Minutes of the Committee of the Whole meeting of the Council of the Village of Warfield, held in Council Chambers at 555 Schofield Highway, Warfield, BC on Wednesday, July 17th, 2019, at 6:00 pm.

Mayor Langman called the meeting to order at 6:00 p.m.

a. Community Futures Update - Eric Kalacis, Executive Director Mr. Kalacis provided a PowerPoint presentation updating the work program and results experienced by the Greater Trail Community Futures over the past year. He provided insight regarding the local teams, programs and initiatives, highlighting the structure and purpose of rural economic development through entrepreneurial promotion. He expanded on the resources available to local entrepreneurs such as loans, business counselling and economic development events. Mr. Kalacis detailed the successes and current ongoing initiatives as set out in the strategic plan priorities and attendant strategies.

Council thanked Mr. Kalacis for his presentation and he left the meeting.

b. PetroCanada Service - Christine and Margret Ann Herd - Business Opportunity

C and MA Herd outlined their proposal for a car wash and requested Council advise whether there is a possibility and sewer capacity to handle the effluent from a car wash. They noted that they wished to have a determination from Council prior to expending funds for plans.

Council responded that the Forrest Avenue sewer line had insufficient capacity currently and that a future feasibility study to determine the priority and requirements for an upgrade would be reviewed at the time of the next budget in late fall or winter of 2019.

Council Enquiries

Council discussed the sink hole/caving-in culvert issue on Wellington Avenue. Council directed a study to be done as a priority task. CAO Cresswell advised that as this issue is classified as flood mitigation, WSP is working on a grant application to move this project forward.

Mayor Langman called the meeting to order at 7:00 p.m.

Delegations a. A & O Bergland – Speed Limits & Signage b. A Weeks – Speeding & Safety Concerns

Both parties provided a comprehensive presentation expressing their concern for the residential street speed limits being excessive and that drivers do not use caution when driving on our roadways. Both parties provided statistics comparing survival rates of people hit my vehicles traveling at speeds of 30 vs 45 or higher. They also noted the lack of sidewalks which is a cause for greater concern for pedestrians on the roadways with speeding vehicles disregarding pedestrian safety on public spaces. The residents requested the speed limits be lowered and updated signage installed on busy roads and thoroughfares.

Council expressed that traffic speed is a safety concern of all Council Members in concert with the residents of Warfield.

Council directed staff to research the ICBC Road Safety programs and use the resources to put forth a report to council on increasing our residential road safety and to let the delegates know when that report will be provided. Council reiterated that staff and Council are looking into lowering the speed and taking precautionary measures to make the residential roads safer.

Council discussed the Committee and the process and determined that recommendations from a staff member present at the meeting as well as more Committee members would be more effective. Minutes and agendas are required and the priority of which bylaws and policies to review will be done in advance of meetings.

Council discussed the Fortis right of way property and directed staff to notify the residents along the Village property that we are going to enforce no parking of vehicles or storage of trailers or any personal affects on that property as of a certain date because of the liability it poses on the

Village. Council discussed the need to have a plan put in place for that property before signage and barricades be put in place.

Council discussed the need to have an inventory of all the signs around the village and a study to find out what signage is needed before putting up more.

Member Reports

Councillor Masleck reported the Infrastructure Advisory Committee has a meeting on August 6th. Councillor Parkinson reported she attended the Veterans Low Income Housing Seminar. Councillor Yunkws reported she will have an Age Friendly report for the next council meeting August 21st. Mayor Langman reported on the minutes from the meeting with Ministry of Transportation & Infrastructure(MOTI) that she attended with Councillor Yunkws, along with School District 20 transportation representative, Staff Sergeant Wicentowich and a Councillor from City of Trail. She is also meeting with MOTI at the UBCM convention in September.

Amendment Agreement to Village of Warfield-Teck Water Agreement Dated October 1, 2008

THAT the Council for the Village of Warfield accept the agreement amendment to the Village of Warfield-Teck Resources Agreement to extend the termination date to December 2026, AND FURTHER THAT the Mayor and Chief Administrative Officer be authorized to execute the agreement accordingly.

REPORT: CHIEF ADMINISTRATIVE OFFICER AUGUST 15, 2019

Report to Mayor and Council for the August 21st, 2019 Council meeting

ADMINISTRATION: • Staff is currently working on the following projects: o ICBC Road Safety Program and speed reductions, very little information as to process on the ICBC website; staff will follow up with telephone inquiries. o Risk assessment of linear assets (probability and consequences of failure) took place on Wednesday July 31 with most staff in attendance as well as most of the Infrastructure Advisory Committee members. o Safety inspections have been instituted at the Village worksites as per Worksafe BC regulations. Monthly safety meetings with all staff as required by regulation, will begin in September. • A separate Public Works Report and a Bylaw Enforcement Report are included as following agenda items.

INFRASTRUCTURE: • A meeting with the Infrastructure Advisory Committee was held August 6 regarding issues and responsibilities. Minutes and a Terms of Reference recommendation will be included on the September 4 agenda. The IAC participated in the risk assessment rating of the linear assets.

FINANCE: • On the agenda under Financial Matters, starting in September there will be Quarterly Budget Variance Report in addition to the Schedule of Accounts included on each Council agenda. • I have reviewed the budget closely with the CFO in order to ensure we are familiar with the Village’s 2019 objectives. • A meeting with WSP Consulting Engineers was held August 14, 2019 to review the requirements and scope of a Trail Creek Flood Mitigation Grant application (Provincial 100% funding). This was identified as a high risk item by the IAC previously.

FACILITIES/SERVICES: Water • Water testing laboratory results are compliant with the Operating Permit. • Initial discussions with Kerr Wood Leidal regarding the City of Trail system capacity will be called shortly. Centennial Pool • No significant issues at present. The August revenue and usage appears to be good. Warfield Hall

REPORT: CHIEF ADMINISTRATIVE OFFICER August 15, 2019 Page 2 of 2

• Hall rentals were low in July but have become more consistent in August. Village Office • Storage of archival files as required by the records retention rules is difficult given the limited storage on the main floor. Staff have cleared out a significant number of old files and had them shredded on site, however, we are still limited in space requirements. I propose to contact the Volunteer Fire Department Chief and inquire whether any upper floor space may be returned to the Village for secure storage purposes.

OTHER: FortisBC Right of Way • As directed by Council, a letter was sent to all residents adjacent to the FortisBC SROW requesting removal of structures and vehicles from the site. It seems to be a divisive issue, however, as this is a Occupiers’ Liability Act issue and in turn, a Village insurance issue. Either the Village needs to control the use and access to the SROW, or alternatively manage the lands for those uses and maintain them appropriately. Bylaw Enforcement (non- • Given the ongoing complaint process issues and the unintended consequences of the “2 complaint policy”, and after discussions with the contracted Bylaw Enforcement Officer and front office staff, the whole bylaw enforcement policy and procedures have become higher priority. Business Licensing • The final provincial approvals for the cannabis retailer, Green Pineapple, have been received and the business license has been issued. A new business license application for cannabis edibles has been submitted for the former KSCU site. The Provincial application is awaiting the approval process, the business license application was submitted to secure place in time. • An update of the Intermunicipal Business License system is being undertaken by the local municipalities and led by the City of Trail. This is in addition to the broader Kootenay based system that is being instituted in East Kootenays with some local West Kootenay municipalities signing on. Youth Action Network • A meeting with the Youth Coordinator was held July 17 regarding programming and scheduling, further discussion held with the CBT Regional Coordinator, and staff has developed a draft contract with deliverables to be further discussed. • Follow up meetings and discussion regarding the Youth Advisory (Oversight) Committee Terms of Reference and membership will occur in September. ISL Engineering and Land Services has reviewed the June 2019 flow data provided by the RDKB for the Rossland, Warfield and Columbia Pollution Control Centre (CPCC) flow metering sites. The flow meters have been certified by Monitario Technical Services . Monitario supplied and installed the meters and flumes and is providing technical advice and support on the meter devices and their associated accuracy. The purpose of this review by ISL is to verify the consistency of the data and confirm that the required maintenance activities have been undertaken for the month of June 2019.

The June 2019 data covers the period between Saturday, June 1st , 2019 and Sunday, June 30th, 2019.

Flow data for the month of June 2019 is summarized in Table 1 below:

The data indicates the flow meters are operating generally as intended. The Rossland and Warfield sites were not collecting data during the performance of scheduled maintenance. Temporary interruptions in remote data logging due to maintenance works have been interpolated.

Detailed monthly flow data information from Table 1 is presented in the attached Tables 2 and 3 and Graphs 1 through 4.

Short term flow data interruptions were observed at the Warfield Flow Monitoring Station on June 03, 2019 from 13:45 to 14:02 and on June 19, 2019 from 08:12 to 08:29. Short term flow data interruptions were observed at the Rossland Flow Monitoring Station on June 19, 2019 from 08:09 to 08:26 and from 17:26 to 17:42 Flows were interpolated for these periods.

A sudden increase in flow data was observed on June 17, 2019 between 16:39 and 17:12 at both the Rossland and Warfield Flow Monitoring Stations. The rise and fall of the flow values occur over a series of data entries and are not considered to be an anomaly. As such, no adjustment to the flow data has been made.

Reductions in recorded flow for the CPCC were detected between 16:02 and 16:42 on June 24, 2019. The flows for his period were interpolated.

Maintenance procedures (i.e. flume purge/cleaning and ‘zero-check’ procedure) were performed for June 2019 in accordance with Monitario’s letter of guarantee:

• Rossland and Warfield Site maintenance was primarily performed by RDKB operations staff and is detailed in the table below:

As of December 1st 2015, flow data from the Rivervale Pump station is being measured and collected daily. The RDKB has requested that ISL review and certify the monthly data and include it as a percentage of the total flow measured at the CPCC. ISL has reviewed the data logged from on-site SCADA and compared it with daily totalizer reading entries collected by RDKB staff. ISL finds the data to be consistent and free of anomalous readings. A summary of the Rivervale Flow Data compared with CPCC flow totals is shown in Table 4 below:

SUBJECT: Integrated Official Community Plan Designation Change - Bingay Road

Background: The subject property is bounded by Highway 3B, Bingay Road and Whitman Way and is legally described as Lot 34 Block 4597 NEP23347. There are 5 rights of way registered against the property in favour of West Kootenay Power & Light (FortisBC), Inland Natural Gas (FortisBC), Teck Cominco (2) and the Village of Warfield.

The existing restrictive covenant placed on the land by Teck Cominco limits the use significantly to only commercial or industrial as defined in any Village of Warfield Zoning Bylaw. More specifically the uses prohibited are: • Any residential use, whether permanent, temporary, seasonal or ancillary to allowable uses; • Agricultural; • Park/open space; • Playground; • Recreational facility; • Institutional use (daycare, schools, community centres or similar).

Zoning: The property is currently zoned CD1 Comprehensive Development Zone 1 and the permitted uses all fall within the prohibitions set out in the registered restrictive covenant except for Office Building.

Official Community Plan: The property is designated as Comprehensive Residential in the Integrated Official Community Plan. This is in opposition to the existing zoning under the Village’s Zoning Bylaw and effectively removes the ability to use or develop the land. An OCP amendment is required to avoid the sterilization of the property. Currently the zoning is inconsistent with the OCP designation – the Local Government Act requires that the zoning bylaw must be consistent with the OCP.

The Bylaw presented before Council at this meeting would have the effect of designating the subject property as Comprehensive Commercial, which would remove the inadvertent error which caused the inconsistency between the OCP and permitted uses of the land in the Zoning Bylaw.

A Bylaw to Amend the Village of Warfield Integrated Official Community Plan Bylaw 846 (2017)

WHEREAS the Village of Warfield deems it necessary and appropriate to amend its Integrated Official Community Plan Bylaw #846 (2017);

NOW THEREFORE the Council of the Village of Warfield, in open meeting assembled, enacts as follows:

1. This Bylaw may be cited as the “Village of Warfield IOCP Bylaw 846 (2017) Amendment Bylaw 877 (2019)”.

2. The Village of Warfield IOCP Bylaw 846 (2017) is amended by amending Appendix B1: Map 1 LAND USE DESIGNATIONS MAP as follows:

SUBJECT: Zoning Bylaw Text Amendment to Permitted Uses in Comprehensive Development Zone

Background: The intention of this bylaw text amendment is to expand the permitted uses under the current Zoning Bylaw 440 for the Comprehensive Development Zone. This will have the effect of allowing closed storage units and recreational vehicle storage in the CD1 zone under a Development Permit process.

This text amendment is in response to a request from Back Alley Distributing to develop land on Bingay Road. The subject property is bounded by Highway 3B, Bingay Road and Whitman Way and is legally described as Lot 34 Block 4597 NEP23347. There are 5 rights of way registered against the property in favour of West Kootenay Power & Light (FortisBC), Inland Natural Gas (FortisBC), Teck Cominco (2) and the Village of Warfield.

Action: If Council provides two readings of the bylaw with the proposed text amendments, then it will be forwarded to Public Hearing for comment by residents of Warfield and further deliberation by Council thereafter.

2. The Village of Warfield Zoning Bylaw No. 440 (1984) as amended from time to time, is hereby further amended by addition the following definitions:

“Self storage facility” means a facility that provides separate, individual closed storage units for rent to the general public for self-service storage of personal goods, materials and equipment. “Recreational vehicle storage” means screened parking of recreational vehicles by fee to the general public on a term basis.

3. The Village of Warfield Zoning Bylaw No. 440 (1984) as amended by Village of Warfield Zoning Amendment Bylaw No. 537 (1995) is hereby further amended by the addition of the following uses in Section 901 COMPREHENSIVE DEVELOPMENT ZONE 1 (CD1) subsection 901.2 PERMITTED USES, under a) 13. Self storage facilities 14. Recreational vehicle storage

ENACTMENT

4. If any section, subsection, sentence, clause or phrase of this Bylaw is for any reason held to be invalid by the decision of a Court of competent jurisdiction, the invalid portion shall be severed and the part that is invalid and severed shall not affect the validity of the remainder of the Bylaw.

5. This Bylaw shall come into full force and effect on the final adoption thereof.

Summary of Actions During Reporting Period:

The final report and action plan is being presented (or was already) tonight. It includes a great deal of work by our taskforce- (Thank you all!) and Shannon Gordon. We are hoping that Council will adopt the Age Friendly plan and implement items on an as needed, as we can afford them basis.

There have been several exploratory meetings between representatives from the City of Trail, the City of Rossland, me, Shannon, and our CBT rep. We have been exploring the potential of creating one shared Seniors Coordinator between all of the communities (as noted in the Age Friendly Plan) and what that might look like. It is still in the early days (with much to work out still), but I am happy to share the information we have created/shared so far.

I firmly believe that our community (including those who are aging) would benefit from having more recreational and social programming. This is one potential option. Great care is being given when considering costs, budgeting, and how our communities would equitably share the Seniors’ Coordinator.

Isobel Mackenzie, the Seniors’ Advocate is in town on Sept 20, 2019 and will be at a town hall meeting in the afternoon. More details to follow.

Summary of Actions During Reporting Period:

• I attended the local Better at Home presentation by United Way in Trail at the Legion on July 7, 2019. It was well attended, with representatives from as far away as . • The purpose of the meeting was to share what Better at Home is, what it is not, and how we can get one for the Lower Columbia region (meaning Beaver Valley to Rossland). • It is a program which varies from community to community and provides help at home for seniors. The services offered cost depending on what each senior can afford, and what service they need. • The services range from driving, to friendly visiting, to gardening and cleaning. They are not medical in nature. • There is a pocket of money available for the program annually, and it would be hosted by a local organization. Only one presented as an option- that was the Beaver Valley Age Friendly group. • There was discussion around the importance of having each community represented and their specific needs addressed. • Typically this program is funded through grants, and other funding opportunities (including the annual one from United Way).

We met July 3, 2019. Find our recommendations as follows:

1. Capital Asset Policy -we felt that our skills and expertise were not sufficient to address this, however, we have several general comments/questions -we should be able to read it- perhaps write it in plain language (what does it specifically do?) -is it being followed? is it still relevant? Is it useful to staff? -on pg. 3 ‘revenues’ should be replaced with the word ‘cost’ 2. Half-Masting Flag for Mourning -#3- add “or past mayor” -#4- do we have any freemen? (if yes, they should be recognized) 3. Smoking in the Workplace Policy -add vaping to the policy 4. Parking and Trails Donation -# 8- is a budget item -#7- wording is awkward

General Recommendations: 1. Have page numbers on policies which are longer than one page. 2. Create a consistent template for all policies
