(JMC), Helix Innovations (Helix) and Sherman’s 1400 Broadway N.Y.C., LLC (Nat Sherman) Overview Effective June 1, 2020, Retailers in Massachusetts will be prohibited from selling certain “flavored” tobacco products, including menthol, mint and wintergreen tobacco products, to adult tobacco consumers. Per the recent changes to the Massachusetts Tobacco Control Law (MTCL), AGDC is providing a list of the Altria Tobacco Operating Companies’ tobacco products it believes may continue to be sold by Retailers in Massachusetts after June 1, 2020. Details Per the requirements of MTCL 105 CMR 665.010(E), the PM USA, Nat Sherman, USSTC, JMC and Helix tobacco products that should continue to be available for sale after June 1, 2020 are listed in Attachment A to this communication. The tobacco products listed in Attachment A do not qualify as “flavored tobacco products” as defined in the MTCL. It is our position that Retailers may continue to merchandise, advertise and sell the tobacco products listed in Attachment A to adult tobacco consumers in Massachusetts after June 1, 2020. Retailer Action Per the requirements of MTCL 105 CMR 665.010(E), Retailers should maintain this communication, including Attachment A, “within the retailer establishment.” Additional AGDC will communicate to Retailers any changes or updates to Attachment A, as needed.     Directory of Fire Safe Certified Cigarette Brand Styles Updated 11/20/09 Beginning August 1, 2008, only the cigarette brands and styles listed below are allowed to be imported, stamped and/or sold in the State of Alaska. Per AS 18.74, these brands must be marked as fire safe on the packaging. The brand styles listed below have been certified as fire safe by the State Fire Marshall, bear the "FSC" marking. There is an exception to these requirements. The new fire safe law allows for the sale of cigarettes that are not fire safe and do not have the "FSC" marking as long as they were stamped and in the State of Alaska before August 1, 2008 and found on the "Directory of MSA Compliant Cigarette & RYO Brands."
