I was only a teenager then and I was fortunate to become friends witH several of tHe refugee kids from these families. At tHe time, tHe violence tHat spread across tHe former Yugoslavia seemed incomprehensible to me, and I decided to Help collect and send aid packages with the local German Red Cross to the war-torn region. WHile in High school and as an undergraduate student, I tried to study and understand tHe roots of tHe conflict, tHe gross human rights violations and the aftermath. A decade later, I eventually travelled to Sarajevo in Bosnia and Herzegovina to visit a friend, Jasmina Viteškić. I had met her a few years earlier in San Francisco, before she moved back to Her Hometown to work as a trial monitor for the Organization for Security and Cooperation in Europe (OSCE). My visit turned out to be physically and emotionally overwHelming. I witnessed not only the beauty of a city surrounded by the Dinaric Alps in tHe Sarajevo valley witH lavisH forests and tHe Miljacka River, but also the deep social, political and economic scars of a war that ravaged the city and region for many years. THese experiences in tHe Balkans and tHe recent conflict fueled my interest in further studying accountability efforts in the former Yugoslavia and pursuing this topic as part of my Ph.D. program. My dissertation took sHape molded by tHese experiences and motivated by a desire to better understand how people in the Balkans understood the cataclysmic events of the past two decades and used a variety of transitional justice mechanisms to address the legacies of the conflict. As a Ph.D. student in Political Science at Mason, I Had many opportunities to conduct research on post-conflict and transitional justice in the Balkans. THe Human Rights and Global Justice Working Group at tHe Center for Global Studies in particular was a great space and platform to interact with like-minded scholars to discuss how transitional societies across the world coped with the legacies of violence. Under the direction of the working group leader, Dr. Jo-Marie Burt, I also Helped organize over Half a dozen events related to accountability and transitional justice, including conferences on “Human RigHts Tribunals in Latin America: the Trial of Fujimori in Comparative Perspective” (2008), “Accountability After Mass Atrocity: Latin American and African Examples in Comparative Perspective” (2009) and “Arts after Atrocity: Global Human Rights and Local Representations of Violence and Resistance” (2012), among others. This scholarly exposure, together with my long-held interest in the Balkans, helped shape my ideas and develop my research. iv In this context, I would like to thank my dissertation advisor Dr. Jo-Marie Burt from the Department of Public and International Affairs (PIA) at Mason for Her continuous support, availability and flexibility wHile researching and writing my dissertation. I am indebted to the other members of my committee as well, Dr. JoHanna Bockman from tHe Department of Sociology and Anthropology at Mason and Dr. Peter Mandaville from PIA, wHose timely and constructive feedback helped clarify my ideas and shape my argument over the years. Earle Reybold’s advice, from the College of Education and Human Development at Mason, inspiring me to use a combination of different qualitative methods to find adequate answers to my research puzzles. Outside the Mason community I am appreciative of a Foreign Language and Area Studies grant, allowing me to enroll in an intensive Bosnian-Croatian-Serbian language class in the summer 2009 at Indiana University in Bloomington; as well as an American Council of Learned Societies grant to conduct preliminary fieldwork in tHe Balkans in tHe fall 2009. In this context I would also like to thank Dr. Lidija Cvikić, a linguistic professor from the University of Zagreb who helped me get settled in Croatia. A gendered analysis of transitional justice, with a case study on Bosnia and Herzegovina Author: Anisa Bina Supervisor: Jonatas Machado Co-Supervisor: Carla Marcelino Gomes Abstract This work will seek to prove that even though women are left out of transitional justice processes, and their agency is left unrecognized, through their own initiative they prove to be active agents of change and work towards bringing justice to the community. Transitional justice is not only an opportunity for rebuilding the society, but also for eliminating inequalities, and changing traditional gender roles. Women have been entirely absent or highly underrepresented throughout transitional justice processes, while their presence is reduced to passive victimhood, leaving their agency unrecognized. This work assesses the gendered implications in transitional justice, and seeks to explore the reasons for the exclusion of women by analysing how masculinity impacts war, and the ways this flows as a continuum in the post-conflict period. The first chapter defines and analyses transitional justice efforts in Bosnia and Herzegovina, while the second chapter analyses the gendered implications of the war in Bosnia. The third chapter will establish the link between transitional justice and gender, while the final chapter will implement this analysis to the role of women in transitional justice processes in Bosnia and Herzegovina. Abstract This is a novel study of the German press’ visual and textual coverage of the wars in Bosnia (1992-95) and Kosovo (1998-99). Key moments have been selected and analysed from both wars using a broad range of publications ranging from extreme-right to extreme-left and including broadsheets, a tabloid and a news-magazine, key moments have been selected from both wars. Two sections with parallel chapters form the core of the thesis. The first deals with the war in Bosnia and the second the conflict in Kosovo. Each section contains one chapter on the initial phase of the conflict, one chapter on an important atrocity – namely the Srebrenica Massacre in Bosnia and the Račak incident in Kosovo – and lastly a chapter each on the international involvement which ended the immediate violence.

In early 2010, the National Stability and Reconciliation bill was officially promulgated, granting immunity from criminal prosecution to people who committed serious human rights violations and war crimes over the past thirty years. In March 2007, a coalition of powerful warlords in parliament pushed through the amnesty law to prevent prosecution of individuals responsible for large-scale human rights abuses in the preceding decades. It was not publicized and promulgated until early 2010. It was revived in 2010 to facilitate amnesties for reconciliation and reintegration of the Taliban and the islamist political party Hezb-i Islami Gulbuddin. In the absence of a practical justice system to address the lack of accountability by the warring parties, the government was urged to ask the International Criminal Court to investigate allegations of war crimes and crimes against humanity committed by all parties to the conflict.

    International Decision-Making in the Age of Genocide: Srebrenica 1993-1995 Rapporteur Report The Hague June 29-July 1, 2015 International Decision-Making in the Age of Genocide: Srebrenica 1993-1995 Conference in The Hague, June 29 – July 1, 2015 Executive Summary Leading decision-makers from more than a dozen countries gathered in The Hague from June 29 to July 1, 2015, to consider the failure of the international community to protect the United Nations “safe area” of Srebrenica, resulting in the largest massacre in Europe since World War II. Participants included three former members of the UN Security Council, senior government and UN officials, peacekeepers, and eyewitnesses to the Srebrenica tragedy. Over the course of four working sessions, a public event, and numerous informal meetings, conference participants focused on a disastrous two-year chain of events that culminated in the fall of Srebrenica in July 1995. They examined the origins of the “safe area” policy, beginning with the March 1993 visit to Srebrenica by French General Philippe Morillon, and disagreements on how to implement frequently impractical Security Council resolutions. The discussion revealed sharp disconnects between the policy-makers in New York, the peacekeepers on the ground, and the people the “safe areas” were ostensibly designed to keep safe. “I saw this conference as a kind of truth commission,” said Srebrenica survivor Muhamed Duraković. “Twenty years on, we cannot bring back the dead, but we can learn from what went wrong in Srebrenica. If we are not able to go through the process of fact-finding, truth, and reconciliation, we may be creating problems for future generations.” At the heart of the international failure in Srebrenica in July 1995 was the inability of the major powers to devise and implement an agreed strategy for ending the defining conflict of the immediate post-Cold War era.

NATIONAL CRIME COMMISSION CONFERENCE E. R. CASS2 Crime, from whatever standpoint it is considered, is seen to transcend in importance most of the other great problems of the day. It is a more complex, phenomenon than is generally supposed, and is a constant source of degradation of public and private morality. The citizens of many states have been aroused because of crime, more particularly spectacular crime, and the many statements, some accurate, and too many inaccurate, relative to it and the treatment of the criminal. Attempts to determine the exact *crime situation and its causes bring forth marked differences of opinion. Many reforms are proposed, and cover the entire range of administrative activities from the pblice to the final Court of Appeals, and even the conduct of governors in criminal matters. Each separate official agency dealing with crime defends its methods and attempts to place the responsi- bility elsewhere.

  • Day of Remembrance for Srebrenica
    Proclamation WHEREAS, both the United States Senate and the United States House of Representatives passed resolutions acknowledging the genocide that the Serbian forces perpetrated in Srebrenica, and all of Bosnia and Herzegovina, from 1992 to 1995; and WHEREAS, July 11, 2015, is commemorated as the 20th anniversary of the Srebrenica massacre in which at least 8,372 innocent Bosniak civilians were summarily executed and 30,000 were expelled from their homes in the worst atrocity in Europe since the Holocaust; and WHEREAS, this anniversary raises awareness of the tragic suffering of the Bosnian people and honors and remembers those who died as a result of the policies of ethnic cleansing and aggression; and WHEREAS, on July 11, 1995, the Bosnian town of Srebrenica in Bosnia and Herzegovina, at the time a UN “safe area” under international protection, fell to invading Serbian forces; and WHEREAS, Bosnian Serb forces deported women, children, and the elderly in buses, held Bosnian Muslim, or Bosniak, males over 16 years of age at collection points and sites in north eastern Bosnia and Herzegovina under their control, and then summarily executed and buried the captives in mass graves; and WHEREAS, the greater Vancouver area is home to more than one thousand Bosnian immigrants - primarily Bosnian Muslims, or Bosniaks - who were displaced during the 1992-1995 war; and WHEREAS, many Vancouver residents and organizations, including churches, mosques, synagogues, and grassroots organizations, welcomed Bosniak refugees and assisted in their resettlement; and WHEREAS, regardless of who is perpetrator or victim, all war crimes must be condemned, victims remembered, and justice pursued; and WHEREAS, the City of Vancouver recognizes the importance of this event to bring closure for the Bosnian people through justice and truth.

The district court dismissed the UN as party to the suit, basing this decision on the organization’s statutory immunity from pros- ecution. As a basis for holding the Netherlands liable for Dutchbat’s actions, the district court utilized the effective control standard.
