RESUMO Este trabalho tem como objetivo analisar discursos feministas que tematizam os sujeitos transgêneros e/ou travestis e/ou transexuais. Tratam-se sobretudo de análises de discursos feministas radicais trans-excludentes e/ou autointitulados “críticos de gênero” através de um referencial teórico transfeminista, ao qual a autora deste trabalho explicitamente se filia. Concentramos nossas análises nas teorizações de duas autoras acadêmicas: Janice G. Raymond e Sheila Jeffreys. As teorizações destas duas autoras possuem uma vasta influência nos posicionamentos trans-excludentes nos discursos e movimentos feministas contemporâneos. Para tanto, iremos utilizar conceitos provenientes do campo teórico da Análise de Discurso, tal como o de formação discursiva, visando compreender a textualização da problemática teórica feminista. Nosso corpus de análise conta com textos provenientes de livros, revistas acadêmicas (artigos e resenhas de livros), portais de notícias, sites e blogs (todos de acesso público). Abordamos os temas centrais de polêmicas entre transfeministas e feministas radicais: alterações corporais pela medicina; socialização; estereótipos, identidade e abolição de gênero; a negação da autenticidade das identidades trans e a sexualidade lésbica. Levamos em consideração a íntima relação entre as construções linguísticas e ideológicas para a análise de discursos feministas. Nomeamos duas tendências no discurso feminista radical trans-excludente: paternalista e conspiratória. Nos detivemos sobretudo para os efeitos produzidos pelas construções linguísticas de negação que incidem sobre as formulações que tematizam a questão da subversão e identidade de gênero. Em virtude da importância e centralidade do efeito de denegação nos discursos analisados, trazemos as considerações teóricas da linguística e psicanálise sobre a negação. Além da negação, trazemos a discussão sobre pressuposição linguística e sua relação com o conceito de pré-construído, além da questão do reconhecimento, vulnerabilidade, subjetividade e a relação entre feminismo e psicanálise. Pudemos concluir que em virtude do reconhecimento das identidades transgêneras ser enquadrado no âmbito individual e intencional e a problemática da subversão de gênero ser textualizada pelo efeito de denegação, não houve uma mudança de terreno epistemológico de uma problemática idealista pela formação teórica feminista radical trans-excludente. ABSTRACT This work aims to analyze feminist discourses that has transgender and/or transvestite and/or transsexual subjects as its themes. It’s mainly about discourses analysis of trans- exclusionary radical feminism and/or self-titled “gender critical” through a transfeminist theoretical referential, which the author of this work explicitly joins. We focused our analysis on the theorizations of two academic authors: Janice G. Raymond and Sheila Jeffreys. The theorizations of these two authors have a vast influence on the trans- exclusionary positions in contemporary feminist discourses and movements. To do so, we will use concepts from the theoretical field of Discourse Analysis, such as discursive formation, in order to understand the textualization of the feminist theoretical problematic. Our corpus of analysis includes texts from books, academic journals (articles and book reviews), news portals, websites and blogs (all publicly accessible). We address the central issues of controversy between transfeminists and radical feminists: body modifications in medicine; socialization; stereotypes, gender and abolition of gender; the denial of the authenticity of trans identities and the lesbian sexuality. We take into account the intimate relationship between linguistic and ideological constructs for the analysis of feminist discourses. We have named two tendencies in trans-exclusionary radical feminist discourse: paternalistic and conspiratory. We have focused mainly on the effects produced by the linguistic constructions of negation that focus on the formulations that thematize the question of subversion and gender identity. Due to the importance and centrality of the denegation effect in the analyzed discourses, we bring the theoretical considerations of linguistics and psychoanalysis about negation. In addition to negation, we bring the discussion about linguistic presupposition and its relation to the concept of pre-constructed, and the question of

My name is Sasha Buchert and I’m a Senior Attorney at Lambda Legal. I’m testifying in support of the Tony Hunter and Bella Evangelista Panic Defense Prohibition Act of 2019 and in support of the Sexual Orientation and Gender Identity Panic Defense Prohibition Act of 2019. LGBTQ people, and transgender women of color in particular, move through the world under the constant threat of impending violence. In the words of one transgender woman of color in a recent New York Times article, “it’s always in the forefront of our minds, when we’re leaving home, going to work, going to school.”1 This fear is well-substantiated. At least 21 transgender people, almost all of them transgender women of color have been murdered this year already.2 Almost all of the murders involve the victims being shot multiple times, and commonly involve beatings and burnings. Two of those murders this year took place in the DC area; Zoe Spears a Black transgender woman, was found lying in the street with signs of trauma near Eastern Avenue in Fairmount Heights last June and Ashanti Carmon, also a black transgender woman was fatally shot this year in Prince George's County, Maryland.3 There has also been a troubling increase in violence targeting people based on their sexual orientation. Hate crimes have increased nationally over the last three years,4 and there were a record number of suspected hate crimes in D.C.

The defendant claiming this defense will say that the discovery that the victim was biologically male provoked him into a heat of passion causing him to lose self-control. If the jury finds that the defendant was actually and reasonably provoked, it can acquit him of murder and find him guilty of the lesser offense of voluntary manslaughter. The trans panic defense strategy is troubling because it appeals to stereotypes about transgender individuals as sexually deviant and abnormal. In this article, we examine the cultural structures of masculinity that may lead a man to kill a transgender woman with whom he has been sexually intimate.

The constitutional amendment deliberated to Liberal Feminism; grant women a guarantee against gender discrimination, gaining political support from liberal groups. However, Radical Feminism; at the beginning of the 1970s, conservative and anti-feminist groups began to emerge in the American social Second Feminist Wave; context, advocating against the constitutional amendment promoted by feminists, preventing their ratification as United States of a national law.
