I. INTRODUCTION

A. Project Description

1. The West Bengal Drinking Water Sector Improvement Project (WBDWSIP) aims to provide safe, reliable and continuous drinking water as per Government of ’s standard to about 6 million people in the Arsenic, Fluoride, and salinity affected selected areas of North 24 Parganas, South 24 Parganas, East Medinipur and districts in accordance with the Vision 2020 of Government of West Bengal (GOWB) and Government of India Strategy for Drinking Water Supply. The Project will ensure drinking water security through 24/7 piped water supply schemes in the areas covered. The Project will have the following key outputs: Output 1: Drinking water infrastructure expanded and upgraded in North 24 and South 24 Parganas, East Medinipur and Bankura; and Output 2: Smart water management, capacity building for operational sustainability and sanitation planning achieved.

2. The project, WBDWSIP, has been divided into subprojects that will undertake Bulk Water Supply and distribution in selected blocks of North 24 Parganas, South 24 Parganas, Bankura and East Medinipur. The subprojects are further sub-divided into packages.

3. Provision of a water supply distribution system in the fluoride (ground water) affected block of Indpur in is taken up under the WBDWSIP. A parallel subproject, implemented under WBDWSIP, will provide bulk water supply (treated water) for further distribution to the households in the project area. The subproject includes the following civil works components: (i) Intermediate Booster Pumping Station (IBPS) cum Ground Level Storage Reservoir (GLSR) and allied works of capacity 1400 kl at Raghunathpur; (ii) IBPS and allied structures at Gobindpur (iii) laying of transmission mains 156 kilometer (km) including rising mains from (a) IBPS/GLSR at Gobindapur to IBPS/GSLR at Chenchuria and Raghunathpur, including en-route 4 nos. of reservoir; (b) IBPS/GLSR at Gobindapur to 12 OHRs (3 OHRs in Indpur block 9 OHRs in Taldangra block); (c) IBPS/GLSR at Raghunathpur to 13 nos. of OHR in Indpur block; (iii) construction of 19 overhead reservoirs (OHRs) in Indpur Block; (iv) laying of 757 km distribution network of 20 OHR zones in Indpur block; and (v) provision of household service connections with water meters.

B. Scope of this Report

4. This land acquisition, resettlement and indigenous peoples due diligence report for the package WW/BK/02A is prepared for design and construction of an IBPS cum GLSR at Raghunathpur, another IBPS at Gobindpur (in Indpur block), transmission mains and 19 numbers of new overhead tanks including water distribution network and house connection and metering works in Indpur block. The DDR report is updated to reflect site changes and beneficial impacts to indigenous peoples identified during the course of detailed design being prepared for the package by PIU Bankura with assistance of DSISC as on 30th November 2019. The Land Acquisition, Involuntary Resettlement and Indigenous Peoples DDR will be updated and reconfirmed for final involuntary resettlement impacts after completion of detailed design and detailed measurement surveys (DMS).1

5. A due diligence process was conducted to examine the land acquisition and resettlement issues in detail based on available design, aligned with ADB SPS, 2009. This report describes the findings and provides copies of relevant documents, community consultations and photographs.

This due diligence report needs to be considered along with the Resettlement Framework prepared for this project.

6. During detailed measurement survey, involuntary resettlement related impacts will be further assessed and if required, a resettlement plan prepared and submitted to ADB for approval. The final document will be reviewed and disclosed on implementing agency and ADB websites. No civil works contract package should be awarded, and civil construction works started before the completion of final document (DDR or Resettlement Plan implementation) for the said package. The implementing agency is responsible to hand over the project land/site to the contractor free of encumbrance.

II. SUBPROJECT DESCRIPTION

A. About the Subproject Area

7. As per information available in the project report of PHED, only 8.76% of the total rural habitations in the select project block are served with piped water supply based on ground / sub-surface water source. The impact of ground water abstraction and the associated risks of fluoride contamination in Indpur block cannot be undermined. In effect, a comprehensive piped water supply scheme (PWSS) with sustainable water sources is essential to effectively mitigate the risks and impact of fluoride contamination.

B. Subproject Description

8. For the blocks of Indpur and Taldangra, raw water is to be abstracted from Dam, which will be pumped to 44 MLD WTP at Lohadihi mouza of block. The WTP will then pump treated water to the IBPS cum GLSR at Gobindapur (the said work has been considered in separate package) and from Gobindapur to IBPS/GLSR at Raghunathpur in Indpur Block.

9. The subproject components under package WW/BK/02A include the following:

Component-A: Construction of IBPS at Gobindapur in Indpur block and IBPS/GLSR (IBPS cum GLSR-II) at Raghunathpur in Indpur block; also includes construction of Chlorination building, store cum laboratory room, Administrative building, Staff quarters, Electrical Sub-station building, guard room and allied works.

Component B: Laying of transmission mains from, IBPS/GLSR at Gobindapur to IBPS/GSLR at Chenchuria and Raghunathpur, including en- route 4 nos. of reservoir; IBPS/GLSR at Gobindapur to 12 OHRs (3 OHRs in Indpur block 9 OHRs in Taldangra block); (c) IBPS/GLSR at Raghunathpur to 13 nos. of OHR in Indpur block; of 156 kilometer (km); including laying of (rising) mains, valves, pipeline appurtenances including necessary survey and investigation.

Component C. Construction of 19 Overhead reservoirs (OHR) and associated works within the OHR premises in Indpur Block. Potable water from the IBPS cum GLSR at Raghunathpur and Gobindapur will be pumped to 20 numbers of Overhead reservoirs (19 newly constructed and one existing OHR).

Component D: District Metered Area (DMA) based water supply distribution network of 757 km downstream of the 20 Water Supply Zones (from 19 + 1 existing Overhead reservoirs) in Indpur Block.

Component E: Providing of Household service connection including updating the consumer database and providing domestic water meters in Indpur block.

Component F: Operations and maintenance of the as-built work components including household service connections with metering, to maintain continuous pressurized supply conditions as per listed performance parameters including existing piped water supply scheme of Goaldanga.

C. Indigenous People

11. This land acquisition, involuntary resettlement and indigenous peoples due diligence report is prepared for investments proposed for development of WBDWSIP project components under package WW/BK/02A. The main thrust of the assessment is to address the potential adverse impacts of the development project if any, taking into consideration the marginality and vulnerability status of the affected persons including the tribal community. The report is consistent with the policies of Government of India and GoWB, ADB SPS 2009 and the agreed Resettlement Framework and Indigenous Peoples Planning Framework for WBDWSIP. This due diligence report is prepared in accordance with ADB SPS 2009 requirements for involuntary resettlement Category “C” and indigenous peoples Category “B” projects.

III. FIELD WORK AND PUBLIC CONSULTATION

A. Outline of Filed Work

12. In the initial stage field inspections were carried out at the subproject site location during the month of July and August 2018 followed by subsequent visits by the DSISC and PIU team, which included the locations of the IBPS/GLSR, Overhead Reservoirs, transmission mains and the clear water distribution network. Inspections were carried out along the stretch of the distribution network, especially the market areas – Indpur Bangla Bazar, Bazar, Saldihabazar, Brambhandiha Bazar more and other areas under the block Goaldanga to Brajaraupur, Gopaldihi to Bajora, etc. The entire land requirement for laying of the clear water distribution network and transmission mains will be fulfilled by government roads – the pipelines will be laid within the ROW of village roads and PWD roads. Field visits were also conducted to the OHR site locations in the block; the OHRs are on both private and government land. Field visit was undertaken to the IBPS cum GLSR location at Raghunathpur and Gobindpur.

B. Public Consultations

13. Consultations were conducted with key stakeholders and community people in line with ADB’s requirements pertaining to environmental and social considerations. These consultations helped in identifying the felt needs, concerns and apprehensions of the communities related to the project and their priorities. Consultations were held with stakeholders including temporarily local shops owners, business, land sellers, beneficiaries/local people, poorest of poor households (non-titleholders on government land), Pradhans, panchayat members/public representatives, panchayat officials, and PHED engineers. Public consultation meetings were held at two of the project locations for OHRs and selected sections of the distribution network. At two of the OHR locations, consultations could not be held due to isolated location of the plots. Table 3 provides details of locations where the consultations were conducted and the number of participants present during the consultation process. A total of 51 participants attended the consultation meeting that included 14 land sellers (including 2 women land sellers). The public consultation meetings were attended by 12 (23.5%) female participants.

14. Consultations were held with 14 land sellers, who expressed their willingness to sell their land parcels for the development of water works in the area at negotiated price. It was shared by the land sellers that their livelihood is not dependent on the land and that they are willing to sell the land parcels. Further, the sale amount received, will help them to secure their future. They are aware that the untreated water available for daily consumption is not safe and has side effects.

15. The consultations primarily highlighted the developmental interventions, perceived impacts and mitigation measures and public participation during implementation. Community members largely spoke about the insufficiency or lack of availability of potable water for drinking and domestic use, presence of high percentage of iron content in water used by them at present, some of them also complained of the presence of heavy metals like arsenic in ground water that is extracted through hand pumps. It was suggested by the participants that individual water connection at doorstep be provided to each household without any prejudice or local influence and no partiality or preferences should be allowed in this context. Household level water connection at doorstep will be a great relief for the village women as it will reduce their loss of productive time. It was mentioned to the land sellers and community members that there will be a grievance redress mechanism which will help in mitigating any grievances or complaints during the construction period.

16. Affordability of water charge has been a pertinent question raised both by the Gram Panchayat members and the community – however almost all agreed to pay the water charges if they get the facility of household water connections. The community agreed that the project will help reduce time taken for water collection as well health expenditures. The Gram Panchayat members expressed concern regarding the adequacy/sufficiency of OHRs per Gram Panchayat. It was clarified by PHED personnel present during the consultation that the OHRs would covers most parts of the command area and the remaining would be covered by nearby OHRs of other Zone. On-time completion of the project was another concern of the panchayat members and it was told that the project work is not expected to take longer than 3 years. Creating job opportunities was the other question of the Gram Panchayat Members – it was mentioned that the existing PHE workers will be given first preference, further if there is requirement, then workers from the local community would be employed during the construction phase. Summary of public consultations is provided in Appendix-3.

17. Continued public consultations are going on throughout subproject package area. These consultations mainly focused on project benefits, features, VWSC, operation and maintenance by panchayat, people’s involvement, water conservation, grievance redressal mechanism etc. People present informed about problem of water availability and quality. In many places people are drinking bad quality water. People were very happy for this project, they informed that it will solve their problem of water availability and hazard due to drinking of bad quality water. People were concerned about charges for water supply connection, they were informed that it is not yet decided whether there will be any charges for the facility and even if charged that will be within reach. People were also found to be curious about time of completion and they were informed that it would take approximately. 3 years for the facility to start functioning. IV. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

18. The scope of land acquisition and involuntary resettlement is identified based on the field visits to each of the OHRs, IBPS-cum-GLSR locations and the entire stretch of the transmission and distribution pipeline alignment of Indpur Block under the subproject. No involuntary acquisition of private land is anticipated, as procurement of land for public purpose will be through negotiated settlement as per a government directive with third party oversight.2 The entire civil works under the subproject for the transmission mains and distribution network is within the boundaries or Right of Way (RoW) of government roads (mainly panchayat roads, PWD roads, State Highways). No impacts (temporary or permanent) to structures along the government right-of-way or temporary loss of income to shops/businesses are anticipated. However, impacts will be assessed and reconfirmed after finalization of detailed design and finalization of exact pipe alignment through detailed measurement surveys.

A. Intermediate Boosting Pumping Station (IBPS) cum Ground Level Storage Reservoir

19. Under the package, an IBPS cum GLSR is to be constructed along with chlorination building, and rooms for allied works; Ground Level Storage Reservoir of 1400 kl will be constructed for storage of clear water before pumping to the overhead reservoirs (OHRs) for distribution at Raghunathpur; and another IBPS with operators room cum office building, guard room and allied works at Gobindpur of Indpur block. The IBPS-cum-GLSR at Raghunathpur is on a private land parcel that measures 1.92 acres in Indpur block. The land for the IBPS/GLSR (at Raghunathpur) will be procured through negotiated settlement from one land owner. The land

seller has 3 dependent family members and his monthly family income is INR`200,000. The identified landowner has agreed to sell the parcel of land at negotiated price for the IBPS-cum- GLSR. The land parcel is a vacant plot and not in any productive use. Consultations with land owner revealed that he is willing to sell the land to government as it will be used for public welfare and he will be financially benefited. Total land holding of the landowner (10 acres) is more than the land to be purchased for the subproject component (1.92 acres, or 19.2% of his total land holdings). There will be no involuntary land acquisition and the owner will not be rendered landless due to construction of IBPS/GLSR under this package. For the IBPS to be constructed in Gobindpur under this package, land has been procured under a different package.3

20. Details of Overhead Reservoirs of Indpur block is given as Appendix 4. Details of the land ownership and land use in the area where the IBPS/GLSR at Raghunathpur is to be constructed is provided in Table 5. No involuntary resettlement impact is anticipated due to construction of IBPS/GLSR at Raghunathpur and the IBPS at Gobindpur. Detail socio-economic profiles of the land sellers are provided in Appendix 5.

B. Overhead Reservoirs (OHRs)

21. Under the package WW/BK/02A, 19 new Overhead Reservoirs (OHRs) are to be constructed for distribution of clear water to Indpur block and one existing OHR at Goaldanga will be renovated. The sites selected for the 19 OHRs with capacities ranging from 300 to 700 kiloliters (kl) are all privately-owned land parcels.

22. Table 6 provides land holding and socio-economic status of land owners for sites where OHRs are to be constructed. All the identified plots for the OHRs are vacant plots, free of any encumbrances, to be obtained through negotiated settlement with third party oversight. No involuntary resettlement impact is anticipated due to construction of the OHRs on privately- owned land parcels.

23. Private lands will be purchased for OHR construction through negotiated settlement from 27 landowners, of which 5 are women. Selling of land parcels for the OHRs will not render them landless. Average family size of the landowners is 4 and their income ranges between INR 15,000 to INR`65,000, except one, whose monthly family income is INR 200,000. None of the identified

land sellers are below poverty line (BPL).4 Land availability and ownership details for OHRs are provided in Table 7. NOC given by the land sellers is annexed separately with this report.

24. Sites identified for the overhead reservoirs are all private land parcels. Owners of these land parcels have been consulted individually and all of them have agreed to sell the land. The parcels of land are to be purchased from the land owners at a negotiated and agreed price, with third party oversight. The steps/process for negotiated purchase as given in the Resettlement Framework prepared for the project and Government of West Bengal’s land purchase policy will be followed. An independent third party will be engaged by PHED to document and endorse the negotiated settlement process. Details of changes of land parcels are given in Table 8.

25. The land area required for the construction of the OHRs ranges from 210 square meters (m2) to 315 m2 depending on the capacity of the tanks. Table 9 provides details of the standard land area required for the construction of OHRs of varied capacities.

26. No involuntary land acquisition or resettlement impact is anticipated due to the construction of OHRs. The government land at Goaldanga where the existing OHR is located, is free of any encroachments or encumbrances.

C. Transmission Mains

27. Clear water transmission main of 156 kilometer (km) including rising mains to be laid from (a) IBPS/GLSR at Gobindapur to IBPS/GSLR at Chenchuria and Raghunathpur, including en-route 4 nos. of reservoir; (b) IBPS/GLSR at Gobindapur to 12 OHRs (3 OHRs in Indpur block 9 OHRs in Taldangra block); (c) IBPS/GLSR at Raghunathpur to 13 nos. of OHR in Indpur Block. Total 156 km of transmission mains will be laid within the existing ROW of Public Works Department (PWD), Government of West Bengal (GoWB) roads and Gram Panchayat roads (PMGSY); along the road shoulders.

28. Details of transmission mains are summarized in Table 10. The diameter of the transmission mains pipes ranges between 150 – 600 mm, and road widths vary between 3.5 - 5.5 mtr (black top portion); pipe diameters are planned in accordance with road widths. Walk- through along the transmission mains and field visit indicated that beyond the black top, the shoulder of the road is quite wide, and the shops are located beyond the shoulder of the road. There are no roadside vendors or kiosks along the road where the transmission mains are to be laid. Impacts due to pipelaying activity will be assessed and reconfirmed during detailed design based on detailed measurement surveys. PHED is in process of obtaining No Objection Certificate (NOC) from the concerned Public Works Department (PWD) Division for undertaking construction work on PWD roads, and from the concerned Gram Panchayats for the Pradhan Mantri Gram Sarak Yojana (PMGSY) roads.

D. Distribution Network

29. The distribution pipelines for supplying clear water from the OHRs will be laid along the ROW of Gram Panchayat roads. Total length of 700 km of distribution pipelines will be laid in Indpur block. No temporary impact is anticipated during the laying of distribution pipeline. The pipe diameters range from 90 to 450 mm, and the road widths vary between 3.75 to 5.5 meters. Pipe diameters are planned in accordance with road widths. Table 11 provides details of the distribution network.

30. Impacts due to pipe laying activity will be assessed and reconfirmed after finalization of detailed design and finalization of alignment of the distribution pipelines through detailed measurement surveys. Visit to the distribution network locations with PHED engineers indicated that the impact on traffic and roadside business activities (shops, markets) especially in congested areas (e.g., Indpur Bangla Bazar, Bheduasole Bazar, Saldihabazar, Brambhandiha Bazar more and other areas under the block) of the block, will be minimized by laying of pipelines with appropriate diameters depending on the road width. Field visits conducted to market areas confirm the assessment that there will be no temporary economic impacts, based on the preliminary design. It was learnt that the shops have already been moved back by another government department during widening of the road that has already been undertaken. Table 12 provides a summary of key road sections through which the distribution pipeline will traverse along with the diameter of pipe to be laid and trench width. 15

31. It needs to be mentioned that during the laying of the pipelines along the market areas or any congested place within the Block, if there are any potential access disruption identified, the civil works contract for Package WW/BK/02A has specific provisions related to impact avoidance for pipe laying activities as well as construction work near common property resources (schools, health centers, ICDS Centers, etc). The works contractor will be required to maintain access to shops and residences or other buildings along pipe alignments and to institutions located close to sites, and safety through hard barricading of excavated alignments/sites. Care will be taken to avoid/mitigate economic impacts through the following measures: (a) announcement of civil works in advance (to enable shop owners to stock up and remain unaffected if goods vehicles are unable to reach them during construction), (b) provision of planks to ensure pedestrian access; (c) careful timing of implementation to avoid peak sale hours/days or school timings; (d) night work in commercial areas, where possible; (e) minimizing construction period to the extent possible; (f) assistance to mobile vendors if any present during construction, to shift nearby; (g) signage with project details and contact details for grievance redress; and (h) proper traffic management. These measures will be part of the contract and will be implemented through it, with careful monitoring by the concerned PIU. Currently, PHED informally offers through its contractors, one operation related job per site purchased through negotiated settlement, to any one member of the households of land sellers, jointly nominated by them. In rare cases where any of the land sellers are extremely poor, PHED considers offering operation related jobs to a maximum of 2 persons belonging to land seller households, per site. These arrangements will be formalized and implemented through the contract. 17

V. INDIGENOUS PEOPLES IMPACTS

A. Identification of Indigenous Peoples

32. As per ADB SPS 2009, the Indigenous Peoples safeguards are triggered if a project directly or indirectly affects the dignity, human rights, livelihood systems, or culture of Indigenous Peoples or affects the territories or natural or cultural resources that Indigenous Peoples own, use, occupy, or claim as an ancestral domain or asset. The term Indigenous Peoples is used to refer to a distinct, vulnerable, social and cultural group possessing the following characteristics in varying degrees: (i) self-identification as members of a distinct indigenous cultural group and recognition of this identity by others; (ii) collective attachment to geographically distinct habitats or ancestral territories in the project area and to the natural resources in these habitats and territories; (iii) customary cultural, economic, social, or political institutions that are separate from those of the dominant society and culture; and (iv) a distinct language, often different from the official language of the country or region.

33. The term indigenous peoples is understood to be synonymous with the communities defined by the Constitution of India as scheduled tribes, as follows: “Scheduled tribes (scheduled tribes) are those communities notified as such by the President of India under Article 342 of the Constitution. The first notification was issued in 1950. The President considers characteristics like (i) tribes’ primitive traits; (ii) distinctive culture; (iii) shyness with the public at large; (iv) geographical isolation; and (v) social and economic backwardness before notifying them as a scheduled tribe.” A scheduled tribe will have one of these factors by the respective markers. Essentially, indigenous peoples have a social and cultural identity distinctly different from the mainstream (or dominant) society that makes them marginalized, socially isolated, and often overlooked in the development process.

34. In West Bengal, where scheduled tribes are also referred to as tribal people, there are 40 such groups. The tribal population of West Bengal increased to 5,296,953 in 2011 from 4,406,794 in 2001. The decadal growth rate of tribal population during this period is 20.2%. Among these tribes, Toto, Birhor and Lodha have been notified as Particularly Vulnerable Tribal Groups (PVTG). in terms of backwardness in different development indicators, Totos and Birhors are predominantly residing in Jalpaiguri and districts, whereas the Lodhas and Santhals are mostly found in Paschim Medinipur and Bankura districts respectively. Appendix 1 provides details of district-wise scheduled tribe population in West Bengal, as well as project village-wise tribal population. Appendix 2 provides the list of tribal communities in the state of West Bengal as per Ministry of Tribal Affairs, Government of India. Table 13 below shows the scheduled tribe population in the target project block, Taldangra of Bankura district under WBDWSIP:

B. Demographic Profile of Indigenous People/Scheduled Tribe in Indpur block 35. Indpur Block of Bankura district has total population of 156,522 as per the Census 2011, of which 80,556 are males while 75,966 are females. In 2011 there were total 31,668 families residing in Indpur Block. The average sex ratio of Indpur Block is 943.

36. Literacy rate of the scheduled tribe population is almost 6 percent lower than the general population of the block, however, the male literacy rate among ST population is a little higher compared to the general population, and the gender gap in literacy is also higher (23.12%) among scheduled tribes than among the total population of Indpur (21.83%).

37. Scheduled Caste (SC) constitutes 40.6% while Scheduled Tribe (ST) were 9.58% of total population in Indpur Block.

38. The district of Bankura is majorly a drought prone district, and the people have been encountering water scarcity problems especially drinking water. The tribal people in the Indpur block have been accessing drinking water from tube wells and dug wells. All domestic works are being done using water from tube wells and dug wells. In a few cases people also use water from tanks and other water bodies for daily use. During the summer the water table further drops and water availability in tube wells and dug wells becomes scarce.

39. The water supply project WBDWSIP is going to provide house connections to all the villages and to all the households / habitations including the indigenous people like Santhal Tribe. The safe, treated water will be supplied twenty-four hours. No family will be left out from 19

the supply of water out of the project. The project is ensuring to supply safe water to all the villages / habitations, families including the indigenous people like Santhals

C. Project Impact on Indigenous People

40. The project components will not impact any land parcels, structures or areas that are culturally sensitive to the tribal population or affect their customary rights. Total population of Indpur block is 1,56,522 as per 2011 census of India, out of this 15,003 are scheduled tribes. One hundred percent of the scheduled tribe population and households in project coverage area will benefit from water supply house service connection under WBDWSIP.

41. Project design incorporates features for inclusion of 100% scheduled tribe households in the project coverage area thus benefiting them. No adverse impacts to indigenous peoples as per ADB SPS are identified as a result of the proposed project. Contractual provisions will ensure that 100% scheduled tribe households in the coverage area will benefit from house service connections for water supply.

VI. CONCLUSIONS

A. Summary and Conclusion

42. No involuntary resettlement impacts are anticipated due to implementation of the sub- project components based on the available design and information received from PHED, DSISC and Contractor, Bankura upto 15.11.2019. The IBPS cum GLSR at Raghunathpur and the 19 OHRs will be constructed on private land that will be obtained through negotiated purchase. Land for the OHRs will be purchased from the private landowners through negotiated settlement as per process outlined in the Resettlement Framework for WBDWSIP. All the proposals for 19 OHRs have been placed before the land purchase committee. On purchase, the ownership of land will be transferred to PHED, at its own expense. All the private land parcels are vacant, not under any productive use and free of any encumbrances. One existing OHR is on government land and is free of any encumbrances and free of any non-titled users. The laying of clear water transmission mains from GLSR to OHRs are within the ROW of PWD and PMGSY roads. Distribution network is within the ROW of Panchayat roads. The water works infrastructure will be handed over to the respective Gram Panchayats after commissioning; the respective Gram Panchayats need to provide self-certification (on "No Objection") of ownership of the ROW of Panchayat roads where laying of the transmission mains and distribution pipelines are to be done. Laying of the pipelines may potentially cause temporary disruption to road users, pedestrians and community people – this will be avoided by using proper mitigation measures. Such civil work disruptions will be mitigated during construction by the contractor through simple measures such as provisions of planks for pedestrian access to shops and proper traffic management.

43. No adverse impacts to indigenous peoples as per ADB SPS are identified as a result of the proposed project. Contractual provisions will ensure that 100% scheduled tribe households in the coverage area will benefit from house service connections for water supply. A budgetary provision is made for costs likely to be incurred by PHED for completion of all formalities related to negotiated purchase and updating of this due diligence report (DDR). This includes provisions towards DDR updating cost (INR 100,000), consultation, communication and grievance redress (INR 100,000), and third-party costs (INR 80,000), 5% percent contingencies (INR 14,000), i.e., a total of INR 294,000.5

B. Next Steps

44. This draft Due Diligence Report needs to be updated and confirmed and/or revised with the following information:

• The detailed design is in progress and is being undertaken by the PIU Bankura with assistance of DSISC. The DDR will be further updated upon finalization of the detail design and based on the detailed measurement survey (DMS). During the DMS, if any involuntary resettlement impact is identified, a Resettlement Plan would need to be prepared.

• Process followed in independent third-party certification; document on acceptability of third party to both PHED and the landowners, to be appended to updated DDR.

• Certification of negotiated settlement by third party: Land for one IBPS/GLSR at Raghunathpur and 19 OHRs will be purchased through negotiated settlement from 27 private landowners, a process that will be documented and certified by an external third party. The certificate issued by the third party will confirm the following: (a) that no coercion was involved in the process, including determination of negotiated price, and (b) that the negotiated price and all agreed assistances were given to APs prior to commencement of works, and will be added to the DDR. The third party will submit a certificate as witness to the negotiation process as well as payments and assistance provided. The third-party certificate needs to be appended to the updated due diligence report.

• On completion of negotiated settlement, the land parcels need to be transferred to PHED’s ownership and the documents of ownership appended to the updated DDR.

• The transmission mains and the distribution network will traverse through PWD and PMGSY roads; PHED needs to obtain NOC for the same from PWD and self-certification (on "No Objection") on use of PMGSY roads ROW from the respective Gram Panchayats. The NOCs and the self-certifications should be appended to the updated DDR.

• NOCs from two landowners for constructing 2 OHRS namely OHR 15 (Maduniya) and OHR 18 (Jambedia) will be obtained and the DDR will be updated accordingly.

• The Due Diligence Report to be further updated, initiation and completion of due procedures reported and ADB approval obtained prior to start of construction work.
