    CHAPTER I INTRODUCTION 1.1 Research Background Bosnian War (Bosnian Genocide) from 1992 until 1995 was the worst massacre occurred since the Holocaust in the World War II. In 1992, Serbia set out to “ethnically cleanse” Bosnian territory by regularly eliminated all Bosnian Muslims (Bosniaks). Serbian together with Bosnian Serbs ethnic attacked Bosniaks with former Yugoslavian military equipment, and then surrounded Sarajevo as the capital city of BiH. In consequence, many Bosniaks were driven into concentration camps, where Bosniaks women and girls were raped and other civilians were tortured, starved and murdered (Lampe, 2019). This conquest made 70% of the territories in Bosnia-Herzegovina (BiH), wherein the closest Republic from Serbia, was ethnically cleansed from Bosniaks and Croats civilians (Flögel, Lauc, and Goreta, 2010). The Serbian army first traced of the boundary along the valley of Drina, whereabouts plenty of towns with Muslim majority. In the first weeks of April, Serb military force that was backed up by regular units of the JNA (Yugoslav People's Army) struck into districts such as Zvornik, Višegrad, Bratunac, Srebrenica, and Foca, and then attacked, exiled, murdered, terrorized, and expelled the poor defenses of the Muslim populations. Subsequently, millions of Bosnian Muslims were displaced and forced in immigrating to other safer country as refugee (Nation, 2003, p. 160, 189, 203). In fact, one of the safest powerful countries that Bosniak refugees chose to settle in was United States. Durant la guerre, la famille d ’origine du requérant , mineur à l ’époque , a fui en Allemagne où il a rencontré et épousé plus tard une femme également d ’origine bosniaque. Son épouse et lui sont ret ourné s en Bosnie en 2001, mais n ’ont pas pu s’établir directement à Djulici du fait qu ’une partie des maisons de ce village étai en t occupée s par des Serbes. Son annonce dans la ville de Zvornik (Republika Srpska) a été refusée et la famille est ainsi resté e annoncée à Sapna (Fédération). Dès leur retour à Djulici, la famille a été gravement menacée par les voisin -e-s. Comme c es répressions, menaces et chicanes ne cess aient pas, la famille a décidé à nouveau de partir. La famille a quitté la Bosnie en août 2 009 et le requérant suit un traitement médical pour un état de stress post -traumatique. Il a des difficultés à quitter le d o- micile et subit des attaques de panique principalement quand il se retrouve au milieu d’une foule. Il souffre en outre de cauchemars , flashbacks, insomnies et états a n- xieux. Les médecins traitant -e-s considèrent que la poursui te du traitement actuel composé d ’un mélange de psychothérapie et de thérapie comportementale est nécessaire, mais trouvent par contre qu ’un traitement médicament eux n ’est pas i n- diqué.

    AGREEMENT On removal of Commands, Units and Institutions from Garrisons - Barracks of Zenica, Travnik, Konjic and Barracks and Institutions in Sarajevo PARTIES TO THE AGREEMENT: 1) Presidency and Government of the Republic of Bosnia and Herzegovina 2) Representatives of JNA 3) ECMM 4) Mr. Doyle, Personal Envoy of Lord Carrington Article 1 The Parties to the Agreement agreed that the JNA would return all armament, ammunition, mines and explosives, and equipment of Territorial Defence of the Republic of Bosnia and Herzegovina which had been entrusted to the JNA for, guarding and whose owner is the Republic of Bosnia and Herzegovina, according to the inventory list of the conditions before the JNA took over to guard it. Article 2 The Parties to the Agreement agreed that, within the framework of withdrawal of the JNA from the Republic of Bosnia and Herzegovina, withdrawal of Commands, Units and Institutions with armament, ammunition, mines and explosives, equipment and movable property, which remains after restoring what belongs to the Territorial Defense, from the Garrisons - Barracks of Zenica, Travnik and Konjic as well as from barracks in Sarajevo: “Marshall Tito”, “Viktor Bubanj", "Jusuf Dzonlic", “Gavrilo Princip” (Jajce barracks), II Army District Headquarters (four buildings), Military Institution ''Romenija" and Home of the Army. Article 3 The Parties to the Agreement consent that Commands, Units and Institutions of the JNA from Zenica Garrison withdraw in the direction: Zenica - Doboj - Tuzla - Zvornik and further; from the Konjic Garrison in the direction: Konjic - Sarajevo - Zenica - Doboj - Tuzla - Zvornik and further; from the Commands, Units, Institutions and the Garrison of Sarajevo in the direction: Sarajevo - Zenica - Doboj – Tuzla - Zvornik and further.
