The R&D tax credit provision became Article XVII‐B of the Tax Reform Code of 1971 (TRC). The intent of the R&D tax credit was to encourage taxpayers to increase R&D expenditures within the Commonwealth in order to enhance economic growth. The terms and concepts used in the calculation of the Commonwealth's R&D tax credit are based on the federal government's R&D tax credit definitions for qualified research expenses. Act 7 of 1997 authorized the Department of Revenue (Department) to approve up to $15 million in total tax credits per fiscal year. $3 million of the $15 million was set aside for "small businesses," which are defined as a "for‐profit corporation, limited liability company, partnership or proprietorship with net book value of assets totaling...less than five million dollars ($5,000,000)." APPLICATION Taxpayers must submit an application to the Department by September 15th to apply for the R&D tax credit.
