The revival of sick industrial units is undertaken as per Government policy explained below:ê The problems faced by Sick Units are duly considered by the concerned Government agencies and necessary incentives provided by adopting one or more of the following measures:ê (a) Reduction in fix charges of electricity bills. (b) Tariff in respect of products and raw materials is appropriately reduced or increased. (c) Loans are re-scheduled / re-structured keeping in view the merits of each unit. (d) Payment of utility bills and other dues is allowed in installments. (e) Easy installments of outstanding dues.

This has now been replaced by the new Cell Culture Rabies Vaccine given as five injections given in the arm. The supply of this new vaccine has started in the last week of January, 2010 and so far over 6,000 doses have been supplied to different government hospitals. The present demand of Anti-rabies vaccine and Anti-snake venom serum is annexed. Senator Wasim Sajjad: Mr. Chairman, yesterday this Bill was presented before the House and I was amongst those Senators who had requested that this may be taken up today, not because that there was any intention to oppose the Bill but because being mindful of the fact that this is a very important piece of legislation; myself and the honourable Senators felt that they should have time to study it and make their contribution and present their views before this House. Now, there is no doubt that this is a very important piece of legislation. We had transplants of various kinds taking place in Pakistan for several years and the complaints have been that some of these are commercially oriented. The people buy and sell kidneys and in fact, there is a tourism trade going on in Pakistan where people come from abroad, bring kidneys and the transplant takes place. In fact there are various kinds of transplants, kidney is perhaps, the most common and very high incidents of kidney disease in Pakistan, so therefore, within Pakistan also there is need and demand for kidney transplants. These are life saving techniques but they have got a bad name because No.1, they were commercially oriented and No.2, these operations and these transplants were being conducted in places which were perhaps, not capable enough to carry out these delicate procedures with the result that there were also complaints of high fatalities in these operations. It is to meet this requirement that this law has been 50 presented and while I am speaking on this, I would like to pay tribute and appreciate the services of Dr. Adeeb Rizvi. (Thumping of desks) Senator Wasim Sajjad: His institute in Karachi which has been doing commendable work over the last several years. I think he has made an input into this law and the law has been made after taking into account a number of factors. But still, there is always a need of improvement. I would have insisted on certain amendments but again conscious of the fact that any amendment will further delay the legislation, I will be making the suggestion through you and through the House that this law may be reviewed after one year of its functioning so that if there are any short comings which we come across on the basis of advice of experts, the people in this field then those short comings can be removed through appropriate amendments in the Bill. Straightaway sir, I would feel that some of there provisions which may create problems, there is a large demand for kidney transplant in Pakistan. The incidence of disease is fairly high and we are a nation of 160 million going on to 170 million people. The demand for this is all over the country. There may not be enough centers which can cater for this and the composition of the Evaluation Committee whose reference has been made in section 5 of the Act. Now this kind of Evaluation Committee according to the law, as soon as after the commencement of this Act, the Federal Government may, by notification in the official Gazette, appoint as many Evaluation Committees as may be necessary. There is of course the enabling provision by which the government can appoint many Evaluation Committees but if you look at the composition, you will find that it must consist of a surgical specialist, a medical 51 specialist, a transplant specialist, a nephrologist, neurophysician and an intensivist where available. Such people of high caliber are not available all over the country. So you will have only at the first instance, just a handful of committees may be in Karachi and Lahore and therefore the work of the Evaluation Committee will be hard, a lot of work because as I said we are a nation of 160 million people, you may have a case in Okara, Mianwali, Abbottabad, Mansehra and if you read this section IV which says åthe cases of unclaimed brain dead hospitalized patientsç äunclaimedã and these are important because sometimes the person is åunclaimedç and his kidney or other organs can be used to transplant. åThe cases of unclaimed brain dead hospitalized patients can be presented to an Evaluation Committee for transplantation after intense search for their relatives within 24 hours.ç Now if there are handful of committees may it not be possible to do this within 24 hours and kidney transplant, sir, I am not an expert, I believe it is not something that you just take a kidney and put it somewhere. It is not something that you take it out of the shelf and transplant in somebody else. Tissue matching has to take place then the kidney has to be transplanted within a certain time frame. It is not that you can keep it endlessly. Similarly transplant is not just a kidney, you have a retina transplant, liver transplant. So we need perhaps to look at this as to how it will function in actual practice. As to what difficulties we face when we are trying to administer this law and in the presence of this law, I feel that the number of available organs may not be very much and the demand is very high. So we have to look at it how do we meet this need. What do we do because these are life saving procedures. A person who has damaged his kidneys lives, life of a miserable person and a person who needs, let us say transplant of 52 a retina is a person who can get eyesight. Similarly liver transplant, people can die because of this and a transplant gives them a new leaf of life. So these are very important life saving procedures and we should ensure that while we must be ethical and we must avoid commercialism and while we must ensure that the transplant are done by competent and expert hand with the best facilities. We all recognize it but at the same time there should be some mechanism by which the highest number of organs are available for the very high population of Pakistan. Then there is a monitoring authority under section (a) which comprises of the Minister of Health and other people and if let us say that I have the opportunity to make an amendment, I would have introduced an amendment at this stage saying that the monitoring authority should review this law and after one year, present a report to the Parliament as to what further changes are needed in this law in the light of experience, but I am not going to do this for the reason that this will delay the passage of this Bill and further create difficulties in the administration of this kind of mechanism which is being postulated in this Bill. So, I would recommend to the government that although this is not recommendation which is candidly, nevertheless, they should take it into account and perhaps the Minister for Health, I am glad that he is here and I am grateful to him that he allowed this opportunity to speak today because yesterday there seemed to be a hurry to pass this Bill yesterday but I appreciate the democratic spirit yesterday. I do so again today but I would say that the government should be even it is not a statutory requirement, but they should make a statement that we will keep working on this. This is a new law and in the context of a new law, we will have a fresh experience. It is first time that Pakistan is enacting such a law and in the light of 53 our own experience, the government should evaluate the performance of this law and after one year, present a report to the Parliament as to what difficulties they faced and what further changes they need so that it will become a more better legislation. I would also suggest that persons who transplant, donate their organs, living persons they may donate it to a close relative or they may donate it by virtue of the permission of the Evaluation Committee. Some of the donors may suffer medical problems. Some of these donors who donate kidneys, for example, they may have medical problems and it is not unusual to have a medical problem. They may have affection infection, they may have other problems. Sometimes these problems can be fatal. Perhaps some sort of insurance mechanism that may be devised by the Government of Pakistan so that those people, who sacrifice their organs for their dear ones and in the service to humanity, they have some safeguard that they do not go into a process where their organs are donated and then when they come into medical difficulties, they have nobody to fall back upon. So there should be some insurance schemes by which these people can be benefited. Such schemes should be looked at by the monitoring committee and they should devise an insurance system. How they can do it? It is a matter of detail, I think this can be suggested by honourable members who can look into it. Perhaps they may not be able to do it today but as I said if this matter can come up again before the House in an yearãs time on the basis of the recommendation or report of the monitoring authority of the Health Ministry, then we should look into this aspect. What do we do if let us say a person who has donated an organ suffers some disease, has a problem and he is a poor man who has done it for the love of his family, brother, father, mother or because of such considerations, he is now facing medical 54 problems, what do we do? We let him to die? Do we leave him in a lurch, we do ignore him or as a responsible country, as a responsible community, we provide some benefit inbuilt into the law so that he does not have to beg, borrow or look donors.
