Amendment # 4373 – No Federal funds for the future development and operation of the Defense Travel System Background The Defense Travel System (DTS) is an end-to-end electronic travel system intended to integrate all travel functions, from authorization through ticket purchase to accounting for the Department of Defense. The system was initiated in 1998 and it was supposed to be fully deployed by 2002. DTS is currently in the final phase of a six-year contract that expires September 30, 2006. In its entire history, the system has never met a deadline, never stayed within cost estimates, and never performed adequately. To date, DTS has cost the taxpayers $474 million – more than $200 million more than it was originally projected to cost. It is still not fully deployed. It is grossly underutilized. And tests have repeatedly shown that it does not consistently find the lowest applicable airfare – so even where it is deployed and used, it does not really achieve the savings proposed. This amendment prohibits continued funding of DTS and instead requires DOD to shift to a fixed price per transaction e-travel system used by government agencies in the civilian sector, as set up under General Services Administration (GSA) contracts. Taylor erhaps the most asinine amendment to the already mulish United PStates Omnibus Crime Bill (Currie, 1994) was submitted by Sena- tor Kay Bailey Hutchison (R-TX) three days before the Senate over- whelmingly approved HR. 3355. On November 16, 1993, the junior senator from Texas stood before the most exclusive millionaires' club in the world and lamented that prisoners serving sentences "for offenses like carjacking, armed robbery, rape and arson received as much as $200 million in Pell [higher education] funds, courtesy of the American taxpayer" (Congressional Record - Senate, 1993). She explained to the august assembly that although the year before they had approved the Higher Education Reauthorization Act (HERA), which in part stipu- lated that prisoners serving death and life without parole sentences were prohibited from receiving Pell Grants, the current reduced prisoner eligi- bility was still "not right." Thus the senator's solution was to prohibit all state and federal prisoners from receiving Pell higher education grants. The senator was not alone in her discontent, nor the only legislator moved to action. Three weeks before, waving a copy of the Pottstown, PAMercury above his head, Representative Timothy Holden from Penn- sylvania fulminated before the C-SPAN cameras that he was appalled to learn from the newspaper's report that prisoners were receiving $200 million in Pell Grant funding, allowing them free college educations (Berkey, 1993A). ''There is an obligation to do the best you can to give incarcerated people a chance, but certainly not from a program that has been earmarked for low-income people to educate their children," explained the representative.

The most prominent is 18 U.S.C. § 1956. Section 1956 outlaws four kinds of money laundering—promotional, concealment, structuring, and tax evasion laundering of the proceeds generated by designated federal, state, and foreign underlying crimes (predicate offenses)—committed or attempted under one or more of three jurisdictional conditions (i.e., laundering involving certain financial transactions, laundering involving international transfers, and stings). Its companion, 18 U.S.C. § 1957, prohibits depositing or spending more than $10,000 of the proceeds from a predicate offense. Section 1956 violations are punishable by imprisonment for not more than 20 years. Section 1957 carries a maximum penalty of imprisonment for 10 years. Property involved in either case is subject to confiscation. Misconduct that implicates either offense may implicate other federal criminal statutes as well. Federal racketeer influenced and corrupt organization (RICO) provisions outlaw acquiring or conducting the affairs of an enterprise (whose activities affect interstate or foreign commerce) through the patterned commission of a series of underlying federal or state crimes. RICO violations are also 20-year felonies. Even a quick glance at the geographic distribution of the women in Congress suggests that there is a distinct political geography to the districts they represent: twenty-six of the eighty-four female US House members serving in 2015, or nearly one-third, were from California and New York. Eight more were from Florida. In other words, 40 percent of the women in the House came from only three states. Texas, with thirty-six districts, has only three women in its House delegation.1 Female Representatives are not randomly distributed across the country. Congressional districts in the United States vary widely in their demographic characteristics.     WHITE COLLAR CRIME Robert J. Anello* & Miriam L. Glaser** INTRODUCTION A mention of New York City, the seat of the Second Circuit, invariably evokes thoughts of finance. The home of Wall Street and the World Trade Center, Manhattan is also home to many of the country’s major banks, hedge funds, and stock exchanges; the Securities & Exchange Commission has a branch office in New York, as do the Federal Reserve Bank, the Commodity Futures Trading Commission, and the Antitrust Division of the Department of Justice. Even the Court of International Trade is located in Manhattan. Unsurprisingly then, New York City has also played host to some of the most important white collar criminal prosecutions in the nation. As the federal appellate court with jurisdiction over this financial center, the Second Circuit has ruled on many critical issues related to white collar crime. Distinctive in its understanding of business practice, its readiness to identify and oppose legislative encroachment into the realm of the judiciary, and in the high value it places upon legal history and stare decisis, the Second Circuit’s sophisticated jurisprudence has influenced courts nationwide. This Article will address six different areas of white collar law and procedure: (1) fraud, (2) the Racketeer Influenced & Corrupt Organizations Act (RICO), (3) conspiracy, (4) public corruption, (5) white collar practice, and (6) sentencing. Many of the cases profiled in this Article have driven legal and cultural developments far beyond the federal courts, including the cases of Leona Helmsley, one of New York’s most prominent real estate moguls; the “Mafia Commission,” a take-down of the bosses of the Five Families of La Cosa Nostra; and Abscam, a massive sting operation created by the federal government to expose corrupt officials.
