DEDICATION My dissertation is dedicated to my parents, Roger and Frances Chase, and my brother Paul. First, to my loving parents who made it possible for me to realize my dream. It was through their belief and faith in me, and their enduring emotional and financial support that enabled me to persevere and complete my Ph.D. program. They have always been and have remained unselfish with their expressions of love, devotion, and inspiration. Thank you, mom and dad. To my brother, Paul who, along with my parents, has been my biggest fan and cheerleader throughout this process. His pride in my achievements and endless words of praise and encouragement provided me with the additional strength I needed to accomplish my goal. He has always been a wonderful brother and loyal friend. Thank you, Paul. iii Reproduced with permission of the copyright owner. Further reproduction prohibited without permission. ABSTRACT Personal plight legal practice includes all legal work for individual clients whose needs arise from disputes. This is the site of our worst access to justice problems. The goal of this project is to identify sustainable innovations that can make the services of personal plight law firms more accessible to all Canadians. Accessibility is vitally important, but it is not the only thing that matters in personal plight legal practice. Thus, this book seeks out innovations that not only improve accessibility, but also preserve or enhance service quality as well as law firms’ profitability.

Retributive Hatred as a Reactive Moral Attitude Jeramy S. Gee A dissertation submitted in partial fulfillment of the degree of Doctor of Philosophy University of Washington 2014 Reading Committee: Jean Roberts (Chair) Stephen Gardiner Ingra Schellenberg Cass Weller Program Authorized to Offer Degree: Department of Philosophy ©Copyright 2014 Jeramy S. Gee University of Washington Abstract Retributive Hatred as a Reactive Moral Attitude Jeramy S. Gee Chair of the Supervisory Committee: Professor Jean Roberts Department of Philosophy Philosophers’ attention to negative attitudes has grown in recent decades. However, whereas philosophers have offered a number of descriptions of, and justifications for, attitudes like resentment and contempt, hatred is usually met with antipathy even when we might be inclined to be sympathetic to the hater. In this dissertation I offer a sustained examination of hatred I and make a rather startling claim: There are cases of hatred that are morally justifiable. The kind of hatred I defend is what some philosophers have called retributive hatred. This is hatred adopted in response to wrongdoing and in which hostility is driven by a retributive notion of moral desert. To make my case I argue that retributive hatred is distinguishable from such attitudes as prejudicial hatred, malice, and spite—attitudes with which it is often confused—and that it is not liable to the kinds of criticisms that can be levied against these types of hatred. I then show that retributive hatred should be classified among the reactive attitudes. Thus there are conditions governing when retributive haters can be understood as properly representing their targets as hateful and I argue that these conditions can be met.

  • A Marquette Lawyer
FOUR MODELS OF WHAT IT MEANS TO BE A MARQUETTE LAWYER At Marquette Law School’s annual alumni awards event on April 3, 2019, at Eckstein Hall, Dean Joseph D. Kearney referred to the four recipients as “anomalies.” In fact, he applied that term to all of the several hundred people who attended the program. “There is no requirement that anyone remain involved with his or her law school, years after graduation,” Kearney said. He said that he was happy to label the alumni being honored as “anomalies” who didn’t float on the ebbing tide that, as time passes, carries many lawyers far away from connections to the law school from which they graduated. The four award recipients have followed diverse career paths, each with great success. But the bond they still feel to Marquette Law School—and the ways they continue to show this—brought them together. In the words of Marquette University’s President Michael R. Lovell in introducing the event, the awards “honor what makes Marquette great—that is, our graduates and the work that they do, going out to change the world.” Here are edited excerpts from the presentations given about each of the recipients and the recipients’ acceptance speeches. ALUMNA OF THE YEAR JUSTICE ANNETTE ZIEGLER, L’89 From Dean Joseph D. Kearney The Honorable Annette Kingsland Ziegler arrived to law school and the legal profession largely without direct examples: In particular, she had no lawyers in her family. At the same time, she brought parts of her upbringing to the endeavor: Among other things, a job in the hardware store that her parents owned outside Grand Rapids, Michigan, gave her both considerable experience in working with people and an appreciation of the value of hard work.

Caudillo Justice: Intercultural Conflict and Social Change in Santa Fe, New Mexico, 1837-1853. Dissertation Presented in Partial Fulfillment of the Requirements for the Degree Doctor of Philosophy in the Graduate School of The Ohio State University By Michael J. Alarid, MA Graduate Program in History The Ohio State University 2012 Dissertation Committee: Randolph Roth, Advisor Kenneth Andrien John F. Guilmartin Copyright by Michael Joseph Alarid 2012 ABSTRACT This project is the story of the Hispanos in New Mexico who were caught within the maelstrom of American colonization, of complex peoples with their own power structures who occupied a space in the path of a burgeoning empire. More specifically, this is the tale of how an ethnically distinct, religiously different, and politically and economically savvy people endured the process of American colonization. My focus is 1837 to 1853, and I examine the relationship between Hispanos and incoming immigrants; first from Mexico and later from the United States. I seek to challenge previously held notions about how the process of territorialization played out in Santa Fe County and New Mexico more broadly during both the Mexican and American periods. I argue that the New Mexican “elites” were in actuality Mexican caudillos: local strongmen who utilized their vast kinship networks and wealth to dictate regional policy – providing protection to the local population when it was in their best interest, exploiting and intimidating them when it was not. My approach considers multiple variables, such as class, race, economy, criminality, resistance, and accommodation, as well as how each of these variables influenced the strategies and actions of multiple social groups – New Mexican landholders, poor vecinos, Anglo settlers, and the territorial authorities in Santa Fe County.
