Preface

This due diligence report is prepared by the Project Management Office (PMO) of Sanjiang Plain Wetlands Protection Project (SPWPP) under the resettlement policy framework developed by the PPTA of ADB in 2004. There is no detailed RP for this component so has been implemented following the Resettlement Framework document since the project started in 2005. Therefore, the PMO has prepared this report so ADB can review the progress of this component and ensure it is being implemented in accordance with the PRC laws and regulations as well as ADB’s Involuntary Resettlement Policy as set out in the Resettlement Framework.

All the data used in this report is collected and provided by relevant forestry bureau or forest farms. The PMO's resettlement advisor used these data to prepare this due diligence report for the resettlement review.

1 Project Background

Sanjiang Plain is one of the largest fresh water wetlands in and also a habitat for birds globally. In 1999, the Chinese Government submitted the conceptual document of the “Sanjiang Plain Wetlands Protection Project” and Project Proposal of PDFB to GEF through ADB. After a period of preparation, GEF approved the donation on Feburary 8, 2005; and ADB approved the loan on March 14, 2005. The total project investment is USD 55.55 million, including USD 15 million from ADB loan and USD 12.14 million from GEF donation.

The Project has 4 components:

(1) Watershed Management: forestation and water source conservation within the nature reserves; enhancement of water resources management within the watershed (or the nature reserves) to restore the water balance; and development of watershed water resources planning to improve the basin-level management;

(2) Nature Reserve Management: improvement of existing management and planning skills to eliminate the threats to the global endangered species ;introduction of practical and controllable model to restore the ecological function of six wetlands nature reserves involved; recovery of the quantity and scale of wild animals with international significance, especially the breeding population of the migrant birds in Sanjiang Plain Wetland; elimination of environmental threats to endangered species; and enforcement of relevant laws and regulations to reduce over-use of natural resources;

(3) Alternative Livelihood: development of agro-forestry and non-timber Foresry Products to continuously increase the income of local residents; development and implementation of Village Development Plans to support community development and planning; and assistance to nature reserves in developing master plan of ecological industry and in conducting pilot activities.

(4) Capacity building in wetlands management: capacity building for nature

reserves and local governments in terms of wetlands protection, and public awareness on protection of wetlands, wild animals and biodiversity. Provide specific training for women if appropriate.

It is planned to restore an area of 4300 ha farmland to forest in the Watershed Management Component.

1.1 Impact of Original Project Design

According to original project design, the “restoration farmland into forest” subproject involves 28 forest farms in 5 counties. See Table 2-1 below for details.

1.2 Resettlement Progress in Original Project Design

The resettlement is planned to be conducted from 2005 to 2010.

1.3 Resettlement plan for Farmland to Forest Conversion

Component in Original Project Design

The resettlement requirements for the Farmland to Forest Conversion Component is set out in the Resettlement Framework_(RF) and concerned project documents of this project prepared in September 2004.

For those persons who will be affected by farmland to forest restoration outside the nature reserves, the land ownership will not be transferred. The forestry farm or the village will (i) readjust the remaining farmland within the forestry farm or the village, (ii) ensure that the affected forestry workers or villagers can obtain the same quantity and quality farmland as other workers or villagers, and (iii) ensure the affected workers or villagers can continue as forestry workers, receive the wage and share the profits of forestry. However, since the income from reforestation is a long term venture, in order to remedy the income losses during the tree growth phase, the Project arranged a sub-component of developing non-timber forest products (NTFPs). Based on

investigations, it was determined that an area equivalent to 20% of the farmland restored to forest will be used for developing NTFPs in order to offset any income loss to the forest workers or villagers during the tree growth phase1.

2 Project Progress and Actual Impacts

2.1 Implementation Progress

Up to September 2008, a total of 34433.5 mu (about 2296ha) farmland has been retstored to forest, as 53.39% of the overall goal. A total of 388 persons are affected. See Table 2-1 for details.

2.2 Farmland Conversion to Forest Status in Hulin County

As planned, the total farmland area to be returned to forest is 15,000mu, affecting 10 villages and 337 villagers.

Up to September 2008, the actually restored area is 6000mu, accounting for 40% of proposed goal. 42 people were affected; among them, 19 are regular staff and 23 are contracted staff. The forest restoration activities have been implemented since 2006 through 2007. The overall situation of farmland to forest conversion in Hulin City can be found in Table 2-2. Also Appendix 1 is for details.

Comparing to 2004 Farmland to Forest Conversion Plan, it can be found that the locations of farmland to be restored have been changed a lot. Townships and towns involved in farmland to forest conversion have been increased to four from original two. According to Hulin County Forestry Bureau, the main consideration of making these changes is to minimize the social impacts on affected villages, especially on villagers’ livelihood. After adjustment, the new locations are all waste upland that have not been used by those villages. The Forestry Bureau has signed farmland to forest conversion agreements with affected villages whereby the young plants will be provided by the bureau and raised by the villagers, and the grown forests will be owned by local village committees with guaranteed survival rate. Therefore no person is adversely affected by the project and the benefited area is the whole Hulin County, especially those villages involved in farmland to forests conversion.

Four Forest farms were affected which caused impacts on 42 workers; among them, 19 are regular staff and 23 are contracted staff.

Based on the Resettlement Framework for forest restoration (2004), Hulin Forestry Bureau resettled all the APs, The resettlement results are shown in Appendixes 2 and 3. More detailed rehabilitation measures for affected groups

can be found in the relevant alternative livelihood plan prepared by each forest farm.

2.3 Farmland to Wetland Conversion in Linkou County

As planned, the total farmland area to be returned to forest is 15,000mu, affecting 10 FFs in 6 townships or towns and 298 persons.

However, during the project implementation, the Linkou County Forestry Bureau found that Hushan FF is not well suited to implement farmland to forest conversion for this project. The main reason is because Hushan FF has abundant forestry resources and nice ecological environment and the state-owned agricultural land (farmland) is small and scattered, hardly meeting the requirements of Sanjiang Plain Wetlands Protection Project. After several times of site survey and analysis, the Forestry Bureau of Linkou County decided to exclude Hushan FF in the farmland to forest conversion for Sanjiang Plain Wetlands Protection Project. Nevertheless, the forestry bureau of Linkou County still promised to complete the overall goal and decided to re-allocate the 1,650mu farmland to forest conversion task of Hushan FF to nine other FFs equally. Hence, despite of the exclusion of Hushan FF, the overall farmland area to be restored remains to be 15,000mu. Up to September 2008, the actually restored farmland is 9,762mu, as 65.08% of planned goal. The remaining task will be finished in the 2009-2011. The farmland to forest conversion work in Linkou County has been implemented since 2005 through to 2007 (see Table 2-3).

After adjustment, 9 FFs in 6 towns and 166 persons are affected by the farmland to forest conversion project in Linkou County. All the affected persons (APs) are regular staffs of involved FFs. Detailed information in terms of affected FFs in Linkou County’s farmland to forest conversion work can be found in Appendix 3. Detailed information of affected groups is summarized in Appendix 5

2.4 Farmland Conversion Progress in Huanan County

As planned, the total farmland area to be returned to forest is 4,500mu, affecting 4 FFs and 234 villagers.

Up to September 2008, the actual progress is 1,106mu, accounting for 24.6% of overall goal. A total of 37 persons are affected by the farmland to forest conversion, including 33 regular staff and 4 temporary workers. All the APs have already been resettled appropriately by Schisandra fruit planting and so on. Detailed information is summarized in Table 2-4. More detailed information of APs is summarized in Appendix 6.

2.5 Farmland to Forest Conversion Progress in Baoqing County

As planned, the total farmland area to be restored to forest is 15,000mu, affecting 8 FFs and 775 persons.

Up to September 2008, the actual progress is 9015 mu, excluding the area of nursery, so 60.1% has been restored. A total of 49 persons are affected by the project, all are regular employees of the forest farms. See Table 2-5 for details.

All the APs have already been resettled appropriately in accordance with 2004 Resettlement Framework. Detailed information in terms of affected forest farms, employees and resettlement is summarized in Appendix 7 and 8 separately.

More specific resettlement plans for affected groups can be found in the alternative livelihood plans prepared by involved forest farms.

2.6 Farmland to Forest Conversion Progress in Luobei County

As planned, the total farmland area to be restored to forest is 15,000mu, affecting 5 FFs, 1 nursery and 573 persons.

Up to September 2008, the actual progress is 8550.5mu, or 57% of overall goal. A total of 94 persons are affected in the project, all are regular employees of involved forest farms. See Table 2-6 for details.

All the APs have already been resettled appropriately in accordance with 2004 Resettlement Framework by afforestation and catering business. Detailed information in terms of affected forest farms, employees and resettlement is summarized in Appendix 9 and 10 separately.

3 Resettlement of Affected Groups

3.1 Original resettlement plan

According to project design, all the farmlands to be restored under this project are state-owned land. And all the affected persons are employees of involved forest farms or contracted from nearby villagers.

It is specified in 2004 ADB Resettlement Framework that though no land will be acquired in this project, the incomes of villagers who are making their lives on the farmland are still affected. Hence, the rehabilitation measures will include: i) intercropping in several years; ii) involvement of workers/farmers in replanting and raising plants; and iii) encouragement of developing non-timber forest products. These measures can ensure no adverse impacts be placed on the incomes of workers or villagers.

The ADB Resettlement Framework gives the entitlement matrix for APs, as stated in Table 3-1 below.

3.2 Actual measures taken

Up to September 2008, a total of 34,433.5 mu (about 2296ha) farmland has been retstored to forest, or 53.39% of the overall goal. A total of 388 persons have been affected, much less than originally estimated; in fact, no villagers have been adversely affected because only waste land is utilized for reforestation in the Project villages. The only active farmland used for reforestation was dry lan or slope land located within State Forest Farms. This approach has minimized social impacts.

In accordance with project design and ADB requirements, Sanjiang Plain Wetlands Protection Project Management Office (PMO) issued a document officially at the end of 2004, which required affected agencies to prepare the alternative livelihood plan for their employees and to submit relevant outputs.

It needs to be noted that before the involvement of our project team in 2007, some of the affected agencies have already begun to prepare for the farmland conversion work in accordance with national policies at that time and started to resettle affected staffs.

After the mobilization of our consulting team, the alternative livelihood specialist provided recommendations in terms of the revision and upgrading of the original “Alternative Livelihood Plan for APs” according to ADB requirements and based on the results of baseline study and community visits, and assisted involved agencies in the completion of formal alternative livelihood plans by August 2007.

Based on above plans, affected agencies conducted the rehabilitation

measures for affected workers. A brief resettlement plan is attached as Appendixes 1 to 10. Detailed information in terms of alternative livelihood plans can be found in specific alternative livelihood plans prepared by forest farms. The implementation of alternative livelihood plans will be assessed by external resettlement monitoring agency and then reported to ADB.
