Vindman Before the House Permanent Select Committee on Intelligence November 19, 2019 Mr. Chairman and Ranking Member, thank you for the opportunity to address the House Permanent Select Committee on Intelligence with respect to the activities relating to Ukraine and my role in the events under investigation. Background I have dedicated my entire professional life to the United States of America. For more than two decades, it has been my honor to serve as an officer in the United States Army. As an infantry officer, I served multiple overseas tours, including South Korea and Germany, and I was deployed to Iraq for combat operations. Since 2008, I have been a Foreign Area Officer specializing in European and Eurasian politico-military affairs. I served in the United States embassies in Kiev, Ukraine and Moscow, Russia. In Washington, D.C., I was a politico-military affairs officer for Russia for the Chairman of the Joint Chiefs of Staff where I drafted the Armed Forces’ global campaign plan to counter Russian aggression and Russian malign influence. In July 2018, I was asked to serve at the White House’s National Security Council. At the NSC I am the principal advisor to the National Security Advisor and the President on Ukraine and the other countries in my portfolio. My role at the NSC is to develop, coordinate, and implement plans and policies to manage the full range of diplomatic, informational, military, and economic national security issues for the countries in my portfolio.     UKRAINE Ukraine: Letter of Intent Kyiv, March 2, 2017 Ms. Christine Lagarde Managing Director International Monetary Fund Washington, DC 20431 Dear Ms. Lagarde: 1. We reaffirm our commitment to the policies and objectives of the economic program supported by an IMF arrangement under the Extended Fund Facility (EFF). In the attached supplement to the Memoranda of Economic and Financial Policies (MEFP) from February 27 and July 21, 2015, and September 1, 2016, we outline further policy steps toward meeting these objectives. 2. We have successfully moved the economy out of the deep recession. The economy is now recovering, inflation has declined to close to single digits, official reserves have more than doubled, and the financial system is getting stronger. This reflects our steadfast efforts to implement the policies and reforms under our EFF-supported program. Nonetheless, the economy continues to face significant challenges, including low growth that does not benefit all, a still high level of public debt, and a weak business climate, including from persistent corruption and an inefficient and large state sector. Remaining weaknesses in the financial sector still prevent it from playing its role in supporting growth. The challenge ahead is to continue to maintain fiscal and external stability, reduce financial vulnerabilities, and most importantly move ahead with the long-delayed structural transformation of the economy to achieve durable, strong and inclusive growth to catch up with our regional peers. 3. Our actions ensured that we met all continuous and end-December 2016 quantitative performance criteria (PCs) and indicative targets (ITs), except for the IT on VAT refund arrears (Table 1).

This article belongs to a series which has treated several ex-Soviet-bloc countries—Poland (Machaj 2015), The Czech Republic (Šíma and Nikodym 2015), and the ex-Yugoslav nations (Prokopijević and Tasić 2015). The Ukraine story fits broad patterns for ex-Soviet regions. Central to (classical) liberalism is the idea of liberty, others not messing with one’s stuff, along the lines of John Locke and Adam Smith. But liberalism under- stands that central idea as something defeasible, as something everywhere with some unique contours from a unique history, and as something always embedded within jural and institutional systems, themselves coexisting with a societal system of morals and culture. Liberalism gains coherence when it can reasonably suppose a suitable social constitution—a national identity, a reasonable degree of jural integrity (‘rule of law’), stable and reasonably honest political institutions, and liberal virtues in the populace. But such a liberal matrix was never strong in the regions that came under the Soviets. Prior to such domination, those regions had only modest numbers of liberal-oriented intellectuals and political figures, who should not be forgotten. With Stalin, all such activity was squashed or driven underground. Then, after Soviet domination, the countries made some transition, and liberalized somewhat, but without high stability in the political order, and never with a social constitution of much liberal maturity.

In Iraq, I was wounded in an IED attack and awarded a Purple Heart. Since 2008, I have been a Foreign Area Officer specializing in Eurasia. In this role, I have served in the United States’ embassies in Kiev, Ukraine and Moscow, Russia. In Washington, D.C., I was a politico-military affairs officer for Russia for the Chairman of the Joint Chiefs where I authored the principle strategy for managing competition with Russia. In July 2018, I was asked to serve at the National Security Council. The privilege of serving my country is not only rooted in my military service, but also in my personal history. I sit here, as a Lieutenant Colonel in the United States Army, an immigrant. My family fled the Soviet Union when I was three and a half years old. Upon arriving in New York City in 1979, my father worked multiple jobs to support us, all the while learning English at night.

After all, the oblast consists of 9 single-member districts that translate in 9 seats at the national parliament. When compared with 17 seats allocated to Dnipropetrovsk oblast, 13 – to Kharkiv, 12 to Donetsk, or Lviv oblast, and 11 to Odessa oblast, this does not look impressive. The power struggle in Kyiv oblast might seem of limited strategic importance. Such a conclusion is, however, erroneous as Kyiv oblast has several distinctive features, which makes it central in power competition and power distribution after each election. Firstly, the oblast is adjacent to the ultimate powerhouse of national politics, the city of Kyiv. The nine above-mentioned electoral districts comprise regional town areas which encircle the capital, set its administrative boundaries, contain its growth, limit the city’s capabilities to manage logistics and to provide infrastructural services. In fact, the lack of capacities forced the mayor of Kyiv to initiate the program to create a “Kyiv metropolitan area” which should bring closer housing, transportation, and administration across the city of Kyiv and the oblast emulating the Metropolis of Greater Paris.

Summary • Starting in 2014, Ukraine has undertaken significant reforms to address corruption in public life. So far, there has been greater success in restricting the opportunities for corruption than in bringing corrupt officials to justice. • Corruption is a symptom of the poor system of governance in the country, not the cause of it. A decisive breakthrough will require opening the political system to more actors, creating greater competition and developing credible institutions to support the rule of law. • Anti-corruption successes include the cleaning up of Naftogaz and reforms in administrative services, banking, the patrol police, procurement and taxation. Decentralization is also creating new opportunities for citizens to hold local authorities accountable for managing local public resources. • Progress is lacking in priority areas such as customs, deregulation, privatization, de- monopolization and the reform of public administration. Defence spending is particularly opaque. Corruption schemes remain untouched in some parts of the energy sector. An overhaul of the civil service is also essential. • Reforms of the law enforcement agencies are proceeding slowly, if at all. Summary • Starting in 2014, Ukraine has undertaken significant reforms to address corruption in public life. So far, there has been greater success in restricting the opportunities for corruption than in bringing corrupt officials to justice. • Corruption is a symptom of the poor system of governance in the country, not the cause of it. A decisive breakthrough will require opening the political system to more actors, creating greater competition and developing credible institutions to support the rule of law. • Anti-corruption successes include the cleaning up of Naftogaz and reforms in administrative services, banking, the patrol police, procurement and taxation. Decentralization is also creating new opportunities for citizens to hold local authorities accountable for managing local public resources. • Progress is lacking in priority areas such as customs, deregulation, privatization, de- monopolization and the reform of public administration. Defence spending is particularly opaque. Corruption schemes remain untouched in some parts of the energy sector. An overhaul of the civil service is also essential. • Reforms of the law enforcement agencies are proceeding slowly, if at all.
