Πρόκειται για άντρες της ΕΕΦ. Διακρίνονται όλοι όσοι έλαβαν μέρος στην πτώση της Σρεμπρένιτσα, εκτός από τον Βασίλη Σχιζά, που φαίνεται δεν τον έπιασε η κάμερα (υπάρχει, όμως, σε άλλη φωτογραφία από εκείνη τη μέρα, όταν μαζί με δύο άλλους κάνουν κάτι [2]αηδιαστικά αστεία με μια κεφαλή γουρουνιού, ύψιστη προσβολή για τους Μουσουλμάνους), και τον διοικητή της ΕΕΦ Αντώνη Μήτκο με τον βοηθό του Καλτσούνη Κωνσταντίνο, που εκείνες τις ώρες, σύμφωνα με στοιχεία από τις δίκες στο Ποινικό Δικαστήριο της Χάγης, συνόδευαν στις μετακινήσεις του τον Σερβοβόσνιο διοικητή της ΕΕΦ και υψηλόβαθμο στέλεχος-κλειδί στον σερβοβοσνιακό στρατό Ζβόνκο Μπάγιαγκιτς (Zvonko Bajagic) ή ’Duga puska’. Στη σκηνή από την ολλανδική δημόσια τηλεόραση, βλέπουμε τους Ελληνες της ΕΕΦ, να ετοιμάζονται για διασπορά στις περιοχές γύρω απ’ την Σρεμπρένιτσα όπου είχαν καταφύγει οι άντρες πρόσφυγες και οι υπερασπιστές της πόλης. Πρόκειται για επιχειρήσεις, κυρίως για στήσιμο ενεδρών κυνηγιού μουσουλμανικών κεφαλών, από σερβικά αποσπάσματα θανάτου, όπως αποδείχτηκε τις επόμενες μέρες. Διακρίνεται να περνάει δεύτερος ο χρυσαυγίτης λοχίας της ΕΕΦ Σπύρος Τζανόπουλος, τρίτος ο Ελληνορουμάνος Αννα Φλορίν και οι άλλοι τρεις είναι οι Κυριακίδης Κ., Λυμπερίδης Γ. και Δημουλάς Xαράλαμπος. Στη δεύτερη σκηνή του Associated Press (απ’ το 0.44’ και μετά), την ίδια μέρα, διακρίνονται οι άνδρες της ΕΕΦ μαζί με ένοπλους και άλλους παραστρατιωτικούς από το 10ο Απόσπασμα Σαμποτάζ (10 Di- verzantski Odred, 10th Sabotage Detachment) [Σ.Σ.: Στη συνέχεια θα δώσουμε λεπτομέρειες σχετικά με το ποιοι ακριβώς ήταν αυτοί]. Πρώτος περνάει ο υποδιοικητής Βασιλειάδης Τρύφων, ο οποίος αποστρέφει ελαφρώς το πρόσωπό του μόλις αντιλαμβάνεται την κάμερα, ποιος ξέρει για ποιο λόγο. Το 10ο Απόσπασμα Σαμποτάζ, στο οποίο υπερήφανα υπηρετούσαν δύο από τους Ελληνες της ΕΕΦ, ο ένας εκ των οποίων ήταν ο Αγγελος Λάτσιος, ήταν η πιο αιμοσταγής μισθοφορική παραστρατιωτική μονάδα (1.200 εκτελέσεις σε 5 ώρες, προς 5 μάρκα το κεφάλι, μόνον οι 4 απ’ αυτούς έφαγαν 142 χρόνια φυλακή για εγκλήματα πολέμου). In 1991 Croatia, Slovenia Serbia and promoter of the genocide in Bosnia-Herzegovina and Macedonia declared independence. Bosnia became an independent nation in 1992. The largest population of Bosnia was made up of Muslims, while Serbs became the minority, accounting for about 32% of the Bosnian population. Once Bosnia was declared an independent nation, many of the Serbs residing in Bosnia were angry and decided to take action. Between April 1992 and November 1995, Serbia set out to remove all Bosnian Muslims. About 200,000 lives were lost during the Bosnian genocide.

    BALKAN January 8, 2004 Page 6 VIEW FROM THE HAGUE SIEGE OF SARAJEVO ENDANGERED CIVILIANS On 5 December this year, the International Criminal Tribunal for the former Yugoslavia sentenced General Stanislav Gali ć to 20 years in prison for spreading terror among the civilian population during the siege of Sarajevo. The city of Sarajevo was under siege for about three and a half years. For almost two years of that time, from September 1992 to August 1994, General Gali ć was the commander of a branch of the Army of Republika Srpska (VRS), called the Sarajevo Romanija Corps, or SRK, which had virtually encircled Sarajevo. Parts of the city were controlled by the Army of Bosnia and Herzegovina. The Prosecution alleged that the SRK under General Gali ć's command conducted a campaign of sniping and shelling attacks on civilians in Sarajevo. Under international humanitarian law war as such is not considered unlawful. However, certain principles of warfare apply that military commanders must respect. One such principle obliges military commanders to distinguish between military objectives, on the one hand, and civilians, on the other, and not to attack civilians under any circumstances. And yet, the SRK's campaign resulted in a large number of deaths and injuries to civilians. The Tribunal Prosecution alleged that the SRK, under General Gali ć's command deliberately killed and injured civilians in order to terrorize them. Terrorising civilians Terrorising civilians during armed conflict is specifically prohibited by Article 51 of Additional Protocol I to the Geneva Conventions of 1949. The former Yugoslavia ratified this protocol in 1978.

During the war in Croatia, the tension increased between the Serbs and the communities of Bosniaks and Croats. Bosniaks and Croats began to leave the municipality because of a growing sense of insecurity and fear amongst the population which was caused by Serb propaganda which became increasingly visible. Atrocities McAllister Hard Lessons from the Yugoslav Tribunal How can the interna- tional community deter government and rebel forces from committing atroc- ities against civilians? Long after liberated Nazi concentration camp survivors held up the ªrst sign declaring, “Never Again!” civilians have faced genocide during civil wars around the world, from Bangladesh to the former Yugoslavia, and more recently in northern Iraq. Sexual violence, torture, and forced dis- appearances are among the other horrors that civilians continue to endure in wartime. In the 1990s, international ofªcials sought to respond to such suffering by es- tablishing a new generation of wartime international criminal tribunals (ICTs), starting with the International Criminal Tribunal for the former Yugoslavia (ICTY) in 1993. The ICTY paved the way for the establishment of the perma- nent International Criminal Court (ICC) ªve years later. Unlike earlier ICTs in Nuremberg and Tokyo, as well as more recent war crimes tribunals in Rwanda, Sierra Leone, Cambodia, East Timor, Lebanon, Bosnia, and Kosovo, the ICTY and the ICC are mandated to prosecute international criminal law violations committed in the context of active armed conºicts. In granting the ICTY and the ICC such authority, their founders hoped that the tribu- nals would deter combatants in those conºicts from perpetrating violence against civilians.1 Nevertheless, more than twenty-ªve years after the ICTY opened its doors, international justice scholars continue to debate the role of wartime tribunals in deterring atrocities against civilians, particularly in ongoing conºicts. Growing up, Sara was told that her father died as a war hero during the Bosnian war. She took pride in his death, and used his patriotism to hold herself to a high standard of honor.     ANNEX 4: MECHANISMS IN EUROPE INTERNATIONAL CRIMINAL TRIBUNAL FOR THE FORMER YUGOSLAVIA Conflict Background and Political Context The Socialist Federal Republic of Yugoslavia (SFRY) emerged from World War II as a communist country under the rule of President Josip Broz Tito. The new state brought Serbs, Croats, Bosnian Muslims, Albanians, Macedonians, Montenegrins, and Slovenes into a federation of six separate republics (Slovenia, Croatia, Bosnia and Herzegovina, Macedonia, Montenegro, and Serbia) and two autonomous provinces of Serbia (Kosovo and Vojvodina). Ten years after Tito’s death in 1980, the country was in economic crisis and the mechanisms he had designed to both repress and balance ethnic demands in the SFRY were under severe strain. Slobodan Milošević had harnessed the power of nationalism to consolidate his power as president of Serbia. The League of Communists of Yugoslavia dissolved in January 1990, and the first multiparty elections were held in all Yugoslav republics, carrying nationalist parties to power in Bosnia, Croatia, Slovenia, and Macedonia.1763 Meanwhile, Milošević and his political allies asserted control in Kosovo, Vojvodina, and Montenegro, giving Serbia’s president de facto control over four of the eight votes in the federal state’s collective presidency. This and the consolidation of Serbian control over the Yugoslav People’s Army (YPA) heightened fears and played into ascendant nationalist feelings in other parts of the country. Declarations of independence by Croatia and Slovenia on June 25, 1991, brought matters to a head. Largely homogenous Slovenia succeeded in defending itself through a 10-day conflict that year against the Serb-dominated federal army, but Milošević was more determined to contest the independence of republics with sizeable ethnic Serb populations.

Two sections with parallel chapters form the core of the thesis. The first deals with the war in Bosnia and the second the conflict in Kosovo. Each section contains one chapter on the initial phase of the conflict, one chapter on an important atrocity – namely the Srebrenica Massacre in Bosnia and the Račak incident in Kosovo – and lastly a chapter each on the international involvement which ended the immediate violence.
