FEDERATION INTERNATIONALE DE L' AUTOMOBILE World Motor Sport Council Decision Re: Article 151(c) International Sporting Code – Vodafone McLaren Mercedes 13 September 2007 The World Motor Sport Council (“WMSC”) met on 13th September 2007 to consider a charge that Vodafone McLaren Mercedes (“McLaren”) had breached Article 151(c) of the International Sporting Code. 1 Background 1.1 Scuderia Ferrari Marlboro ("Ferrari") has submitted that it received information on 24 June 2007 suggesting that unauthorised use may have been made of certain of its confidential information. Ferrari has submitted that it subsequently learned that certain of its confidential information had come into possession of Mr. Michael Coughlan (“Coughlan”), the then Chief Designer of McLaren. 1.2 On 3 July 2007, in the context of litigation in the High Court of England and Wales ("High Court Proceedings") between Ferrari and Coughlan, a search was undertaken at the private residence of Coughlan under the authority of that Court. According to the evidence before the WMSC, during that search, a dossier of some 780 pages of confidential information belonging to Ferrari was recovered. 1.3 In light of the results of the search, Ferrari wrote to the FIA late on 3 July 2007 inviting it to consider whether the FIA should launch an investigation into the matter. 1.4 After preliminary investigations, on 12 July 2007 the FIA wrote to McLaren requesting it to appear at an extraordinary meeting of the WMSC in Paris on 26 July 2007 (“the 26 July WMSC meeting”). McLaren was informed that, at the 26 July WMSC meeting, it would be asked to answer the charge that between March and July 2007, in breach of Article 151(c) of the International Sporting Code, it had unauthorised possession of documents and confidential information belonging to Ferrari. -

But just how reliable are those numbers when they’re produced on a rolling-road? We take one car to five different chassis dynamometers on the same day to answer that question. Story and photos : Peter Knivett Rolling-road thrashes : don’t you just love them? Gathering a group of similar machines together at some willing rolling road always makes for pretty interesting reading – and particularly the owner’s reactions after what can all too often be a disappointing power run. The textbook line is usually ‘I’m gutted, I thought it would make over 300bhp,’ when their pride and joy has actually made just 187 bhp. On the face of it, who’d argue with this disappointed punter’s line of thinking? After all, they’ve probably spent thousands of pounds on all the right tuning goodies, plus they ‘had a mate on an internet forum who’s told me it must be really quick, because his brother said so, and he worked at Prodrive once, and he knows what he’s talking about…’ Month in, month out, you see this sort of tale repeated across all sectors of the performance tuning market, and it never fails to amuse, because it’s a classic case of putting the component-expenditure cart before the testing horse. Despite melting his credit card by splashing out on tuning goodies our disappointed punter forgot to spend just 50-75 pounds having his car tested on a rolling-road, which could well have made a crucial difference to its ultimate performance. -

Simtek Grand Prix was Born from Simtek Research Ltd, the name standing for Simulation Technology. The company founders were Nick Wirth and Max Mosley, Both of whom had serious pedigree within motorsport. Mosley had Been a team owner Before with March, and Wirth was a mechanical engineering student who was snapped up By March as an aerodynamicist, working underneath Adrian Newey. When March was sold to Leyton House, Mosley and Wirth? Both decided to leave, and joined forces to create Simtek. Originally, the company had a single office in Wirth’s house, But it was soon oBvious they needed a Bigger, more wind‐tunnel shaped Base, which they Built in Oxfordshire. Mosley had the connections that meant racing teams from all over the gloBe were interested in using their research technologies, But while keeping the clients satisfied, Simtek Began designing an F1 car for BMW in secret. -

MAX MOSLEY AND THE ENGLISH RIGHT TO PRIVACY INTRODUCTION On March 30, 2008, the British weekly tabloid News of the World published a characteristically scandalous and salacious piece of journalism.1 Entitled ―F1 Boss Has Sick Nazi Orgy with Hookers,‖2 the article described the participation of Max Mosley,3 then-President of the Fédération Internationale de l‘Automobile (―FIA‖)4 in a sado-masochistic orgy with multiple prostitutes.5 The article was accompanied by images of the alleged orgy, and News of the World‘s website simultaneously published the print edition‘s content along with edited video footage of the sex acts.6 A follow-up story ran on April 6, 2008, in which one of the women involved in the sex acts was interviewed by the newspaper. -

FREEDOM OF EXPRESSION: MOSLEY CASE 1. Introduction “… An ‘intense focus’ is necessary upon the comparative importance of the specific rights being claimed in the individual case…” 1. This statement was made during the Mosley v. News Group Newspaper Limited judgment by David Eady, also known as Mr. Justice Eady, an High Court judge in England and Wales notable for having presided over many high- profile libel and privacy cases. In that occasion, once again great attention has been given to the issue of balancing “the competing interests of privacy and of freedom of expression”2. This topic has always been really controversial. After the recognition of the right to privacy, “the normative panorama of the journalistic activity”3 has been completely renewed. Journalists have started paying more attention to the respect of personal dignity of the people involved in their news and it’s also possible to find a more diffuse sensitivity about privacy, a term that in certain society has even became hackneyed. Citizens are now more aware of their rights and this is clearly visible by the higher number of legal cases that fill our tribunals as well as our newspapers today. -
