Haydon Hall, 110 Laurier Avenue West, Ottawa, on Wednesday, 09 April 2014 beginning at 10:00 a.m. The Mayor, Jim Watson, presided and led Council in prayer. MOMENT OF SILENCE Council observed a Moment of Silence in honour of Jamie Fisher, former Ottawa City Councillor (representing Elmdale Ward from 1985 to 1991), who passed away on March 20, 2014. OTTAWA CITY COUNCIL 2 MINUTES 72 WEDNESDAY, 09 APRIL 2014 NATIONAL ANTHEM The national anthem was performed by the St. George School Choir. ANNOUNCEMENTS/CEREMONIAL ACTIVITIES UNITED WAY ACHIEVEMENT ANNOUNCEMENT BY THE MAYOR City of Ottawa employees were applauded after raising $519,007 for the United Way/Centraide of Ottawa through the 2013 Employee Campaign. ROLL CALL ALL MEMBERS WERE PRESENT EXCEPT COUNCILLOR P. HUME. CONFIRMATION OF MINUTES The Minutes of the regular meeting of 26 March 2014 were confirmed. DECLARATIONS OF INTEREST INCLUDING THOSE ORIGINALLY ARISING FROM PRIOR MEETINGS No declarations were received. Association of Municipalities of Ontario (AMO): Bill 69, The Prompt Payment Act Put Aside ; Government Announces Construction Liens Act Review New Building Canada Fund Announced - Agreement with Provincial Government Required to Allocate Funding in Ontario AMO’s Interest Arbitration Update AMO Report to Members - Highlights of the March 2014 Board Meeting Ontario Cabinet Shuffle Announced Release of Province's New Accountability Measures Other Communications Received : Correspondence received from the City Clerk and Solicitor advising Members of Council of notification received from City employees Marc Belisle and Catherine McKenney that they will be taking a leave of absence, as they intend to run in the upcoming 2014 Municipal Election. Correspondence received from the Ottawa Taxpayer Advocacy Group, containing the signatures of 177 people, asking that the City disclose evidence related to a Toronto Divisional Court Judicial Review. OTTAWA CITY COUNCIL 4 MINUTES 72 WEDNESDAY, 09 APRIL 2014 REGRETS Councillor P. Hume advised he would be absent from the Council meeting of 9 April 2014. MOTION TO INTRODUCE REPORTS MOTION NO. 72/1 Moved by Councillor S. Moffatt Seconded by Councillor D. Thompson That Agriculture and Rural Affairs Committee Report 40; Finance and Economic Development Committee Reports 39A and 42; and Planning Committee Report 67 be received and considered. CARRIED COMMITTEE REPORTS AGRICULTURE AND RURAL AFFAIRS COMMITTEE REPORT 40 1. ZONING – 7149 MCCORDICK ROAD COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 7149 McCordick Road from Agriculture, Subzone 3 (AG3) to Agriculture, Subzone 5 (AG5), and to OTTAWA CITY COUNCIL 5 MINUTES 72 WEDNESDAY, 09 APRIL 2014 Agricultural, Subzone 3 , Rural Exception [xxxx] (AG3 [xxxx]), as shown in Document 1 and detailed in Document 2. MOTION NO. 72/2 Moved by Councillor D. Thompson Seconded by Councillor S. Moffatt WHEREAS Recommendation 1 of this report currently recommends that the zoning of 7149 McCordick Road be amended from Agriculture Subzone 3 (AGS) to Agriculture Subzone 5 (AG5) and to Agriculture, Subzone 3, Rural Exception [xxxx] (AG3 [xxxx]) ; AND WHEREAS Staff has recognized that there was an error in this recommendation and that Area 1 of the subject property is to be rezoned to Agriculture Subzone 8 (AG8) as shown in Document 1 and detailed in Document 2 and not Agriculture, Subzone 5 (AG5) ; BE IT THEREFORE RESOLVED THAT Recommendation 1 of this report read as follows: That Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 7149 McCordick Road from Agriculture, Subzone 3 (AG3) to Agriculture, Subzone 8 (AG8), and to Agricultural, Subzone 3 , Rural Exception [xxxx] (AG3 [xxxx]), as shown in Document 1 and detailed in Document 2. AND BE IT RESOLVED that no further notice be given under subsection 34(17) of the Planning Act. CARRIED Item 1 of the City Council Agenda, as amended by Motion No. 72/2 and set out in full below, was then put to Council: That Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 7149 McCordick Road from Agriculture, Subzone 3 (AG3) to Agriculture, Subzone 8 (AG8), and to Agricultural, Subzone 3 , Rural Exception [xxxx] (AG3 [xxxx]), as shown in Document 1 and detailed in Document 2. ZONING – 6182 BANK STREET COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 6182 Bank Street from Development Reserve, Subzone 1 (DR1) to Village Residential First Density, Subzone I, Rural Exception 624 (V1I [624r]), as shown in Document 1 and detailed in Document 2. CARRIED 3. ZONING - 5650 MITCH OWENS ROAD COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 5650 Mitch Owens Road from Parks and Open Space (O1) to Parks and Open Space with an Exception (O1 [xxxr]) to permit the addition of an office use and a Recreational Athletic Facility use, as shown in Document 1 and detailed in Document 2. REPORT ON BUDGET EXPENSES PURSUANT TO ONTARIO REGULATION 284/09 COMMITTEE RECOMMENDATION That Council adopt this report. CARRIED 5. 2014 TAX RATIOS AND OTHER TAX POLICIES COMMITTEE RECOMMENDATIONS That Council approve: 1. The adoption of the following tax ratios and by-laws for the mandatory property subclasses and the tax rate percentage reduction for farm land awaiting development: Commercial excess land (i.e. commercial, office building and shopping centre property classes) - 70% of the applicable commercial property class tax ratio; Vacant industrial land, industrial and large industrial excess land - 65% of the applicable industrial property class tax ratio; Farm land awaiting development subclass I - 75.0% of the residential property class tax ratio and the corresponding tax rate percentage reduction for the awaiting residential, multi-residential, commercial and industrial property classes; and Farm land awaiting development subclass II - no tax rate reduction. 4. That the tax rates for 2014 be established based on the ratios adopted herein. 5. That the 2014 capping and clawback provisions be as follows: a. That capping parameters be approved at the higher of 10% of the previous year’s annualized tax or 5% of the 2014 Current Value Assessment (CVA) taxes; b. That capped or clawed back properties whose recalculated annualized taxes fall within $250 of their CVA taxation be moved to their CVA tax for the year and be excluded from any future capping adjustments; c. That properties that have reached their CVA during 2014 or crossed over from the clawed back category to the capped OTTAWA CITY COUNCIL 10 MINUTES 72 WEDNESDAY, 09 APRIL 2014 category remain at CVA taxes and be excluded from any future capping adjustments; and d. That properties that cross over from the capped category to the clawed back category remain subject to clawback adjustments. 6. That the tax level for “new construction” properties be set at a minimum level of 100% of their CVA taxes for 2014 and future taxation years. 7. That the property tax mitigation programs be continued for 2014, including the charitable and vacancy rebate programs, the Farm Grant Program and the Low Income Seniors and Persons with Disabilities Complete Tax Deferral Program as previously approved by Council. CARRIED 6. CORPORATE BUSINESS CASE APPROACH COMMITTEE RECOMMENDATION That Council receive for information the business case approach outlined in this report. ZONING - 2148 CARLING AVENUE AND 830 AARON AVENUE COMMITTEE RECOMMENDATIONS That Council approve an amendment to Zoning By-law 2008-250: 1. To change the zoning of 2148 Carling Avenue from Residential Third Density, Subzone C, (R3C), to Arterial Mainstreet (AM) as shown as Area A in Document 1 and detailed in Document 2, so as to permit the development of a commercial building; and
