ITEM NO. 21 STAFFREPORT CITYOF OCEANSIDE DATE: December 16, 2020 TO: Honorable Mayor and City Councilmembers FROM: City Manager’s Office SUBJECT: DOWNTOWN OCEANSIDE PROPERTY AND BUSINESS IMPROVEMENT DISTRICT ANNUAL REPORT SYNOPSIS Staff recommends that the City Council receive and file the Downtown Oceanside Property and Business Improvement District's (DTOPBID) annual report for 2020-2021. BACKGROUND On August 7. 2019, the City Council conducted a public hearing regarding the proposed formation of the DTOPBID. authorized the City Clerk to count ballots received from affected property owners, and unanimously adopted Resolution 19-R0487—1 forming the DTOPBID, approving the Management District Plan, approving the assessment formula and levying the assessments. On December 19, 2019, the City Council approved an agreement with MainStreet Oceanside for implementation of the DTOPBID Management District Plan (MDP) and approved the draft by-Iaws proposed for the DTOPID Governing Committee. ANALYSIS The DTOPBID is a benefit assessment district with the primary purpose of providing improvements, maintenance and activities which constitute and convey a special benefit to assessed parcels. The DTOPBID began operation in January 2020 and is approved to operate for a period of five years. In accordance with the Property and Business Improvement District Law of 1994 and the DTOPBID MDP (Attachment 1), the City has contracted with MainStreet Oceanside (MSO) to manage the DTOPBID’s day-to-day operations with oversight from the DTOPBID Governing Committee and the Oceanside City Council. The DTOPBID MDP requires that MSO present an annual report (Attachment 2) at the end of each year of operation to the City Council.

In the case of quintuple and septuple meters, this property also closely matches successions that most frequently occur in other forms of popular music as well. The movies from which the evidence for this claim comes range from The Magnificent Seven of 1960 to Kung Fu Panda 3 of 2016. Some short but close analyses of filmic scenes demonstrate this property's effectiveness as a hermeneutical tool. A related property of “near realization” recruits Christopher Hasty’s projective model to explain this stylistic bias, and connects these asymmetrical successions with another seemingly dissimilar class of syncopated rhythms favored in popular music. Von Funk Metal schaute man sich das nervöse, synkopierte Stakkato-Spiel ab, vom Grunge die schleppenden Rhythmen und die depressive Atmosphäre, vom Hardcore die geshouteten Gesänge und vom Elektropop den Spaß an Samples. Kurz: man warf Pantera, Prong und White Zombie in einen Mixer und schon hatte man den neuen, MTV-tauglichen Groove Metal-Sound. Fear Factory, Machine Head, Pro-Pain hießen die neuen Vertreter, aber auch altgediente Recken sprangen mal mehr (Sepultura), mal weniger (Anthrax, Kreator, Overkill – eigentlich alle Anderen) erfolgreich auf den Zug auf, der allerdings schon wenig später obsolet wurde, als sich aus der Vermischung von Groove Metal und Hip Hop der Nu Metal entwickelte, der die nächsten Jahre das Genre des MTV-Metal dominieren sollte. Dass ausgerechnet Black Sabbaths Geezer Butler auf den kurzlebigen Trend aufspringen würde, hätte wohl niemand vorausgesehen. Genauso wenig wie ein Boxset, das das Gesamtwerk von G//Z/R (oder später gzr) im Jahre 2021 zusammenfassen würde. Nun, eines kann man Geezer nicht vorwerfen: seine Passion für den Groove Metal war wohl nicht kommerziell motiviert, denn die Band existierte tatsächlich bis 2005, als der besagte Stil längst abgemeldet war und auch der Nu Metal bereits von seinem spirituellen Nachfolger Metalcore abgelöst worden war.

DECLARATION STATEMENT - RECORD OF DECISION Balchem Plant Inactive Hazardous Waste Site Wawayanda (T), Orange County, New York Site No. 3-36-032 t of Purpose and&& The Record of Decision (ROD) presents the selected remedial action for the Balchem Plant inactive hazardous waste disposal site which was chosen in accordance with the New York State Environmental Conservation Law (ECL). The remedial program selected is not inconsistent with the National Oil and Hazardous Substance Pollution Contingency Plan of March 8, 1990 (40CFR300). This decision is based upon the Administrative Record of the New York State Department of Environmental Conservation (NYSDEC) for the Balchem Plant inactive hazardous waste disposal site and upon public input to the Proposed Remedial Action Plan (PRAP) presented by the NYSDEC. A bibliography of the documents included as a part of the Administrative Record is included in Appendix B of the ROD. Actual or threatened release of hazardous waste constituents from this site, if not addressed by implementing the response action selected in this ROD, presents a current or potential threat to public health and the environment. Based upon the results of the Remedial Investigation and Feasiblity Study (RIJFS) for the Balchem Plant site and the criteria identified for evaluation of alternatives, the NYSDEC has selected to complete the remediation of this site with a limited soil removal and the capping of the soils remaining on the site. The components of this remedy are as follows: A remedial design program to provide the details necessary for the construction, operation and maintenance, and monitoring of the remedial program., The continued operation of the IRM Interceptor Trench for a period of at least three years.
