofoptionsavailabletotheUnionrangingfrom abandoningtheconstitutionalprojectaltogether,continuingtotrytoratifythepresenttext unamended,seekingtoclarifyoraddtothepresenttext,restructuringand/ormodifying thepresenttextwiththeaimofimprovingit,orembarkinguponacompleterewrite;

27. Considersthatapositiveoutcomeoftheperiodofreflectionwouldbethatthecurrenttext canbemaintained,althoughthiswouldonlybepossibleifaccompaniedbysignificant measurestoreassureandconvincepublicopinion;

28.CallsonthemembersoftheEuropeanCounciltoacceptbothindividualandcollective responsibilityforbringingintoforceaConstitutionforEurope;andinsiststhatthey coordinatemorecloselyboththecontentandtimingofthenationalcampaignsandgive evidencetothecitizenoftheirpoliticalwillandmutualsolidarity;

29.TakesnoteofCommission’s‘PlanDforDemocracy,Dialogueand Debate’(COM(2005)0494),butcallsontheCommissionnotonlytodeliverits communicationsstrategybutalsotoshowdecisivepoliticalcommitmenttohelpthe Unionemergefromitscurrentconstitutionaldifficulties;

30.UnderlinesthatRomaniaandBulgariamustbeinvolvedinalltheactionsreferredto above;

31.Callsuponallcivilsocietyassociationsandorganisationstoincludetheentryintoforceof theConstitutionasoneoftheirprioritiesfordiscussionanddebate;

32.DemandsinanycasethateveryeffortbemadetoensurethattheConstitutionentersinto forceduring2009;

Letterof17October2005fromPaoloCosta,chairmanoftheCommitteeonTransportand Tourism,toMrJoLeinen,chairmanoftheCommitteeonConstitutionalAffairs Translation DearColleague, Iwaspleasedtolearnthatyourcommitteeintendedtodrawupareportontheperiodof reflectionthatwasintroducedaftertherejectionoftheEuropeanConstitutionbythe electoratesofFranceandtheNetherlands.OnbehalfoftheCommitteeonTransport,Iwould liketoconveytoyououropinionregardingthereportbyMrDuffandMrVoggenhuber. WearepleasedthatParliamentistakingtheinitiativeinthisdebate.SincetheMemberStates aredividedonthesubjectandtheCommissionseemstobereluctanttotaketheinitiative, Parliament,whichrepresentsthepeoplesofEurope,shouldrelaunchthedebate.Inthis connection,wewelcomeyourrapporteur'spreliminaryideaswhich,althoughambitious, stresstheneedforaclearstructureandtimetableforthedebate. Inourcommittee'sopinion,itisimportantthatthepreparationoftangiblepoliciesbe continuedandstrengthenedwherepossible.ThecitizensofthetwoMemberStatesexpressed theirdisapprovalofthedraftEuropeanConstitution,butnotofEuropeancooperationand integration,whichareconsideredtobewaysofsolvingthesharedproblems. Forthepresent,theEuropeaninstitutionsmusttakeactiontorestorethepublic'sconfidencein theEuropeanproject.Bettercommunicationisneeded,inparticularinordertocombatthe falseargumentputforwardbysecondratenationalleaderswhoblameBrusselsfortheirown failures. ButwhatweneedmostiseffectivemeasuresinthefieldsthatEuropeancitizensseeas important.TheEuropeaninstitutionsshouldnowworktowardsachievingtheirstrategic objectives,eventhoughtheyareforthemomentobligedtouseoutdatedinstrumentssuchas theNiceTreaty. Weshould,furthermore,recognisetheneedforgreatertransparencyandsimplificationofthe decisionmakingprocessinalltheinstitutionsconcerned,bybeinganswerable,asfaras possible,directlytothecitizenswithoutthenationalgovernmentsactingasintermediaries.As acommitteewhichworksessentiallyonthebasisofthecodecisionprocedure,wefeelthatit isanelementofthedraftConstitutionthatmustbepreservedinanyfutureproposalsfor reform. 1. PendingtheratificationoftheConstitutionalTreaty,warnsagainstanytotalorpartial endorsementofthenewTreatyprovisionsgivenitsconstitutionalambitionandthefact thatthiscouldbeperceivedasanattempttocircumventcitizens'wishesinthecountries whichhavenotyetratifiedtheConstitutionalTreaty;

2. ConsidersequallyimpracticableanyattempttorenegotiatetheConstitutionalTreaty sincethisalreadyexpressesthemostbalancedsolutionthatcouldbeachievedduringthe negotiationsbothwithintheEuropeanConventionandatthesubsequentIGC,andhasin factalreadybeenratifiedbymorethanhalfoftheMemberStates;

3. RegretsthattheratificationprocesshasfounderedintwoMemberStates;supports, however,theviewthattheratificationprocessshouldcontinueatthepacedecidedonby eachMemberStateandthattheConstitutionalTreatycanbeappliedasawholeonlyif andwhentheratificationiscompletedinaccordancewiththenewTreaty;recommendsto takeadvantageofthereflectionperiodtorespondwithoutdelaytothematterswhich appeartobeattherootofthefailureoftheratificationprocessintwoMemberStatesand tofillthecurrentgapbetweencitizenswishesandtheEuropeanintegrationprocessin orderthattheprogresstowardsaconstitutionalEuropemayresume;

4. Proposesthat,inparalleltothereflectionprocess,andwithoutdelay,theEuropean Parliamentlaunchandcoordinatea‘EuropeanCitizensFirst’initiative,aimedat

5. RecommendsthatsuchanInitiativecoversnonexhaustivearrangementssuchas:

(a) ageneraldebatetotakeplaceatthebeginningofeveryyearintheEuropean ParliamentwiththeparticipationofalltheHeadsofGovernmentortheir representativesandEuropeanCommissionersontheguidelinesofthedifferent Europeanpolicies,

(b) extensivepublicdebatesinnationalparliamentsontheEuropeaninitiativeswhich especiallyconcernEuropeancitizenssuchashumansecurityincludingthefight againstterrorism,enlargement,immigration,thesocialmodel,etc.,preferably groupedinaspecific"Europeandebateday"tobeestablished,possibly simultaneously,ineachnationalparliament,

(c) thegreaterparticipationofEuropeanactors,suchasMembersoftheEuropean ParliamentandCommissionersandhighrankingofficialsofthedifferentEuropean institutions,innational/regionaldebatessoastobetterexplainwhattheEuropean Unionactuallydealswithaswellasgettingfeedbackonwhatcouldbeachieved,

(d) thesettingupof"NationalandEuropeanCitizens'Fora"toopenlydiscussanyaspect affectingeverydaylifewithintheUnion,

(e) priortoadoptionofanyimportantlegislation,anassessmentshouldbeestablished settingoutitsexpectedimpactonthedaytodaylifeofthecitizensaswellasthe wayinwhichsuchlegislationtakesintoaccounttheirconcernsandwishes,

(f) thecreationofa"EuropeanCivicandDemocraticSpace"onthebasisoftheCharter ofFundamentalRightsoftheUnionandthelegislativepackageneededforits development,

(g) theenhancementofdemocracyandopennessintheEuropeandecisionmaking processwithoutfurtherdelaybypromotingtheConstitution’sinitiativetoconvene Europeanreferendums,officiallyestablishingtherightofpetition,openingtothe publicallthedeliberationsandvotingintheCouncilofMinistersaswellasthe warningprocedureprovidedinfavourofthenationalparliamentsregardingthe principleofsubsidiarity;

6. PointsoutthattheEuropeanintegrationprocessneedstobebroughtclosertoyoung peopleandaccordinglyproposesthatEuropeanhistoryandtheworkingsoftheEU institutionsbemadeacompulsorysubjectofstudyinallEUschools;

7. IsoftheviewthattheperiodofreflectionontheConstitutionalTreatyratification processdecidedbytheBrusselsEuropeanCouncilof1617June2005offersagood opportunityforfurtherreexaminationoftheroleofeachinstitutionbothintheexternal actionfieldoftheUnionasawholeandintheCFSPfield;considersthatmajor improvementscouldbemadewithoutdelayonthebasisoftheexistingTreatiesinterms ofcoherence,visibility,openness,andefficiencyinsomeareaswhichcouldofferreal Europeanaddedvalue;

8. Recallsinthisconnectionthat,accordingtothelatestEurobarometer,publicsupport existsinallMemberStates(almost69%)infavourofabiggerrolefortheUnionin externalrelationsandthatthenewConstitution'sprovisionsinthisareahavenotbeen questionedduringtheratificationprocess;underlinesthereforethattheCFSPcouldalso playanimportantroleinreinforcingtheEuropeanprojectinpublicopinionandin demonstratingtheadvantagesoftherelevantpartsoftheConstitutionalTreaty;

9. Regrets,inthisrespect,theattitudeofsomeMembersStateswhich,inspiteofthe adoptionoftheConstitutionbytheEuropeanCouncil,haveusedtherightofvetoin importantforeignaffairsmattersfordomesticreasons;calls,therefore,onallMember StatestoactinaconstructivemannerinlinewiththespiritoftheConstitution;

10. PointsoutthattheappointmentoftheHighRepresentative/SecretaryGeneralofthe CouncilhasimprovedthevisibilityoftheEUontheworldstage,buttakestheviewthat suchvisibilityhasnotbeenmatchedbyanequalimprovementoftheeffectivenessofthe EUexternalaction;

11. Proposesthereforethat,duringthereflectionperiod,prioritybegiventoalimitednumber ofareaswhichbetterconnectwiththewishesandconcernsofEuropeancitizensandtheir expectationsoftheroletobeplayedbytheUnionininternationalaffairs,suchasthe EuropeanNeighbourhoodPolicy,humansecurityandthefightagainstterrorism, migrationmanagement,includingmeasurestocombatillegalimmigration,andthe Union’scontributiontopovertyreductionandbettereconomicandsustainable developmentinaglobalisedworld;

12. Inthisregard,recommendstotheCommissionthatitshouldpresenturgentproposalsin thosepriorityareasandbetterexploittheimmensepossibilitiesofferedbythepolitical, commercial,economicandfinancialinstrumentsandpoliciesunderthefirstpillarofthe existingtreatiesasawhole,therebyconstitutingasignificant'softpower'fallingwithin thecompetenceoftheCommunityandservingtheUnion'sobjectivesininternational affairs;

13. RecommendsinthisconnectionthattheCommissionshoulddevelopafarmore integratedandproactiveapproachintheCommunity'sexternalactionfieldandalso exploitbetteritsimportantroleunderthesecondpillaroftheexistingtreaties,for examplebymakingmoredecisiveuseofitsrightofinitiativeintheareaofCFSP, targetingparticularissueswhereEuropeanopinionclearlyexpectsaction;

Underlinesthatpoliticaldialoguewiththirdcountriesandregions,moreproactiveaction inrelationswithinternationalorganisationsandmoreflexibleanddynamicuseofthe Commission'sdelegationnetwork,undoubtedlyoneofthemosteffectiveandwell informedforeignservicesintheworld,couldcreateadditionalopportunitiesregarding bothfirstandsecondpillaractivities;

15. Recallsinthisconnectionthatalthoughparliamentarydiplomacydoesnotconstitutean alternativetoestablished,intergovernmentaldiplomacy,itcouldplayamuchmore meaningfulroleasacomplementarytoolfortherelationsoftheUnionwiththird countriesandregions;stressesthereforeitsreadinesstouseitsnetworkofmorethan 30standingparliamentarydelegations,itsnumerousadhocdelegationsandinter parliamentaryconferencestostrengthentheUnion'sexternalactionaswellasitsCFSP;

16. Isoftheviewthat,withoutalteringtheexistingdecisionmakingprocess,many additionalpracticalarrangementscouldbemadetoenhancecoherenceintheconcerted actionoftheUnion'sinstitutionsandservicesonexternalaffairs,suchas:

(a) unreservedlysharingtheinformation,reportsandanalysescompiledbytheservices, delegations,SpecialRepresentatives,embassies,etc.oftheUnionanditsinstitutions andoftheMemberStates,

(b) holdingregularjointmeetingsbetweentheGroupofExternalRelations Commissioners,theHighRepresentative/SecretaryGeneraloftheCounciland delegationsoftheCommitteesoftheEuropeanParliamentdealingwithexternal affairsissuesinordertobetterappreciateandcoordinatestrategicpriorities,

(c) holdingregularjointmeetingsbetweentheCouncil'sWorkingGroupsand COREPER,theCommissionandtherapporteursoftheEPinordertobebetter acquaintedwitheachother'scurrentpositions,

(d) improvingcooperationbetweentheDirectoratesforExternalActionsofthethree Europeaninstitutionsbyfacilitatingregularworkingmeetingsandexchangesathigh level(DirectorsGeneralandDirectors)andmediumlevel(HeadsofUnitandDesk Officers),includingtherotationandexchangeofEuropeancivilservantsdealing withexternalaffairsissues,

(e) enhancingtheinteractionbetweenthe127delegationsandrepresentationswithother EUinstitutionsanddelegations,MemberStateforeignministriesandembassies, EuropeanbusinessandEuropeancitizensbyorganisingregularcontactsand meetings,providingpracticalassistanceandexchangingMemberStates'diplomatic personnelandofficialsoftherelevantinstitutionsonareciprocalbasis;

17. RecommendstocontinuepragmaticallytodevelopandbuilduptheESDPonthebasisof thedecisionsadoptedbytheEuropeanCouncilandtheCouncilofMinisters,ashasbeen thecasesincetheStMaloDeclarationin1998;sharestheviewthatthesedecisionsare alreadycoveredbytheexistingtreaties(inparticularArticles18(2)and26oftheTreaty onEuropeanUnion,underwhichthePresidencyandtheHighRepresentativeare responsibleforimplementingdecisionstakenbytheCouncilpursuanttoArticle13(3)) andthattheycouldthereforebeputinplacepriorto,andifnecessaryalsowithout,the

18. ProposestogreatlyreinforcetheEuropeanUnionSatelliteCentre(EUSC)bothona personnelandbudgetarylevelsoastobetterachieveitsmainobjectiveofgeneral securitysurveillanceandsupportforPetersbergtypemissions,treatyverification,arms proliferationcontrol,maritimesurveillanceandenvironmentalmonitoring(including bothnaturalandmaninduceddisasters);

19. Isconvincedinparticularthatensuringthedemocraticaccountabilityandtransparencyof allactivitiesundertakenbytheEuropeanDefenceAgencyisamatterofurgencywhich doesnotdependonthecomingintoforceofthenewTreaty;isfurtherconvincedthat settinguptheEuropeanCivilPeaceCorpsinaccordancewiththeresolutionsadoptedby theEuropeanParliamentonseveralpreviousoccasionsisalsonowfeasible;

20. EncouragesboththeCouncilandtheMemberStatestofurtherincreasedefacto parliamentaryscrutinyofESDP,atnationallevel,byenhancingtheroleplayedby nationalparliamentsintheauthorisationofESDPoperations,and,atEuropeanlevel,by givingtheEuropeanParliamentamajorroleinthescrutinyoftheentireCFSPbudget througharevisionofthe1999InterinstitutionalAgreement;

21. AsksoncemorethattheCouncilshouldnotonlyinformbutalsoregularlyconsultand involveParliamentonthemainaspectsandbasicchoicesmadeonCFSP/ESDP;

Preparatory work on the setting up of the External Action Service

22. StressesthatthecreationofthenewpostofEUMinisterforForeignAffairsandbuilding upthefutureExternalActionService(viaforexampleanadhocinterinstitutional agreement)needstobeinlinewiththeprogressoftheratificationprocessandtobe underparliamentaryscrutiny;

23. RecommendsthattheprovisionsoftheConstitutionalTreatybefollowedbysteadily progressingthepreparatoryworkforthenewService,whilstprovidingforitseffective creationonlyfollowingratificationoftheConstitutionalTreaty.

6 Welcomestheinitiative´planD´fordemocracy,dialogueanddebatetakenby CommissionerWallströmtostartanongoingdialogueonEuropeanpoliciesatboth regionalandlocallevel;further,stressestheneedtoinvolveEuropeanyouthinthewider debateandstimulateitscommitmentto´Europeanthought´;

7 Stresses,inthisregard,theabsolutenecessityofprovidingadequatefundingforcohesion policy,reiteratingonceagainthattheamountof0.41%ofCommunityGNIisthe minimumleveloffundingbelowwhichthatpolicymightproveineffectiveinachieving itsobjectives;

8 CallsupontheCommissiontopresentanaccurate,reasonedassessmentoftheeffects whichcertainorpossibleenlargementsoftheEUtoincludenewMemberStatesarelikely tohaveonregionalpolicy;

9 Recommendstheuseofspecifictoolssuchastheinternet,televisionprogrammes, advertisementsandinformationseminarsinschoolsanddirectedattheyoungtogenerate adialogueonEuropeanpoliciesatnational,regionalandlocallevel;

EXPLANATORY STATEMENT

Theincreasinglyopenandinternationalnatureofagriculturalmarketswillhaveamajor structuralimpactonthefarmingindustryandruraldevelopmentintheEuropeanUnion. Againstthisbackground,measurestoprotect,maintainthecompetitivenessofandstrengthen onasustainablebasistheeconomicpotentialofruralareasmustbeakeyCommunity objectiveinthecontextoftheLisbonStrategy.ThroughthereformoftheCAP,theEUhas takenanimportantstepintherightdirection.Thereformwillsubstantiallyimprovethe marketintegrationofthefarmingindustry.Thiswillopenupnewopportunitiesfor development,buttheseopportunitieswillbringwiththemrisksforholdingsandmarkets whichfailtoadjustquicklyenough.Atthesametime,societyismakingevergreaterdemands onagricultureandfoodproduction.

Parliamenthadtofightforalongtimetosecurecodecisionrightsintheagriculturalsphere.It iswelcomethatthedraftConstitutionshouldhavetakenovertheprovisions,inforcesince theAmsterdamTreatywasratified,stipulatingthatcodecisionappliesintheareasof environmentalprotection,foodsafetyandconsumerprotection.Eventoday,theCouncilof AgricultureMinisterscandisregardParliament'sopiniononagriculturalpolicymatters. Againstthisbackground,althoughthedraftConstitutionofferedtheprospectofincreased democraticlegitimacy,inthatallfundamentalfarmpolicydecisionsweretobesubjectto codecision,onmanymarketrelated,andthereforevital,issuesitwouldhaverepresenteda backwardstepbycomparisonwiththecurrentsituationtheCouncilwastotakedecisionson thoseissueswithnoParliamentinvolvement.

TheCommonAgriculturalPolicyisacornerstoneoftheEuropeanintegrationprocess.In viewoftheCAP'sgreatsignificance,andgiventhehugeshareofEUbudgetaryspendingfor whichitaccounts,Europeancitizensmustbeofferedguaranteesofthehighestpossible

PE364.708v0200 24/67 RR\595752EN.doc EN degreeoftransparencyandconsensualdecisionmakinginthissensitivearea.Fullcodecision onallissuesrelatingtoagriculturalpolicy,consumerprotectionandfoodsafetymustbe thereforebeseenasfundamentaltoanyfutureEuropeaninstitutionalstructure.

ThiswillalsonecessitateafundamentalredrawingoftheobjectivesoftheCommon AgriculturalPolicy,however:PartIII,ArticleIII123isoutdatedandnolongerservesa readilyexplainablepurpose.Today,theEUfarmingindustryprovidesemploymentfor10 millionpeople.Itrepresentstheonlyguaranteeforsustainableruraldevelopmentandispart ofthefabricofrurallife.Today,theCAPstandsforthemarketoriented,environmentally friendly,lowresourceimpactandsociallysustainableproductionofhighqualityfoodstuffs inaccordancewithinternationallyfairconditions.TheCAPtakesaccountofanimal protectionrequirementsandtakesmeasurestopreventanimaldiseaseepidemics.

YourdraftsmantakestheviewthatthedraftConstitutioninitscurrentformwillnotproduce aCAPwhichisacceptabletosociety.Instead,astheCommitteeonAgricultureandRural DevelopmenthasalreadyurgedinitsopinionontheTreatyestablishingaConstitutionfor Europe,Parliamentshoulddoeverythinginitspowertomakethepublicunderstandthe significanceoftheCommonAgriculturalPolicy,theadvancesithasbroughtaboutandthe benefitsitoffersconsumers.

SUGGESTIONS

TheCommitteeonAgricultureandRuralDevelopmentaskstheCommitteeonConstitutional Affairs,thecommitteeresponsible,toincorporatethefollowingsuggestionsinitsmotionfor aresolution:

1. Takestheviewthatthecommonagriculturalpolicy(CAP)mustcontributetoachieving theLisbonStrategyobjectivesinparticularboostingemployment,researchand technology,soastohelpmaketheEuropeaneconomymorecompetitiveandproductive,

Regrets,thatunderthepresentTreatythecodecisionproceduredoesnotapplytothe commonagriculturalpolicy(CAP)andcalls,aspartofafuture(deletion)treaty,forthe codecisionproceduretobeextendedasamatterofprioritytotheCAP,particularlyin ordertofillthegapsintheproposedConstitutionalTreaty(ArticlesIII230(2)andIII 231(3);

3. RegretsthefactthatdecisionscannowbetakenwithoutParliament'sinvolvementon matterspreviouslycoveredbytheconsultationprocedure;regardsthisas counterproductiveinthelightofthedoubtsvoicedbybroadsectionsoftheEuropean publicconcerningthedraftConstitutionandthecallsforareductioninthedemocratic deficit;

4. PointsoutthattheobjectivesoftheCommonAgriculturalPolicylaiddowninArticle III227runcountertotheobjectivesoftheEuropeanUnionsetoutinArticleI3;forthis reason,regardsitasessentialthattheobjectivesoftheCommonAgriculturalPolicy shouldbeupdatedwithaviewtotakingaccountofrecentdevelopmentsinthatpolicy and,inparticular,itsmultifunctionalrolevisàvisfarmersthemselves,ruraldevelopment, theenvironmentandconsumersandmeasurestopreventcontagiousanimaldiseases;.

5. InthelightoftheobjectivesoftheCommonAgriculturalPolicycontinuestoregardthe followingtextasappropriate:

NotesthatthedebateontheConstitutionalTreatyisalsoadebateonEuropeanidentity anditsmanyanddiversevalues;takestheviewthattheEU’sprogrammesoncultureand educationpolicymakeasubstantialcontributiontobuildingupanawarenessofbeing EuropeanandpreservingandfurtherdevelopingEuropeancultures;drawsattention thereforetotheimportanceofasuitablebudgetforcultureandeducation,inthefinancial perspectiveaswellaselsewhere;

TheCommitteeonCivilLiberties,JusticeandHomeAffairscallsontheCommitteeon ConstitutionalAffairs,asthecommitteeresponsible,toincorporatethefollowingsuggestions initsmotionforaresolution:

1. PointstothemanyimprovementsthattheConstitutionmakestotheexistingTreatiesas regardssecurity,freedom,andjustice,includingforexample:doingawaywith organisationaccordingto‘pillars’,thusenablingmostoftheproceduresencompassed withinthepresentthirdpillartobebroughtwithintheCommunitysystem;thewideruse tobemadeofdecisiontakingbyqualifiedmajorityvoteandthesimplificationof legislativeacts;thewiderrangingjurisdictiontobeconferredontheCourtofJustice;the strongerroleforParliamentinthejointexerciseoflegislativeauthority;placingEuropol withinaCommunityframework,asopposedtoitspresentstatuswithinthe intergovernmentalsphere,whichmakesfornobetterthanverypoordemocraticcontrol; incorporationoftheCharteroffundamentalrightsintheactualtextoftheConstitution, therebyenablingittorankaslaw;theproposedaccessionoftheUniontotheEuropean ConventionfortheProtectionofHumanRightsandFundamentalFreedoms;increased powersforEurojust;theprospectofsettingupaEuropeanpublicprosecutor’soffice;and astrongerroleforthenationalparliamentsandtheEuropeanParliamentasfaras assessmentisconcerned;

2. EmphasisesthestrategicimportanceofParliamentinthepublicdebateontheConstitution andtheneedforformsofcommunicationtobedevelopedwhichwillengagethegeneral public;

Stressesthatthedebatemustbealargescaleonecuttingacrossinstitutions,social partners,politicalpartiesandthemedia,andthatitmustbesupportedbymeansof maximumpublicity(includingpublicityprovidedbytheinstitutions);stressesthatthe Europeanfreedom,securityandjusticeprojectmustbecentraltosuchadebate;

4. Welcomesthefactthat,on17and18October2005,theEuropeanParliamentandthe nationalparliamentsheldameetinggivenovertojudicialandpolicecooperationin Europe;notesthatthemeetingshowedthatthereisaconsensusonthemanynewfeatures whichtheConstitutionaddsinthisfield,aswellasontheneedforalltheparliamentsof theUniontoworktogethermoreactively,inparticulartoenhancedemocraticcontrol over,andtheeffectivenessof,EuropolandEurojust;considersinthisconnectionthat regularcyclesofinterparliamentarydebateshouldbeestablished;

5. RecognisesthatratificationoftheConstitutionisnowbesetbyseriousdifficultiesthat willrequirethenationalgovernmentsandparliaments,aswellastheUnioninstitutions,to redoubletheireffortstoprovidetheUnionwithmeansofactioncommensuratewithwhat isatstakeandwhatcitizensexpect,especiallyinordertofightcrimeandterrorism withoutinanywayencroachingonfundamentalfreedoms;considersthatsuchobjectives canbestbeattainedthroughaConstitution;

6. Believesthatitisessentialtoremedythedemocraticdeficitthatstillcharacterisesthearea offreedom,security,andjustice,andthereforeconsidersitvitaltomakethe‘bridging’ clausesfullyoperativeasprovidedforin

− Article67oftheECTreaty,especiallyasregardstheneedtoconferfulljurisdictionon theCourtofJustice,and

− Article42oftheEUTreaty,intheformfirstlaiddownintheMaastrichtTreaty;

7. DrawsattentioninthisconnectiontotherecentadvancesthattheCourtofJusticehas maderegardingCommunitycompetencesforthepurposeoflayingdowncriminal penaltiesandtothejudgmentsconcerningmutualrecognitionofjudicialrulings(Gözütök case)andthe ‘ne bis in idem’ principle(Pupinocase);

8. PointsoutthattheEuropeanfreedom,securityandjusticepolicyrequiresconsistentand integratedassessmentsasprovidedforintheConstitution;pointsoutthatsuchmatters involveactionoutsidetheUnion,which,byitsverynature,requirestheEuropeanUnion toestablishunityamongstitsinstitutionsandwithinitslegislation;

9. Considersthat,asamatterofpriority,theimpactofUnionpoliciesonfundamentalrights shouldbetakensystematicallyintoaccountandpointstotheurgentneedtosetupa fundamentalrightsagencytohelptheinstitutionsaccomplishtheirtask,observingthe principlessetoutintheresolutionadoptedbyParliamenton26May2005byanabsolute majorityofitsMembersinaccordancewithArticle192oftheECTreaty;considersin particularthattheagencyshouldbesetupbyParliamentandtheCouncilunderthe codecisionprocedureandenjoycompleteindependence;considersthatsuchindependence shouldbeensuredbyvariousmeans,includingthenominationtothepostofdirectorofan individualwhoisacknowledgedashavingexperienceinfundamentalrightsandwhowill havetobeselectedinaccordancewithaprocedurewhichprovidesforParliamentandthe

6. CallsonMemberStatestotakeadecisiveroleinleadingatnationallevelaEuropewide interactive,structuredandcoordinateddebateonthefutureofEuropeandthe ConstitutionalTreaty,andencouragediscussionatregionalandlocallevelaswell;

7. Takestheviewthatthephaseofreflectionshouldbeused,ontheonehand,toensurethat citizensarefullyinformed,notonlyabouttheConstitutionitself,butalsoaboutthe existingTreaties,andontheotherhandtoclarify,broadenanddemocratisetheconsensus aroundtheConstitutionbyfindingsolutionstoexistingproblemssuchasimmigration, demographyandemploymentandtoprovidearepresentativeprofileoftheopinionsof citizensbymeansofpublicopinionpolls(Eurobarometer);

8. Recommendsbroadeningthedebatetoincludequestions,withtheparticipationofall Europeancitizens,aboutthefutureofEuropeandissuesthatwereattheheartofthe referendacampaigns,suchastheaimofEuropeanintegration,Europe'sroleintheworld andthefutureoftheEuropeansocialandeconomicmodel;

9. Recommendsthatwomen'sNGOsandwomen'sforabesupported,inordertoenhance thedialogueontheConstitutionaltreaty,withtheaimofensuringthatwomenreceive clearinformationontheimpactthattheConstitutionaltreatywouldhaveon,andthe contributionitwouldmaketo,thedailylivesofEuropeancitizens;

10. RemindstheMemberStatesthatanydialogueontheEuropeanventuremustnecessarily includearecognition,asafundamentalvalue,oftheequalityofwomenandmen,inthe knowledgethatthisequalityisavectorofpeace,freedom,justiceandsocialprogress;

11. Recallsthatthedreamofagreat,unitedEuropemustberealisednotonlyonthebasisof convergingeconomicaspirationsandinterests,butalsoonthatofvaluessharedbyall Europeancitizens,becauseitisthesetruevaluesthatwillgiveEuropeitsownidentity andenableittoassumeitsresponsibilitiesontheglobalstage;

12. InsiststhatanyreflectiononthefutureofEuropemustbebasedonrespectfor"unityin diversity"andgenderequality,andthatthefightagainstallformsofdiscriminationmust beupheld.

The underlying logic and analyses remain the same 1.1 ThelogicandanalysesthatledtheEESCtoadopt,withaverylargemajorityits opinioninfavouroftheConstitutionalTreaty(28October2004) 1havenotchanged, andnorthereforehavetheargumentsandrecommendationsdeveloped.Indeed,inthe Committee'sopinionthevagariesoftheratificationprocessoftheConstitutional Treatyconfirmthevalidityofthepositionsithastaken. 1.2 Forexample,thereferendumresultsinFranceandtheNetherlandsnotonly demonstratethefailureoftheMemberStatesandtheEuropeaninstitutionsto communicatetothepublicwhatEuropeisactuallyaboutandhowitreaches agreementsbut,theyalsorevealthegulfseparatingthepublicfromtheEuropean project.Itmustbesaidthatthisgulfisnotuniquetothosecountriesandisnotsimply theresultofpoorcommunicationorthecurrenteconomicsituation,butitdoescall intoquestionthenatureoftheagreementitselfandthusthewayinwhichitwas reached. 1.3 Itisworthwhilerecallingthe"clearmessages"which,intheCommittee'sOctober 2004opinion,itbelievedshouldbegotacrosstocivilsociety: • theuseoftheinstrumentofthe"Convention",a"stepforwardintheprocessof democratisingtheEuropeanventure"; • theestablishmentofaConstitutionasa"revolutionary"stepinthehistoryofthe Europeanventure; • theestablishmentofamoredemocraticUnionwhichwouldrecognisethatthe interestsofthepeopleareparamountinthebuildingofEurope; • theestablishmentofaUnionwhichwouldaffordbetterprotectionofthe fundamentalrightsofEuropeancitizens; • theestablishmentofaUnionwhichwouldbecapableofmeetingtheaspirations ofitscitizensbyvirtueoftheCommunitymethodandCommunitypolicies. 1.4 DespiteaseriesofshortcomingsintheConstitutionalTreatywhichtheCommittee alsohighlighted,itarguedstronglyforEuropeancivilsocietytoberalliedbehindthe achievementsoftheConstitutionalTreatyinordertoovercometheseshortcomings. 1 CESE1416/2004.

RR\595752EN.doc 45/67 PE364.708v0200 EN 1.5 ThoseidentifiedbytheCommitteeincludedthefollowing: • thelackofadequateoperationalprovisionsforimplementingtheprincipleof participatorydemocracy; • theabsenceofprovisionsacknowledgingtheroleplayedbyorganisedcivil societyinimplementingthesubsidiarityprinciple; • theweaknessofEUgovernanceasregardseconomicandemploymentpolicyand theabsenceofrulesprovidingforconsultationoftheEuropeanParliamentandthe EESCintheseareas,whichconcerncivilsocietyplayersmostofall. 1.6 IntheCommittee'sopinion,alloftheseobservationsremainpertinentandvalid.Inits October2004opinion,theCommitteearguedstronglynotonlyinfavourofthe ratificationoftheConstitutionalTreaty,butalsothatEUcitizensneededtobemade awareofthedemocraticprogressachievedbythedraftConstitutionandofits advantages. 1.7 Thedebateswhichtookplacearoundtheratificationprocessdemonstratedyetagain thatoneofthemajorchallengesfacingtheEuropeanUnionisthequestionofhowto preserveandguaranteegrowth,jobsandprosperityforthecurrentandfuture generations.AsthelatestEurobarometersurvey(Eurobarometer63,September2005) shows,thisquestionisattheheartofEuropeancitizens'concerns. 1.8 Avitalelementintheresponsetothatchallengeistobefoundintheobjectivessetout intheLisbonStrategy,asidentifiedbytheHeadsofStateorGovernmentin2000,a StrategywhichoffersaconcretevisionofthefutureofEuropeansociety. 1.9 Itisnecessarytorecognisehoweverthat,despitefiveyearsofintensedebatesand activitiesatEuropeanlevel,theresultssofarhavebeendisappointingandthe implementationoftheStrategyhasbeenfoundwanting. 1.10 "Alongside undeniable progress, there are shortcomings and obvious delays" reported theEuropeanCouncilinMarch2005.Theremaybemanyreasonsforthese shortcomingsandthedelay,butmostwouldagreeonthefollowingtwoobservations: • theStrategyistooabstract.Therearenovisibleconsequencesforpeopleand businesses.Publicopiniondoesnotmakeadistinctionbetweentheeffectsof globalisation,EUpolicyandnationalpolicyontheirlivingandworking conditions; • theStrategyremainsatopdownprocess.Therehasbeentoolittleinvolvementon thepartoforganisedcivilsociety.InsomeMemberStatestheStrategyismoreor lessunknowntomanyoftheconcernedstakeholders.Nogenuineconsultation seemstohavetakenplace,notleastwithintheopenmethodofcoordinationfor researchandeducation.

PE364.708v0200 46/67 RR\595752EN.doc EN 1.11 ThustheMarch2005EuropeanCouncilnotablyunderlinedtheneedforcivilsociety toappropriateandparticipateactivelyinachievingtheaimsoftheLisbonStrategy. 1.12 ItisparticularlyclearinthiscontextthatthefutureoftheEuropeanmodelofsociety, includingitssocialmodel,whichisafundamentalpartofthecollectiveidentityof Europeancitizensandwithwhichtheystronglyidentify,willdependontherealisation oftheLisbonStrategy'sobjectives.Thus,thechallengeisnotsomuchaboutthefuture oftheConstitutionalTreaty,importantthoughitis,butaboutcreatingtheconditions whichwillenableEuropeancitizenstoreappropriatetheEuropeanprojectonthebasis ofaglobalsharedvisionaboutthesortofsocietytheydesire. 1.13 Thatiswhy,initsOctober2004Opinion,theCommitteealsoestablishedalink betweentheConstitutionalTreatyandtheLisbonStrategy,arguingthat: "The Lisbon Strategy should be introduced into the debate since it maps out a vision of the future for all citizens of the EU marked by: competitiveness, full employment, shared knowledge; investment in human resources; and growth, whilst preserving the living environment and the quality of life through sustainable development …" 2. Getting back on the tracks – a shared vision through participatory democracy 2.1 TomasterthechallengesfacingtheEuropeanUnion,theEuropeanintegrationprocess mustbe"relegitimised",basedonanewconceptionofdemocraticactionwhich bestowsadeterminingroleoncivilsocietyanditsrepresentativeinstitutions. 2.2 Tothatend,theparticipationofcivilsocietyinthepublicdecisionmakingprocessis anessentialinstrumentinreinforcingthedemocraticlegitimacyoftheEuropean institutionsandEuropeanaction.Itisanevenmoreessentialelementinencouraging theemergenceofasharedviewaboutthepurposeandthedirectionof"Europe"and thusanewconsensus,onthebasisofwhichitshouldbepossibletopursuethe EuropeanintegrationprocessandtodefineandimplementaprojectfortheEuropeof tomorrowwhichwillrespondmorefullytotheexpectationsofitscitizens. 2.3 TheEuropeanUnion'sinstitutionsandtheMemberStategovernmentsmustencourage agenuinesubsidiarityculturethatembracesnotonlythedifferentlevelsofauthority butalsothedifferentcomponentelementsofsociety,insuchawayastodemonstrate totheEuropeancitizenthattheEUwillactonlywherethereisclearaddedvalueand inrespectoftheprincipleofbetterlawmaking. 2.4 AccordingtothelatestEurobarometerfindings,53percentofthosequestioned believedtheirvoicedidn'tcountintheEuropeanUnion.Only38percentbelievedthe opposite. 2.5 Suchfindingsdemonstratetheneedtobuildandtousetoolswhichwillenable Europeancitizenstobegenuinelyinvolvedintheexerciseofdefiningaprojectforthe enlargedEurope,aprojectwhichshouldbeequippedwithtruecontentandwhichwill encouragethemtosupportandidentifywiththeEuropeanintegrationprocess.

RR\595752EN.doc 47/67 PE364.708v0200 EN 2.6 InthiscontextitshouldbeemphasisedthatthedemocraticlegitimacyoftheEuropean Unionreposesnotonlyonacleardefinitionofthepowersandresponsibilitiesofits institutions.Italsoimpliesthat: • thoseinstitutionsenjoypublicconfidenceandcanrelyonastrongcommitmentby citizensinfavouroftheEuropeanproject, • theactiveparticipationofcitizensinthedemocraticlifeoftheEuropeanUnionis fullyguaranteedand • specificfeaturesofEuropeancitizenship,whicharemorethanthemeresumof nationalcitizenships,aresought 1 2.7 IntheCommittee'sopinion,thecurrentlysuspended,ordelayed,ratificationprocess ontheConstitutionalTreatycontainsanessentialirony:theabsenceofthe Constitution,andinparticulartheabsenceoftheprovisionsinTitleVIonthe democraticlifeoftheEuropeanUnion,furtherunderlinestheneedforthe Constitution.AfundamentalchallengefacingtheUnionisthereforehowtogetthat basicmessageacross. 2.8 IntheCommittee'sopinion,thelogicbehindtheConstitution'sprovisionsfor participatorydemocracyandcivildialogueremainsentirelyvalid.TheEuropean institutionsmustthereforeinvestfullyinthelogicoftheConstitutionTreatyand establishanauthenticparticipatorydemocracy. 2.9 Theneedtoenhanceparticipationisallthemoreurgentgiventhat,notwithstanding everythingthathasoccurredintherecentpast,theEuropeanUnion'scitizensexpect muchofit.ThesameEurobarometersurvey,citedpreviously,indicatedthatsome60 percentofEuropeanUnioncitizensfavourincreasedintegrationwithintheUnion (variousotheropinionpollsproducesimilarfindings).Theresultsalsoindicatethat,in thefaceofurgentchallengessuchasthefightsagainstunemployment,povertyand socialexclusion,Europe'scitizenswouldliketoseetheUnion'srolereinforced. 2.10 Already,inOctober2004,theCommitteearguedthat,inordertoovercomethe Treaty'sshortcomingsandalsoinordertoensureitsratificationthroughtherallyingof civilsociety,anumberofmeasurescouldbetakentobuildontheproposed institutionalframeworkandimproveitthroughoperationalmeasures.Inparticular,the Committeearguedthat: • theprovisionsonparticipatorydemocracyshouldbemadethesubjectofaseries ofcommunicationsdefiningtheconsultationproceduresandtheroleoftheEESC;

PE364.708v0200 48/67 RR\595752EN.doc EN • civilsocietyshouldbeconsultedonthecontentoftheEuropeanlawdefiningthe proceduresforimplementingtherightofcitizens'initiative.TheEESCcouldbe askedtodeliveranexploratoryopiniononthissubject; • theprincipleofparticipatorydemocracyshouldbeappliedtotheEU'skey strategiesforpromotinggrowth,employmentandsustainabledevelopment. 2.11 InthiswaytheCommitteehassoughttoconvinceEUgovernmentsandinstitutionsof thevitalneedtorallycivilsocietyandcivilsocietyorganisationsbehindthespirit,as muchastheletter,oftheConstitution. 2.12 TheCommitteenotesthatthe"broaddebate"envisagedbytheHeadsofStateor GovernmentintheirJunedeclarationisnotcurrentlyoccurring.TheCommitteefeels thatsuchabroaddebateshouldberelaunchedassoonaspossible.However,the Committeealsofeelsthatsuchadebatewouldbecounterproductiveunlesspublic opinionissomehowreassuredaboutthenatureoftheEuropeanintegrationprocess and,inparticular,aboutthedemocraticaspectsofthatprocess. 2.13 ThereflectionperioddecideduponbytheHeadsofStateorGovernmentofthe MemberStatesinJuneshouldnaturallybeusedtoconsiderwaysofovercomingthe politicalandinstitutionalsituationwhichhasresultedfromthereferendumresultsin FranceandtheNetherlands. 2.14 ButintheCommittee'sopinionthereflectionperiodshouldaboveallbeexploitedto helpestablishthefoundationsofapopularsharedvisionaboutthefutureofEurope andofanewsocialcontractbetweenEuropeanditscitizens,ofanewconsensus whichwouldalsoestablishtheframeworkwithinwhichthepoliciesnecessaryto guaranteegrowth,employmentandprosperitycanbeplaced.Inthiscontext,Member Stategovernmentsshould"takehometheEU". 2.15 Itisvitaltodemonstratethat"participatorydemocracy"and"civildialogue"arenot emptyslogansbut,rather,essentialprinciplesonwhichthesuccessoftheEuropean Union'spoliciesandthereforeofitsfuturedepend. 2.16 Itisthereforeindispensabletoinvolvecivilsocietyasbroadlyaspossible,atnational, regionalandlocallevel,inallfuturedebatesanddiscussions,toencouragetheUnion's citizenstoexpresstheirconcreteexpectationsand,inordertodothis,toputinplacea genuinestrategyoflisteningandofdialogueabouttheUnion'spoliciesandaboutthe visiontheyhaveoftheirsharedfuture. 2.17 InthiscontexttheCommitteewillcloselyexaminetheEuropeanCommission's"Plan D",allthemoresobecauseitisconvincedthat,todate,norealdebatehastakenplace andthatthemethod,timetableandresourcesplannedforstimulatingthedebate–not onlyinalltheaccessioncountriesbutalsoatintraCommunitylevel–willbecrucial. TheEESCwelcomestheviewsrepeatedlyexpressedbyEuropeanCommissionVice PresidentMargotWallströmthatcommunicationisatwowayprocessandthat "Europe"mustlistenmore.IntheCommittee'sunderstanding,"listening"doesnot

"Communicating Europe" 3.1 Moregenerally,theCommitteehaswelcomedtheemergingunderstandingthatthe EuropeanUnionshouldequipitselfwithagenuinecommunicationstrategyandthatit shouldoverhaulandenhanceitscommunicationtools.TheCommitteewelcomedthe EuropeanParliament's26April2005reportontheimplementationoftheEuropean Union'sinformationandcommunicationstrategy,andwelcomedtheEuropean Commission's20July2005adoptionofanactionplantoimprovecommunicating EuropebytheEuropeanCommission. 3.2 TheCommitteehasitselfadoptedandregularlyrevisedastrategiccommunication plan.Inaddition,inDecember2004theCommittee'sBureauapprovedanoverall strategicapproachtothechallengeof"CommunicatingEurope".Inbothcontextsthe Committeehassoughttoenhancethebridgingfunctionofitsmembersandofthe organisationstheyrepresent.TheCommitteewasacommittedparticipantinthe2004 socalled"Wicklowinitiative",notablytablingastrategicdocument,"Bridgingthe Gap",attheAmsterdaminformalministerialmeetingonhoworganisedcivilsociety ingeneralandtheCommitteeinparticularshouldbemorefullyinvolvedinthe communicationprocess. 3.3 TheCommitteewelcomedtheNovember2004EuropeanCouncil'srequesttothe EuropeanCommissiontoelaborateacoherentcommunicationstrategyfortheUnion. TheCommittee,inclosecooperationwiththeEuropeanCommission,isorganisinga stakeholders'forumonthecommunicationschallengedesignedtoenablecivilsociety organisationstofeedtheirviewsintothereflectionprocesscurrentlyunderwayand whichtheEuropeanCommissionmayalsoconsiderwhendraftingitsexpected consultativeWhitePaperonthecommunicationschallenge. 3.4 TheCommittee,whichorganisedasimilarstakeholders'forumtoaddressthepolicy issueofsustainabledevelopmentinApril2005,isreadyandwillingtoorganise similarsuchconsultativeandlisteningexercisesonmajorpolicyissues,thus enhancingorganisedcivilsociety'svoiceandhelping"Brussels"bettertolisten. 3.5 Inthiscontext,theCommitteeemphasisesthecentralroleithopestheEuropean Parliamentwillcontinuetoplayasthefirst,andmostvital,elementinthedemocratic bridgingexercise.TheCommitteeisreadytoactasapartnerotheEuropean Parliament,asitdidduringtheConventionprocess,organisinghearingsandforumsof itsowninitiativeoronthoseissueswheretheParliamentwishesparticularlytoconsult withorganisedcivilsociety. 3.6 SuchconsiderationsleadtheCommitteetoemphasisetwofundamentalconsiderations. First,whilsttheCommitteewelcomestheincreasingemphasisoncommunications strategiesandcommunicationstools,itshouldberecalledthatanycommunications approachcanonlybeasgoodasthecontentofthemessageitcontains.Thus, communicationisacomplementarymechanismandnotanendinitself.Second,

PE364.708v0200 50/67 RR\595752EN.doc EN whilsttheCommitteeisfullycommittedtothetwinprocessesofestablishinga Europeanlevelcommunicationstrategyandenhancingcommunicationtools,Union levelactivitymustbeseenascomplementarytothecommunicationsprocessestaking placewithintheMemberStates.Thus,suchaEuropeanlevelstrategyisvitally necessarybutitisfarfromsufficient. 3.7 Inthiscontext,theroleofrepresentativeandconsultativeinstitutionsatMemberState level–nationalparliamentsandnationaleconomicandsocialcouncilsnotablyamong them–aswellasatregionalandlocallevelshouldbestressed. 4. Recommendations Start making participatory democracy a reality now! 4.1 ThereasonsandthelogicwhichledtheCommitteetovoteinfavourofthe ConstitutionalTreatybysuchalargemajority–particularlyitsprovisionsonthe democraticlifeoftheUnion–remainthesame.TheCommitteecontinuestobelieve firmlythatthebestwaytoguaranteetheUnion'sdemocraticlifeistoanchorsuch provisionsinafixedconstitutionalsettlement.However,thecurrentperiodof uncertaintyshouldnotpreventalloftheEuropeanUnion'sactorsfromtaking measuresasofnowtostartmakingparticipatorydemocracyareality.Allofthe Union'sinstitutionsshouldthereforereflectactivelyonhowtheycan: – givecitizensandrepresentativeassociationstheopportunitytomakeknownand publiclyexchangetheirviewsinallareasofUnionaction; – maintainanopen,transparentandregulardialoguewithrepresentative associationsandcivilsociety; – carryoutbroadconsultationswithpartiesconcernedinordertoensurethatthe Union'sactionsarecoherentandtransparent. Inaddition,theEuropeanCommissionshouldconsideranticipatingtheprovisionsof ArticleI47(4)oftheConstitutionalTreatybyconsultingcivilsocietyonthecontent oftheEuropeanlawdefiningtheproceduresforimplementingtherightofcitizens' initiative(theEESCcouldbeaskedtodeliveranexploratoryopiniononthissubject). 4.2 Foritspart,theEuropeanEconomicandSocialCommitteereassertsitsdetermination toplayanimportant,ifcomplementary,roleinenhancingcivildialoguenotonly throughtraditionalconsultativemechanismsbutalsothroughitsbridgingfunction betweenEuropeandorganisedcivilsociety.TheCommitteedrawsattentioninthis contexttotheneedforfreshthinkingaboutwaysofinteractingwithorganisedcivil society.TheCommitteeisready,willingandabletoactasafullpartnerinall activitiesdesignedtoenhancecivildialogue. Capture public imagination and deliver on the Lisbon Strategy! 4.3 Europeaneconomicconditionsareakeyfactorindeterminingpublicattitudestowards theEuropeanintegrationprocess.TheEuropeanEconomicandSocialCommittee reaffirmsitssupportfortheLisbonStrategybutinsiststhattheUnionanditsmember

RR\595752EN.doc 51/67 PE364.708v0200 EN statesmustbeseentobedeliveringontheircommitments.TheCommitteeis convincedthattheLisbonStrategyisthebestpossibleguaranteeoftheUnion'sfuture economicprosperityandsocial,environmentalandculturalwellbeing,yetithas singularlyfailedtocapturethepublicimaginationinthewaythat,forexample,the "1992"campaigntocreatetheSingleMarketmanagedtodo.TheMemberStatesmust acceptandhonourtheirresponsibilitiesinthiscontext.TheStrategymustberendered lessabstractanditsaims(ifnotitstitle)introducedintodomesticpoliticalparlance. Civilsocietyandcivilsocietyorganisationsmustbeinvolved. 4.4 Foritspart,theEuropeanEconomicandSocialCommitteewillcontinuetowork underthemandategranteditbythe2223MarchEuropeanCouncil,"tosetupwith MemberStates'economicandsocialcommitteesandotherpartnerorganisationsan interactivenetworkofcivilsocietyinitiativesaimedatpromotingtheimplementation ofthestrategy".(Doc.7619/1/05/rev.1Council,paragraph9). Bridge the gap – enhance communication 4.5 TheCommitteehasconsistentlyarguedtheneedforenhancedcommunication betweentheEuropeanUnionandthecitizensonwhosebehalfitpurportstowork.The Committeerecognisesthatalotofworkhasrecentlytakenplaceatthelevelofthe EU'sinstitutions,bothindividuallyandcollectively;tocitebuttworecentexamples, thecompleterestructuringoftheEuropeanParliament'swebsiteandtheEuropean Commission'sEuropeDirectservice.TheCommitteefavourscloseinterinstitutional cooperationinthefieldofcommunication.ItnotestheCommission's"PlanD"and alsoitsintentionoflaunchingaWhitePaperinthenearfuture.Itisfullycommittedto playingasupportingrolewhereveritcaninbridgingthegap,asevidencedbyits78 Novemberstakeholders'forumonthattheme. 4.6 However,theCommitteebelievesthatcommunicationcanonlybeasgoodasthe messageitcontains.ReferringbacktoitsviewsontheLisbonStrategy,itbelievesthat theEuropeaninstitutionsbut,aboveall,thememberstates,needtoreflectfurtheron howtheycommunicateEurope.Muchhasalreadybeensaidabouthaltingthe"blame game",butitisclearthat"Europe"istoooftenperceivedasnegativeordefensive,and thatinsufficienteffortismadeto"sell"thepositiveaspectsoftheintegrationprocess. 4.7 Inthecontextofenhancingcoordination,theCommitteecallsforthesocalled "Wicklowinitiative"(informalmeetingsofEuropeanaffairsministers)tobere activated,buttobegivenaspecificandpermanentmandatetoexaminewaysinwhich Europecanbebettercommunicatedandtoprovidememberstateswithaninformal contextinwhichtotakestockofpublicopinionandtoexchangebestpractices.Atthe interinstitutionallevel,theCommitteecallsfortheInterInstitutionalGrouptobe similarlymandatedtomeetatmoreregularandmorefrequentintervalstodiscuss communicationissues.Suchmechanismsareparticularlyimportantgiventherapid rateoftechnologicaldevelopment(forexample,mobilephones,broadband)andthe rapiddevelopmentofnewcommunicationtechniquestoexploitthese. 4.8 TheCommitteeunderlinesitsbeliefthatcommunicationmustbeapermanentconcern andnotthesubjectofanoccasionalcampaignonaspecificissue.

Recognise where the primary responsibility lies 4.9 TheEuropeanUnion'sinstitutionsmustguardagainstafalse,ifclearlywell intentioned,beliefthatthecurrent"disconnect"canbesolvedfromthecentrallevelof "Brussels".Inreality,whattheEuropeaninstitutionsdointhefieldofcommunications canonlybecomplementary.Themainresponsibilitylieselsewhere.Theoutcomeof theelectionstotheEuropeanParliamentandtheresultsoftheFrenchandDutch referendumsontheConstitutionalTreatyshowclearlythatmanyEuropeancitizens viewEuropesceptically.ThisregardsabovealltheeffectsofEuropeanlegislationon theirlivingandworkingconditions.ItisdowntotheMemberStatestoexplaintotheir citizensthemeaningoftheEUandthenecessityofspecificEuropeanlegislationand tocommunicatetheresultingeffectstoeachrespectivenationalsphere. 4.10 Publicopinion,includingcivilsociety,willbeconvincedofthelegitimacyandthe commonfutureoftheEuropeanUniononlyifthereisperceivedcredibility,trust,a transparentlegislativeprocessandawellfunctioningruleoflaw.Inthefirstinstance, thesehavetobesafeguardedbythegovernmentsofthememberstates.Governments havetoactasrealcoownersoftheUnionandabstainfromthe"wethey"modeland theconstantdoubletalkthatthismodelinvolves. 4.11 AstheroleoftheIrishNationalForumonEuropedemonstrated,civilsociety organisationscansometimesmakedecisivecontributions.Itisessentialtoenhance communicationatarelevantlevel(local,professional,etc.)andtoexplainthesuccess storiesoftheEuropeanpolicyorlegislativeprocessinrelevantandaccessibletermsat thatlevel.Civilsocietyorganisationsarewellplacedtodothis.TheEESCisthus determinedtohelpandencouragecivilsocietyorganisationswithintheMember States,particularlythroughthebridgingfunctionofitsmembers.Moreover,ifawide debateabouttheEuropeanprojectandaboutEuropeanpoliciesisindeedtobe launched,thenitmustbeginatthelowerlevelsofcivilsocietywithinthemember states.AEuropewideforumwillonlymakesenseifitallowsfortheexpressionof theseviewsreportedbackupandalsodown.Indeed,whatisneededisnotsomucha topdownorabottomupapproach,butabottomdownapproach. 4.12 Thisopinionhasdeliberatelyeschewedmuchdiscussionaboutthefutureofthe ConstitutionalTreatyandtheoptionsopentotheEuropeanUnion.Clearly,a permanentreturntothestatusquoanteoftheNiceTreatycannotbeanoption.But perhapsthebroaddebateenvisagedbytheHeadsofStateorGovernmentcouldhelp illuminethebestwayforward.However,theCommitteenoteswithsomealarmthat suchbroaddebateislargelyabsentinmostoftheMemberStates.Intheabsenceof suchdebate,itisdifficulttoseehowgenuineprogresscanbemade. RR\595752EN.doc 55/67 PE364.708v0200 EN organisationofregionaleventsbytheEuropeDirectcentresandalltheproposalsfor thepromotionofcitizens'participationinthedemocraticprocess. 3.4 CallsfortheCommissiontoanticipatecertainaspectsoftheConstitutionalTreaty's provisionsonthedemocraticlifeoftheEuropeanUnion,believingthatthesemeasures willnotonlyreassuretheEuropeancitizenbutalsofurtherdemocratiseandinvigorate thedebate. 3.5 Arguesthereforethatcivilsocietycouldalreadynowbeconsultedonthecontentof theEuropeanlawdefiningtheproceduresforimplementingtherightofcitizens' initiative.Inthiscontext,theEESCcouldbeaskedtodeliveranexploratoryopinion onthissubject.Itcouldalsolenditssupporttocivilsocietyinitiatives. 3.6 Theprovisionsonparticipatorydemocracyshouldbemadethesubjectofaseriesof communicationsfromtheEuropeanCommission,definingtheenvisagedconsultation proceduresandtheroleoftheEESC. 3.7 CallsupontheEuropeanCommissiontoconsiderputtingforwardalegislative proposalforatrueCommunicationsPolicy,andtherebytoconfrontthe"hidden"issue oftheabsentlegalbasewhichhasresultedinsomanyinformalmechanismsandan unbalancedapproach.Thetablingofsuchaproposalwould,intheCommittee's opinion,itselfencouragedebate. 3.8 Theprovisionofadequatefinancialresourcesisnecessaryfortheimplementationofa communicationstrategythatmeetscitizens'expectations. 3.9 Oncetherequisiteresourceshavebeenplacedattheirdisposal,themedia,localand regionalauthorities,politicalgroupsandcivilsocietyorganisationswillhavethe meanstoactasaconduitforinformation.Theywillbeabletoconveyclearmessages ontheimplicationsoftheintegrationprocessthatareattunedtotheconcernsoftheir localaudience. 4.
