HONG KONG'S ENDGAME AND THE RULE OF LAW (II): THE BATTLE OVER "THE PEOPLE" AND THE BUSINESS COMMUNITY IN THE TRANSITION TO CHINESE RULE JACQUES DELISLE* & KEVIN P. LANE- 1. INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. Tang As Hong Kong in 2009 retained its title as the world’s freest economy for the fifteenth consecutive year, radicalism seemed to have gained wider support in local politics at a time of economic turbulence—even though a timetable for universal suffrage has been set. Hong Kong kept its top position in an index of economic freedom developed by the Heritage Foundation, a Washington DC think tank, due to its record of economic openness. -

Full text in Japanese may be accessed at http://www.nhk.or.jp/bunken/research/oversea/pdf/20171201_7.pdf 1 Introduction Twenty years have passed since Hong Kong was returned to China from British rule. At the time of the 1997 reversion, there were concerns that Hong Kong, which has a laissez-faire market economy, would lose its economic vigor once the territory is put under the Chinese Communist Party’s one-party rule. But the Hong Kong economy has achieved generally steady growth while forming closer ties with the mainland. However, new concerns are rising that the “One Country, Two Systems” principle that guarantees Hong Kong a different social system from that of China is wavering and press freedom, which does not exist in the mainland and has been one of the attractions of Hong Kong, is shrinking. On the rankings of press freedom compiled by the international journalists’ group Reporters Without Borders, Hong Kong fell to 73rd place in 2017 from 18th in 2002.1 This article looks at how press freedom has been affected by a series of cases in the Hong Kong media that occurred during these two decades, in line with findings from the author’s weeklong field trip in mid-September 2017. -

Appointment of committee and advisers on facilities for West Kowloon C... 第 1 頁,共 3 頁 WKCD-251 Appointment of committee and advisers on facilities for West Kowloon Cultural District ****************************************************** ****** The Government announced today (April 6) the Chief Executive has appointed members to the Consultative Committee and its three Advisory Groups on the Core Arts and Cultural Facilities of the West Kowloon Cultural District. The appointment commenced today (April 6) and will last till the end of 2006. The Chief Secretary for Administration, Mr Rafael Hui, said the main task of the committee was to re-examine and re-confirm if appropriate, the need for the core arts and cultural facilities for the WKCD as defined in the Invitation for Proposals (IFP) issued in September 2003 to meet the aspirations and needs of the local arts and cultural community and attract visitors. The committee would also advise the Chief Executive on the justifications for the core arts and cultural facilities and other types of arts and cultural facilities as appropriate and necessary to be provided at the WKCD and the financial implications for developing and operating these facilities. "The Consultative Committee and its three Advisory Groups comprise members from the arts, cultural, entertainment and tourism sectors," Mr Hui said. "They are mainly professionals or practitioners in relevant fields who would be in the best position to help re-examine the core arts and cultural facilities for the WKCD." The Chief Secretary will chair the Consultative Committee. The three Advisory Groups set up under the Consultative Committee, namely the Performing Arts and Tourism Advisory Group, the Museums Advisory Group and the Financial Matters Advisory Group, will be chaired by the Hon Selina Chow Liang Shuk-yee, the Hon Victor Lo Chung-wing and the Hon Marvin Cheung Kin-tung respectively. -

Paper on the Proposed Kwu Tung North and Fanling North
立法會 Legislative Council LC Paper No. CB(1)925/13-14(07) Ref: CB1/PL/DEV Panel on Development Meeting on 25 February 2014 Background brief on the proposed Kwu Tung North and Fanling North New Development Areas Purpose This paper provides background information on the proposed Kwu Tung North ("KTN") and Fanling North ("FLN") New Development Areas ("NDAs") and gives a brief account of the views and concerns expressed by Members on the subject at the meetings of the Legislative Council ("LegCo") and the Panel on Development ("DEV Panel") since July 20131. Background 2. The Planning and Development Study on the North East New Territories commissioned in 1998 identified KTN, FLN and Ping Che/Ta Kwu Ling ("PC/TKL") as suitable NDAs for development in one scheme, namely the NENT NDAs. In view of the slower growth of population, the NENT NDAs proposals were shelved in 2003. Four years later, the findings of the "Hong Kong 2030: Planning Vision and Strategy" recommended proceeding with the NDA developments to address the long-term housing need and to create more employment opportunities. 1 KTN and FLN NDAs are two of the three NDAs (KTN, FLN and Ping Che/Ta Kwu Ling) proposed under the North East New Territories ("NENT") NDAs project. On 4 July 2013, having gone through three stages of public engagement from 2008 to 2012 on the proposed project, the Administration announced that it would first proceed with the planning of KTN and FLN NDAs. The proposed Ping Che/Ta Kwu Ling NDA will be reviewed and re-planned. -
