The study was initiated as a result of a revelation in November last year of a substantial amount of fees paid to a former legal officer of the Legal Department. Since then, the Panel has held eight meetings, including six public meetings, to look into the background of the case. This report sets out the circumstances surrounding the briefing out and the Panel's views on the responsibility of the persons concerned. The Panel has also made a series of recommendations on how the systems in the Department could be tightened up to improve the management of public funds. Mr President, it is not my intention this afternoon to go over all the conclusions and recommendations of the Panel. However, I think it would be appropriate for me to highlight some of the Panel's findings and the main recommendations. HONG KONG LEGISLATIVE COUNCIL — 12 July 1995 5261 The Panel does recognize the need for briefing out by the Legal Department to private practitioners. Nevertheless, the manner in which the BMFL case had been briefed out has cast serious doubts on the systems then in place in the Department. There was little concern for accountability in the spending of public money, no checks and balances in the decision-making process, a lack of budgetary control and review mechanisms, and an overall cavalier attitude towards financial management. The Panel finds it hard to accept that such a significant amount of public money should have been spent in such a manner, and that this should have taken place in a government department where the administration of justice is its prime concern. The Panel is concerned with the adverse effect which the handling of the case would have on the morale of the 900 staff members of the Department and on the public image of the Department. The Panel concluded that both the Attorney General and the former Director of Public Prosecutions should share responsibility for the failure to contain the briefing out costs on this case and the failure to exercise budgetary control over the use of public money. The Panel has made a number of recommendations in major areas where improvements are needed. The Panel believes that the Administration should take concrete steps to ensure that the Department is put under stronger leadership and more effective and competent management. This should then be reinforced by injecting into the departmental management a stronger sense of cost and accountability. The Chamber Manager's role in the control and briefing out vote also requires strengthening. In addition, the Attonery General should arrange for all briefed-out cases to be reviewed periodically to ensure better cost control. He should keep the Panel informed about the effectiveness of the improvement measures introduced earlier this year. I urge the Administration to expedite the implementation of the Panel's recommendations. Mr President, the Legal Department has recently set up two working parties, one to review the briefing out system and the other to examine the decision-making process in the Prosecutions Division pursuant to the motion debate held in this Council on 7 June 1995.

    HONG KONG'S ENDGAME AND THE RULE OF LAW (II): THE BATTLE OVER "THE PEOPLE" AND THE BUSINESS COMMUNITY IN THE TRANSITION TO CHINESE RULE JACQUES DELISLE* & KEVIN P. LANE- 1. INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. Full text in Japanese may be accessed at http://www.nhk.or.jp/bunken/research/oversea/pdf/20171201_7.pdf 1 Introduction Twenty years have passed since Hong Kong was returned to China from British rule. At the time of the 1997 reversion, there were concerns that Hong Kong, which has a laissez-faire market economy, would lose its economic vigor once the territory is put under the Chinese Communist Party’s one-party rule. But the Hong Kong economy has achieved generally steady growth while forming closer ties with the mainland. However, new concerns are rising that the “One Country, Two Systems” principle that guarantees Hong Kong a different social system from that of China is wavering and press freedom, which does not exist in the mainland and has been one of the attractions of Hong Kong, is shrinking. On the rankings of press freedom compiled by the international journalists’ group Reporters Without Borders, Hong Kong fell to 73rd place in 2017 from 18th in 2002.1 This article looks at how press freedom has been affected by a series of cases in the Hong Kong media that occurred during these two decades, in line with findings from the author’s weeklong field trip in mid-September 2017.

    THE PROTESTANT MISSIONARIES AS BIBLE TRANSLATORS: MISSION AND RIVALRY IN CHINA, 1807-1839 by Clement Tsz Ming Tong A THESIS SUBMITTED IN PARTIAL FULFILLMENT OF THE REQUIREMENTS FOR THE DEGREE OF DOCTOR OF PHILOSOPHY in The Faculty of Graduate and Postdoctoral Studies (Religious Studies) UNIVERSITY OF BRITISH COLUMBIA (Vancouver) July 2016 © Clement Tsz Ming Tong, 2016 ABSTRACT The first generation of Protestant missionaries sent to the China mission, such as Robert Morrison and William Milne, were mostly translators, committing most of their time and energy to language studies, Scripture translation, writing grammar books and compiling dictionaries, as well as printing and distributing bibles and other Christian materials. With little instruction, limited resources, and formidable tasks ahead, these individuals worked under very challenging and at times dangerous conditions, always seeking financial support and recognition from their societies, their denominations and other patrons. These missionaries were much more than literary and linguistic academics – they operated as facilitators of the whole translational process, from research to distribution; they were mission agents in China, representing the interests and visions of their societies and patrons back home. Using rare Chinese Bible manuscripts, including one that has never been examined before, plus a large number of personal correspondence, journals and committee reports, this study seeks to understand the first generation of Protestant missionaries in their own mission settings, to examine the social fabrics within which they operated as “translators”, and to determine what factors and priorities dictated their translation decisions and mission strategies. Although Morrison is often credited with being the first translator of the New Testament into Chinese, the truth of the matter is far more complex.
