AND WHEREAS Staff has recognized that there was an error in this recommendation and that Area 1 of the subject property is to be rezoned to Agriculture Subzone 8 (AG8) as shown in Document 1 and detailed in Document 2 and not Agriculture, Subzone 5 (AG5) ;

BE IT THEREFORE RESOLVED THAT Recommendation 1 of this report read as follows:

3. The adoption of the following tax ratios and by-laws for the mandatory property subclasses and the tax rate percentage reduction for farm land awaiting development:

 Commercial excess land (i.e. commercial, office building and shopping centre property classes) - 70% of the applicable commercial property class tax ratio;

 Vacant industrial land, industrial and large industrial excess land - 65% of the applicable industrial property class tax ratio;

 Farm land awaiting development subclass I - 75.0% of the residential property class tax ratio and the corresponding tax rate percentage reduction for the awaiting residential, multi-residential, commercial and industrial property classes; and

 Farm land awaiting development subclass II - no tax rate reduction.

4. That the tax rates for 2014 be established based on the ratios adopted herein.

5. That the 2014 capping and clawback provisions be as follows:

a. That capping parameters be approved at the higher of 10% of the previous year’s annualized tax or 5% of the 2014 Current Value Assessment (CVA) taxes;

b. That capped or clawed back properties whose recalculated annualized taxes fall within $250 of their CVA taxation be moved to their CVA tax for the year and be excluded from any future capping adjustments;

c. That properties that have reached their CVA during 2014 or crossed over from the clawed back category to the capped

category remain at CVA taxes and be excluded from any future capping adjustments; and

d. That properties that cross over from the capped category to the clawed back category remain subject to clawback adjustments.

6. That the tax level for “new construction” properties be set at a minimum level of 100% of their CVA taxes for 2014 and future taxation years.

7. That the property tax mitigation programs be continued for 2014, including the charitable and vacancy rebate programs, the Farm Grant Program and the Low Income Seniors and Persons with Disabilities Complete Tax Deferral Program as previously approved by Council.

That Council approve an amendment to Zoning By-law 2008-250:

1. To change the zoning of 2148 Carling Avenue from Residential Third Density, Subzone C, (R3C), to Arterial Mainstreet (AM) as shown as Area A in Document 1 and detailed in Document 2, so as to permit the development of a commercial building; and

2. To change the zoning of 830 Aaron Avenue from Residential First Density, Subzone O, (R1O), to Arterial Mainstreet (AM), with a Schedule, as shown as Area B in Document 1 and detailed in Documents 2 and 3, so as to permit the development of a commercial building and to preserve a soft landscaped area.

1. An update and streamlining of the Environmental Noise Control Guidelines (2006), as outlined in this report;

WHEREAS, on July 11, 2001, City Council approved the creation of special reserve funds for those former municipalities who had reserve funds in excess of the average of all the former municipalities and that the use these special reserve funds be limited to funding only community-related projects in those former municipalities; and

WHEREAS on September 26, 2001, City Council approved the following guidelines for these community-related projects:

1. Any project must be consistent with the overall mandate of the City;

2. Projects should provide benefit to the entire former municipality or be divided into multiple projects so that reasonably equal benefits are realized across the former municipal area;

3. The projects should be community-focused projects and may include projects that cannot be accommodated within the funding capabilities of the City’s capital budget in the timeframe desired by the community;

4. The projects should not result in inordinate on-going operating costs that need to be borne by the taxpayers; and

5. The project should not create a new level of service that will create future pressure for the City to develop similar facilities in other parts of the city; and

WHEREAS by 2013 only the Cumberland Reserve Fund had not dispersed its funds completely and, on June 12, 2013, when considering a report from Finance on Capital Adjustments and Closing of Projects, City Council approved a motion from Councillors Monette and Blais that the Cumberland Reserve Fund could remain open “for additional project(s), being completed by December 31 2013”; and

WHEREAS, although the portion of the reserve dedicated to Ward 19 were expended by the December 31, 2013 deadline, a balance of $7,709 remains in the portion of the reserve dedicated to Ward 1; and

WHEREAS Councillor Monette has indicated he wishes to allocate the remaining funds to the Cardinal Creek community park or to Friends of for new signage at the beach and he is aware that this request involves Council revisiting a previous decision and requires a vote of ¾ of those present and voting to take effect;

THEREFORE BE IT RESOLVED that City Council approve that the Cumberland Reserve Fund (project 902250) not be closed and that the balance of $7,709 be used for additional project(s), being completed by November 30, 2014.

WHEREAS Council approved the provision of Tax assistance, Rehabilitation grant, and Development Charge Relief for the property at 345-357 Booth St, pursuant to the Brownfields Assistance Program, on February 13, 2013; and

WHEREAS, pursuant to Council policy, such assistance ceases if any portion of the subject property is sold; and

WHEREAS there is a pending development proposal for 20 townhouse units fronting on Booth St at the site; and

WHEREAS a third party wishes to purchase the property and proceed with the proposed development; and

WHEREAS the development of this site will bring additional taxable assessment to the City;

THEREFORE BE IT RESOLVED THAT:

1. Subject to recommendation 2, 345-357 Booth St will continue to be eligible for the Tax Assistance/Rehabilitation Grant/Development Charge components of the Brownfields Program approved on February 13, 2013 in FEDCO Report 28A, Bulk Consent Agenda Item G, notwithstanding that Lots 28 and 29 on Plan 2545 have been conveyed to another person.

2. In the event that the property at 345-357 Booth St is conveyed to another person, the site will no longer be eligible for tax assistance or development charge relief.

WHEREAS on January 24, 2014 the Government of Ontario announced a new grant-based provincial initiative called the Healthy Kids Community Challenge; and WHEREAS the Healthy Kids Community Challenge has been designed as a community-led program where partners from different sectors, including education, parks and recreation, public health and business, work together to implement activities to promote healthy weights for kids; and

WHEREAS the Government of Ontario required that applications be submitted by a municipality or Aboriginal Health Access Centre or Community Health Centre for Aboriginal communities that identified a community champion and can serve as the fiscal transfer agent for funds by March 14, 2014; and

WHEREAS selected communities may receive support and funding of up to $1.5 million from the Ministry of Health and Long-term Care over four years to fund new or enhanced programs focused on physical activity, healthy eating or adequate sleep within a defined community; and

WHEREAS Government of Ontario would only accept applications from community with a maximum population of 200,000 and a minimum of 10,000 and that a community may be a specific geographic boundary or be defined by other factors, such as ethnicity, socioeconomic status or language; and

WHEREAS the City of Ottawa’s Parks, Recreation and Cultural Services Department and Ottawa Public Health held stakeholder consultations on February 19, 2014, which included representatives from municipal councillors’ offices, child and youth serving agencies, community health and resource centres, school boards and local networks, to assess commitment of an Ottawa- based application; and

WHEREAS City of Ottawa’s Parks, Recreation and Cultural Services Department and Ottawa Public Health and stakeholders designed an application that fulfilled the requirements set-out by the Government of Ontario and defined the

OTTAWA CITY COUNCIL 31 MINUTES 72 WEDNESDAY, 09 APRIL 2014 community as a group of 20 neighborhoods with high concentrations of low- income families and those with children who are not on track for school entry; and

WHEREAS successful applicants will be required to develop, implement and evaluate action plans to promote healthy weights for kids in the defined communities;

WHEREAS staff from City of Ottawa’s Parks, Recreation and Cultural Services Department and Ottawa Public Health submitted an application to Government of Ontario on March 14, 2014 to meet the deadline and, prior to the application deadline, members of the Board of Health for the City of Health Unit and the Community and Protective Services Committee were provided with a memo outlining details of the application; and

WHEREAS Councillors Holmes and Taylor have agreed, as the Chairs of the Board of Health and the Community and Protective Services Committee, to be the Community Champions for this initiative; and

WHEREAS there is a provincial requirement for local champions and the fiscal transfer agent to be identified;

THEREFORE BE IT RESOLVED THAT, should the grant application to the Government of Ontario for the Healthy Kids Community Challenge submitted by Ottawa Public Health and the City's Parks, Recreation and Cultural Service Department be successful, Ottawa City Council approve that the City of Ottawa will act as the fiscal transfer agent for this program, including reviewing the Transfer Payment Agreement with the Ministry of Health and Long-term Care; and

BE IT FURTHER RESOLVED THAT Council approve Councillors Taylor and Holmes as the local champions of this program.
