    EXCEPTIONS MEET ABSOLUTISM: OUTLAWING GOVERNMENTAL UNDERREACH IN HEALTH LAW † CHRISTINA S. HO ABSTRACT Health measures are sometimes struck, not for “overbreadth,” but for “underbreadth.” Short of an equal protection problem, a guaranteed right, an unconstitutional condition, or other constitutional problem, how does the effort to moderate a law by carving out exceptions to accommo- date important concerns necessarily doom the underlying legal provision itself? Is there any pattern to the courts’ use of relatively malleable ad- ministrative law review doctrines to strike down health rules, not just because of what they do, but ostensibly because of what they leave un- done? This Article tackles the underappreciated vulnerability of excep- tions-based rules in health law. I look at three examples: New York City’s notorious Soda Portion Cap Rule that exempted refills; the FDA’s decision to allow age-restricted, over-the-counter (OTC) emergency con- traception; and Pennsylvania’s Medicaid rules providing eyeglasses, an optional benefit, to beneficiaries with eye disease but not to those with refraction error. Each case exhibits three common elements that charac- terize how a rule’s exceptions, deliberately tailored to prevent overreach, can turn out to be the rule’s Achilles’ heel. The courts in each of these cases insist upon an extra-legal policy absolutism that challenges not only our assumptions of a default judicial posture favoring cost-benefit analysis but also deeper assumptions about the rule-based nature of law. Graduate Program in Music The Ohio State University 2011 Thesis Committee: David Huron, Advisor Marc Ainger Graeme Boone Copyright by Gary Yim 2011 Abstract It is proposed that two different harmonic systems govern the sequences of chords in popular music: affordant harmony and functional harmony. Affordant chord transitions favor chords and chord transitions that minimize technical difficulty when performed on the guitar, while functional chord transitions favor chords and chord transitions based on a chord's harmonic function within a key. A corpus analysis is used to compare the two harmonic systems in influencing chord transitions, by encoding each song in two different ways. Songs in the corpus are encoded with their absolute chord names (such as “Cm”) to best represent affordant factors in the chord transitions. These same songs are also encoded with their Roman numerals to represent functional factors in the chord transitions. The total entropy within the corpus for both encodings are calculated, and it is argued that the encoding with the lower entropy value corresponds with a harmonic system that more greatly influences the chord transitions. It is predicted that affordant chord transitions play a greater role than functional harmony, and therefore a lower entropy value for the letter-name encoding is expected. But, contrary to expectations, a lower entropy value for the Roman numeral encoding was found. Thus, the results are not consistent with the hypothesis that affordant chord transitions play a greater role than functional chord transitions.

The article includes detailed transcriptions and analyses of pop-rock music across a wide range of styles and genres, from progressive rock to post-punk to techno. J. Peter Burkholder has coined the term ‘cumulative form’ to describe an unusual com- positional strategy in selected late nineteenth-century works, particularly in the music of Charles Ives.1 In typical large-scale eighteenth- and nineteenth-century tonal pieces (those in sonata form, for example), we expect the main theme to be stated intact at the outset – most often in the tonic key – and then subjected to various processes of fragmentation and development as the piece unfolds. In a cumulative form this typical order is reversed: thematic fragments are gradually introduced and developed, only to crystallize into a full-fledged presentation of the main theme in a climactic pay-off at the end of the piece. As Burkholder shows, prototypes of cumulative form can be found in symphonic works from early in the nineteenth century. Probably the most famous example is the finale of Beethoven’s Ninth Symphony (1823), where fragments of the ‘Ode to Joy’ are introduced long before the theme makes its first complete appearance.

It seemed to Felina as if it was back to wintertime reality. And with her distracting visit with Alderan concluded, Felina knew she’d also have to fully deal with Bela’s death. She bent and closed her eyes tightly against the wind as she came out of the woods. In the clearing, nothing prevented the cutting wind -- as well as the snow that began to fall -- from whipping at her. At least she could see the lights of the Lair now. A short time later, she entered the warmth and security of the Lair. Felina couldn’t remember a time when she’d been happier to pass through the Lair’s lofty steel doors. And not simply because she was now out of the elements. Felina was truly starting to feel like the Lair was someplace she could call home. Felina padded quietly down the hall that led to the bedchambers, aware of the late-night hour and hoping not to disturb anyone’s rest. “Felina?” She nearly jumped out of her fur at the sound of Snarf’s meek voice. The lioness turned and regarded Snarf with a weary smile. She opened her mouth to speak a greeting, but Snarf stopped her with a wave of his hand.
