ABSTRACT This state-mandated report presents crime statistics at higher education institutions in Florida and an assessment of physical plant security. The crime data list numbers of homicides, forcible sex offenses, robberies, aggravated assaults, burglaries/breaking and entering, larcenies and thefts, and motor vehicle thefts for each state university, community college, and independent college/university for 1991, 1992, and 1993. Totals for all crimes by type of institution are included. The assessment of plant safety lists each institution and notes whether safety reports had been, received from each. The summary of findings notes the following: (1) for state universities, homicides, forcible sex offenses, aggravated assaults, and burglary all declined from 1992 to 1993 while robberies, larceny, and motor vehicle theft increased; (2) for community colleges, aggravated assault and burglary decreased while all other categories increased;(3) for independent colleges and universities, there were decreases in robberies and aggravated assaults though sex offenses, burglary, larceny, and motor vehicle theft increased. Appendixes detail the statutory reporting provisions, offer guidelines for completing reports, and define offenses. (JB)

3 SUMMARY OF FINDINGS

The Florida Postsecondary Education Security Information Act requires the Commissioner of Education to convey to the President of the Senate and the Speaker of the House of Representatives an annual report on campus crime statistics of crimes reported to have occurred on the campuses of the community colleges, state universities, and the independent colleges and universities of Florida, and an annual assessment of physical plant safety provided by the state universities and the independent colleges and universities of Florida: Community colleges are not required to report on physical plant safety.Institutions are required to make their campus crime statistics available to the public upon request.

The aggregated data for 1992 and 1993 for the state universities show decreases in Homicides from 3 to 1; Forcible Sex Offenses, from 24 to 19; Aggravated Assaults, from 158 to 106; and Burglary/Breaking and Entering, from 434 to 412. In all other categories, the number of reported incidents increased. Robberies increased from 31 to 45; Larceny/Theft increased from 3664 to 3712; and Motor Vehicle Theft increased from 282 to 321.

Community colleges showed decreases in the number of incidents of Aggravated Assault from 58 to 53 and Burglary/Breaking & Entering from 305 to 192. In all other categories, the number of reported incidents increased. Homicide Offenses increased from 0 to 1; Forcible Sex Offenses, from 3 to 5; Robbery, from 8 to 21; Larceny/Theft, from 1599 to 1744; and Motor Vehicle Theft, from 305 to 316.

For the independent colleges and universities that reported campus crime statistics for both 1992 and 1993, there were no Homicide Offenses. Reported decreases included Robberies which decreased from 49 to 18 and Aggravated Assaults which decreased from 115 to 86. Forcible Sex Offenses increased from 9 to 12; Burglary/Breaking and Entering increased from 266 to 279; Larceny/Thefts, from 1496 to 1674; and Motor Vehicle Thefts, from 166 to 180.

This Report on Campus Crime Statistics includes offenses which were reported to have occurred on property controlled or owned by the institution.It does not reflect those crimes against students nor the crimes committed off the premises of the campus in the surrounding areas. Only Part I Mandatory Offenses as defined by the Florida Department of Law Enforcement Uniform Crime Reporting Program are included. The Assessment of Physical Plant Safety reports are not standardized as to format to allow the necessary flexibility for reporting on a wide variety of institutional types and sizes. A brief table indicates whether or not the independent colleges and universities submitted the Physical Plant Safety Report. No attempt is made to summarize the content of the Physical Plant Safety Reports.

24 STATUTORY PROVISIONS

Section 240.2682, Florida Statutes. Florida Postsecondary Education Security Information Act. (1) This act may be c 'ted as the "Florida Postsecondary Education Security Information Act." (2) For the purposes of this act, "postsecondary institution" means a state university identified in s. 240.2011, a nonpublic college or university licensed pursuant to s. 246.081, or a nonpublic college or university exempt from licensure pursuant to s. 246.085. History.s 1 ch 80-142.

Section 240.2683, Florida Statutes. Report on campus crime statistics.- - (1) Each postsecondary institution shall prepare an annual report of campus crime statistics for submission to the respective governing or licensing boards of jurisdiction. The data for these reports may be taken from the Florida Department of Law Enforcement Annual Report. The Department of Education shall prescribe the format for institutional submission. The Board of Regents and State Board of Independent Colleges and Universities shall compile the reports and convey the aggregate institutional reports to the Commissioner of Education. (2) Each postsecondary institution shall prepare a report of crime statistics as reported under subsection (1) for the most recent 3-year period. The report shall be updated annually. The institution shall give notice that this report is available upon request. History.--s 2 ch 89-142.

Section 240.2684, Florida Statutes. Assessment of physical plant safety.- The president of each postsecondary institution shall conduct or cause to be conducted an annual assessment of physical plant safety. An annual report shall incorporate the findings obtained through such assessment and recommendations for the improvement of safety on each campus. The annual report shall be submitted to the respective governing or licensing board of jurisdiction no later than January 1 of each year. Each board shall compile the individual institutional reports and convey the aggregate institutional reports to the Commissioner of Education. The Commissioner of Education shall convey these reports and the reports required in s. 240.2683 to the President of the Senate and the Speaker of the House of Representatives no later than March 1 of each year. Section 240.3815, Florida Statutes. Report of campus crime statistics.- - (1) Each community college shall prepare an annual report of statistics of crimes committed on its campus and shall submit the report to the State Board of Community Colleges. The data for these reports may be taken from the annual report of the Department of Law Enforcement. The Department of Education shall prescribe the form for submission of these reports. The State Board of Community Colleges shall compile the reports and convey the aggregate institutional data from the reports to the Commissioner of Education. (2) Each community college shall prepare annually a report of statistics of crimes committed on its campus for the preceding 3 years. The community college shall give students and prospective students notice that this report is available upon request. History.--s 8 ch 90-302.

25 GUIDELINES FOR COMPLETING THE ANNUAL REPORT OF PHYSICAL PLANT SAFETY

Each president of each state university identified in Section 240.2011, Florida Statutes, and each nonpublic college or university licensed pursuant to Section 246.081, Florida Statutes, and each nonpublic college or university exempt from licensure pursuant to Section 246.084, Florida Statutes, is required to conduct or cause to be conducted an annual assessment of physical plant safety.

An annual report shall incorporate the findings obtained through such assessment and recommendations for the improvement of safety on each campus. No particular form or format will be provided for completing the required annual report. This will be left to the discretion of the presidents.

The annual reports are to be submitted by the presidents to the appropriate governing or licensing board of jurisdiction no later than January 1, 1995.

27 26 GUIDELINES FOR COMPLETING THE ANNUAL REPORT OF CRIME STATISTICS

Sections 240.2683 and 240.3815, Florida Statutes, provide that all community colleges, state universities, and independent colleges and universities are required to report campus crime statistics for a three year period of time. The data for these reports may be taken from the Florida Department of Law Enforcement Annual Report, 'Crime in Florida,' or must otherwise be compatible with that report as to the definition of the crimes reported.

For purposes of this requirement, each institution shall provide the number of crimes which were reported to have occurred in any facility of the institution or on any property owned or under the control of the institution within the State of Florida during the year for which the report applies.

Only the Part I Mandatory Offenses, as defined by the Florida Department of Law Enforcement Uniform Crime Reporting Program, shall be included in the report.In a case where an institution does not have its own police force, it will be necessary for the institution to obtain the required information from law enforcement agencies. Information must be requested by geographic location to appropriately reflect campus boundaries. In cases where institions have multiple campuses or educational centers, it may be necessary to combine information obtained from more than one law enforcement agency..

The annual reports are to be submitted by the preidents to the appropriate governing or licensing board by January 1, 1995. The institutions must give notice to interested parties that the report is available upon request.

29 28 DEFINITIONS: Part I MANDATORY OFFENSES As Defined by the Florida Department of Law Enforcement Uniform Crime Reporting Program

I. HOMICIDE OFFENSES

MURDER AND NON-NEGLIGENT MANSLAUGHTER

DEFINITION: The killing of one human being by another.

GENERAL RULE: Any death due to a fight, argument, quarrel, assault, commission of a crime or by premeditated design.

SPECIAL INSTRUCTIONS: The natural death of a person during the commission of a crime is not reported. Do not report suicides or accidental deaths. Should one be inadvertently reported, delete it when it becomes known. Attempted murder offenses should be classified as an assault rather than homicide. Justifiable homicides are not to be included in this category.

II. SEX OFFENSES, FORCIBLE

DEFINITION: Any sexual act directed against another person, forcibly and/or against that person's will; or not forcibly or against the person's will where the victim is incapable of giving consent.

GENERAL RULE: The element of force or threat of force is necessary before a sexual offense is reported in this category. Any sexual act or attempt accomplished by force is classified as a forcible sex offense regardless of the age of the victim or the relationship of the victim to the offender.

A. FORCIBLE RAPE

DEFINITION: The carnal knowledge of a female, by a male, forcibly and against her will or where the victim is incapable of giving consent because of her youth or because of her temporary or permanent mental incapacity.

SPECIAL INSTRUCTIONS: The Sexual Battery Statute - The forcible rape classification falls under the State's sexual battery statute. This statute covers many sexual acts that do not meet the criteria of rape.It is recommended that each case of sexual battery be reviewed to determine whether or not a rape has occurred. Sexual acts covered by Part I Mandatory Offenses (continued)

the sexual battery statute that will not be reported under this classification include a) adultery and fornication where no force is used; b) incest where no force is used, and the victim is old enough to consent to the act; c) sodomy; d) sexual abuse where no force or threat of force can be determined; e) fellatio; f) cunnilingus; and g) statutory rape where the female victim is under the legal age of consent.

B. FORCIBLE SODOMY

DEFINITION: Oral or anal sexual intercourse with another person, using either personal sex organs or objects to commit the act, forcibly and/or against that person's will; or not forcibly or against the person's will where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental incapacity.

C. FORCIBLE FONDLING/INDECENT LIBERTIES/CHILD MOLESTING

DEFINITION: The touching of the private body parts of another person, using either an object or human contact to commit the act, for the purpose of sexual gratification, forcibly and/or against the person's will; or not forcibly or against the person's will where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental incapacity.

III. ROBBERY

DEFINITION: The taking, or attempting to take, anything of value under confrontational circumstances from the control, custody or care of another person by force or threat of force or violence, and/or by putting the victim in fear.

GENERAL RULE: As a general rule, robbery differs from larceny in that it is aggravated by the element of force or threat of force to the victim. The victim, who usually is the owner or person having custody of the property, is directly confronted by the perpetrator and is threatened with force or fear that force will be used.

IV. AGGRAVATED ASSAULT

DEFINITION: An unlawful attack by one person upon another where either the offender displays a weapon, or the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration or loss of consciousness.

GENERAL RULE: As a general rule, all felonious and aggravated assaults will be classified in this category. Do not include assaults with the intent to rob or rape. Attempts to commit these crimes will be reported in .the categories of robbery or rape.

An assault, or threat of an assault, with any weapon or item used as a weapon other than hands, fists and feet, will be classified as an aggravated assault.It is not necessary that injury be inflicted.

When personal weapons (hands, fists and feet, etc.) are used, the victim must be seriously injured by personal weapons. Usually, this involveS a broken bone or injury so severe that the victim should be admitted to a hospital beyond mere emergency room treatment. This is the type of offense that would ordinarily be tried in a felony court.

SPECIAL INSTRUCTIONS: In most instances the initial facts will be sufficient to clearly establish the proper classification of an assault. Careful consideration of the following factors should clarify the classification of an aggravated assault: 1) the type of weapon used or the use made of an object as a weapon; 2) the seriousness of the injury; 3) the intent of the assailant to cause serious injury (especially in classifying acts by young children.) An assault exists when there is the threat and the ready ability to carry out a threat. Any attempted assaults may be optionally reported as an intimidation, rather than as an assault.

V. BURGLARY/BREAKING AND ENTERING

DEFINITION: The unlawful entry into a building or other structure with the intent to commit a felony or theft.

GENERAL RULE: As a general rule, report as one offense any unlawful entry or attempted forcible entry of any dwelling house, attached structure, public building, shop, office, factory, storehouse, apartment, house trailer, warehouse, mill, barn, other building, ship or railroad car.If there is apparent unlawful entry and the offender has not completed an act or the actions or intent of the offender are unknown, it should be reported as a burglary. Any time there is an uncertainty as to why entry was made to a structure, it should be reported as a burglary.

SPECIAL INSTRUCTIONS: Breaking into a vehicle, a telephone booth or certain other coin operated device is to be reported as larceny rather than as breaking and entering. The unlawful entry of a tent, camping trailer, mobile home on a sales lot, a house under construction that is not capable of being closed should be reported as larceny since the breaking and entering classification applies only to permanent buildings capable of being closed.

VI. LARCENY/THEFT OFFENSES

DEFINITION: The unlawful taking, carrying, leading or riding aw,4 of property from the possession, or constructive possession, of another person.

GENERAL RULE: All larcenies and thefts resulting from the following will be counted here: pocket picking, purse snatching, shoplifting, larceny from motor vehicles, theft of bicycles, larceny from buildings, larceny from any coin operated machines and 'all other* type larcenies.

Embezzlement, fraudulent conversion of entrusted property, conversion of goods lawfully possessed by bailees, lodgers, or finders of lost property, obtaining money or property by false pretenses, larceny by check, larceny after trust, larceny by bailee are all to be classified in the appropriate crime category of Fraud or Embezzlement.

A. POCKET PICKING - The theft of articles from another person's physical possession by stealth, where the victim usually does not become immediately aware of the theft.

B. PURSE-SNATCHING - The grabbing or snatching of a purse, handbag, etc., from the physical possession of another person.

C. SHOPLIFTING - The theft by a person, other than an employee of the victim, of goods or merchandise exposed for sale.

D. THEFT FROM A BUILDING A theft from within a building which is either open to the general public or where the offender has legal access.

E. THEFT FROM COIN-OPERATED MACHINE OR DEVICE - A theft from a machine or device which is operated or activated by the use of a coin or token.

F. THEFT FROM MOTOR VEHICLE (Except motor vehicle parts/accessories) - The theft of articles from a motor vehicle, whether locked or unlocked.

G.All other larceny.

VII. MOTOR VEHICLE THEFT

DEFINITION: Theft of a motor vehicle.

GENERAL RULE: The theft of a motor vehicle will be reported. in this category. Thefts involving the following types of motor vehicles will be included: Automobile, bus, camper/recreational vehicle, truck/van, motorcycle, other self- propelled object used for transporting passengers or cargo. This category does not include bicycles, equipment built for construction or farming purposes.

SPECIAL INSTRUCTIONS: A vehicle stolen entry will be required for all committed motor vehicle thefts reported. A vehicle stolen entry will not be valid for an attempted motor vehicle theft. Joy riding incidents should be classified as a committed motor vehicle theft with the vehicle being shown as stolen and recovered.
